New Employment Opportunities and Bankruptcy?

Will my recent bankruptcy come between potential job/new career path?
I dont want to get into "why" I filed bankruptcy. I will say, I had no alternative.
Currently, I am in my 2nd year in college and I want to obtain employment while I am in school so that I dont have to take any more loans. I have put in a couple applications and have had one interview. Will the employer know when he interviews me that I have a bankruptcy? I have been told know days the employers dont even call ex employers because the only questions that can be ask are if the employee is rehirable? Is this true? I am concerned because if a new employer see’s that I have filed bankruptcy, and can’t get any good solid feedback from ex-employers then how will he/she know that I am a good prospect for the job?

Someone owed me money for a car but declared bankruptcy and is keeping the car. What do I do?

I sold my car last year to someone for 00. He gave me 0 up front and we drew up a contract stating that the rest would be due no later than December 6th, 2010. When the time came, after many missed emails and calls he told me the car was in the shop and that he couldn’t pay it right then. After a great amount of emails and calls that went unanswered, I showed up at his house and asked his mom if he was there. He told me he had to file for bankruptcy and his lawyer told him not to say anything to anyone. He told me the car "had been taken" and told me to talk to his lawyer about it. After trying to leave a message at his office three times, the secretary got fed up and told me that there probably wasn’t anything that they could do for me and that I was named in the papers but they didn’t have the car and they have no idea who has the car. After this, I decided to do a bit of snooping online and have enough evidence to show that he still has the car and is even in fact trying to sell it online. He won’t respond to calls and keeps redirecting me to his lawyer. His lawyer answered the phone today surprisingly and told me that I was named as an unsecured creditor and that my pitfall was in not declaring a lien on the car when I drew up the contract. I asked him
‘If I were to go to his house and ask for the car back, would he have to give it to me?’
‘Bear in mind that he is my client and everything I say will be in his argument, but no, he has a right to the car because you gave him the title after signing the contract.’

I tried to contact a lawyer but he said he’d charge me 0 for a consultation.

I told the kid I’d need the money by the end of December so I knew I was going to be able to afford taking summer classes this year. Now I’m broke and can’t afford summer classes and might even
have to graduate late..this guy is ruining my life.

What should I do?

How to help a depressed relative in significant debt?

I have a relative ("Lou") who is in debt. Lou is in his early 30’s. The debt is more than K. Lou seems depressed, and I believe spends (restaurants, clothes, etc) as an escape from real life. In the past, the family has repaid Lou’s debt without conditions, but every time more debt appears later. This time, the family offered to refinance the debt only if Lou hews to a budget. Lou is resisting the budget since it imposes controls that any adult might resist. Plus, Lou is worried about his life being in too much flux and not being able to guarantee he can live within the budget. The only alternative is for Lou to default on his debt. We don’t really want that because of the long-term implications of bankruptcy. We also worry about pushing Lou "over the edge". There is no drinking or drug problem. There may be a gambling problem. What do we do? Lou refuses to go to counseling.

When is the best time to file bankruptcy?

Details – Got misguided by a con-artist mortgage broker. I was paying my mortgage on time and then refinanced because he told me I’d get a lower interest rate. The bank "forgot" to put an escrow account in my loan, unbenownst to me until nearly a year later. It jacked my payment up by 0/mo.

Anyway, tried restructuring with the bank and put my house on the market. I found two buyers but the bank has been unwilling to come down on their price, even though the house’s value has depreciated significantly.

I had a 722 score but now my credit is completely shot all because I made a dumb choice by refinancing and got taken. So… I really didn’t want to go through bankruptcy but only as a last resort. However, the house is still in limbo with the potential buyer (short sale) #2 if the bank agrees to an offer. Should I file bankruptcy now or when it gets closer to a court date? I get about 50 calls a day from bill collectors. I just leave my phone on silent and keep on working.

I know there’s never a BEST time, so when is the RIGHT time if someone is contemplating bankruptcy? And what will happen to me?

Credit reports and bankruptcy?

I have to wonder why people tell other people not to file bankruptcy because "it will be on your credit report for 7-10 years." I ask this because, if you’re not paying your bills, that too will be on your credit report for a long time. As in, what is the difference? At least when you file bankruptcy, you are consolidating your bills and trying to start over. If you can’t pay your bills, then they’ll just pile-up with late fees and never leave your credit report.

My Ex-Best Friend.. Should I..?

My ex-best friend has been on my mind for the past 4 years now. Here is a Short version of what happened:

We were best friends for 9 years. We married brothers, so we became sisters and we were a very close group. My husband became Very ill and had to have surgery. He ended up in the hospital in november 2004 and was there until january 2006. he nearly died 5 times from Several complications. anyway, the last day that i saw her in person was the day of his surgery, she and my brother-in-law come to the hospital and when they left she didn’t even give me a hug.

a week before christmas 2004 she called me to tell me they were getting divorced and when i told her my husband was dying she said "that sucks" with no remorse for her friend/brother at all, or me! she immediately moved into a trailer with three guys, got knocked up, and moved to another state. i havent seen her in 4 years! she left us all in shock, my brother-in-law then lost his job, filed bankruptcy, went through the divorce, and was dealing with his brother dying in the hospital.

plus, i stayed with my husband the entire year in the hospital with no way to contact anyone (i didnt even have a cell phone).. and since she moved around i had no way of finding her anyway. she told a mutual friend that i can kiss her *** for not acknowledging her birthday that year!!! my husband was dying and i never got a call or email or even a card or visit! wtf!

then, my husband passed away in december 2007.. my friend told her and i still got no card or email or anything. but on christmas day 2008 she sent me a message on myspace saying "merry christmas"… how am i supposed to take that? i said, "you also" and that was it.

i can’t stop thinking about her and how maybe i am wrong somehow?!?! but She is the one who abandoned Me.. i keep getting these guilty feelings like the divorce may have been hard for her (but i doubt it), it was her choice to do so and it in no way could have been more stressful than what i was going through.

please someone give me advice or what could make me feel better? everyone is telling me to completely let it go. i dont know if i want closure, but im almost certain i dont want her as a friend anymore.. she’s changed Way too much since then, even her religion, friends, clothes, lifestyle.. everything! Should I contact her? help!!

Should a person stay married to a mentally ill person that breaks marriage vows, cheats?

My wife has a disorder where the pathology is such that they are serial cheaters and liars in many of them and they will bring on their abandonment with self-sabotaging of the marriage due to irrational fears fo being abandoned in the first place. She has no healthy fear of consequences the way her brain functions and has engaged in risky sex with my coworker and even public sex. I know someone will say that i took vows like "in sickness and in health" and "til death do us part", but there is no cure fo rthis and often relapse with all known treatments.

She has Borderline Personality Disorder, and she took a vow to "forsake all others" and has cheated every couple of years of our marriage and smears me to people. Since she has been diagnosed, her therapists have shown her that she is mostlikely the root of most of her problems. She has destroyed an otherwise decent and functioning family. She acts much as though she has multiple or split personalities.

I have given her 22 years of my life taking care of her and her mother who had it too. Her mother was highly abusive to our marriage and very selfish. I have lost a fortune in real estate due to her selfish impilsive spending and are filing bankruptcy. How much should someone endure when only one has upheld marital vows and the other has been a raging, violent, serial liar and cheater?
Breaking the marriage would help me of course, and it could help her to realize consequences and stop making the same mistakes over and over and learn to appreciate her family and not destroy it. It will both help and hurt our children as being around her full time is toxic, but so is being 10 and 12 years old and having your parents divorce and for her to impulsively date, move in and marry men on a whim. She will devote the rest of her life, even after she married another, to making my life hell as i am her icon of abandonment that left her though Borderlines more often than not bring this on themselves. To answer your question better, HackDon, this disorder is famous for being a no-win situation for the family members.

How to get money for college when family in bankruptcy?

My parents have filed bankruptcy and it wont be up for 2 more years. I start college this fall, but we don’t qualify for state or federal grants because "we make too much money". What the FASFA people don’t realize is the payment they make monthly to the bankruptcy court. My parents are so poor they have to borrow money from me that I make at my part time job, just to buy groceries. I wont be able to work much when school starts and I was wondering if anyone knew of some scholarships (no matter how little, every bit helps) or grants so that paying for books and related expenses wouldn’t be such a hassle. Tuition is free until i leave my community college (I have %75 bright futures). I just need help paying for books, supplies, and possibly gas. Can anyone help?
No loans whatsoever. I need grants or scholarships.

I need help with creating a budget or atleast tips on saving money?

I am filing ch 7 bankruptcy and should be discharged in about a month….I would like to point out that I got in bankruptcy due to medical bills and being left with a 3K mortgage in my lap….boyfriend bailed. I truly need to make a fresh start…I wont have a lot of $, but there has got to be a better way to pay bills, save a little and have some "cush" when things like unexpected car repairs come up. Any advice?

$8000 tax credit and bankruptcy?

Hi.
We have a joint mortgage and I (husband) filed Bankruptcy last year and was discharged on January 2010. However on my credit it is reported as "INCLUDED IN BANKRUPTY & DISCHARGED" when on my wife’s it is showing current on payment. We are still making payment but mine does not report when hers is reported.
We filed out tax separately where I claimed the mortgage as I am the primary. We are now worry that we might not be able to get the 00 credit since mine does not reported as pay on time.
Our quesiton is should we worry about this or it is fine?
By the way in the bankruptcy 7 I filed there was a stipulation where any tax return shouldnot be kept to pay the creditors.
I have already received my South Carolina tax refund and just waiting for the Federal which was done together with the 00 tax credit.
Also what can I do to report the mortgage current on my credit?
Please let me know.

Question for a bankruptcy lawyer about required documentation?

We are talking to this one law firm and the secretary is says we need the last 2 years tax returns to file for bankruptcy.

We have the full return from last year, but from 2007 some little things are missing. I ordered tax transcripts from the IRS which shows our AGI and everything from 2007, and I actually ordered for 2006 and 2005 which is over and above what they needed.

The "secretary" says we cannot proceed without the original W-2’s from 2007. The IRS says this is official tax documentation showing we filed and the amount of income we earned. Should I just drop this place and find anothe lawyer.

Are tax transcripts generally sufficent enough in your experience?

creditor harasses me even after i hired a bankruptcy lawyer. what to do?

the bankruptcy lawyer told me that i should refer all creditor calls to him and i’m not supposed to tell anything else to the creditor. I told this to the creditor several times, but he keeps asking me only one question –

"how will you pay? you must pay it"

I told them, "i will not pay anything as i have a bankruptcy lawyer and you contact him"

he stubbornly responds,

"this is an attempt to collect a debt and you must pay. How will you pay — credit card, check or money order. Again i repeat you must pay"

i said, "did you call my bankruptcy lawyer? why don’t you"

he stubbornly says, "you have no lawyer, so don’t make excuses and we will continue calling till you make payment. so once again i repeat you must pay and how would you pay?"

i hung up the phone on them. what to do? bankruptcy lawyer says he never ever received any call from such creditor whatsoever.

Why don't we hear about what happened to the person whose SSN Elvira stole?

That’s what I’d like to know about, I am so sick of all this one sided "I just wanted to work and be with my son" BS. If the media wants to present a fair and unbiased story then it should also cover that.

Did she cost someone allot of money when she used their number? Did they have to file bankruptcy or lose their home?
caldude – when the income is reported to the IRS it is ADDED to their total income, and then they OWE TAXES on that income.

Also if she claimed more exemptions then she is entitled to there wouldn’t the withholdings, so come tax time there are added fines (interest) on the taxes owed.

The costs to straighten all this out is very high, because you need a lawyer.
no MX, I am right, I happen to have a degree in accounting. The IRS will eventually straighten things out, but ya know what, FIRST the person is audited and then several months later things might get fixed. In the meantime the legal citizen is left hanging.

Home Mortgage not reaffirmed during ch 7 bankruptcy?

We filed ch7 bankruptcy 3yrs ago. It was discharged. Just recently I discovered our home mortgage was never reaffirmed. We’re making payments, our mortgage company is happy. But our payments are not being reported to any credit agency (our credit report doesn’t show we even have a mortgage.)

A quick call to our lawyer who handled this told us that no assumption papers were signed. I know when I filled out the "so you want to file bankruptcy" paperwork that I checked that we wanted to assume our mortgage. Our lawyer said the following:
A) it wasn’t a big deal but nothing could be done now
B) the mortgage companies often don’t allow mortgages to be reaffirmed (essentially saying it was their fault)
C) we should seek other methods of rebuilding our credit.

Does any one know:
A) is it really no bid deal?
B) should I fight to determine who’s fault this really was?
C) is there anything that can be done to get our mortgage back in good standing?

I filed for bankruptcy about a week ago and my car was repoed can I finance another one before the 351 meeting

O.k i filed bankruptcy about a week ago and I dont know how long it takes before my dischare meeting. Im desperate for a car? I had a previous car but it was reposessed by the bank about a month ago. My lawyer told me that if i go finance another car then at my discharge meeting they might not clear me from all my debts? Is this True? How soon should i wait to get a car becuase I am really in need of one. After my discharge or when i recieve the letter that my debt is cleared. Also my girlfriend is willing to finance the car for me, but wants to know that when i’m done with the whole "bankruptcy thing" will my credit be so bad that i wont be able to take over the payments. please any info is very helpful.

When a "possible landlord" asks…?

Why are you moving from your current home and we are filing bankruptcy and foreclosing on our home…what should we say? We officially file tomorrow and and the foreclosure has not been given a specific date but we are going to look at a rental and want to be as upfront as possible. The initial "bankruptcy w/ forclosure" is an answer that might turn anyone off. How can I explain that we are lookingfor a fresh start and have good jobs w/ personal references that could back us up. We’ve owned two homes in our current city and fell into the "subprime" fallout (like many others) with our current home.
OK, as not to offend the Realtors…we were given a 30yr fixed loan which no lender would touch at this point in time to refinance because we did have a high income to debt ratio. The "fallout" did not help our situation.
Yes, we do take blame but I’m not asking YOU REALTORS OR LENDERS SO BUG OFF!!!!!!
