So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!

Lawyers, as far I know, cost hundreds if not thousands of dollars… So… if I want to try to file bankruptcy with my wife how are we supposed to hire and/or afford a lawyer to help us?

I’m 23 years-old and my mother began taking out credit cards in my name when I turned 18. My credit is now horrible. I’ve contacted all three bureaus, the police, etc. The bureaus and companies I’ve contacted have told me that I’m still responsible. The police have done nothing. Now I’m apartment searching…except I’m getting denied everywhere because my credit is so horrible. I contacted a lawyer to clear this up, but it’s ,000 down. As a 23 year-old student, I don’t have that money. I’m wondering if I should/could just file for bankruptcy and be done with this. This sucks.
*I had no knowledge of her doing this
*I’m not trying to protect her
*I’ve written letters to all credit bureaus, they’ve done nothing and are holding me responsible
*The cops are fully aware, I even have a police report, and they literally have done nothing
*I’d prefer they throw her in jail, because it’s where she belongs

I sold my car last year to someone for 00. He gave me 0 up front and we drew up a contract stating that the rest would be due no later than December 6th, 2010. When the time came, after many missed emails and calls he told me the car was in the shop and that he couldn’t pay it right then. After a great amount of emails and calls that went unanswered, I showed up at his house and asked his mom if he was there. He told me he had to file for bankruptcy and his lawyer told him not to say anything to anyone. He told me the car "had been taken" and told me to talk to his lawyer about it. After trying to leave a message at his office three times, the secretary got fed up and told me that there probably wasn’t anything that they could do for me and that I was named in the papers but they didn’t have the car and they have no idea who has the car. After this, I decided to do a bit of snooping online and have enough evidence to show that he still has the car and is even in fact trying to sell it online. He won’t respond to calls and keeps redirecting me to his lawyer. His lawyer answered the phone today surprisingly and told me that I was named as an unsecured creditor and that my pitfall was in not declaring a lien on the car when I drew up the contract. I asked him
‘If I were to go to his house and ask for the car back, would he have to give it to me?’
‘Bear in mind that he is my client and everything I say will be in his argument, but no, he has a right to the car because you gave him the title after signing the contract.’

I tried to contact a lawyer but he said he’d charge me 0 for a consultation.

I told the kid I’d need the money by the end of December so I knew I was going to be able to afford taking summer classes this year. Now I’m broke and can’t afford summer classes and might even
have to graduate late..this guy is ruining my life.

What should I do?

can you hire a lawyer in another state for bankruptcy?
I am in another state but I need to file for bankruptcy because my house’s sale date is only days away.
Is it okay to hire a lawyer in Hawaii where I am currently at? or do I have to hire a lawyer who is in California?

I’m being sued by my electric company. (Connecticut Light & Power) I have a very high bill , as a result of being on several payment arrangements over the years, because I am low income. My daughter has severe, life threatening asthma, and I am on the medical protection program to ensure her safety. I tried to work out an agreement with the lawyer’s office handling the lawsuit, and originally, they were going to have me on a payment arrangement of /week, or so I thought. Now, they’re claiming that they’d need my month’s usage plus a payment towards the rest of the bill to be able to settle the lawsuit, which I can’t afford. I don’t work because I have complications from having Lyme disease, and I have PTSD, and my husband is only on unemployment, with only 6/week, when we have a mortgage payment of 1157.33 a month, and were already behind some. I explained this already, and they don’t want to help me at all. I just honestly need some serious legal advice. Without the judgement and cruel comments, please. Should i file bankruptcy? What happens if I have to go to court? I honestly don’t have the money, and am so afraid and confused right now. Please help!!!

And please, no cruel comments about my life. People on this site love to knock others down all the time, and right now, I have more than enough to deal with, obviously.

I gave my Lawyer ,250.00 deposit for my personal bankruptcy and ,750.00 for my business bankruptcy I gave him everything he asked for with in one day or less. I got a case number for my personal after 13 months then it was dismissed in less the one month later do to him not filing a few documents. This has been going on for 16 months I now have several liens on my house.

My family is not the best with money. But somehow I made it through with a decent understanding of the income/spending ratio.
Anyway, my mother is filing bankruptcy, but the lawyer wants 1200 to do it. Her wages already being garnished, she can’t save up the money so it has fallen to her 3 children to do it (because we care). I have a little in a savings account, and my sister has a bit, too. My brother agreed to help out also.
I figured this would be handled in less than a week, but that was 2 weeks ago. Now I get invited along ON VACATION by my sister in law. My brother’s family is going to South Carolina for a week.

Am I crazy, or should this whoole thing already be resolved before the 1st of the month when rent is due!?!?
I already declined the vacation, telling my sister in law that money is tight and I can’t take that much time off work or I won’t be able to to pay all my bills. (I work an hourly wage)

When I was 16 years old I was driving my parents vehicle and their insurance had just lapsed. I was coming up to a 3 way intersection and my brake line snapped and I ended up hitting this woman, no serious injury’s and alchohol was not involved. any way, the lady that i hit sued my parents for 145k, needless to say my parents didnt have that kinda cash just laying around so they filed bankruptcy. then they (the people that sued my parents) waited until i turned 20 and sued me for 156k. the majority of the amount they sued me for was the cost of their vehical… which was an 84 conversion van. Is this legal? can they sue my parents, then sue me? is it legal to sue someone who was a minor when something happened when that person turns of legal age? thats why they sued my parents to begin with because i wasn’t old enough to be held legally responsible. please help what should i do? they took my license and i cant drive and im 24 now. i don’t know what to do but this don’t seem right
Ok, i dont know how they did it but when they sued me i had moved out of state and some how they served my papers ot my parents and not me, and YES the majority of the lawsuit outlined their van, and YES i KNOW that she didnt have any major injury’s only a broken toe …YES a broken toe. AND NO i KNOW that at 16 you cant hold somone responsible in a civil suit. if your going to sue somone that is 16 you cant. u have to sue their parents. that 16 year old is not legally responsible for his/her actions in a civil suit.when i confronted the ATTNY that sued me his exact words were, "how old were you then? …16… and how old are you now? 22… well your old enough to be held responsible now arent ya!" thats the exact convo that i had with the lawyer 2 years ago when i found out they sued me. and they DID NOT sue me and my parents at the same time, they sued my parents, my parents filed bankruptcy THEN they sued me.
oh and they took my license for failure to pay the suit. If i were neglegent than i can see it but i didnt know that my parents had no insurance, and did nothing wrong, my car malfunctioned and i got into an ACCIDENT, not like i was trying to street race and drift through a 3 way intersection or somthing.

I know it varies depending on the law firm. I found a lawyer that charges about 00 to file bankruptcy. I was wondering how much I can save by going thru pre-paid leal service. I’m wondering if the saving is enough to sign up for PPLS and then file bankruptcy.

I had a consultation with a lawyer and he told me that I would qualify for Chapter 7 bankruptcy. He also told me that he wants 00 in order to proceed. If I had 00 I would be paying off some of my debts. How can I go about filing Chapter 7 without a lawyer or by using the least amount of money possible? Thank you in advance for any advice.

My husband and I have accumulated more debt than we can handle of the years and with two kids, we have decided to just file for bankruptcy. We just moved to another state at the end of December and have to wait 91 days before we can file. So, our 91 days are up on March 28th and that is when we intend to file. However, my husband co-signed a loan for someone and that person has not made the payments. Now we have a court date, that court date is on March 29th.

My question is for anyone who has been in a similar situation. If you have had to file bankruptcy and have a court date for a creditor the same day you file, can they still make you pay? We would just like to know if we go into court that day, saying that our lawyer filed the paperwork for a bankruptcy the day before or is in the process of filing the paperwork, would that save us from having to pay the debt if the debt is going to be included in the bankruptcy?

Any advice is helpful.

How do I file for bankruptcy by myself or with a cheap lawyer?? I have about 50k in debt. Right now I am not working and I can not afford to pay off my debt. I am trying to figure out which route to go. Husbands family went bankrupt. We have 80K debt which we ARE able to pay off. Husband is very influenced by sister to file for bankruptcy. ….If they never signed a contract or any kind of written agreement?

My grandfather loaned his sister’s grandson, Zach,(my second cousin) a loan of twenty thousand dollars. He claimed he was going to better his life by taking flying lessons to become a pilot. He convinced my Papaw that this was basically a "education" loan. My grandfather, being the generous and giving person he is lent him the money and set up a payment plan with Zach to get the money back over time. This was in April of 2009. My Papaw was diagnosed with cancer in June 2009 and passed away in November 2009. Zach made payments until November 2009, when my Papaw passed away.

Before my Papaw passed, he told my aunt (which is over his estate) to make sure that Zach keeps making payments. Now Zach has become extremely disrespectful to our immediate family. He doesnt make any payments, he doesnt return calls or texts and he gloats and posts pictures of a new small business he has opened on Facebook. My aunt even met with him and lowered his payment so he would be able to pay.

So what I am wanting to know is, without having any written agreement between Zach and my grandfather, can we take him to court to get the money back?

Also another detail is today we ran into him at the bank and he said "I just filed bankruptcy, my lawyer should be in contact with you"

Should I get a divorce? I have been married for 4 years and the entire relationship is about my husband. He has a lot of issues. First, he is an alcoholic. I have tried to help him and support him when he says that he is going to stop, but he always starts back drinking. After we were married I found out he cheated on me with this woman who attempted to commit suicide when she found out he was married (which tells me that this was an intimate relationship, not a one night stand like he told me). But I forgave him. He lost a job because of his drinking and began to drink all day every day. During this time I was pregnant. I had to pay all the bills all while I was pregnant. My entire pregnancy was miserable; the only time I was able to enjoy it was on the day of my baby shower. He stayed drunk so much that I had to ask a neighbor if they could help me if I had to go to the hospital in the middle of the night. He ran up a high cell phone bill talking to an ex girlfriend who lived in another state. I had to file for bankruptcy because I could no longer afford the bills on my own. I lost my home that I worked so hard to get before I married him. I could have lost my job because my credit is so dependent on me maintaining a security clearance. I helped him find a good job that offered good benefits and possible advancement. Right before he started the job he got arrested for a DUI. Well, once he actually started the job he was unable to pay any household bills because he had to pay for the lawyer and child support for his other children from a previous relationship. He barely helped me with any of the household bills. We have separated 2 times for short periods of time, but I always feel sorry for him because he says he doesn’t have a place to go. He has hit me before and has pulled a gun on me. He calls me out of my name whenever we get into arguments. He just received about 7000 from school and only gave me 700 for bills. He goes out and buys all this unnecessary stuff, including beer and cigarettes and claims that he is buying things for us. Recently, he quit the good job and says that he is about to start his own business. The job he had paid for his child support and benefits for his other kids. He never helps me buy things for our child. He says that he doesn’t help me with the bills because I don’t tell him what is due. I am a totally different person. I went from a size 8/10 to a size 16. I am always angry I find myself lashing out at people and I know this is because of the situation I PUT MYSELF IN… But why can’t I just file for divorce and get him out of my life. I called the attorney and gave him all of my information, but I haven’t sent him the payment yet. I know that I am not in love with him, but I can’t understand what is holding me back from mailing the payment to start the divorce. I know this is unhealthy. I know this is a lot but can someone outside reading in tell me clearly why I am holding on and what you think I should do. Please help me any good advice.
