Can my dad file bankruptcy?

My dad owe ,000 to credit cards, lines of credit etc..

It all started when we bought a house. My dad was the only one working. After two months purchasing the house, my dad lost his job. So, hoping the he’ll find another job, my dad kept on paying the mortgage, property tax etc from his credit cards.

He did not find any job. My mom found a job but not a good paying job.

After 3 years, we couldn’t afford it and sold the house.

Right now, we live in an apartment. My dad is diabetic and has other medical problems and can’t find any job. Also, his language difficulty is preventing him from finding a job.

My mom works and its enough just for rent and food for our family.

My dad keeps getting phone calls from credit companies and stuff asking him to pay. My mom gives him 50 or 100 bucks per month to pay his credit cards but she can’t do this every month because she only earn that extra if she works extra hours. She has arthritis and her doctor told she shouldn’t work much.
My parents’ first language is not English, hence my dad has difficulties with English.

Okay so my mom cosigned for me and i got a car a year ago. well recently she filed for bankruptcy ?

and now i cannot view my online account or receive statements in the mail. well i recently moved and I am 2 months behind but i have the money now and i want to pay but i am worried the money is going to just dissapear and they are going to take my car away! But i have not received any phone calls or statements or even letters saying they were taking it! Oh yeah and when i call I cant get info without talking to someone and they say i can pay by phone or mail! but wont tell me a thing. It’s annoying! Ive paid my payment for a year now. My mom has never paid it and yeah?

if you are totally unemployed, have no assets and you can't afford bankruptcy lawyer, then what to do?

please don’t scold me for having so much debt or being financially responsible. Whats done is done. Only the present and future advise i need now.

I can’t find job. It is very hard. Even though i have bachelor degree in math, i can only get .50 an hour which is nothing to fight the ,000 unsecured debt.

I defaulted on my payments since february 2009. The .50 hour an job — almost all of it goes on cell phone bill, broadband bill, car gasoline, dog food and dog vetreneary expenses (i have 2 large dogs).

I get 100’s of phone calls by harassing creditors. I no longer pick up the phone. I can never raise 00 for bankruptcy lawyer in such poor financial situation. My interest rate has hiked to 36% APR and i keep getting slapped with more and more fees of interest and penalties. I QUIT!

What will the creditors do to me now? there is not 1 single asset i own, except for my 2 beloved dogs.
Will creditors send me to jail? how will this situation end?

Please advise. I see no end to this at all as long as job market is stagnated.
.50 an hour job is as good as being unemployed. right?

I am on disability and being called by debt collectors and attorneys, should I file bankruptcy?

Back in June I was terminated from my job due to my epilepsy, I hold nothing against the company as they did all that they could with an ADA accomodation, however my seizures caused me to miss to much work. I ended up getting approved for disability, being considered permanently disabled and now make 950 dollars a month, which is my only income. The loss of income forced me to drop out of college and now I have 70,000 in student loan debt coming due. I have been getting constantly contacted by different collectors and attorneys regarding many of my debts, 3 credit cards, totaling about 1,000 dollars, my pickup was repossessed in June and they are trying to collect the final 1500 dollars that they could not get from selling it, which is now being handled by an attorney threatening litigation. I also owe on a large number of medical bills, 6,000 owed for a balance with snap on tools, which the toolbox was stolen so I cannot return it, and many old debts that are beyond the states statute.

The only asset I have is my motorcycle worth 5,000 dollars as I have lost everything else and rent my home. Basically when comparing all of my liabilities to my income and my assets, I am insolvent and from what I have been able to find out basically "judgement proof"

I cannot decide if I should file for bankruptcy to try to get a fresh start since there is no way I will ever be able to get these debts paid down. I do know that there is the possibility of my student loans being discharged due to disability. I don’t really want to file but I am starting to think that either I will have to, or just keep putting up with many of the phone calls and send cease and decist letters to the ones beyond statutes. Does anyone have any suggestions on this?
I have already spoken with Sallie Mae in regards to my student loan debts, and they did advise me that I am in the rare circumstance where the loans can be forgiven.

As far as the motorcycle goes, it is my life, although I do not drive currently, as i know better, I don’t need to put other people at risk or myself, but the motorcycle is the one thing I refuse to get rid of, as it took me a long time to be able to purchase it, and it is more important to me than anything, including my own life. This may sound crazy, but my motorcycle got me through alot of times when I was depressed. Even my therapist and my doctors all say not to get rid of it since it is all that I have. As far as my debts do go, not including the student loans I am sure that I have over a total of 0,000 in debt as I had to have brain surgery 2 years ago and still owe for that along with a large number of epilepsy specialist visits. I have spoken with an attorney in the past and they have said I do have enough
As far as student loans being bankruptcy proof, I am well aware that they are in most circumstances, but there are circumstances such as being totally and permanently disabled, which by their definition means for a period of 60 consecutive months. I am certain that I will not be working for that long as we have had no luck in controlling my epilepsy so far. Many of the legalities on that I am aware of as I was majoring in accounting, and was only a couple of classes shy of graduating when I was forced to quit
Yes, that is correct, I am sorry my wording was off on that, while bankruptcy itself does not get rid of them, certain circumstances do permit the discharge of them, such as total and permanent disability. i have spoken with them and they are currently on deferment for hardship while everything goes through. It isn’t actually the bankruptcy itself that gets rid of them, but filing for discharge. I would definitely prefer to pay them off however, but with the cost of my medication each month actually being double what I receive in income and with medicaid refusing to cover them due to stating that they are not a preferred medication and refuse it even with requests from an epileptologist, I have no choice but to pay for them out of pocket until I can get approved for patient assistance. I am also in the process of working with vocational rehab to try to get me through school so that I can get a desk job as I am so limited on work that the only ones that I am able to do physically ar

Debt collection agency questions. Could this be fraud?

My husband has been getting phone calls from a collection agency at work. The agent calls but when my husband answers he hangs up right away. They will leave messages but will not talk to anyone when they call and someone answers.

The supposed debt was from an HSBC credit card. We filed chapter 13 bankruptcy in 2006. The card application was dated April 2007. I would have never applied for a card after filing bankruptcy. We received a bill for a credit card from Orchard Bank which we had in 2005 and the account was placed on our bankruptcy case. So I contacted the attorney and he said to disregard the notice. We moved in 2007 and had problems with mail being forwarded back to our old address. We had electric, cable, insurance bills that were sent to our old address. I became concerned and called the providers. They told me that the bills were sent back to them with address unknown.
I almost had all my utilities disconnected and our insurance canceled. We also had problems with the postal carrier placing mail in wrong boxes at the old address.
I’m concerned that someone may have opened up an account with a pre-approved credit offer. We received letters from one collection agency and I contacted my new attorney and she asked them to verify the debt. They did verify the debt but it wasn’t a card that we ever had.
HSBC then sent it to another agency. Then this new one. I sent them 3 letters asking them to verify the debt. I have never received any bills, letters, nothing from them. Just the phone calls at work. I then mailed them two certified letters asking them to stop calling my husband at work and to verify the debt. This was 2 months ago. No letters but the calls are still happening.
I checked my husband’s credit report and found the old HSBC/Orchard card listed and a new HSBC card listed to it. Should I dispute the file to the credit agency? Another strange item is that the collection agent told my lawyer that we paid on the bill. This is all really strange. I would never send in a payment of only . Is this a way to get this off of my husband’s credit report and to get this agent to stop? Thanks.

Who are debt buyers and what do they gain by buying the unpaid debt if person is to file bankruptcy?

I was default for several months on all my bills. Then i was delinquent. After that the credit card companies started calling 20 times a day to my house. I still did not pay. Then a collection agency was involved and they too did that boring stuff of excessive callings and mailings. Finally the collection agency sent the debt to "debt buyers". The debt buyers also played the same role of excessive phone calls and letters asking to pay bill. However I still did not pay anything.

Then the debt buyer sold the debt to another debt buyer. Finally it reached the lawsuit stage and I still don’t care to pay anything. I showed up at the court and demanded proof the debt is mine (even though i knew its mine). The creditor lawyer did not bring any paperwork so a new court date was set 3 months later.

In those 3 months the debt buyers again called and called and mailed lot of bills. But i still didn’t pay anything. Then just 1 day before the court date, i filed chapter 7 bankruptcy protection.

So my question is what was the point of debt buyers buying my debt and harassing me when i ended up filing bankruptcy. What will debt buyer do now? will they sell it again to another debt buyer? I don’t quite understand whats the purpose of their role?

I retained a bankruptcy lawyer back in may, to file for bankruptcy of course…..he told me it would take about 4 months…..here it is 7 months later…..he cashed my check within 3 days i retained him back in may…..my main reason was for garnishment…..i went and saw him 2 and a half weeks ago, after numerous phone calls, and asked how much longer to get filed, so the garnishment would stop…i said " what, a couple weeks"?…he says no…a couple days…..here it is 3 weeks later, after 5 voicemails…no response…still not filed….still being garnished……do i have any leverage here!!!!!!!!!!….i feel he owes me money, cuz hes takin his frickin time,…he was quick to cash my 1500 dollar check though 7 months ago!!!

When a wife is unrepentant of adultery, How do you help her to see Gods light?

There are no Children in our relationship. I recently found out that my wife of 10 years committed adultery with a roommate we had living with us. I want for us to overcome this problem and other smaller problems within our marriage. I already forgave her for her intercession. After I found out about her infidelity, I went to a men’s retreat, and have become a reborn Christian. I have never cheated on my marriage vows and still hold these vows sacred even after all that has happened, I Love my wife and want her back. I have written to her 5 pages of my faults in our marriage, and have asked for forgiveness for my faults. She says that I am forgiven from her lips but her heart says otherwise. I know that I have the biblical right to divorce her, but this is not what I want, I want to work with her in mending our marriage. However, she will not stop taking phone calls from her lover, we have been separated for a month now (not my decision) and I believe that she (although I don’t have proof) living with him. Because she will not talk to me, I don’t even know where she is living. (Don’t judge me here I have my reasons). She insists that she is going to file for divorce… so if the bible says I have the right to divorce her, I can, but this is not what I want. The bible also says that God hates divorce, and to do all things possible to mend the marriage. This is what I want but she does not want any part of it. I have forgiven her, and have treated her with respect as my family has, and she continues to treat us like garbage. So I ask again how do you help an unrepentant adulteress find Gods Light and Love????? Should I divorce her, or should I let her file for the divorce? When do you take off your wedding band, when the vow is broken, or when the divorce is finalized? Since we are not living together at the moment and I have lost everything in my life and yes I do mean everything, my wife, my home, my job, my business, having to declare bankruptcy, and some serious medical problems. I have found that God did not turn his back on me rather I turned my back on him for many years. I am now rediscovering who I am and I am taking steps to better myself. But what do I do about her???????

Attorney neglect?

My husband and I filed chapter 13 bankruptcy in 2006.
The attorney that represents us has failed to respond to 3 letters sent to him requesting help with our case. A certified letter with
delivery confirmation and signature required upon delivery. At least 5 phone calls and several emails. I have a new lawyer who has looked at our case. She found the case to be "botched badly". I had to quit work due to a back injury. So we lost my income which is included in the case and ch. 13 payments. He has us paying too much back to creditors. The last thing is that he made an error and now we owe over 00 in back taxes to both the IRS and city taxes. I called him once
and the secretary forwarded the call to his line. The phone rang for over 30 minutes. I received a call then flashed to answer when I hung up his phone was still ringing. Should I file
a grievance with the county bar association and also fire him?

Should a chapter 13 bankruptcy take 6 months to affirm?

We filed 13 bankruptcy in December. Our attorneys have made several mistakes along the way. When it came time to have our hearing to have it affirmed, our trustee said that the payment was too high and they needed to rework it to prove that we can afford it, otherwise they would throw it out. Our hearing on this was last week. They had two months to rework our figures. Apparently, they set ANOTHER hearing 30 days from now to rework it AGAIN. I dont’ understand what needs to be reworked. We only have one income coming in. Also, we filed taxes in Januray, BEFORE the bankruptcy was affirmed. Will we still have to give them half? It sucks that we’re paying on a bankruptcy that may still get thrown out and is not yet affirmed. It’s not fair if we have to give up have of our refund on a bankruptcy that wasn’t affirmed when we filed our taxes. I just don’t understand what is taking so long. What can I do? Our attorneys aren’t giving us direct answers and aren’t returning phone calls or emails. Can I call the trustee to see what’s going on?
Our car is included. We got to keep our house but we were behind 6 months and had to include that rearrage in the bankruptcy.

Bankruptcy or choosing to default on credit card debt. What are the ramifications of each?

I have A LOT of credit card debt from opening a business and having to sell it in one year because of family responsibilities. Saw a bankruptcy attorney, but the options don’t seem to work for me as there’s no way I could ever pay off these debts.
I know it’s very immoral, but what will actually happen if I just stop paying on them? I know I’ll be inendated with phone calls and lose my good credit standing, but can they attach my bank account or any other asset?

can I get my repossessed car back if I file chapter 13 bankruptcy?

my car was reposessed about 2 weeks ago and is just now going up for sale. If I file for bankruptcy is it really possible to get my car back before its sold. I believe filing would require the bank to put a hold on the sale.

If the Bankruptcy lawyer is too lazy to take things off your credit report?

his job I am told but 2 years later I took everything off then I go to refinance and the lawyer at new bank says there’s a lien for 21000. Meantime his broker promised me the world. Now it’s been 2 1/2 months of holding 30,000 dollars of mine. Will not return phone calls I have called numerous times. I am disabled and now my mortgage went from 807 to 2100 I make 1200 a month. I put 140000 aside to pay mortgage till credit goes up but, don’t look good to me I am broke. Then he paid the Bankruptcy lawyer behind my back 450.00 to reopen the case which I swear wasn’t was not on my credit report. Or in the house of deeds. He wants more he told me. Does he get it? Isn’t one price it. If he did do it? . I called the Court House it was written off. Will legal aid take care of this? I can’t afford a big lawyer and don’t trust anyone after 3 predator lenders and two lawyers who are playing with my mind. At 18 percent a day. Legal??? Please someone.
