My husband and I filed for chapter 7 bankruptcy 6 weeks ago due to a wage garnishment and other reasons. Our lawyer told us because of the timing and amount garnished we would get all of the garnished money back. The automatic stay has been in place for 4-5 weeks. My question is when or how long does it take before you receive that money back?
On 4/25 I hired a lawyer (and paid agreed upon amount) to file bankruptcy for me. He stated that he would be able to file within a day of completing paperwork. On 5/12 all paperwork completed and necessary classes taken, the next week he would not answer or return my calls. Secretary stated he filled banktuptcy over weekend. Finally spoke to him and he said it was filled but his computer down so cant give me case number. I searched the bankrupcty (pacer) website, it has not been filed. He won’t answer or return my calls that I have made. And his secretary told me she can’t help she doens’t know whats going on and that I am in the same boat as three other clients. He won’t answer phone or return my calls.What should and can I do? I need to file bankruptcy ASAP. thanks for any imput
my sister in law aubmitted all paperwork paid in full in august, now has still not heard anything from lawyer and he wont take her calls or see her. what can we do creditors keep hounding her.
My b/f is currenty filing for bankruptcy. We got credit cards when we bought our house and we just got way out of hand with them and are now in alot of financial trouble. There are about five cards out of the many that I am a "joint" user on with him. We didnt know the difference between joint and authorized user when we were signing up for the cards or we would have never put me on as a joint with him. Im afraid that the creditors are going to come after me once the case has went completely through, because according to what I have read online they are allowed to. Is there anyone out there in this same situation or anyone that has went through it?? His lawyer told me that they dont always choose to go after the joint user but if the debt is over a thousand dollars they may. Is it true that they can not go after me if I am unemployed?? We had thought about filing together in the beginning but we are not married so we were not allowed to do that and would have to pay for two seperate filings when most of the debt is only in his name and about 6500.00 of it is in mine….

We are going to file for Chapter 7 this December. I was curious how many months they usually want to see. Most places I read it is 3 months. I am hoping it is 3 months because we were not expecting to file until now and our statements might look bad any further that 6 months back.
The reason we have to wait till December is that my husband had a previous bankruptcy before I met him. The lawyer told us to wait. We are not paying our credit cards because we can’t afford it.
I have contacted one recently but I only found 3 reviews. I was advised that I can pay 200.00 down to retain them and pay 380.00 per month for 4 months. Once this was paid the papers would be filed for the bankruptcy. I was also advised that once the 200.00 was paid to stop paying my bills and refer the creditor to my lawyer. In theory with my financial state this would be a great thing. In the 3 reviews I have found they have all stated that they had paid in full and a year later they were still waiting for the papers to be signed. The one lady was being sued by one of her creditors for failure to pay. Can anyone help shed some lite on this? I obviously have made enough bad financial mistakes I don’t want to make another one.

So I stepped on my pride and did what I didn’t want to do ..I filed for bankruptcy, Chapter 7, in January 2009. It was cleared and everything was discharged in May 2009. I am now interested in joining the United States Coast Guard Active Duty in 2011 sometime. I am curious if this is going to impact my enlistment. I have read numerous online entries, they all clash though. I saw a video on YouTube by a lawyer that states Active Duty military can file for bankruptcy and it won’t jeopardize their job. If that is so, how is it any different with someone who has a cleared bankruptcy that wants to enlist?
I understand this will interfere with security clearances. I am willing to deal with that to serve in the Coast Guard. Any recruiters, any advice? Please no trolls that are here to advertise or scorn me for having a bankruptcy.
I have about 25k in credit card debt. Use to be about 9500 but after 10 years they are all judgments and with all the interest and fees its about 25k now. About a year and a half ago i had a really nice job was making decent money. I saved about 9000$ so i can try to pay my debt off. Originally on average i owed about 2500 to each of the credit cards i had. I got all my info together and called each of them to try to set up a plan so i could pay them off. Right now discover says i owe about 7k originally 3k, and city says i owe 6.5k originally 2.4k, washington is now about 4.5k originally 1.8k those 3 are my highest and all three wouldn’t agree for nothing lower then what they say i owe. all others agreed to a very nice settlement. I offered discover 4.5k , city 4k, and Washington about 2.5k to settle. Washington accepted 3k. but city and discover gave me a no and said that if i didn’t have the full amount they would just garnish my checks till its paid in full. At the time i was off work because my back started to give in. I had the doctor take some x rays and she told me that i had to take physical therapy for my back and should stay away from heavy lifting. Which means i cant do my job no more. So now i am unemployed and well luckily i still had that 9k i saved. Well now i am just fed up with them. I already ran out of money and my brothers and sisters are supporting me and i want to just file for bankruptcy and go to school and get my self a degree in business. Does anyone have any advise you can give me. Thanks in advance.
I also forgot to put this in. My brother was going to help me before when i was working he was willing to put in about 3k on top of my 9k so i could get out of debt. But now hes also low on funds and well i just decided to file for bankruptcy and hes willing to help me pay a lawyer for the process.
Also I am not really worried about the credit score part, i have 6 sisters and 3 brothers and well i learned my lesson and i made sure they learned from my mistakes and they are really thankful for my advise about credit cards lol and bank loans. They all have almost perfect credit scores and i had a big hand in getting them there. My sister offered me a position in a business she is opening and all i have to do is go to school for the position. She was actually the one that tried to negotiate with the credit card company’s on my behalf and she just told me to file since they wont accept a settlement.
I just want to see how many options are available for a situation like this. So i am open for any suggestions, advise, ect… from respectful people who can understand the situation. If you want to criticize, go right ahead too lol I want to here all your opinions.

hehe ya i already knew about that but i am safe from that too because my sister owns about 3 businesses and she is willing to offer me a marketing position. I am really good at it too i have been helping her with allot so i just want to get a degree in that field and go work for her.
I have given the guy my credit report and other paperwork to get the bankruptcy filing started. I gave him a deposit and will give him the rest when my student loan is deposited this week. He responded to my emails just fine until I sent him two regarding a judgment that had just been entered against me last week. He hasn’t responded to either one. I am concerned because I hear that my bank account can be frozen and I don’t want the creditor to get to my student loan money. Why do you think the lawyer will not respond to questions regarding this?
I don’t want the student loan discharged, the loan funds get deposited in my bank account and I don’t want the creditor in the judgment to get a hold of these funds because I use them for living expenses.

Try and settle with all those creditors? If so, how? I mean ive heard that you have to ask them for a letter stating that if you pay the settlement they will remove the judgment and remove all that info from your credit report.
The hospital bill alone is 20K, the other 8 are about 20K all together.
I cant afford to pay all of it, but i can afford settlements with them.
I would appreciate some info from someone with experience or knowledge…..

My husband and I filed bankruptcy in 2005. We live in Ohio. According to our lawyer Ohio law has a law where if you file bankruptcy on your home you can continue to live in it as long as you make your payments. We have continued to make our payments and have lived in our home ever since. When we filed bankruptcy we had the otion to sign a paper that would obligate us to the loan. If we signed it we HAD to pay off our house and could not file bankruptsy on it again. If we did not sign it we could just live in it as long as we made our payments and then we could just "walk away" whenever we wanted (we were not obligated to pay it off). We did not sign the paper. Now we are ready to move on. We asked the bank and they said we could sell it and pay off our mortgage and then we could reborrow from them again, (now). If we just walked away we could not reborrow, from them (ever). So my question is: If we just leave it will it affect our ability to borrow from another lender down the road.
I just had my bankruptcy chapter 7 . None of the creditors showed up at the meeting and when it was about to get discharged , 60 days latter, one creditor filed Adversarial Proceeding .
My lawyer told me that he does not represent me in this and i have to look for a new one, even all the other debts had been discharged by bankruptcy.
What should I do, about this ? Apparently, I don’t have any money to pay for the new lawyer. What does it mean to me, can I settle with the creditor, or make a payment plan on my own?? Anyone help?????
Also, I had my 341 meeting on April 30th, and Adversarial Proceeding was filed on June 30th.
From the net , I got that creditor has 60 days after the meeting to file Adversarial Proceeding.It looks like they filed a day latter (May==31 days, June == 30).Would I be correct on this one? or…..my calculations and information are wrong???

Ok so we filed about 2 years ago and nothing has happened we were released and that’s it we aren’t living in the house but there’s nothing happening we still have the keys nothing at all has happened there. We had a lawyer but when I asked him he was a total ass and said your case is over your dismissed I’m not your lawyer anymore you want legal advice or help pay for it. I was served yesterday legal papers that I’m being sued for less than ,000.00 by my creditor, first I’m unemployed, I looked up online and found a lawyer that charges 50 for filing bankruptcy, I need to know the best option and plus I don’t have any money! they only thing I own is my car which is been paid off, I know it sounds like a radical question but how are they thinking of getting paid by me when I don’t have any assets? are they trying to take away my only property which is my car? and plus I can borrow money from my mom( I’ve been living with her)(her salary is approx: ,000 annually)(since I’ve looked over the fact that they see if you’re living with someone they might take them responsible as well!)(so she can’t be because we’re already below the minimum salary rate) anyways my radical question is should I even get bother by it? I mean they can’t get anything off of me! I’m flat BROKE! my bank account is even overdrawn by thousands! and since if you’re answer is yes<< (you are being sued so start the PANIC ALARM) which is best? and do attorneys from nonprofit organizations do the same work as an attorney who gets paid some 00 ? (I mean if it’s him charging me because he will go to court and file my papers and stuff..)(hearing meeting is %100 me<< so I’m wondering to go cheap with it to prove to the court that I AM BROKE for real! or borrow money and pay the lawyer! which is best?
