Texas bankruptcy- File or just let bills go? 8000 annual income 20k debt?

ok, My mother in law only makes 8100 a year. She earns this money from a death pension from when her husband died. She owns her home which is woth nothing, owns a car prolly worh about 1500. She owes about 20k in credit card debt. She uses it to buy food and medication because of her diabetes and is left with nothing every month. She spends about 400 a month on these three cards. So it’s just a viscious cycle of making the credit payments so she can buy her meds and food and pay her electricity.

To be honest, I don’t even know if it would be worth her filing bankruptcy or just stop paying the bills. I told her to stop paying them starting January, because she just can’t afford it.

I guess bottom line, can she stop paying her bills right now for a couple of months if we have to find an attorney to file or should she just stop paying them and dealing with the collection calls? I was gong to do a cease and desist letter to the three companies so they wont call or bother her. She just cana’t make it. She’s not going to sell her house, she’s 62 so a lien or judgement on house wouldnt matter, and she meets the means test.

Her three cards equal about 20k in debt. And they havne’ t been used for luxary items of course.

But is it true that they could not garnish her bank account or death benefit pension?

Please any information would be helpful. She cant make it and it’s hard for her.

**** Extra details. The Death annuity is a civil service retirement thing. He died when he was 35 and it that is the amount of what his ritirement would have been at 35. so that is what she gets and has for the last 35 years. She’s not a smart woman and doesn’t thnk of counseling hense why I’m asking you guys.
Reading FTC, it says retiremenet is not garnishable, and survivor annuity. But don’t know if it’s one or the other. Its just his retirement that he would have gotten at that age when he died.
So…..should she even file? Is it garnishable? She can’t take it out fo the bank…it comes from the US Treasurey.

Can I File a Law Suit Against a Hired Lawyer who did not file my bankruptcy on time?

I hired a lawyer to file bankruptcy for my wife and I. She messed up a couple times and my wife was taken off and then she wasn’t licensed in our area and then she told me she was going to have to let it cancel and refile in order to get my wife back on it. I asked her if we had time to see about selling our home to pay off all our debts before she refiled and she said yes we had 30 day. I asked her to refile when she had to so we would not loose our home. My father in law passed away and we had to go from Florida to NH and put my mother in law in a nursing home and close and empty their house. When we got back it was about 6:00 pm. We found out our house was being auctioned off the next morning and the courts and our lawyers office was closed. So I went the next morning to the court and filed a motion asking the court to delay the sale because our lawyer was suppose have filed our bankruptcy and hadn’t and that we just returned the night before. The judge denied our motion and our home was sold and we had 24hrs to move out. When I got a hold of the lawyer she said she didn’t refile because we had to pay her to. Were we paid her and she messed up can we sue her and if so how long do we have to find a lawyer that will sue another lawyer?
We were gone almost a month and I thought they had to serve us papers in person!

We MIGHT be filing/declaring bankruptcy. Please read on to understand the situation…?

We are financially struggling here in California and now we have a baby. She has a birth defect so I, the mom, need to stay home to tend to my cute little baby girl. The only problem is that it’s been real hard to catch up with all of our bills.

We are in ,000 debt and my husband makes about that much in a year (gross – if I spelled that right). I’m sure ya’ll know it’s pretty damn expensive here in CALI so we’re trying to go back to Texas. My mother-in-law is opening her door to us and we are going to be living with her w/out having to pay any rent or utilities.

Should we still file for bankruptcy in your opinion?

My mother-in-law is worried that if we do that we will end up having to pay a very high interst rate when we’re ready to buy a house. I’m pretty sure that we won’t buy a house until 3-5 years from now.

I know there are probably more cons then there are pros, but I guess I’m worried that in the future we won’t be comfortable living with my mother-in-law anymore and we want to live in a apartment. So we’ll still have to pay our debt and all of our new living expenses.

Can anyone tell me will it be very hard to buy a house even if we’ll be first time home buyers if we filed for bankruptcy?

My mother in law likes my husband's little brother girlfriend better than me?

So my husband and I dated for almost 5 years before we were married, my husband is the oldest of 4 boys, and closest to his mother. My husbands younger brother has been dating this girl for maybe a year, and his girlfriend kisses up to my mother in law, she showers my mother in law with gifts, she’ll go out and start her car for her and warm it up. It’s so annoying cause all I hear when my husband and I visit is how wonderful she is or what other expensive gift she bought her. It’s like I should have to go bankrupt to get her to like me, I buy her gifts when it matters…mothers day, christmas..birthdays…etc, is it just me or is my mother in law being a bit shallow, or should I make more of an effort?

My mother in law is filing bankruptcy and I'm a user on her credit card what happens to my credit?

My mother in law has a store credit card and my husband is listed as a user not co applicant and she is thinking about filing bankruptcy. On his last credit report the card does show up on his report. Do we need to remove him as an authorized user to protect his credit? If we do, will that affect his score? If she closes the account does that affect his score?
