Any bankruptcy filing invokes an automatic stay, meaning that civil lawsuits are prevented from proceeding.
If the civil lawsuit has not yet been filed, it cannot be filed while you are in bankruptcy.
If it has been filed already, the bankruptcy filing will put a halt to it.
May 17th, 2010 at 10:40 amIf the court has received the filing, the lawsuit goes forth. Your financial status is irrelevant to the suit at this point.
