Bankruptcy Chapter 7 for Medical Debt?

Hi, I’m in a bad situation. I’m uninsured, and I had a severe retinal detachment a week ago. I had to go to emergency room, and then treatment. The hospital is going to bill me with huge amound, probably around 30k they said. And doctors are not even sure if I’ll get my vision back, as I still can’t see after the treatment. I applied for country programs, but they are not covering them because I went into emergency room care before applying for those programs. I do not have a job, and my poor wife works to support me and makes only about 600 dollars a month after tax. I don’t know what to do. I’m a student who has no job, and my wife and I live in my parents house. Therefore, I’m interested in filing bankruptcy. I have no way of paying this amount, and I certainly do not want my poor wife’s paycheck going to the debt. What happens when I file for bankruptcy? Will it affect my wife’s credit? I had perfect credit with excellent history until this happened. If I file for bankruptcy, will I lose all my current in-good-standing credit card with my bank? I don’t owe anything nor do I have any outstanding debt except this medical bill. Is it possible to file for bankruptcy but keep my wife’s credit score out of it? What are the requirements to quality for chapter 7? I heard that medical debt is unsecured, so it can be discharged. I have no job, unable to find job in this economy, I was going to cheap community college when this whole thing happened. What should I do? I need help. Will they put me in jail for not paying this debt?? thank you, kind people. I’m totally screwed.

Unemployed housewife, bankruptcy & household income?

I have a considerable amount of credit card and medical debt. I’m currently unemployed and caring for our two small children while my husband works and pays the bills. I babysit for a little boy and make about 0 cash a week, but we’re falling severely behind on everything. I have been searching desperately but I cannot find a job that pays well enough after taking chilcare costs into consideration.

So after a lot of discussion, my husband and I have decided that I should declare bankruptcy. His name would not be on it, as the debt is in my name alone. I just assumed that his income would be a factor when I file because it is the only household income we have. He says that it will not even be considered since his name will not be on the filing, and that I will file claiming "zero" income. Who’s right?

Also, he says I should just say my income is the small amount I made babysitting, but I did not pay taxes on that. What about that? Will I be in trouble if I disclose this information?

Do I have the ability to bring legal action against my attorney?

Our (chapter 13 bankruptcy) attorney failed to subimit documents to the court. He directly lied to us and told us that he did. We’re in the last year of bankruptcy and in need of purchasing a car. He told us almost 3 weeks ago that he submitted the papers to the court and then admitted to my husband today that he didn’t. What recourse do we have? Thanks in advance…

And just for everyone’s edification… it was not because we had out of control debt. It was because we had a child that was born with extensive medical needs far and beyond our insurance and the fact that I needed to stop working for 3 years. It was all medical debt.

Should my brother file for bankruptcy?

I just want know of a good bankruptcy lawyer in NJ. My brother through out last year has been dawning in credit card/.medical debt. The medical debt is due to my nephew, who was born not so healthy and had to get many surgeries and so much attention from different doctors at Children s hospital of Philadelphia (CHOPS). As of right now he is not delinquent on any credit cards, but I fear that soon he will. I am just trying to fine options for my brother. What can be his best alternative.

Should I pay off my medical debt or file bankruptcy?

I do not have any credit cards but have about 12k worth of medical debt, most of which is in collections – I did not have insurance and was not eligible for assistance. Now a new friend has offered to help me either file bankruptcy or pay off my medical debt if I negotiate with them to lower it. What should I do? I thought if I filed bankruptcy I would be able to recover faster. Any suggestions would be helpful. Thanks.
