When I turned 18 I made the huge mistake of applying for every credit card anyone would ever give me. Now I am 22 and have a boat load of debt including judgements, collections, student loans, car loans, pay day loans, etc. Totalling 40,000.00 plus!!!! I want to know if bankruptcy would be good route for me as my credit is already poor. Can it make it any worse?

I borrowed 30.000 from a relative to buy a small house because we are losing our home in the bankruptcy. The mortgage had to be signed and recorded in 30 days. Because I can’t have more than 20.000 in equity n our home. My attorney had forgot to inform us of this and now the bankruptcy court has seized our new house. His excuse was he has too many clients and it was a simple mistake. We can now buy it back from the court for 30.000. We don’t have another 30.000 what can we do, is it our attorney’s fault. We hired him because we don’t know a lot about the bankruptcy rules.

I am looking to file Chapter 7. Talking with a few attorney’s I have gotten an average price of k. I would like an attorney and dont intend on filing on my own as I know it would be a mistake. Can anyone recommend a paralegal service in the valley that is a bit more reasonable cost wise.

When I called and asked what happened, They told me that all necessary docs were filed and they have copies of everything that was filed and the copies show the court stamp as being filed, even the doc that the court said was not filed.
Then I was told that it was a court error. She told me she spoke with the court supervisor and was told that even if it was a court error,if i want to refile, I have to pay the full filing fee again.
They want me to pay for refiling, I disagree it is not my fault that the court files are incomplete.
Can the court make me start all over even though we can show them a copy of the missing doc which bears the courts "FILED" stamp?
Since I paid the lawyer to do the filing isn’t it the lawyers responsibility to guarantee her services since I provided all the information necessary for the filing? Isn’t it her responsibility to pay the filing fee to start the process all over again? Or should the court have to accept a copy of the "FILED" missing doc to complete the file and reopen the case without charging the full refiling fee/

My lawyer has told me that I have to pay the filing fee again even though I am filing BK because I can’t pay my mortgage, I am in foreclosure, and I am currently not employed… I need what few $ I have.

My wife and I got married in 2005. She filed for bankruptcy back in 2001 when she was single. I filed for bankruptcy in 2003. My wife just got this huge bill from the state that we are not going to pay. The bill is for 000.
My wife was getting childcare assistance before we got married; we completed all the required paperwork and attended the meetings with the case worker. Well somehow the case worker was entering the information incorrectly into the computer. So in reaity we should have been denied but we wasn’t.
So because of the case worker’s mistake we have to repay the money back. Its a really messed up situation, especially when the case work said it was her fault. So thats why we want to file bankruptcy.
Do anyone know when we cn fill bankruptcy again since my wife filed in 2001 and I filed in 2003?

When i went to court for the hearing my lawyer relized he had made a mistake in the filing of my chapter 7 because i have not been off my previous chapter 7 but for 7 years and it hasa to be off for 8 years before you can file a chapter 7.What will happen now?

In March 2001 my husband and I filed ch.7 bankruptcy it was discharged in August 2001. Does any know when we can file a Chapter 7 again?
Why don’t you pay off your debts instead of taking the easy way out?
Filing bankruptcy will hurt your guys’ credit scores, it’s not a quick fix.

I’m really not trying to be rude but it just amazes me how people put themselves in these kinds of situations over and over again
My husband has a medical condition and I don’t make the money he does! He will have to have surgery this Feb. he may not be able to walk again. We have lost our house because my job is gone. His not working because at this time he can’t walk and is schedule to have surgery. We have no creidt cards. I was trying to pay all bills but couldn’t pay enough on medical bills so now I’m being granished and have been for a year now. I’m glad I’m able to pay off what I can but, 0.00 a week doesn’t pay the rent or buy food for 3 kids, Guess being homeless isn’t that great either.
And creditors don’t wont to work with any kind of payment. They would rather take us to court try to garnish us then take a payment. Even when we tell them we are all ready being garnished. So yes indeed to live again we will have to file bankruptcy! I need to feed me kids! I can’t get assistance because we made to much money and garnishments do not count! What would you do? Neurologist cost big money and if my husband can walk again than I’d rather make sure his health is better so he can enjoy his twins and his younger child.

it seems that all lawyers charge about the same (00) and i cant find any paralegals specialize in it? is there anywhere i can go where it will cost me less?
Bad Co……. i was thinking of that, but i was scared of making a mistake, thanks for the encouragement. did you do this before or after the law changes though?

My husband and I have filed for ch. 13 bankruptcy in Texas. The attorney that he selected tends to range from nice to rude, especially when we don’t understand an issue. He tends to be a bit pompous when he responds to us. He missed one major creditor that had to be added in as an amendment (property taxes) and failed to calculate the correct amount of monies paid to creditors in the past 90 days. He saw the property tax statement and gave it back to me, and we didn’t add it in the worksheet. I gave him a list of creditors and amounts that we had paid in that time frame, but he only filed our statement of income showing one payment per creditor. Our meeting of creditors is in 20 days. I have considered firing him and getting another attorney. Can I get a refund on his fees from him? Is it possible to have another attorney review our bankruptcy paperwork (second opinion) before being finalized to make sure everything is correct before we find another mistake or the court finds one? Tks.

My attorney filed a chapter 7 bankruptcy. He thought I could have .000 in equity. But, I can only have .000 in equity. He has admitted he made a mistake but it could cost me my home. What can I do? He is asking me to let him work it out but my friends say I need to hire a different attorney.
