A lady dropped off some papers in person today, from a law firm, stating he needs to appear in court Oct 17th. The total came to a little over 1600$, he has 2 other cards with about this much on each (but neither has filed a complaint). Problem is, we are barely making it as it is, we are even on food stamps right now. We have 3 children, and I don’t work right now, I plan to go back to school. Also, he was only 17 when he got the card, he lied on the application, will that have an effect? Should he file for bankruptcy? Can they attach his wages?

If a credit card company takes me to court & gets a court order to garnish my wages from work, will filing bankruptcy stop the garnishment?

I was going through a hard time on the date of a court appearance, my son had been prematurely born in Sept, he was due in January. He passed away in Dec. They put a guilty plea for me because I didn’t go. The case was for some money that my ex had taken out of his dad’s account and we spent it. I know it was wrong, I was dumb. but now they are trying to pin all of the money on me…,000! I would have been willing to do some of it, but damn. So now they are trying to garnish my wages, the only option I can think of is bankruptcy, I have a lot of debt anyway and I really don’t care anymore. I’m young and I can handle it. But I need to know if that kind of judgement would stand through a bankruptcy ch7?

I have a family, we don’t charge anything anymore. Been paying on these bills for several years. Make good wages, all goes to credit card payments. Have about 120 bucks a week for groceries, gas, entertainment. I’m gonna whine here a bit so bear with me, I have made bad decision with my finances, put money into our house that is now maybe worth what we owe on it….Is that any different than the banks making bad decisions? You know, the whole bailout thing. Where’s mine? Or at least a low interest government loan.
Madoff, i agree with your comments. My house is not the issue.I give 65k for it with some land. My wife and i make that much per year. I don’t think i’m house poor. We all make bad decisions in our life. And i would be glad to pay my debtors back. But i can’t do it with 20% interest.

If I have a judgment against me that i just found out about can I file bankruptcy ? My friend was served and appeared for her court case but the credit card company asked for a continuance and never said when the next court date was. When she called up with the court she was told that she would receive something from the court (or credit card company) when the next date will be. The next thing she knows she has a default judgment against her and the company is threading to garnish her wages?

Can she have the judgment Vacated after more than 3 years? Should she just set up a payment plan with the court and not the creditor? Should she file bankruptcy?

The credit card company wants the entire amount of 8500 and will not let her make payments without putting half down.

What should she do.

and before you ask, no they wont lend me the money to pay it off. Its my responsibility so they want me to man up and take action.

This is a question related to last week’s question kindly answered by helpful person…"is not paying unsecured credit card debt an alternative to bankruptcy [?] ". The answer included info that my wages could not be garnished in TX. I now need to know about NM & AZ.
Considering I can’t do debt consol and would very much like to avoid bankruptcy….I am trying to put my life back together after ex husband in TX surprised me by divorcing me after 14 yrs. and then filed bankruptcy himself instead of filing as a couple (which he had told me he would do-as a couple) and in doing so dumped debts on me. Collectors who can’t collect from him are now calling me. THANKS GREATLY FOR YOUR HELP.

i couple of years back i brought a car that i couldnt afford. i returned the car a voluntary repo and that is on my credit. The Lender now wants to garnish my wages to pay back the loan. Does anybody know if you can file bankruptcy on a Federal school loan? If you have already defalted on the loan but they have not garinish your wages yet, and you can not make any payment on the loan at all, can you file an the federal school loans too, when you file?

I just began the process of filing bankruptcy a month ago. It costs 1500 and I’ve been making payments. In the meantime I got a letter from a loan company taking me to court to try to garnish my wages.

Brief background: Moved from one state to another for a job, which was lost. Income has dropped to about 50% of what it was. We’ve gone through our savings to try and pay things. Bring home pay now covers ONLY new house payment, utilities, groceries, life insurance, and government student loan. Have previously surrendered 2nd vehicle, (1st vehicle is paid in full). Old house in old state foreclosed on and being sold tomorrow. Credit cards remaining unpaid and sent for collections, etc.

My question is this: should bankruptcy proceedings begin or should we continue as is? What, if anything, can our creditors do to us (other than trash our credit – which has already happened). We live in Texas. I would appreciate any suggestions. However please refrain from replies such as "get a job", because we are both working full time jobs and have cut ALL unnecessary spending. We dread the thought of bankruptcy, but see no other alternative.
We’ve done the credit counseling, etc., and the funds are simply not there.

Can they garnish wages for debt in Texas?

Im barely making enough to pay rent, so if my auto is repossed and my wages are garnished, I will be homeless. I assume bankruptcy is my only option. should I try to file before or after my truck is repossed?

I recieved a notification in the mail that stated my wages would be garnished by a credit card company. I am currently unemployed but will be employed soon. I know they can garnish about 25% of my wages when I become employed. I owe to more than one credit card company. I owe in total about 00 to different credit card companies. Should I file bankruptcy? I am going to be going through chapter 7 bankruptcy next month (November). My car has 70,000 miles and it is five years, and four months old since I purchased it in 2001 (it had 13 miles when I bought it). If I keep my car for two and a half more years before trading it in, can i get a decent loan after filing for chapter 7 bankruptcy this november? My attorney told me that it wouldn’t hurt me that bad because I get a VA compensation and they can’t garnish my wages. Please help. And if I can get a loan, what kind of interest rate would it be?
