Hi.
We have a joint mortgage and I (husband) filed Bankruptcy last year and was discharged on January 2010. However on my credit it is reported as "INCLUDED IN BANKRUPTY & DISCHARGED" when on my wife’s it is showing current on payment. We are still making payment but mine does not report when hers is reported.
We filed out tax separately where I claimed the mortgage as I am the primary. We are now worry that we might not be able to get the 00 credit since mine does not reported as pay on time.
Our quesiton is should we worry about this or it is fine?
By the way in the bankruptcy 7 I filed there was a stipulation where any tax return shouldnot be kept to pay the creditors.
I have already received my South Carolina tax refund and just waiting for the Federal which was done together with the 00 tax credit.
Also what can I do to report the mortgage current on my credit?
Please let me know.

I have been placed on SS Disability and cannot afford my mortgage. I would like to move south. If I pull my 401k I can get a house real cheap. Then I would like to file bankruptcy on my house here. I would not like to be homeless for a few months. I still have decent credit for now but the funds are going to start dropping quick. Anyone have Ideas on how to do this?

If I include my mortgage in a Chapter 7 bankruptcy filing, how soon after filing will I have to vacate the property. The auction sale date for it is January 11th.

When is a good time to file for Bankruptcy? before or after foreclosure?

My husband and I filed bankruptcy in 2005. We live in Ohio. According to our lawyer Ohio law has a law where if you file bankruptcy on your home you can continue to live in it as long as you make your payments. We have continued to make our payments and have lived in our home ever since. When we filed bankruptcy we had the otion to sign a paper that would obligate us to the loan. If we signed it we HAD to pay off our house and could not file bankruptsy on it again. If we did not sign it we could just live in it as long as we made our payments and then we could just "walk away" whenever we wanted (we were not obligated to pay it off). We did not sign the paper. Now we are ready to move on. We asked the bank and they said we could sell it and pay off our mortgage and then we could reborrow from them again, (now). If we just walked away we could not reborrow, from them (ever). So my question is: If we just leave it will it affect our ability to borrow from another lender down the road.

I own 2 businesses and wife owns a biz. I’m about to lose 1 of the businesses I bought on land contract. I put some personal items as collateral (2 Atv’s and a flatbed trailer).
My other business has been supporting the business that I bought on land contract. They are BOTH not doing well now…. I am NOT sure IF I can get the 1st biz to survive because of debt.
If we give back other business, we are going to probably have to file for bankruptcy.
If we file for bankruptcy, what happens to personal items I guarenteed to the land contract?
What about my wife’s business assets? Her business is doing fair.. but has a few automobiles.
We personally are not doing well and have fell behind in bills also, so personal bankruptcy is likely. We are trying to do loan mod on mortgage.

My bankruptcy attorney was very quick to get my paper work in for chapter 13 and said that I wasn’t eligible for chapter 7. I have over 56k in debt and I was the only one filing not my husband. I paid the plan payment of 0.00 a month since April. In October I still was not confirmed and they wanted me to pay 30. a month for the plan payment. If I could afford to pay 30.00 a month then I really didn’t need to claim bankruptcy right? Now because I can’t afford the plan payment they will have to dismiss my case. I will still have to pay the attorney’s fees and 10% to the Chapter 13 Trustee’s. Then I will get back my money that I put into the plan payment. I was never late on my mortgage but because I went to find out about claiming bankruptcy they told me not to pay my mortgage that it would be part of the plan payment.

I was an idiot and bought a home with my cousin. We jointly own the home. I got married and we had a baby and my cousin and I decided that I would leave the home. She signed a lease in June stating that she would be 100% financially responsible for the home for one year and keep the home in good condition. She never paid a penny. I found out in August she was going to file bankruptcy and walk away from the home. I worked with an attorney to get her out of the home so I could work figure out what to do. She did not leave until mid-September (now the home is 4 months behind in mortgage) and the house was a mess. All the appliances were missing as well (brand new stainless steel appliances that were part of the mortgage) when I finally gained entry into the home. She signed a Quit Claim Deed over to me as well. I cannot catch up on the payments and so I got the home ready to sell. She damaged the home, left it a mess and stole the appliances. I replaced the appliances (with second hand, not as nice white appliances) cleaned the home and fixed the damages. I also have to maintain the yard as well. I started working with a real estate agent and they said I needed her signature to sell the home. I called the bank and they agreed that the quit claim deed really does nothing for me at all. I had my real estate agent call my cousin to ask her to work with them to sell the home, she refused. She said she’s going to file bankruptcy and walk away free and clear, leaving me to take care of the finances of the home. My agent told her that the foreclosure that could happen would still count against her and my cousin just hung up on her. I had my father talk to her mother (they are siblings) and that got me no where. She won’t speak to me as she is "afraid" of me (she’s a lying, deceitful, nasty human being, unlike myself and I have never done anything to her except have her kicked out of the house that she lived in without paying for 4 months). Anyhow, so I have tried every avenue that I can think of to have her work with the agents to sell the home and not have a foreclosure, I feel like I am being held hostage financially. I haven’t received anything from her lawyer about her filing bankruptcy (and she hasn’t yet, I check weekly with the courts). I have a couple of questions -
1. Anything I can do to her for not working to get us out of this financial situation that she put us in? Can I legally hold her responsible?
2. When should I file a case against her for the broken lease and damages to the home? Should I wait a little longer to see if she’s putting that on her bankruptcy or not?

Income is steady (same employer for 3 years) and sufficient to handle a reasonable mortgage…had insurance when the medical bills occured (serious health issue)…will a lender overlook or should I file bankruptcy and wait it out?

Say you get evicted. You file bankruptcy. 2 yrs later you have started over, have a squeaky clean credit report, and have gotten your credit score to 700. (I don’t know if thats possible, just guessing). You go to apply for a mortgage. Will the eviction matter or bankruptcy really even matter with such a high credit score? Thanks for any info.

I’ve decided to file for Chapter 7 bankruptcy…my employment hasn’t been steady in the last year and my debts eclipsed my rent even though I was on a debt mgmt company. All my accounts are closed and I haven’t used a card for anything since July (and that was at best a grocery purchase). I’ve been living off of temporary jobs and the occasional two-week unemployment benefit. I’m single, live alone in a small apartment, have no assets (not even a car). I have approximately K in old credit card debt. I’m not a shopaholic…most of the debt was incurred either to help me stay afloat while unemployed (and not receiving UE benefits).
I know bankruptcy will screw my credit, but I don’t really care…I don’t plan on moving anytime soon or buying anything on credit within the next few years. It would be wonderful to be able to put away some savings after paying my bills (00 a month would pay all my bills and allow me a modest budget of disposable income) would feel wonderful after scraping by for years and praying I don’t lose a job.
I can’t afford to hire an attorney, so I’m having a paralegal help me out. I know an atty would be better, but since I have nothing to save (no assets), I figure things would be pretty cut and dried.
At the moment, I am subsisting on temporary jobs and unemployment benefits during the weeks I am not working. A permanent job could come along, but I’m guessing not for at least another month.
wash – you can make payments to an attorney? I visited one early on in my decision and they quoted me 00, all upfront. I’ve heard that if you screw up your paperwork, you cant file for bankruptcy for a whole year, so I realize the value of an attorney…however, I also have a pretty simple financial matter: no assets, no kids, no mortgage.
Yahir – I don’t know if you’re a real person or not since I see a lot of these links, but just FYI – I was working with a debt mgmt company for about three years before I lost a job and could no longer pay them.
I’m single, no kids, never married.
This paralegal is not working for an attorney…she has her own business. She also told me she has filed for bankruptcy herself a number of times….I don’t know if this is a warning sign or it proves that she knows the ropes as far as what to expect.

I am being sued by former tenants that I had evicted for non payment of rent. They are claiming that I breached the contract for not selling them the property back, but they were in default by non payment and couldn’t get a mortgage when I was going to settle out of court with them. They provided false mortgage pre-approvals and do not pay any of their bills and can’t qualify for a mortgage. I want to file a chapter 7 and wanted to know if this would stop them in their tracks, as my lawyer fees are piling up. I won in district court and got the maximum judgment allowed, they appealed but didn’t continue to pay rent so they were evicted. I am selling the property via a short sale and they put a lis pendens on it, so I have my lawyer working on that. I know that their lawyer is shady as he is a personal friend of theirs. They are doing this to make my life a living Hell and so that I have high attorney’s fees. Do I have to wait or can I file now?
No, there hasn’t even been a court date set and my attorney feels that we’ll win but he said that we’ll never collect from these deadbeats and I want them out of my life.

he was always so controlling growing up. i couldnt drive like my friends could he never let my mom drive either. he always had to drive her out of town. i remember going to the store and i would be with him when he would see a stranger I felt like i would be kicked aside and his performances would began. he would make them feel like he is the best guy in the world. he would always had this thing for helping strangers over his family. we were always brushed aside if a stranger needed help. i just always thought this was weird growing up. i left got married. not 13 years later….i havent lived near him in those years and decided to move down the street from him. he is a contactor and he said he would do anything i wanted to my house and help me. so i paid top dollar for it and i thought my husband ,me and him would work on the house. he does some drywall work and then rips out the bathroom and rips stuff out upstairs and rips the stairs off says he is going to build me the best stairs . so my husband and i are working with him try to learn and do what we can. i was paying him what i could and then he found out i paid the wood layer to lay wood on the floors and he got really pissed and started telling my mom that we are just USING him. He said he is never going back down there and helping me. so my husband and i are now stuck with this house that he just decided to rip stuff out of and say how good he is at fixing it. he knows we dont have any money to hire contractors and we are very limited on knowledge about how to fix it. he would say you cant fix it because you dont have to money to hire contractors. and stuff like that. so my husband and i have been for the past 6 months try to learn and fix. in the meantime during this remodeling period he promised me i would be in the house christmas and i told him we cant do this together longer that that because i have another mortgage and i have to get my house ready to sell. he said i would be in the house last christmas. no he just walks in the house and said if you dont pay me for working 500 a week i would put a lien on your house or you can finish it yourself. so my husband and i just decided to finish it ourselves. he is an alchoholic gets drunk every night. the bad news is that i have been staying with him and my mom until the remodeling is done. he got mad at me last week and locked me and my son out of the house after i went to the grocery store and couldnt get my other child out of the house. my daughter let me in . he changed the locks and my key wouldnt work. he is very jealous because he knows i have about 100,000 equity in my other house and i was asking him to do this one little job that i could find anyone else to do and he thought i was talking about the house i have all the equity in and said he is absolutely not going to do any work on that house and me turn around and sell out and make money on. i had to sell all my stocks have been through my savings just to not lose anything. the whole house was ripped out and i couldnt get my other house sold that had the equity in until i got the house ready to store my stuff in because i couldnt afford storage and had nowhere to put my stuff. he shows no concience. how could you lock your grandchild out of the house? i told him that i am going to lose my house and have to file bankruptcy because he bailed on me and ripped my house out and he could care less. he never showed love to me growing up and doesnt now either. its very eery. i tell my kids i love them all the time. it seems he wants to win. my husbands family has really been helping us with out house trying to get it sold and he gets really pissy not happy for us that they are helping. i asked him if he could just please bring his triler over to the house after work instead of the morning so i could move some furniture and there will be 5 other people here also. he said oh so you are trying to con me into moving furnture. i litterly have to have another person around me when he does stuff for me because he puts on this great show and does this spectacular job when a stranger is around. if it is just me and him he will be throwing my furniture around. i feel like he wants to win . he wants me to fail. this is about him not helping and then us failing and losing one of the houses. he told me when he said he is not working any more on my house that HE has the power to get me and the kids in out house . I have wondered what i did i was a model child growing up and never asked him for anything before this house thing which was a huge mistake. and then i started reading about being a sociopath and he fits the criteria but i am not a psychologist

I have a ton of credit card debt due to divorce, unemployed;credit in toilet; need to file bankruptcy but…I dont even have the money to do that; I have a 2004 cherokee and dont owe anything on it and would take a loan on it to pay bills and get the money to file bankruptcy but dont know if I am allowed to do that; i am unemployed right now; last year i made nothing basically; have no idea how i have even made it; stopped using credit cards nine months ago; what can i do; the grand cherokee is worth like 7 to 8k it only has 55k miles on it; i just dont know what to do; i want to just get my bankrputcy out of the way; a year ago my life was perfect now its in the toilet; barely even getting by; on food stamps; severely depressed; my precription is like 200 dollars a month and now i cant even pay that; i am 36 and make no money and have not for a long time; have no idea if there is anything out there that will help me; i put in applications and resumes in all day long; its so frustrating; now without my script i will be even more depressed and things will only get worse; i wish there was some short term presription help; my doctor charges 50 dollars a visit and i am down one payment with him; if anyone knows about bankrputy or what i can do; i dont want to get one of those 1 month loans and pay 300 screw that; i cant lose my car; plus i dont even know if you can do that when you are about to file bankrputcy i just dont know what to do anymore anyone with advice and not some stupid spam also i have a mortgage on a small condo and am not behind yet because i have a roommate; last year my brother killed himself; my best friend died a month after that and my wife cheated on me and got pregnant and i got divorced; its like can anything good happen; i have never collected any unemployment because i started my own business so i was self employed; i just dont know
i looked into gettng low income but unless your house is in foreclosure or your car is in foreclosure than they wont help you no matter how low your income is; your house or car has to be in foreclosure or about to get your car reposessed for legal aid to do it and i would have no idea on how to file bankrpuctcy; i have no idea

My ex and I bought the house 3 years ago, and have been equally paying it off, after he cheated last december and we split.
I tried to get the house, but the bank said I couldnt do it alone (even tho, I can make the payments) If he goes bankrupt, does the house get automatically transferred to my name, or do I lose the house? or do I get the opportunity to get the house? I am freaking out, coz I dont want to lose my house.
I am renting it out at the moment for half the cost of the mortgage.
Any serious help and advice is sooo appreciated.

I am 25, married, and own a small home. Due to very slow payment (I pay mortgage with student loan monies when they arrive), my house is going into foreclosure. I also have a lot of debt from medical expenses, and hubby has major debt (car, credit cards) from his teen years.
I have enough money to reinstate my mortgage without filing some type of bankruptcy. However, that would leave me with no lump sum of safety money. I do work, so I could feed myself – but I never seem to have enough income to pay for regular expenses AND my mortgage. So, if I don’t file bankruptcy and I catch up/reinstate my mortgage…I know I’m going to fall right back into the "non-payment" category again.
Is catching up my mortgage better than filing bankruptcy? What about the other debts that I have? How is credit affected?
(I’m going to grad school, so I have many years of being a poor college student left. I just need to know what I should do about my house and other bills in collections)
Husband is college student too. Together our income is still VERY tight on making all payments on time.
Yes we have cell phone – but no cable/internet/home phones. I don’t know what else to cut.

I’m in California, I bought the house in July 2005, REFINANCED in July 2006 then stop paying in February 2007 because my mom passed away and I couldn’t afford the payment, insurance and taxes all by myself. My house is now foreclosed. The bank took possession on October 2006. Countrywide continues to send me statement on the HELOC. Does this means that I still have to pay for the HELOC?? I didn’t even take any money from it. It was used to pay for the rest of my original loan when I refinanced. Can I file bankruptcy particulary chapter 7 for the HELOC??
NO! My mother is not on the mortgage. She helped me with it because I bought it for her… she couldn’t qualify.

If so would this protect you from being held in contempt? I filed bankruptcy because I lost my job when my ex wife cheated with my boss. She keeps saying she is going to hold me in contempt for not paying our mortgage that I could not afford since I lost my job.
