Can you choose not to include a repo in it since the car was initially meant for someone else and you already told the bank about this in the beginning when you told them to repo it? And I see that they say not to get anything on credit 6 months before you file… is that 6 months before you file or 6 months before you start the process? I just got two cars in August 2008 so should I wait 6 months before I start the process? There’s no way possible I can even keep ONE of the cars because my monthly insurance payment IS a car payment. A few questions about fraud… will I be charged by the bank? If I make payments on the repo can I still get charged? Can I or should I bring the dealership into it since they did it? I really did not know it was fraud. I know I will still owe them but I want to make sure those lying bastards get theirs, too. I just want to make sure that I can file bankruptcy on the other car. I can deal with paying the repo on the other car by not being able to include it.
Trust me my credit is horrible! Not a problem.
My recent car purchases in August 2008, yes this year, is why I NEED to file bankruptcy.
I was ignorant of how things worked and I had one pulled over me, I admit.
I am like… ,000 in debt.
All in car debt! I only have one past due credit card.
So my question is
Should I wait 6 months from the date I bought the vehicles?
Because it is not fraud… I lost my job and simply can not pay!
I don’t have a degree or any in demand skills so there is no way possible I could afford to pay 00 a months in bills.
I don’t even MAKE 00 a month, gross!

I don’t know the difference between any. What I do know is that my credit is jacked up, mainly with medical bills, and a repo from 2000 (that I thought should have been removed by now). I can’t even get a department store credit card, have NEVER HAD any credit cards or loans, so I don’t understand why I’m always denied when I know folks with much worst stuff, yet they get approved for everything. HELP!
…will my husband be affected if I file? His credit is pretty ok

A friend of mine filed bankruptcy about 5 years back, but canceled the bankruptcy when he got the money to take care of everything. So he never went through with it. At this point in his life, his daughter has no way to get to school, and he knows that last time he filed, he got his car back. Has that law changed? He needs the car bad enough out of repo, and this is serious.

I was unemployed for about 4 months earlier this year. During that time my car payments as well as other payments fell behind. I have been trying to catch them up, unfortunately when I got my new job I took a massive pay cut and can no longer afford the payments. Last week my car got repo’d. I would have to come up with 00 in order to get it back as well as figure out how to manage the payments on top of my other past due bills. This has proven nearly impossible if not completely impossible. Therefore I am going to attempt to file bankruptcy. However, I am borrowing 00 from a family member to buy a 00 vehicle (like i said i live in MN and walking everywhere is very cold). But my question is this: If I do go get this car before the bankruptcy is filed, will they take and sell the car to try to pay off the debts? Or should I just put it in a friend or family members name till the bankruptcy is filed and over-with?

I owe a total of about 8k, so I guess it sounds ridiculous to file bankruptcy. Im just not sure of my options. None of my debt is from credit cards, but I had a repo a year ago. I owe about 3k on that car, then the rest are small debts, like old medical bills. When I apply for any type of credit it tells me I have no credit history which is not true since I owe money. How can I pay this and rebuild my credit?

I was young, (22yrs old) had 2 jobs and made good money. I decided to trade in my old junk of a car and buy a brand new car. I had no credit history so my then bf helped co-sign for my new car. My interest was sky high but I didn’t care at the beginning because I had no idea what I was doing. I paid a very large amount per month and then after about a year, I lost my main job. A few months after that, I lost my other job. I now was collecting unemployment and went through HELL to make sure that car was paid off every month. I started making late payments and my life was just a mess because not only did I have to pay for that car, I had the insurance, rent, etc. I was no longer able to pay my car and that day came when Mr. repo came knocking on the door. They took my car after 2 years of me working my butt off and they auctioned it off for SO cheap (almost had a heart attack at how much they sold it for!)
This was in 2008 and 2 years later, I’m still struggling financially in more ways than a hundred lol…I have really bad credit, I can’t even open a bank account and I feel like my once so organized and amazing life is now totally off track. I don’t know what to do. These are my questions:
1. If I open a bank account, can my lender seize all my money? Not a savings, a checking account.
2. Being that I did not pay the upside down on the car (,000) should I file for bankruptcy and is it too late to do that after 2 years? And for those who want to suggest that I pay off the 16 grand, I’m not because I’m not going to pay for a car I don’t have anymore and you might say well you’re stuck with it you should have never bought a car you can’t afford I don’t want to hear it because you don’t know my story. I want serious answers, not answers that are going to sound mean and not help.
If there is anything that I’m missing? Please, any advise would be GREATLY appreciated. Thanks in advance

I was told by a car dealership salesman that the only way I could get into a car was through a lease, so I did. I have not had the vehicle for a year yet, but have put about 40K miles on it and am having a difficult time making the lease payment and paying the considerably higher insurance requried. I want to turn it back in, but am unsure about how much money they are going to try and bill me for for the mileage and wear and tear, and a host of other penalties etc. Will they put a lien against my home for this, garnish wages, etc.? Would filing bankruptcy before turning it back to them protect me from this? Would a bankruptcy be better than a repo on my credit history?

Im 20 years old and got into a big problem when i was 18-19.
I had a credit card through my bank and then decided to get a car. i went to one of those car places that approves you even if you dont have good credit. needless to say all of the payments got me caught up and because of some life events i ended up not being able to pay any of them. My car was repo’d and my credit card and bank account are charged off now. At this point im getting called 10-15 times a day from the car company and collections. Its been about a year since my last payments and my family thinks i should file bankruptcy.
I really want to get this cleared up but im not sure how to get started!
If anyone has any advice please help!

I filed bankruptcy in 2005. My car loan was included in the bankruptcy. The loan was not reaffirmed, but I kept the car and continued to make monthly payments. The car company has made me pay through their "bankruptcy department" and won’t send me bills or provide me online access to my account. If I let this car go back, will it be counted as a repo, or is it part of the bankruptcy? My lawyer at the time said that it would be part of the bankruptcy and the car company couldn’t count it on my credit as a repo if I ever lost the car. But he wasn’t that good of a lawyer. My credit is really really poor, so would a repo on my record really hurt me at this point?

My husband is 21, unfortunately he has made some horrible decisions in his life regarding money. He is now considered ‘high risk’ by EVERY loan company you can think of, including the NO CREDIT BAD CREDIT NO PROBLEM people, lol. Now his (not mine, my name is not on it, and please remember, I just recently became his wife!) car is up for repossession. He leaves for basic in January, and that will solve many of our money problems. However, we NEED this car, myself and my daughter, while he is in basic and up until that time. How long will it take them to come get it? And the real question I am asking is–with his credit being this horrible, and owing all this money that’s so terribly behind, should he just file bankruptcy?? I know it will freeze the repo and we can at least keep the car. He is only 21, I know that is young, but his credit report is four pages long–of crap he still owes. Would it be better to start over even with a bankruptcy? (my credit is good.)
That is–keep the car for an undetermined amount of time. His mother (imagine that, the apple doesn’t fall far from the tree) filed bankruptcy earlier this year and drove her truck for free for over six months.

I am now legally divorced, but when we separated, I did not cover my a@# financially. My dad was diagnosed with colon cancer, so I was not concentrating on the separation and left with my 2 kids to be with my family. Before I could cancel anything, he overdrew our joint bank account and the car in his possession was repo’ed, but both our names were on the loan. All of this is stated on the divorce decree, but that doesn’t protect me from the creditors. Anyway, now he has filed for bankruptcy. So I am afraid the creditors are going to come after me. Should I file bankruptcy too? I refuse to pay for debts that were his alone, plus I can’t afford it. Any suggestions?

I think I owe about 20,000 in I have 4 credit cards, 1 repo, 2 broken leases, and utility bills oh and 1 cell phone, but I have heard that paying old debts can still lower my score more than what it already is, I dont want to file for bankruptcy but if I dont where am I going to get 20,000 dollars? It all started when I turned 18 I am 25 now. Is it true that after 7-10 years they just fall off your credit should I pay, file bankruptcy or let it fall off, if thats true? My god mother filed for bankruptcy and was able to rebuild her credit but with my luck I wont be able to do anything I want a fresh start and I want to fix my credit does anyone have advise I obviously dont have alot of money please help.

Here is the situation. The couple just got married almost a year ago, both have horrible credit. The wife’s is due to not having insurance and has had major health concerns and piled hospital bills for the past 2 years. Also 2 credit card debts from years ago that equal no more than 3,000 owed on them.As well as a recent accident that has gone to collection in the claim amnt of approx 8,000. The husbands is from misc. small hospital bills( say no more than 2,500) , outstanding cable bill 600, repo’d car approx 7,000, cell phone close to 1600.. so im probably figuring a little high with the 25,000.. but lets just say 25,000. They don’t own a house , currently renting, The husband is active duty ARMY, she is doing online courses and doesn’t work. Their vehicles are paid outright, do not owe for them at all. And have no credit cards in their name . What would you advise??

Its a 2007 Honda Civic EX i owe about 21,000 on it, i dont think anyone would by it because they could go to a car lot and get one for 19,000. my credit right now is very good for my age(21) i know having it repoed or filing bankrupt will hurt my credit i just want to know how bad and which one would be better repo or bankruptcy.
