I hired a bankruptcy attorney in Aug of 2010. But before accepting their service I had asked them specifically that I had money combined with my mom and would that be a problem. The person who interviewd me told "Oh no problem, we just send an amendment document to declare that this account belongs to your mother and not you." Time paaast. And I finally had an appointment with the attorney in Feb 2011 that it was best to dismiss the case so I could have time to fix my mom’s account and refile or do the ammendment and he would charge me 250/hour( even though the contract said 215). So I agreed to dismiss it for him to refile. I was dismissed in early March. I fixed my mom’s account immediatley and within 2 weeks advised to refile. Upto this date, I have been given the runaround stating "well we’re in the process of tranfering your file". Everything was sent electronically. I have given them everything they have requested from me on time. My life is at a stand still. Can’t do anything financially until I resolve this situation. Can I fire this deadbeat and get my money attorney fees back? If so HOW?

I have been married almost 3 years. I have 2 children under 2 yrs old. My husband has a pill problem and is a thief. He has stolen my money so many times I have had to file bankruptcy. I can’t have credit cards, a checking account, or anything. My husband always begs me to come back and I do because I love him. Earlier this year, he stole the last 0 I had and bought pills and wrecked my car. We couldn’t even pay the utilities on our house. (well, I couldn’t pay them, my husband doesn’t have a job.) So he moved in with his dad and I moved in with mine. Recently after we moved in with our dads, I found out I was pregnant. My husband got kicked out of his dads house for stealing and being on pills. He had nowhere to go so I let him stay with me to help me with our newborn daughter. Last week he was on pills again and stole some money from my dad and me so my dad kicked him out. Every time this happens he says he is done with the pills and it won’t happen again. I always take him back and this time I said he cannot stay with my dad and I. We have a house that I am still making payments on but since he doesn’t have a job I can’t pay for the house, utilities, and groceries by myself. Thats why I’m living with my dad so my kids will have water and heat. He is now telling me that he is completely done with pills. His mom is going to put him in therapy and he is going to apply for jobs and possibly go to the army. I do love him and that would be fine but I’m afraid I can’t trust him. My parents are begging me to get a divorce. But even if I do I know I will still see him alot because of the kids and that will be hard for me. When we got married I knew he already had 1 kid which was fine but since we got married he found out he has another and next month he is getting a DNA test for another, which that is really hard for me to deal with. I know he didn’t cheat on me. But if he does get a job, all his money will go to child support for these other kids? He has been put in jail more than once for back child support and is also being questioned for some residential break ins. I am afraid if I leave him I won’t find anyone else and if I did find someone else my husband would make it hell for me. I’m sure it sounds like a no brainer I wish I could turn off my feelings but I really do love this guy too much. I just wanted an outside opinion from someone that doesn’t know us. Thanks in advance
I do not have a drug problem, and when he is on drugs I do keep the kids away from him.

I was hit by a pick-up truck 2 years ago when I was 15,the insurance is ready to settle but the amount isn’t enough to cover the first days medical bill and the attorney says I can sue the person himself but he will probably just file bankruptcy. If I sue him and he does file will I still get my money and how much could I get because I am still having problems from it that the doctors say I will always have
It was his fault,it even states it in the police report. I was crossing the street and he ran the red light. He admitted it was his fault but is now saying it is my fault because I was to short to see over the top of his hood.

i watch this show and my husband says he heard on the radio the other day that rev. run is just about broke because he gives so much of his money to bishop jordan and the church that he runs. i can believe that he does indeed do that but not to the point of going broke so he wanted to find out if it was indeed true. i have not seen anything online about this at all and told him i would not believe it!

We (me, my husband and 2 children) moved in with my father-in-law after his wife passed Christmas of 2010. We moved in to help with the house and bills and manage his money (he had to file bankruptcy 9/2010). He’s horrible with money, if it’s in the bank he spends it. Him and his wife had incurred 10’s of thousands of dollars worth of debt. We were not able to strip off a 30K home equity loan attached to the house. We are currently paying more than a double payment toward the loan so it’s approximate payoff is 6 years or less. (This will NOT change). He’s 72 and in good health. The value on the home is about 120,000. The home equity loan is for just under 29K. And he owes about 92K on the home. We are to inherit the house someday. My question is this, should we put my husbands name on the home. If so, when? Should we "buy" it from him or should we leave him on it. PLEASE NOTE I WANT TO BE FAIR TO HIM AS WELL. Should we wait till we’ve paid the home equity loan down substantially or should we do it soon? I’m wondering because of the inheritance tax. He does have life insurance. Term life, we are to get 15K. I hope that’s enough info…Let me know if I’ve left something out.

My nephew has received a "bail out" from his parents TWO TIMES and he has not learned his lesson!
He applies for a lot of credit, goes on a spending spree, charges 2 or 3 cards to the near max leaving one open then he says that he will pay the cards back "when he gets a job over the summer."
The first time he accumulated ,000 of credit card debt, the second time ,000 of debt!
Now he got a new line of credit and has already accumulated ,500 dollars on it in less than 2 months!
I say that his parents SHOULD NOT pay the balance and let him file for BANKRUPTCY!
How else can he learn his lesson!?
HE IS OBVIOUSLY VERY DANGEROUS WITH CREDIT!
I guess his parents never taught him finance as a kid!
Let this be a lesson to parents everywhere who think that their kids are "too young for money."
He is 19 but I use "teenager" because he still acts like a teen with no sense of money!

How can you teach or punish a teenager infatuated with LIBERAL SPENDING that when you buy on credit its NOT your money?

My husband and I have decided to file bankruptcy. We are in the process of getting all of the account numbers from the creditors that we owe, however when we called one today they would not cooperate with my husband. They said they would only give the information to our attorney. N they also said that since we have no money to pay them they will persue legal action. We have been doing research regarding bankruptcy and read that once we file bankruptcy that none of the creditors will be able to contact us anymore and if legal action was taken towards us then it would have to stop? Is this correct? We told the lady that is fine we are filing bankruptcy but she said that will not protect us if they file legal action first. Should we have done soemthing differently? My husband started to call creditors and everytime we ask for an account number or address they always want to know why. He would tell them that we were filling bankruptcy. We are going to meet with an attorney today.

I’m in trouble what can I say and the only thing left is to file bankruptcy. I do own a home and I’m current with the payments.I do not want to lose my home. What I make right now is just enough to support myself and my kids. Few years ago my then husband took a second mortgage on another property that we own at that time. After separation we have lost that home and we agree for me to remain in this home now and pay for it which I do. The problem is that things changed. I lost my job , divorce etc and we stop paying that loan. Its about 27.000 dollars. After stop paying the loan was handed to a collection agency. I agree to pay them 100 a month. But is getting harder in harder to go by. Mortgage , food, gas , 2 kids ,etc I can’t make it. I really don’t have any other debt except a 1800 dollars credit card that is still current. I have a part time job now and I don’t know how to make it.The ex husband don’t help. My question is can i file to bankruptcy on my own? I don’t have money to pay a attorney. My credit is ruined already.I need to get out of this without loosing my home. When I did my taxes I paid off some other bills that I had. I don’t want to do this just to get away from my debt, but I don’t see any other option. I make 900 a month.
Thanks
i forgot to say that I live in Illinois

I mean its not like America can file bankruptcy. When the Military shuts down for a lack of a paycheck. Law enforcement stops for the same Reason. The money in your hand is no long accepted like the credit card in your wallet. What happens then to the sick the old the children.

I mean seriously our government doesn’t seem to understand that when you don’t have money to spend you don’t spend it therefore you won’t put yourself into any further debt how long will it take before hopefully it doesn’t happen but before our country goes broke?

I had a 3 year lease, my landlord lived out-of-state, he stopped paying the mortgage on the house I rented, used my rent money to pay on his home in TX and filed for bankruptcy when the IL house I was renting went into foreclosure.
I sent him notice that I was moving out in 45 days when I found out he was losing the house. I was current with rent, left the house immaculate (took pics, videos, and a statement from this real estate agent that I left the home in beautiful condition).
He agreed in writing to my move-out date, and also put in writing that HE broke our lease. I did not pay him the last month’s rent (00) because he owed me the 00 security deposit and another 5 in lawncare expenses and some smaller maintenance expenses (I have that in writing from him, too). As he had filed BK I did not feel he would pay me those monies which I why I did not pay the last month’s rent.
LOOOONG story short, he sued me for the last month’s rent, added on another 00 for the 5 days extra I took to finish moving out (he was not offering the home to rent to anyone else, no one was viewing the home – he lost no money as a result of those 5 days).
The day of court, I showed up with my attorney, all my paperwork, receipts, etc and my landlord did not show up but his attorney did. 11 months later I missed a follow-up court date as I was NEVER served or sent notice of the appearance and of course, a default judgment was made, plus fees for his attorney and court costs.
Sorry, long-winded – but here is my question: Can I sue the landlord for return of my security deposit, the lawncare service fees, etc – all the things I have in writing that he owes me? The attorney I had initially hired cost me 0 to show up in court the day my landlord did not. As he already filed for bankruptcy, if I won, he would have to pay me, correct? He is working – I know what company he is now at.
I am in IL and he is in TX which I understand has some kind of homestead rule where creditors cannot put liens on property or garnishee paychecks.
Thank you for advice!
Thank you both very much for replying.
The ex landlord filed his BK over a year ago, so I would think it would be completed by now. I figured anything he gets sued for after it is discharged, he would need to pay? I am certain the money he owed me was not included in his filing – I was never contacted by the court as a creditor.
I do not have funds right now to pay my attorney additional money (got laid off a few months back). So…no money for him – no help from him.
Regarding my getting served about the second court date – no I did not move. When I called the landlord’s attorney, he stated he sent me a notice via regular mail to my correct address. Did not get it. I am working on getting the judgment set aside, but as I found out about the default judgment more than 30 days after the fact, this is a bit difficult.
You are good folks for helping me out – thanks!

Can you please look it over and tell me if there is anything I need to correct or change? I am writing a persuasive essay on Social Security and why people should invest there money in other places. In this assignment we are
Write three paragraphs, which combined will be at least 500 words, explaining why you will or will not use definitions and compare and contrast paragraphs in your final paper.
I intend to use definitions in my final paper. I think that doing so will benefit my essay and its readers, allowing my readers to fully understand the papers true meaning with definitions. It helps the readers to understand what the essay is trying to say and what the main points are trying to convey.
I have chosen to write an essay explaining why Americans should not to rely solely on social security as they retirement benefits. If my essay turns out to be successful, it will convince the readers to start investing in their own personal savings. To do this I will need to state why social security and its funds are slowly dwindling away in my essay. A definition essay will also supply much needed detail on examples that readers may not understand right away about the topic. Detail in an essay should be very important to any writer. Writers make sure that every essay they write includes plenty of detail instead of gloss. Sharp details pull the reader in and encourage them to read more; fine details also help build a stronger case for the point of view so including them in my essay will make my readers share my feelings toward social security. I hope to include resources from the Internet to back up my points further and fully explore options on finding other ways to start saving personal funds for retirement.
Dealing with compare and contrast, I was not aware that I used them as often as I do. While reviewing my paper I did not think, I had compared and contrasted however; I soon found that I had at numerous times. When I was explaining why Social Security may not be around by the time many people retire, I made sure to include steps one can take to be proactive when finding alternative funding for retirement; in this instance, IRA, 401K, stock options, and employee pension plans. However, the disadvantages far outweigh these benefits. The whole point of comparing and contrasting is looking at both the good and bad and seeing which carries more weight.
In the rough draft essay, it states why it may seem like a smart decision for people to put their future retirement funds into an investment besides social security. By maintaining the idea that your there money will recover, economic scandals in recent years have shaken the very idea of a safe investment. In my rough draft, it points out that a large number of people in recent years have diversified their investments, to avoid a substantial loss in the event of a company who invests into experiences a loss, such as bankruptcy. By indicating what they could do and highlighting the consequences, the draft draws out the short- term good and the long- term contrasting them. I think simply writing out comparisons can help the person create the bulk of his/her essay very quickly. Pre writing helped me to create my essay; by pre-writing I mean taking a piece of paper and writing down the advantages and disadvantages of depending on social security and alternate retirement plans. This will also help them to decide for yourself whether you can meet your needs rely remotely on social security when you retire or if you want to be proactive in finding funding options. In my case I am neither too young nor too old to consider looking into options for my retirement. One should much rather start investing money better to protect themselves in the future.

I am trying to figure out which route to go. I owe over 30 Thousand in debt and at the moment I don’t own any property besides a car I bought for ,000 a year ago (1997 Chevy) I don’t have a job currently due to be laid off and on unemployment. I due have income tax which is about 2000 (The lawyer I talked to is charging 1000 + 300 in court fees) so that would be all my money… How hard is it going the paralegal way? Is it a for sure thing my bankruptcy will go through? Is the lawyer a better choice? need help!?

My HOA’s Attorney raked up excessive unjustified fees on me for their own personal gain. I was late paying my HOA fees initially and willing paid the stated late fees along with my HOA dues. However, the Attorney collecting these fees does not accept credit card payments over the phone or online, etc. Therefore, I mailed the amount owed. To my surprise, I later received another letter indicating I owed another 0 for late fees. I ignored this notice b/c I thought that they probably didn’t input my payment in their system prior to the letter going out. So I received another letter stating I owed the 0 plus additional fees, and so on. Basically, each time I paid the stated late fees via mail, the Attorney claimed my payment didn’t arrive on time to their Office, and therefore I owed additional late fees.
In addition, all of my payments were applied towards Attorney late fees rather than my HOA dues. My dues were only 0 per year, but within that year I paid over 0 in additional fees that were never applied towards the full amount owed to my HOA. The Attorney continued to take their money off the top and say that I still owed a balance towards my HOA dues. As a result, I stopped paying b/c I felt I was being ripped off and the fees continued to increase. They ended up suing me for the amount they claimed I owed along with more Attorney fees and court cost.
Since I mistakenly missed the initial court date, when I showed up for the second court date where they filed a judgment against me, they won simply b/c I missed the initial court date. Now they are garnishing my bank account for the amount owed from the judgment.
Currently, I’m unemployed and my home is in foreclosure. I recently filed chapter 7 bankruptcy to stop the sale of my home so I can have time to secure a job and work out a modification on my home loan and get it out of foreclosure. I have not had the meeting of creditor’s as of yet. Can I discharge the past due HOA fees from the judgment/garnishment? I am willing to pay the past due HOA fees I accumulated after the garnishment since I intend on keeping my property. Also, I live in Georgia. Thanks for your answers.

Hi!
We filed bankruptcy last year. It was final in October and we’ve been doing great ever since-staying on budget and living within our means, cutting expenses-we even moved to a smaller place to save money.
We let a car go into the bankruptcy..but here’s the thing. They won’t come pick it up. They said it’s not worth it to them so when I asked if they would send me the title so we can get rid of it, they said no. So, we have an unused car (we let it go because it needs like 00 in repairs and among other debt we had, this vehicle and payments were burying us financially) that is just sitting here collecting dust.
We thought about selling our paid off car (my husbands work vehicle-old..probably get maybe 00 for it) and putting the money toward fixing up the Kia Sorento and re-registering and insuring it….but we’d much rather sell it if possible but without title I think we are stuck.
I talked to our attorney and she said that there are no laws after the bankruptcy that would force the lender to release the lien and title.
Is there nothing else we can do?
Angel
Just a note…we will never be able to pay off the lien…the loan still had a balance of a little over k…no way can we pay that off…..:(
I wonder if we can "rent" it to someone…like a family member that needs a car? But then if they got in an accident we’d be liable, huh? Just trying to think of ideas….
Sorry…more details!
We live in California (Sacramento County) if that helps. I like some of those ideas (mechanic’s lien and the storage idea).
