Here’s my situation. I graduated from college in December 05 and believe it or not, I have not found a full time, good paying job yet. Yeah, I believe I just wasted money and energy on nothing.
Anyways, I’m working a part time job and make approx 0 a month. I have ,000 in credit card debt, most of which I’m still paying from when I was in college 3 years ago (books, food, so on) I have ,000 in student loans, ,000 in medical bills, and it seems everytime i make a payment, it goes to waste because the interests keep rising. I even pay more than the minimum payment. If a credit card is lets say minimum, I will pay about 5, but it’s still not good enough cause the interests will raise that back.
I can’t keep going like this. My credit score is crappy so I can’t get a consolidation loan to pay all of it all.
Would I be able to file for bankruptcy? I have tried everything to get out of debts. I don’t charge anything to my credit cards any longer, but it is still that bad.
What should I do?

I have been sick over a year. I have been battling it out with social security and have not received any income since my illness. I do not own any property, not even a car. It got repossessed during my illness. I had to break my lease and stop paying my credit cards. My total debt is around 80K. My credit is devastated. I found out my former landlord intends on getting a judgement. I have no money, but am allowed to live for free right now because of my parents. I’m 26. I went to law school for 2 years before I got sick. I bought a NOLO book on bankruptcy, but it seems like the process is stressful and confusing. I don’t have the money to hire an attorney. Nobody else has tried to sue me yet. My family said they would pay up to 2K for a bankruptcy lawyer as like a birthday/christmas present, but I feel bad because they have already been paying for so much (my medical bills, me living in their house). Should I file this myself, wait, or get the attorney? There is no way I can pay all these people back at this point.
Oh I have a free consultation on Monday.

I just lost both of my cars that I was paying a total of 1/mo. on. My wife is going to be quitting her job because of childcare issues, tension levels in the family, and all the stress that’s been building up from playing "tagteam" with watching the kids over the past 2 months. I get at least 15 calls a day from credit card companies asking where their money is. I incorrectly filed my taxes in 2005 (filed a Schedule K-1 online with Liberty Tax, and apparently I was missing a Schedule E form), so now I have a tax debt of almost ,000. I will be making just enough money to pay my mortgage, utilities, food, and gas for commuting to and from work (70 miles a day). I am behind on every credit card I have, a Home Depot Consumer Loan, student loans, medical bills, everything. I also live in a suburb of Austin, TX in case anyone was wondering. I don’t know the bankruptcy laws well enough in Texas, and I need major help. Should we file for bakruptcy, and if should which kind of bankruptcy?
I believe most people are thinking that I’m a big spender, but I’m actually more of a tightwad. I don’t buy latte’s at all or have any weekly or daily habits with spending money on food, my wife cannot work due to the fact that everything she makes goes towards paying for childcare, and even still we’re short. I am a general manager of a restaurant, on salary, and I cannot get another job because I have to have open availability. I lived on credit cards and did things like paying my water and electric bills with them, not going out and buying a big screen tv or anything of that sort. Like I said,I am relatively frugal, it’s just childcare mostly that screwed me and now I’m up to my ears in debt because of the decision for my wife to stay at work.

Income is steady (same employer for 3 years) and sufficient to handle a reasonable mortgage…had insurance when the medical bills occured (serious health issue)…will a lender overlook or should I file bankruptcy and wait it out?

I have a private student loan that i defaulted on when I got sick and when I tried to make payments i was told it was charged off. That’s when MRS Associates contacted me DEMANDING payment in full (93,000.00) I told them I clearly couldnt afford that and they offered to settle for something like 50k. I only make 40k a year and clearly do not have the kind of money around. My grandparents are my cosigners and I’m so terrified they will sue them. I’ve begged and pleaded for a payment plan but they refuse. My grandparents have their house in my mother’s name and they don’t own anything other than a car, but I fear for their savings and the whatnot if this does go to court. I’m trying to obviously avoid court at all costs. I know I cannot file bankruptcy, i know i should have paid the loans, i know all of the things that many people post on other questions–like i said i was hospitalized for a few months and never got a handle on my bills after that. If anyone has some advice as to what I should/could do to prevent my grandparents getting sued I’d be so grateful. Thank you and I appreciate your help.
Hey Lari, you get cancer and tell me how you deal with it. How about that? I’m sorry I don’t make 100k that affords my medical bills in addition to my student loans. I pity whoever has the dire unfortune to associate with you.

I filed in April of 2006. I viewed my credit report a couple of years ago, and I remember saying something about it going off of my credit in 2016. Is this when I can file again? 10 years? Or is it 7?
My intention was to never have to file again, but I got sick and have tons of medical bills from the last 3 years.
I take that back. (my memory if awful). I filed in April of 2004 NOT 2006.
This also means my Credit Report said the bankruptcy would come off 10 years from when I filed (so that means 2014 not 2016).

I don’t know the difference between any. What I do know is that my credit is jacked up, mainly with medical bills, and a repo from 2000 (that I thought should have been removed by now). I can’t even get a department store credit card, have NEVER HAD any credit cards or loans, so I don’t understand why I’m always denied when I know folks with much worst stuff, yet they get approved for everything. HELP!
…will my husband be affected if I file? His credit is pretty ok

My live-in-fiance has HORRIBLE credit, & as of right now we are renting & financing 2 cars. Everthing including credit cards & cell phone contracts are under my name, eventually we want to buy a house, but either way we need to fix his credit. Alot of the debt is unpaid hospital bills (was unemplyed for 8 mnths & in those months he got very ill & no ins.) and some of the debt are from when he was younger & abused credit cards.
He owes a bank 0 & now cant even get a back account under his name.
I would say 1/2 of his debt is from 8yrs ago & the other 1/2 (hospital bills) are current.
My question is should he try to consolidate the debt or just file for bankruptcy. His medical bills are about ,000 alone. Misc debt is about ,000.

Like most Americans, I’m in debt. I’m a student with a part-time job and I’ve sunk into some pretty nasty debts. I have medical bills to take care of, as well as other other stuff. I’ve read a bit about debt consolidation and lots of sources say it’s pretty much a scam (you’re not eliminating the debt, you’re just moving it). I don’t think bankruptcy is a good idea.
What can a college student (undergrad) do to eliminate 00+ debt? Are there loan programs that just give you money and a few years before you have to start repaying it? Are there other alternatives?
I’ve decreased personal expenses to pretty much nonexistant. I don’t really buy clothes and food and such and all of my expenses are either medical bills, textbooks, or a monthly laptop payment.

I am being sued for 16000 by an insurance company and my layer says the best thing to do it to file bankruptcy. What will happen to my truck that I bought last year and still owe money on?
I am currently a single mom, going to school full time with one major and two minors. I work at school(workstudy) and have a very very part time weekend job that only pays 7 bucks an hour. I don’t have family to ask for help and don’t qualify for any legal aid. I also don’t think I am resposnible for the medical bills I am being sued for because when I was in the accident, I was bringing my company’s daily deposit to the bank and was still on the clock. My employer refused to pay so now they are coming after me.

Ten years ago I had to file bankruptcy because I was very ill and my medical bills went through the roof. The bankruptcy will be taken off my credit records at the end of this year. One of my creditors was a credit union and I did not want to include them in the bankruptcy but the lawyer said it was mandatory. I would like to contact the credit union and make arrangements to pay the debt I owe them so I can be a member again and because I still feel really awful that they had to be included in the bankruptcy. However, I’ve heard it’s a bad idea to pay off debt involved in a bankruptcy. Is this true? If it’s not true – when should I contact them? Before December or after December? Many thanks for the information!!

I was rear ended by another driver and my case has not been settled even though about 18 months have gone by. The other driver admitted fault, I had physical therapy and back injections and still have pain plus trouble with regular bowel movements (I suffered two badly herniated discs, an annular fissure, and sprained neck). My lawyer had me come in to his office, he said to make a statement, but when I got there, he told me my case was being investigated for fraud. Since then, the other driver’s insurance company has only offered me 10k to settle the case and my medical bills are over 120k. First, how did my lawyer mess up what should have been an easily winnable case? Second, I’ve had to sign away 40% of my settlement to the lawyer that messed up my case, plus 50% of my settlement to the new lawyer I hired, so I don’t know if I will have enough to pay my medical bills, should I prepare to file bankruptcy?

My best friend is going through a hard time right now emotionally, and physically. She has acquired alot of medical bills greater than 7,000 dollars worth. They are now taking over 0 every other week out of her paycheck, which she can not afford. I have mentioned to her to file bankruptcy, she is also wanting to buy a house with a co-signer, what will this do, and how again, do I find out for her upon her request to help her do i find out when was her last bankruptcy?

I have a k car note debt on its way to an attorney for a court hearing in the near future. I haven’t been subpoenaed yet. I have k in medical bills getting the run around from my health insurance and another -k that hasn’t even been filed yet by the doctor but may also be denied.
I can’t afford to have a court garnish my wages a single cent for the car note but can’t file for bankruptcy protection just yet because I’m waiting on the insurance company to either pay or deny. Until then, I won’t get a bill to put on my bankruptcy forms. Also, the other doctors haven’t filed their claims yet. They have up to six months to file a claim and it’s only been 30 days since my surgery.
Bottom line: it would be a waste to file bankruptcy right now over 11k when I have almost 100k coming up in the next few months. What can I do? After I get the subpoena I plan to just file on whatever I have and then hope for the best with the rest. Is that even possible? Are you allowed to file on something that is currently going through litigation?

My husband has been in the hospital 5 times since February. We do not have medical Insurance because of many reasons. When he was in the hospital the only way the family could survive without his income was to put everything from groceries to CIPS on the credit cards because we had no income coming in. Now that he is back to good health and we are both working we still don’t make enough to pay off all these bills. We tried filing for state aid to help with the medical but we were denied. The medical bills alone are over 40 thousand and the credit cards are probably around another 10 thousand. What should we do? If we file will we loose our house and car too? I would like to just erase the medical and credit card debt but keep some other small loans that we have. Is this possible?
and if we do file, what will that do to our credit? Will be not be able to get a loan for a long time?
