I live in Michigan & recently went through a divorce, foreclosure, and was laid off at work. For the past year, I have been unemployed & then am currently temping.
My ex-husband declared bankruptcy and basically, our second mortgage wasn’t foreclosed on (it was a different bank than the first mortgage) and that entire balance is now my responsibility. It’s over ,000. I was served last summer and then in Feb 2009 my MI State Income Tax refund was garnished. Now, I received a writ of garnishment from the court and it was sent to me FROM my old credit union. THEY were served with papers on 6-18-09 and thankgod, the account was CLOSED so they could not pull money from the account.
I am fearful that now, they will get to my CURRENT bank & possibly my staffing company where I work.
I checked my current bank acct. and there is still a positive balance but what should I do? Close this account?
NOTE: I secured a bankruptcy attorney and paid in full within the first week. I was given a first draft and returned that to them over 3 weeks ago. I am awaiting a SECOND draft. It has not yet been filed with the courts. Am I not protected yet? Any advice would be appreciated. Thanks in advance

My girlfriend has an old account from an apartment with her ex and he plans to file bankruptcy. She is wondering what will happen with her portion of the debt when he files. Will she still be completely responsible, responsible for half or will it be completely wiped clean? Thanks in advance!!

….after you get sued for building a faulty house for someone. The judge is in favour of the plaintiff, whose house you built. He rules that you must pay them ,000 to compensate for the cracks in the ceilings & walls and various other mishaps. You then, like a b*tch, file for bankruptcy. Don’t know how to phrase this, but: your claim for bankruptcy is accepted.
Replace the you with defendant. What prompts me to ask this is that the defendant walked out of court saying "You’re not getting one cent" to the plaintiff. Which, for comedic effect, i will add that he got punched in the face :L
Questions:
1) How does the plaintiff get his compensation, in civil law or whatever area of law? Are there alternative ways to gain compensation for this issue other than suing? Obviously the suing did not work out? Like for e.g. in criminal cases you can go to the Victims Compensation Tribunal if suing civilly does not work in your interests.
2) Does the defendant (in bankruptcy) have to sell all his assets and every cent of his future income goes to paying the defendant the compensation? Its only fair..
3) Does he get off scott free?

I was young, (22yrs old) had 2 jobs and made good money. I decided to trade in my old junk of a car and buy a brand new car. I had no credit history so my then bf helped co-sign for my new car. My interest was sky high but I didn’t care at the beginning because I had no idea what I was doing. I paid a very large amount per month and then after about a year, I lost my main job. A few months after that, I lost my other job. I now was collecting unemployment and went through HELL to make sure that car was paid off every month. I started making late payments and my life was just a mess because not only did I have to pay for that car, I had the insurance, rent, etc. I was no longer able to pay my car and that day came when Mr. repo came knocking on the door. They took my car after 2 years of me working my butt off and they auctioned it off for SO cheap (almost had a heart attack at how much they sold it for!)
This was in 2008 and 2 years later, I’m still struggling financially in more ways than a hundred lol…I have really bad credit, I can’t even open a bank account and I feel like my once so organized and amazing life is now totally off track. I don’t know what to do. These are my questions:
1. If I open a bank account, can my lender seize all my money? Not a savings, a checking account.
2. Being that I did not pay the upside down on the car (,000) should I file for bankruptcy and is it too late to do that after 2 years? And for those who want to suggest that I pay off the 16 grand, I’m not because I’m not going to pay for a car I don’t have anymore and you might say well you’re stuck with it you should have never bought a car you can’t afford I don’t want to hear it because you don’t know my story. I want serious answers, not answers that are going to sound mean and not help.
If there is anything that I’m missing? Please, any advise would be GREATLY appreciated. Thanks in advance

Our (chapter 13 bankruptcy) attorney failed to subimit documents to the court. He directly lied to us and told us that he did. We’re in the last year of bankruptcy and in need of purchasing a car. He told us almost 3 weeks ago that he submitted the papers to the court and then admitted to my husband today that he didn’t. What recourse do we have? Thanks in advance…

And just for everyone’s edification… it was not because we had out of control debt. It was because we had a child that was born with extensive medical needs far and beyond our insurance and the fact that I needed to stop working for 3 years. It was all medical debt.

They believe that the SUBPRIME mortgage industry, which has engaged in dangerous and sometimes unscrupulous business practices, should not be shielded by outdated federal law.
i capitalized it so u guys could find it. imdoing research for a debate in english class and i was reading and my word document says that "subprime" is wrong and so does yahoo answers. so i wondered what an alternative word wold be so that i know what its talking about and i will understand better.

My fiancĂ© is trying to rejoin the Navy. He’s talked to a recruiter, gotten his DD214 and knows his reenlistment code. He’s been to a dr. to prove that what discharged him last time no longer applies, now he’s worried about his debt. He knows that if he gets in, he’ll be on salary again which will make meeting his financial obligations easier, but he asked me to try to find out what I could about what would happen if after in re enlists, if he files bankruptcy. Everything I’ve found online says he could be immediately discharged and he won’t get the same clearance he had last time because of the debt alone. He used to have an active SCI Top Secret clearance. He won’t get that this time. Is it true they will discharge him if he tries to file bankruptcy? Do they have any options to help him repay his debt? Thanks in advance.
He’s not getting a steady salary right now and hasn’t been for over a year. He’s got a lot of debt that has built up over the past year and he can’t get out from under it. He needs to clear it. Or find a manageable way to pay it back. We are getting married as soon as he finds out if he is accepted back or not and he needs to be able to take care of me and the kids. Not spend his entire salary on old debts.
Will his debt be an issue when he tries to rejoin? His recruiter didn’t say anything about it but we’ve read he’d need a waiver for that kind of debt to get back in. Is this true?

I filed for a chapter 7 bankruptcy on December of 2001 and it has since been discharged. I would like to know how long that bankruptcy will be on my credit report. I filed the bankruptcy in the state of Connecticut. Thanks in advance for your help.

We’re looking into filing chapter 7 (not the prettiest option but honestly the only at this point) and hoping to save some money. While I’ve considered attempting to do it myself (we have a straightforward bankruptcy and qualify by a longshot) I did see there are quite a few online companies which could make it easier and be more affordable than an attorney. Yes, an attorney is still the safest bet but I’m wondering if there are any online companies anyone are aware of that aren’t a total crock (which, unfortunately, is most of what I’m seeing!) I am currently living out of the country to help my in-laws while they are experiencing some medical problems. I want to know if my parents can file bankruptcy for me if they have power of attorney (in the state of GA)? I know I would have to go back for the meeting with the trustee and the counseling, but if they could file for me, that would really help in our situation. Any help would be greatly appreciated! I refinanced my house through Ocwen in 2002 just before a major surgery to help with cost that I knew I would incur during the no work time. They told me one thing on the phone and when it came to signing, the paper work was nothing like what they offered me on the phone, but at the time is was only one week before surgery so I went ahead and signed. Since then I struggled and finally last year I was able to pay off my 2nd mortgage and all credit cards. The only bill left was the mortgage, since I paid off my vehicle the year before. November of last year I was in a bad car accident that totaled my vehicle. After receiving the check from the insurance company I purchased a used 2008 Dodge Advenger for 15,000 with 6,500 down on a 36 month loan. (Trying to stay debt free). Well December comes in and on the 2nd I was informed that layoffs would begin that week and sure enough two days later I got the call not to come in. This was a big surprise, since my company received records profits just the quarter before. Anyway I feel really bad, but I just cannot handle the mortgage payments anymore and I have tried everything to get the mortgage company to do something. They say I do not make enough for them to be able to help me. I am currently spending three hundred every month more than I am bringing in. My savings is now gone and starting to use credit cards again. And at this point I have a good chance of getting a job outside of Michigan, but if I do get the Obama modification I have to stay here with no hope of a job. Things just look worse at my company each month.
Will I be able to keep the car even though there is some equity in it? And can I let the house go this way with no reprecussions? I feel bad, but I also feel they took advantage of me when I was in a bad situation. And I have had the house on the market for over three years with not even a glimmer of hope. Thanks in advance for any and all advice. For those who like to talk down about people that file bankruptcy I pray you never find yourself in this situation. Current situation:
House owed 99,500 value about 105,000
Car owed 7,000 value about 15,000 (kbb)

I have a vehicle that I am selling to help pay for some debts i have accumulated over the years. I will however still have to file chapter 7 bankruptcy in order to pull myself out of debt. Will selling my property hurt my chances of filing a quick bankruptcy? I was told that any transfer of property may not be good…Thanks in advance for your help…

I can’t take time off work and need it done quick, yet not a scam.
Its been a long time coming and it just has to be done. If there is a reputable online company, or a company in san jose california that works around my schedule. I make ok money but am just sick of my past….its been 10 years since i even used those cards!!! Help?? Thanks in advance

I am filing bankruptcy and someone is claiming that I owe him some money. If I just go ahead and file the amount on my bankruptcy, can he dispute my right to claim this debt on my bankruptcy and potentionally have a court rule that I must pay him back? He is claiming that this is possible. Thanks in advance!!
