Does filing a bankruptcy cover a court ordered restitution?
My wages are being garnished by the state as a result of me falling behind on this court ordered restitution….would filing bankruptcy eliminate this???

how to tell a family member not to spend money on vacation when money is needed someplace else?
My family is not the best with money. But somehow I made it through with a decent understanding of the income/spending ratio.
Anyway, my mother is filing bankruptcy, but the lawyer wants 1200 to do it. Her wages already being garnished, she can’t save up the money so it has fallen to her 3 children to do it (because we care). I have a little in a savings account, and my sister has a bit, too. My brother agreed to help out also.
I figured this would be handled in less than a week, but that was 2 weeks ago. Now I get invited along ON VACATION by my sister in law. My brother’s family is going to South Carolina for a week.
Am I crazy, or should this whoole thing already be resolved before the 1st of the month when rent is due!?!?
I already declined the vacation, telling my sister in law that money is tight and I can’t take that much time off work or I won’t be able to to pay all my bills. (I work an hourly wage)
My car just got repossesed, now what?
I have done a lot of research online but I was hoping to get some answers from people who know or have been through it themselves. My car got repossesed a couple of days ago, I still had about ,000 to pay on it. I am in a very bad spot financially, and thinking about trying to file bankruptcy, will that help with the car situation, will they sue me, can they still garnish my wages if I file bankruptcy? Any information would be greatly appreciated.
How should I word an answer to a summons/complaint?
Hi.. I recently was served with a summons and complaint that states I have twenty days to respond to it in writing to the court or I will be faced with a default judgement. I have looked up alot about this online and found out that in my state (indiana) I can file a "Motion to dismiss fo failure to comply with rules" if the plaintiff did not have a contract written instrument not attached to the complaint and summons, and it did not. I still need to call my court here in my county to be sure that it is the rule before I can try this though. I need to know how to word my answer if I would go with this route and if even if I dont I still have to answer to avoid the default judgement. I know that I need to go through and deny each complaint that is numbered on the sheet but I do not know how to word it exactly. The reason that I am being sued in the first place is because my b/f and I had a couple credit cards that I was a joint on with him. He was always the one responsible for making the payments. He ended up having to file bankruptcy, and once the case was discharged it automatically made me the one responsible for the amount. I have no way of making any kind of payment on it at this time. I have been out of work since 2007 when i found out I was preg with my daughter and i have been a stay at home mom since. So i know that the judge can not order for any kind of wages to be garnished and I do not have any assets for them to take, so most likely its just going to be on my record and if I would get a job or any money withen the next ten yrs or so id have to pay it then. Do I need to deny the complaint in my answer even though I know its true .. or will the judge just order me to pay it then because he wouldnt have been able to hear my story or i guess situation? The complaint states that 1. The defendant is indebted to the plaintiff int he amount of ***** plues accured interest of **** as of jan 2010.
2. Venue is proper with this court and based on the defendant residing in **** County.
3. The plaintiff owns and is the holder of an acocunt due and oweing by the defendant, and is the asignee of Elan/ Mainsource bank.
Wherefore the plaintiff respectfully requests the following relief.
1 Judgement against the defendant in the sum of ******* plus accured intesest of **** as of jan 2010
2 Interest thereon at the rate of 8 percent per annum from jan 2010 , and 8 percent per annum from the date of judgement , until the judgement is satidfied.
3 For plaintiffs costs herein expended
4 For any and all other relief to which the plaintiff may be entitled pursuant to contract, statute. or common law.
how do you represent yourself to stop a motion..what papers do i file? do I appear?
this is from a consumer loan company I filed bankruptcy on..now they are trying to put a lien on real estate I do not own…my ex wife does..i never received a summons or notification…just saw it online when looking something else up
the court action is against me in this case…she had already been notified that the loan co was going to garnish her wages for the loan (joint)..the divorce decree states I have to pay the loan..I couldn’t and filed BK …how can the loan co come after me? I have been told by attorneys to pay her the wages back she is having garnished…because of the ruling in the divorce
Isn’t it if I don’t answer this action although I have no summons…that they win by default? obviously they are not telling the courts I filed bk…
Opinions on filing bankruptcy when dealing with a judgment…?
A few months back, I had to let my automobile go as a voluntary repossesion. Now, they are filing to put a ,000 judgement against me. After I pay my monthly bills and rent, I barely have enough left just for day to day living expenses, NO money in the bank, no assets, etc. WOULD THERE BE ANY VALUE TO FILING FOR BANKRUPTCY? If this judgement is placed, and my wages are garnished, or however they do it….I’ll sink right to the bottom! Any suggestions out there? Thanks.

PLEASE someone w/sincere advice respond. Let me try to paint the picture: I got involved in too much debt around 18 yrs old. I thought I was helping by using my new "good" credit to co-sign loans etc, couldn’t keep up. filed ch 7 bnkrptcy @ 24, began to rebuild credt, got involved w/ a broker that said I could purchase a house A YEAR after filing. The #s differed @ closing from what we originally went over. I had already given my landlord notice, taken my mom out of a nursing home, promised my retired granddad a room, and adopted a dog from the shelter – I signed on the line. Shortly after I was laid off after 5 yrs w/ same company. tried to fix up to sell but found out home was worth less than i paid, took refi to repair & contractor split b4 work complete, tenant bailed on me w/out notice. WHEN IT RAINS IT POURS. I was STUPID i know, but what can i do now? owe so much, on unemplyment, renting, starting new job in 2 wks. afraid of what lawsuits will follow and wages taken… thanx!
HELP!!!!!!I filed Bankruptcy when will they stop garnishing?
HELP! HELP! HELP!I filed bankruptcy today to stop this guy from garnishing my wages. We went to pay the bill at court last week and they told us that he turned it in for garnishment. He never gave us a chance to pay, and we was only the co-signers, so its not like he ever gave us a chance. Well, our work cuts checks on Saturday(we work for Sams Club/Wal-Mart) and we get paid on Thursday. We are supposed to get our Sams Share check on Thursday also. Can it be stopped before then? Do I contact the payroll dept, court, the person, WHO? I need it stopped FAST! I agreed to a month and he is taking 400-500 a month with garnishment. We really tried, we are not trying to take the easy way out, but like I said this Dill head NEVER gave us that chance, and I am in school with 2 kids, married and he is the only one who works, because I am VERY SICK with lots of Med probs and bills, so I cant work… Sorry to explain so much but people get rude and think we are taking an easy way out. PLEASE!
Will they be able to garnish this weeks check or not?

Here is a summary of the case:
I am a father of two children who are now 19 and 20 years old. I used to live in California. Now I live in Maryland since May 2008. During the divorce in 1992, the nightmare started with a family support order that was found to be fraudulent by the Federal Bankruptcy Court.
I was imprisoned for 35 days based on this fraudulent order and based on the DA of the County of Santa Clara California (DA hereinafter) , who testified that I was making ,000 a month, while I was unemployed.
Around 3/10/ 1999, the DA filed a claim for 5,000.00 to enforce pre petition child support arrears. The Bankruptcy Court denied the DA’s motion. The Bankruptcy court also ordered a new support order be entered.
Since 2000, a new support order was entered by the family court. It should be 0, but the DA had my wages garnished for 0 a month. My wages are still garnished to this day, even though my children are now 20 and 19 years old.
The DA has intercepted nine years of tax refunds post wage garnishment. The DA has also taken little money I saved post wage garnishment. The DA emptied all my bank accounts including the last one just a couple a months ago.
I had not one, not two but all three of my properties foreclosed while I was under bankruptcy protection. The DA took over a million dollar from the proceeds of the three trustees’ sale. But the DA acknowledges taking only ,000. I am homeless since 2000. I live in hotels. My credit is in the dump. I need your help to resolve this matter once and for all.
In September 2007, I received a letter stating that I still owe 5,000.00. I received another letter, from DA of Maryland, stating that I owe less than ,000.00. The numbers do not add up. I just found out the MD case was closed since May 2008.
Can this case be handled by a Bankruptcy lawyer or a Family lawyer or a civil right lawyer? Please advise. I hope justice prevails.

The company filed bankruptcy, hasn't paid me and locked my medical spending account.?
I want to killing myself right now. My company was filed bankruptcy last week hasn’t paid of my last wages. Saturday when I was refilled my prescriptions I found out my medical FSB account locked up couldn’t paid for my prescriptions. I still have 0 in this FSB account. what can I do? I really need this money, coming I have a few doctor appointment in this 2 months. What can I do? I need someone tell me where and what should I do? One more thing the CEO said he was not fired us so I can’t file unemployment benefit. He only told us to wait for the trustees to contact us. How come a CEO can do that for his people. I feel so sad and how can the people do that for me. Hope someone can help me of my question. Thanks.
Filing bankruptcy or the best way to get out of debts?
I’m in a substantial amount of debt… Hospital and doctor bill mostly. No credit card debt. Plus, daily living expenses with an infant!!! Problem is — I am being hounded by bill collectors and one debt is about to be turned over to an attorney for collection. I feel certain that this could end in wage garnishment. We don’t have the money to make ends meet — let alone have any part of my wages garnished. I’ve tried making arrangements but we just can’t make the payments no matter how minimal. Should I file for bankruptcy? How can I avoid getting my wages garnished? I have no problem with paying the bills if I just had the money.

WHEN YOU FILE FOR A BANKRUPTCY DO THEY INCLUSE YOUR HOUSEHOLD INCOME OR DO THEY JUST DO IT FOR THE PERSON THAT IS FILING. I MAKE A DECENT MONEY BUT MY WIFE HAS SOME OLD DEBTS OUT THERE AND SHE NOW ONLY WORKS PART TIME. I PAY ALL OF THE BILLS BUT WE HAVE NO EXTRA MONEY TO REALLY TAKE CARE OF HER OLD DEBTS. THEY ARE NOW THREATENING TO GARNISH HER WAGES AND SHE ONLY WORKS PART TIME SO SHE WILL BASICALLY BE WORKING TO JUST PAY THESE DEBTS AND NOT FOR THE EXTRA CASH THAT IS NEEDED?? Can I file for bankruptcy protection after being subpoenaed for debt collection hearing?
I have a k car note debt on its way to an attorney for a court hearing in the near future. I haven’t been subpoenaed yet. I have k in medical bills getting the run around from my health insurance and another -k that hasn’t even been filed yet by the doctor but may also be denied.
I can’t afford to have a court garnish my wages a single cent for the car note but can’t file for bankruptcy protection just yet because I’m waiting on the insurance company to either pay or deny. Until then, I won’t get a bill to put on my bankruptcy forms. Also, the other doctors haven’t filed their claims yet. They have up to six months to file a claim and it’s only been 30 days since my surgery.
Bottom line: it would be a waste to file bankruptcy right now over 11k when I have almost 100k coming up in the next few months. What can I do? After I get the subpoena I plan to just file on whatever I have and then hope for the best with the rest. Is that even possible? Are you allowed to file on something that is currently going through litigation?

BANKRUPTCY Do I need an attorney to collect unpaid wages in a bankruptcy settlement?
After 7 years employed at a firm they locked their doors last Thursday. Chapter 11 happens this week. 7/1 payroll did not happen, and I am a sales person paid upon invoice so I also lost any potentials wages on future work.

Someone told me they will auction off your furniture kids toys anything you have pretty much. Including you won’t get tax returns for the next 3 years, it will all go to creditor. Is this correct? Have to file bankruptcy. Been out of work for 6 months. Two credit cards have been written off but amount, I guess, has been turned over to a collection agency. I received a notification in the mail that my wages are being garnished by a credit card company, for an outstanding debt.
