Lawyers, as far I know, cost hundreds if not thousands of dollars… So… if I want to try to file bankruptcy with my wife how are we supposed to hire and/or afford a lawyer to help us?

Husbands family went bankrupt. We have 80K debt which we ARE able to pay off. Husband is very influenced by sister to file for bankruptcy. He even quit his job and said he no longer wants to work because now there is no need to!I have told his sister numerous times to stay out of our families life but she continues to call him 10 times a day and tell him to file, file, file. I don’t have a lawyer and do not know how things work, but I would really like to legally have a way to tell her to get lost and stop advising and brainwashing him! Just because she has ruined her family does NOT mean she can butt into my family and ruin mine. What can I do legally with a lawyers help? Don’t want to sound stupid when I call up a lawyer, so want to see if any of you know before-hand what I can do. My husband had a really good paying job and so do I and we managed to pay off 90K in five years. If we borrowed the money, I feel like we should pay back if we are physically and mentally able to work and pay off debt. the 23rd their putting my house on the court steps all because Bank of Un-American tricked me when they said they were modifying my home and I have a disabled son that has been abused in 8 different nursing homes, the state has done nothing to help and now me and my disabled son will have to probably file bankruptcy, my son was hit by a vehicle while changing a tire on the freeway here in kansas city mo, he was hit so hard it knocked his leg completely behind him and split his head open in several places, in the nursing holes, he got bed sores many times 150pneumonia’s, broke his arm ,cut the nerves in his arms now he cant lift them ever again, 2 cases ecol bacteria, laid with scabies for almost 2 years, stuck catheterr so far up my son that it toreurethraa in 4 places, yet Governor Jay Nixon has ignored my pleas, my son has had no doctor in over 21/2 yrs because no one will come to the house, Jim Jr averaged once a month while in the nursing holes, in the hospital for urinary tract infections,pneumonia’ss, had to cut off half his heal from letting him lay without rotating him. so I had enough I bring him home, and the state threatens me and says if he dies in my care they will sue me, but it’s okay for the state to allow abuse in the nursing holes and cover it all up like it never happened, the governor has it down pat, your loved ones life is only worth 250,000.00 even if they abuse mame kill your loved one the max is 0,000.00. lawyers won’t take the case because the no money by the time you dodepositionss, with doctors at 90.00 an hour and witness, then split whats left with client, it’s not worth it. So my son gets abused in more ways then any one person should ever have to go through, so I bring him home only to find the state offers my son no help so I can work this stat has caused me to go over 200,000.00 in debt in just the 2 1/2 years since bring Jim home, Doesn’t anybody care is this what this country has stooped to? I’ve also sacrificed the last 11 yrs of my life to take care of my son with absolutely no help from the state, no nurses, no doctors, doctors that write prescriptions like potassium, and flourisimide, acetylisistine, and more without ever seeing the patient, this state allows it. What would you do if this happened to you 17 year old son or daughter, open can at the site yet the police don’t even check the ford motor companyemployeee for alcohol in is system nor did they even write him a ticket for hitting my son while he was changing his tire, you tell me what do you think of a Governor who ignores your pleas, or a police dept that doesn’t even do it’s job or all the multiple nursing holes the abuse and kill your loved ones regularly, maybe you just put your old father or mother in those places so you don’t have to bother with it, let it be on yourconsciouss, I’m putting a video about real encounters of what else this cover up state has done if anybody has any backbone or are just curious, respond, to the rest who don’t care, it will effect you or a loved one someday, there’s practically no way around it,
Should I include my two cars in my chapter 13 ? will they take my cars and what happens when you are discharged from bankruptcy do I have to return the cars if they are not caught up?
so if the payments are up to date how can they take the cars or are you referring to the lawyers seizing them? how am i protected?
I got a personal loan for the down payment on my house then once my job of two years ended the loan went to the lawyers office. I made arrangements with the office because I was getting unemployement at the time. When that ended I couldnt make payments anymore so I finally found a job and I had to play catch up with all my bills so now I recieved the judgement papers and I called the lawyers office and they wont give me any information on how much will they take out of my check once they find out where I work. I live in louisiana what can I do right now about the issue? Should I contact a lawyer to see if they can help me or start sending in payments because the office told me dont send any payments in or should I file bankruptcy ? What should I do please help me
I hired a lawyer to file bankruptcy for my wife and I. She messed up a couple times and my wife was taken off and then she wasn’t licensed in our area and then she told me she was going to have to let it cancel and refile in order to get my wife back on it. I asked her if we had time to see about selling our home to pay off all our debts before she refiled and she said yes we had 30 day. I asked her to refile when she had to so we would not loose our home. My father in law passed away and we had to go from Florida to NH and put my mother in law in a nursing home and close and empty their house. When we got back it was about 6:00 pm. We found out our house was being auctioned off the next morning and the courts and our lawyers office was closed. So I went the next morning to the court and filed a motion asking the court to delay the sale because our lawyer was suppose have filed our bankruptcy and hadn’t and that we just returned the night before. The judge denied our motion and our home was sold and we had 24hrs to move out. When I got a hold of the lawyer she said she didn’t refile because we had to pay her to. Were we paid her and she messed up can we sue her and if so how long do we have to find a lawyer that will sue another lawyer?
We were gone almost a month and I thought they had to serve us papers in person!
I have a friend that wants to file bankruptcy and she wants to know if one can file bankruptcy on their own. We live in Wisconsin and many of the lawyers charge a lot of money plus she would have to pay the filing fee to claim bankruptcy. Does anyone know if this is something she can do on her own? I feel bad for her, she has never had money problems but when then she had some family members fall into some bad times and she thought she could be superwoman and help them all out meanwhile she left herself short and she is in a really bad situation right now. Any suggestions that I can tell her. Thanks!
I am currently being sued in civil court, and have no money for an attorney, the case has gone on for a year now in federal court, and have basically lost my business because of all the time I’ve put into defending myself from something I did not do, and am being "lawyered" to death by 6 lawyers. Because of all this, even if I "would easily win" if I could afford an attorney, I will have to file bankruptcy (chapter 7 for me).
Therefore, relating to an ONGOING CIVIL case and a need to file BANKRUPTCY, here’s my QUESTIONS if you would please use the same numbering system to answer them so I can keep track (thanks thanks thanks):
I would LOVE it if filing the bankruptcy would END the case so I could go on with my life, find another job, build another company etc. I read a lot of yahoo answers and one said “If they haven’t gotten judgment against you … then your bankruptcy filing can and will stop the case.”, but I need to be sure.
1) is there any ADVANTAGE to me in filing bankruptcy BEFORE the judgment (now is preferred so that I can go on with my life which has been destroyed)?…. and what will opposition do if they know I’ve filed for bankruptcy? Will they attempt to continue the case when they know the bankruptcy will go thru? If so, why would they continue the case?
2) Since I’m going to be filing In advance" of the judgement, can I "claim" the "injuries" they haven’t yet enumerated " …on my petition for bankruptcy? …or do I just “list the case” and say “amount pending”? THANKS.
I know about the "automatic stay" (keeps creditors (I currently have NONE and a perfect credit score I’ve worked hard to build all my life) from coming after you etc).
3) After I file for bankruptcy (I know it takes so many months to go thru), these additional related questions, thanks:
3a) what happens to the current civil case?
3b) what do i tell the judge? Do i have to tell the judge or just inform the other side?
3c) will i still have to finish the case (expected one more year of my life)?
3d) if we’re currently in discovery, will it / can it stop discovery / subpoenas etc?
3e) ….or…does it just “suspend” the case until the b/k procedings are over? …or does the case just continue on in real-time?

Do all lawyers charge about the same, and do you have to have the money upfront?
When I called and asked what happened, They told me that all necessary docs were filed and they have copies of everything that was filed and the copies show the court stamp as being filed, even the doc that the court said was not filed.
Then I was told that it was a court error. She told me she spoke with the court supervisor and was told that even if it was a court error,if i want to refile, I have to pay the full filing fee again.
They want me to pay for refiling, I disagree it is not my fault that the court files are incomplete.
Can the court make me start all over even though we can show them a copy of the missing doc which bears the courts "FILED" stamp?
Since I paid the lawyer to do the filing isn’t it the lawyers responsibility to guarantee her services since I provided all the information necessary for the filing? Isn’t it her responsibility to pay the filing fee to start the process all over again? Or should the court have to accept a copy of the "FILED" missing doc to complete the file and reopen the case without charging the full refiling fee/

My lawyer has told me that I have to pay the filing fee again even though I am filing BK because I can’t pay my mortgage, I am in foreclosure, and I am currently not employed… I need what few $ I have.
Apparently no lawyers can help while you have a lawyer retained. But my lawyer has created such a mess that I came home to a stricken order today trying to get my car. My law firm won’t ever return calls or emails and I can’t go see them. How do you find a lawyer to sue a lawyer? Help!
….after you get sued for building a faulty house for someone. The judge is in favour of the plaintiff, whose house you built. He rules that you must pay them ,000 to compensate for the cracks in the ceilings & walls and various other mishaps. You then, like a b*tch, file for bankruptcy. Don’t know how to phrase this, but: your claim for bankruptcy is accepted.
Replace the you with defendant. What prompts me to ask this is that the defendant walked out of court saying "You’re not getting one cent" to the plaintiff. Which, for comedic effect, i will add that he got punched in the face :L
Questions:
1) How does the plaintiff get his compensation, in civil law or whatever area of law? Are there alternative ways to gain compensation for this issue other than suing? Obviously the suing did not work out? Like for e.g. in criminal cases you can go to the Victims Compensation Tribunal if suing civilly does not work in your interests.
2) Does the defendant (in bankruptcy) have to sell all his assets and every cent of his future income goes to paying the defendant the compensation? Its only fair..
3) Does he get off scott free?

I filed for bankruptcy earlier this year, 2 months after the bankruptcy was discharged, I received a call from a repo company saying my car was being repossessed because the reaffirmation agreement wasn’t filed. Come to find out my lawyers office misplaced the paperwork. The bankruptcy was petitioned to be opened again so the paperwork can be filed correctly. My lawyer is now charging me 0.00 for reopening the case. Are they legally allowed to do this?
to file bankruptcy is kinda expensive. Would the lawyers break the price so I could pay monthly? Or how does it work?
I am looking for someone to file my chapter 7, but I don’t have enough money to pay it all up front, are there any lawyers who will let you do it with a payment plan? (and no i don’t mean chapter 13 payment plans i mean the actual fee to file chapter 7)
My checking account was garnished and my dad paid the balance to get the account reactivated. The bank is holding onto the money till the 15th of Jan when it is due to be released. If I actually file for bankruptcy before the money is due to be released is there a chance I can get it back since it hasn’t been turned over to them. I live in Missouri if that helps any lawyers.

Between all the little fees and paper charges, and lawyers fee and so on it is almost 1000.00. Dont you declare bankruptcy because you are broke ?
