How do you file for bankruptcy when you are too broke to pay filing fees?

I am so broke. I even tried to look under the seats of my car to find enough change to buy a kid I work with a 54 cent ice cream cone he earned by good behavior and grades for 4 weeks but I did not have enough. I lied and said I forgot my money at home. So I took him to park and I owe him a ice cream next week I work for a small mental health non profit and my husband has been out of work for two years. I was able to make ends meet except for one credit card,student loan and my car. My student loan took my tax refund for the past two years but I still owe them two thousand. I had the car voluntarily repossed because I could not afford it(big mistake because now the court says owe 10000 when the loan with interest was only 6000 and I paid on it for 2 of the 4 years), The credit card got a garnishment that takes 400 a month from my pay at 25% pre tax which is more than I take home in two weeks now, and now the bank(car loan) has sued me too and wants to garnish me too but I don’t make enough for them to take anymore. I am so tired of eating peanut butter sandwiches, soup, or beans that I get from the food bank. If I could find some way to file bankruptcy I would be ok, but I have no clue where to start. Any help would be great, even the info needed to file or ask for help. I just cant do this much longer.

Where to file bankruptcy?

I currently live in NH/ over 10 years. I own a mobile home and a car. Due to health reasomd I will be moving tp a warmer climate. Yhe house is in my name and PIF as it is old and does qualify for moygage so I pay my parents/ The house will be sold and the money will be a swap for a house where I relocate and technically is for my parents for loians to get me by during litigation. Much of my debt credit cards as I was in a MVA a few years ago by underinsured and dishonest motorrist- cc charges were fort medical bills and if used for purchases cash was tight and some medfical bills wete paid in cash so other needs where charged. I think I have 1 student loan nvut thought all were paid 12 years ago/ Loan is about 1200 cc debt is about 120000 and a few thousand of medical billls are remaining. I did wotk after accident but had surgery from said approximately 2 years after. I did my best paying off debts incured from 2005-2007 but after the surgeries which were kinda influenced by my lawyet as he enphasized need for medical end point even though I expressed there is no medical endpoint. Well my climb to pay devts started again after surgeries and additional disorder called Rsd. I did have LTD but they never paid as a doctor was paid off to fabrricate my evaluation when my job did not like what 2 other doctors concluded, which one of yhese 2 my work sent me to. After aan error on Socoal Securoty ceases ny income for 2.5 years, the feds granted the claim for SSDI. Besides stress of litogation, no income, age of digerative disorders SSDI was granted with an apology of the sort. I akso annulled a marriage within this time leaving me with deby from spouse who commited domestic violence on me and he chose to live off of me. I was also robbed of 5 figures of assets and lost alot of electrical utilities from lightning. I salvaged what I could and did not complrte insurance clai, as briefed to ageny as I was loosing hope and in alot of pain physically abd mentallyt. Years of litigation, paying medical bills, healy
th, etc I started loosing hiope and addressing many issues became to taxing but I did what I could and blockrd out what I couldn’t deal with mentally and financially. My parents lent me money to get by. I alsoi have 1 speeding ticket that I was under thje impression was dismissed. Well I got a letter recenrtly that stated it had veen 3 years and threat tp revoke my license, I alsp have a scar ocroissd my face that is a constant remonder of somr horrific times which will codt about 4000 to fix. I can’t handle another winterin NH as it is compromising my healyj and litigation has and cointinues to keep me from mty lovrf onrs. If my parents pass qwhile waitimhg for the litigation , it would devistate me. Additionally more medical problemsa have arisen due to tjhe weather, stress, and afe. I also have apptoximately 10000 in legal fees from the lawyer for ssdI who did not do his job, I did hid jpb and he wiithdrew representation as I mentioned consideration but planned to dicuss our relationship before making a decision and he wityhdrew vefore our meeting , as I ended up in hospital that day buit left vm in evening avout hospitalization. When I talked to him the next day he informed me that he notified social Security of his withdrawal. SS was one who informed me of incomplete and questionable lawyers effort and mentioned I shpuld consider terminating him. They did thos as a favor as they technically were to correspond with my council but they were quite hekpful and confirmed my concerns of lawyers incompleteness. Well, now he wants 6000 dollars for 1 days work/ I was ythe adjudicator with the congresswoman, Social Security judge and doctors. O had already elvaluated with states doctors, submitted 380 pages of medicsl records, went to 1sr hearing, filed an appel as my doctor still did not feel comfortable that it was safe for me to work. SSI;\ost appeal forms but it was emtered om ytheir computer that it wsd recieved 9 mpnths earlier per protocol and admitted error on theirr part;. such action hindered rehabilitation, medical treatment, quality of life, and blew my immaculate credit, and eventually had to cxcl health insurance and homeowneras insurance. If I fplr ch 7 or 13 and have to appear im court wiyh drawm out litigstiom I would noy file in NH I wpuld opt to fil whrm I move. Is there a reasonable alternative to bankruptcy?

I was laid off in February of 2009 and have not been able to find a good job since. I have been without medical insurance for almost 3 years and have to pay out of pocket for a required medication costing roughly 0 per month. I have moved back into my mother’s house (I’m 26) and I am overdrawn on my bank accounts every week just from paying off my car, my storage (I moved home from another state since I could no longer afford rent,) my medicine, groceries, and then attempting to make payments on my debt. I have spoken with a credit counseling organization (MMI) and they have offered me a plan by which I would pay them about 0 per month. This plan would entail 0 per month for debt payment, 5 for car payment, 5 for my student loan, 0 for medicine and 5 for storage of all of my possessions. This is 95 per month. It does not include food. It does not include emergency preparation. And it is also 0 over my monthly income.

Issue #1: I need a new job. On average, I apply for 20-30 jobs PER DAY. I have been told that, since the economy went bust, EVERYONE checks the credit of a potential employee. Obviously my current poor credit is enough to render me unhireable. If I declare bankruptcy, how much worse can (will?) my job hunting situation be? I currently temp at a front desk for just 30 hrs a week, no benefits.

Issue #2: I need to be able to move out of my mother’s house. She is very kind to have opened her home to me when I am in such need, and I try very hard to stay out of her way, but she makes it very clear that it’s a huge burden on her to have me around (I know she is right, but it makes it no easier). She is also 100% against me declaring bankruptcy, not only for the impact it will have on my life but for the stigma it will bear on hers. I need to be able to have my own place again. But, my current credit is so poor AND declaring bankruptcy would remain for 10 years on my credit report, that no one would possibly rent to me. Which is less devastating to a potential landlord? Terrible credit and a ridiculous debt-to-income ratio, or a recent bankruptcy claim?

Issue #3: My car is currently worth about k less than what I still owe. I have tried to sell it back to the dealership, they charged me k and even when I left the car with them, they immediately called me back to pick it up because apparently something in the undercarriage was repaired wrong (oh and getting my k back was a real hoot, let me tell you.) It has already been repo-ed once and I had to pay money I didn’t have to get it back. I have tried selling in private forums, I have tried refinancing, I don’t know what else I can do. No one will buy a car worth almost ten grand less than they’re paying. I want very much to keep it, but I can’t afford it. And yes, simply letting it go would COST ME MONEY. Dave Ramsay says, "sell the car." What would Dave Ramsay suggest in this situation?

Issue #4: I have no savings. If I declare bankruptcy, I will be living off of my income alone (my savings deteriorated during my time when I was unemployed, after which my debt increased exponentially. HOWEVER. If I declare bankruptcy and can divide my piffle paycheck so that at least SOME of it can go towards savings, then at the end of ten years when the bankruptcy falls off my credit report I will have something, instead of nothing. Or just…more of the nothing I have right now.

Issue #5: I can’t pay these bills. (see the price outline in the first paragraph.) Won’t these companies just sue me anyway, if I don’t declare?

Look. I love and respect my mother (who is not a financier.) I do not want to make her sad because her daughter went bankrupt before the age of 30. But let’s be realistic here. How much worse could my situation POSSIBLY GET if I declare, file for Chapter 7 and get my debts forgiven so that I may begin to rebuild.

I would very much appreciate ANY input, on a REALISTIC, REASONABLE alternative to me filing for bankruptcy. I have listened to "Financial University" by Dave Ramsey about 1000x and I’ve read Suze Orman’s books and seen her show.

It would bring me so much comfort, and I would so appreciate it, if my peers on yahoo who have experience or knowledge with this kind of thing could reach out and give me their honest, informed opinions.

Should I take on Sallie Mae?

My ex-husband went to Auto Finance School while we were married. He was trying to better his opportunities to make more income (didn’t work).He had horrible credit so when he applied for a student loan, he was required to get a co-signer…me!
So since the divorce I filed bankruptcy and included this loan because it turns out it was a private loan that was issued by Sallie Mae. From what I have heard MOST student loans are not dischargable unless you can confirm that the loan was for a non accredited school…I am willing to fight this but I need to know what I am up against. I do not believe this school was accredited. For those who are going to say I shouldnt have co-signed, please save your time…I know the how a contract is enforced. I am a single mom that should not have to carry the burden of his failed responsibly. I handled the financial diaster from my divorce by filing bankruptcy and getting my debt discharged. I am asking if I am correct in fighting the loan based on the accreditation. I am looking for someone who knows bankruptcy law to answer on this subject. Thanks!
I am 90% sure this school is not accredited but I’m not going to take Sallie Mae’s word for it….how to I confirm a school’s accreditation?

If I file for bankruptcy. What is the downfall to that? where or how do I go about doing it?

I have a Student Loan that is effecting my credit which is now Cal Aid my girlfriend says I should file for bankruptcy. What will happen if I do that? and who do I go to to get it done? Will it effect my good credit I do have or get? will effect my bank accounts I have? I do not have a house so i am not worry about mortgage. I can stay on my mother property until 7 yrs is up get a house,right? I just want to have my own apartment for now until I get my section 8 or when I get it, and I am waiting on my attorney to tell me my court date b/c I file for disablement so when I win my case I can afford to have my own apt or house.

What's going on with my bankruptcy lawyer?

I have given the guy my credit report and other paperwork to get the bankruptcy filing started. I gave him a deposit and will give him the rest when my student loan is deposited this week. He responded to my emails just fine until I sent him two regarding a judgment that had just been entered against me last week. He hasn’t responded to either one. I am concerned because I hear that my bank account can be frozen and I don’t want the creditor to get to my student loan money. Why do you think the lawyer will not respond to questions regarding this?
I don’t want the student loan discharged, the loan funds get deposited in my bank account and I don’t want the creditor in the judgment to get a hold of these funds because I use them for living expenses.

Should he go with bankruptcy?

My pops lost his job earlier this year due his boss’s stupidity managing the business not because of the recession. He has always been the one supporting the family with his job for so many years. I’m struggling to make ends meet with my piece of crap job myself then I am drowning in student loan debts and many others. My brother has a really good paying job working at a steel plant. Mom doesn’t work because she is on disability and never ever seriously worked when she was able to work except two jobs she had in my whole lifetime. That was nearly two decades ago. That is more hurt to the wound also. My brother gave my dad an option that maybe he should file for bankruptcy to bail himself out of the hardships the family is dealing with. I know nothing about bankruptcy nor how that would help him out. Only my brother knows about that since it was his idea.

My brother came to me tonight saying things will get tough here at home because he can’t continue pulling all the weight paying all the bills my dad used to pay. Even if I do step in and take my brother’s place keeping the family surviving, that is still not going to be any better. The reason is because I too will have to forever be stuck in this rut we are in as long as my dad is messed up. Dad is doing his best working a part time job and doing some his side business he has at home. The money he makes total is not enough. I have my own debts that needs to be paid off. I also want to be able to live my life the way I should being on my own. I am all grown up now and it is way past my time to move out and live my life like I wished and hoped for. I never wanted to be stuck at home growing older ever year. All I’m saying is that if my brother get to the point where he can no longer help out then that would put me in the position to keep this family afloat. I don’t mind doing it, but it is not something I can continue doing for the rest of my life just for the sake of keeping all the debts paid on time.
David most of my debt came from student loans and car payments on an older used model, car insurance, etc. My job is crap because it does not pay enough to live on. Yes my hardwork getting a degree has gone to waste. I’m not getting any luck finding work related to me degree or any other work.

Private Student Loan debt (93k) in collections: demanding payment in full with grandparents as cosigners. HELP?

I have a private student loan that i defaulted on when I got sick and when I tried to make payments i was told it was charged off. That’s when MRS Associates contacted me DEMANDING payment in full (93,000.00) I told them I clearly couldnt afford that and they offered to settle for something like 50k. I only make 40k a year and clearly do not have the kind of money around. My grandparents are my cosigners and I’m so terrified they will sue them. I’ve begged and pleaded for a payment plan but they refuse. My grandparents have their house in my mother’s name and they don’t own anything other than a car, but I fear for their savings and the whatnot if this does go to court. I’m trying to obviously avoid court at all costs. I know I cannot file bankruptcy, i know i should have paid the loans, i know all of the things that many people post on other questions–like i said i was hospitalized for a few months and never got a handle on my bills after that. If anyone has some advice as to what I should/could do to prevent my grandparents getting sued I’d be so grateful. Thank you and I appreciate your help.

To Pay or Not to Pay? Reinstate mortgage or File Chapter 7 or 13?

I am 25, married, and own a small home. Due to very slow payment (I pay mortgage with student loan monies when they arrive), my house is going into foreclosure. I also have a lot of debt from medical expenses, and hubby has major debt (car, credit cards) from his teen years.

I have enough money to reinstate my mortgage without filing some type of bankruptcy. However, that would leave me with no lump sum of safety money. I do work, so I could feed myself – but I never seem to have enough income to pay for regular expenses AND my mortgage. So, if I don’t file bankruptcy and I catch up/reinstate my mortgage…I know I’m going to fall right back into the "non-payment" category again.

Is catching up my mortgage better than filing bankruptcy? What about the other debts that I have? How is credit affected?

(I’m going to grad school, so I have many years of being a poor college student left. I just need to know what I should do about my house and other bills in collections)
Husband is college student too. Together our income is still VERY tight on making all payments on time.

Yes we have cell phone – but no cable/internet/home phones. I don’t know what else to cut. :(

SideNote to a response on student loans: Student Loan money can be used for any of the following reasons, not limited to: tuition, educational supplies, food, housing, clothing, misc. necessities / personal items, technology purchases (hardware & software), etc. My lenders are VERY aware of the fact that I am investing in my future by paying for current expenses with loans. Hence, the reason that most lenders always mention "housing or room & board expenses" and are very inclusive on those types of expenses.

Can I file bankruptcy and still recieve a student loan?

I’m 22 years old and around 00 in debt. I was recently fired from my job, and have already missed a couple month’s worth of payment. I just recently went in for an interview for another job, but I’m having doubts that I’ll get it. My credit is poor especially since I had troubles a year ago when i was fired and took 2 months to find another job..

Anyway, I’m considering going back to college (I went before for a little while with money my Aunt gave me but eventually dropped out because I couldn’t afford paying for it on my own..) I would really like to go to college full-time but since I am already in debt and have no income I couldn’t really manage paying off my debts without having a full-time job.

I am considering bankruptcy as an option, but would I be able to file for it, and still get a student loan afterward?

What do I need to do to prepare to buy a house after a bankruptcy?

My husband and I filed Chapter 13 bankruptcy and it is to be discharged next year. When it is discharged we will have no debt except for my ,000 student loan that we were not able to include. Our gross annual is k+ now and we have opened and maintained two 0 limit credit cards that have perfect payment history for over a year now.

What else should I be doing between now and then to qualify for a first time home loan once this is discharged? Approximately how much down payment should we be looking to save? Should we be looking to get our credit score be at a certain level considering the bad mark bankruptcy left? Any other tips? I sincerely want a home. We are responsible people who got into a mess because of a medical hardship. We are paying back debt and just hope to come out of this able to purchase our own house.

Must file bankruptcy…scared?

I’ve had perfect credit since I was a teenager. Last year we opened a business and it has failed miserably. We have tried selling it with no luck as the lease is too high. We just lowered the price dramatically but my lawyer says only give it a few weeks at the low price then I’ll have to file personal bankruptcy.
It makes me sad but I have no choice. Only I am filing, not my husband. Most of our debts are in both of our names which will transfer to him. But, the store lease, our back store rent, my credit cards and some of my student loan could go into the bankruptcy. I will be bankrupt for 9 months and then discharged. It will be on my file for 6 years after discharge. I’m in Canada.
I’m scared that it will affect our home as when it comes up for renewal my husband may not qualify on his own. Do you have to requalify at every mortgage renewal or are you safe for the 25 year term as long as you pay every month?
We have 5 children and I just need some peace of mind.

How can I pay off my student tuition if I don't have a job or any source of income and can't file bankruptcy?

I have a loan that needs to be paid off. The problem is is that I don’t have a job or any source of income to pay it off. The problem is also you can’t file bankruptcy on a student loan. Is there any website that I can go into that will help me pay off my tuition. What about the stimulus plan?

What are my rights if I was not informed that my university debt wouldn't be included when I filed bankruptcy?

When I filed chapter 7 bankruptcy, neither my lawyer or the bankruptcy trustee informed me that my debt to a university would still have to be paid. Is there anything I can do??

Why do banks require a co signer on a deferred student loan when you may remove them after 18-24 mo?

I am not eligible to receive a student loan by myself because of my young credit of only about a year even tho I have an excellent score.
I am not able to have my parents cosign for me because they are coming out of bankruptcy a little over a year out and have re established their score. but the loan companies and banks say it needs to be 2 years. I recently transfered to a very expensive school. I did receive a scholarship, but it doesn’t quite cover the cost, which including housing is around 40k per year. I have excellent grades deans and presidents list every quarter of my 3 year length college career.
But what I really do not understand is how on a deferred student loan you are required to have a co-signer when they can be removed as your co signer after 18- 24 months.
This does not make much sense to me and if anyone has any kind of alternative ideas comments or solutions I would appreciate everything I can get my hands on.

How easy is it to file bankruptcy when I only get SSDI?

So I have a small amount of credit card debt…but it’s still there and I have also been informed I could get rid of my private student loan debts by filing bankruptcy. I just wonder how easy or difficult it might be to file a chapter 7 when all I receive is SSDI, I don’t have a job, and I don’t have any assets. I attend college…and only just as long as I keep receiving grants for it…the grants stop, I’m out of school because I can’t afford it. I’m also single, 23 years old and paying rent and other bills with the SSDI…such as car insurance to be able to drive my friend’s car, my cell phone bill which I keep so people can get in touch with me, and then I have medication to buy as well as school textbooks every so often when the grant doesn’t give me enough to supplement for books. Also…if I didn’t keep loosing jobs due to my poor health, than I would repay most of this debt…so please…no harassment from people.
