Im looking for a bankruptcy lawyer in Phoenix AZ. I need help filing for chapter 7 bankruptcy. I’m looking for a payment plan to satisfy my creditors because im getting harrassed for late payments.

do creditors have to stop reporting late payments after bankruptcy filing date or discharge date?

We filed for BK in Feb. 2009, discharged in August from Chapter 7. We are in the process of cleaning up our credit bureaus and are trying to get accurate info as to when reporting of late payments should stop. We were under the impression that a Bankruptcy stay went into effect upon filing, and creditors were unable to try to collect or report any more late payments beyond the filing date. Equifax corrected everything, but Experian is telling us that they can report late pays until the date of discharge. I haven’t yet talked to Trans Union.

Does anybody know what the law says about this? Can they legally report late payments between the filing date, and the date of discharge?

Any advice is greatly appreciated.

If I'm NOT late on payments PRIOR to filing bankruptcy, can creditors report me 30 days late if I stop paying?

I currently have no late payments in 10 years with over 45 accounts, but unfortunately I have to file bankruptcy (bk). Even though the bk will heavily impact my credit score, I want to minimize the damage. If I’m 10 days late on a payment and then file bk, can the creditors report me 30 days late once I reach the 30 day point? This is assuming I was only 10 days late when I filed bk with the court. Will filing bk prevent them from being able to report me if I wasn’t 30 days late when I filed? If they do report me in error, do they have a legal obligation to remove the 30 day late?

Can I file for bankruptcy?

I couldn’t get a loan for my small business and I endup using all my credit cards to cover team, supplies, trips for our team riders, rent, goods and services, some equipment, etc..
The business was as sole and all the card were on my name. So is my personal line of credit.
I was hoping that it will payback the bills and didn’t go that way.
I don’t have really enough to pay all this creditors.
Im sending late payments when I have the money to do it.
Can I file bankruptcy? Am I able to file for chapter 13?
I want to start fresh again.

Is there anyway to expunge a repo off your credit report?

my car got reposessed last week, any they won’t let me get it back by bring the late payments current at all. So what’s next, will i have to hire a lawyer? When will they take me to court? Should i file for bankruptcy?
well they said they wanted the whole balance, which is 12,000
well if they sue me for 14k, then i would have to get a lawyer and proceed to file for bankruptcy, which i never wanted to consider, ever
i was a few months behind and it was not a buy here or pay here lot, i tried making two payments but my check bounced

I'm stuck in a rut because of a car repossession … any suggestions?

I was young, (22yrs old) had 2 jobs and made good money. I decided to trade in my old junk of a car and buy a brand new car. I had no credit history so my then bf helped co-sign for my new car. My interest was sky high but I didn’t care at the beginning because I had no idea what I was doing. I paid a very large amount per month and then after about a year, I lost my main job. A few months after that, I lost my other job. I now was collecting unemployment and went through HELL to make sure that car was paid off every month. I started making late payments and my life was just a mess because not only did I have to pay for that car, I had the insurance, rent, etc. I was no longer able to pay my car and that day came when Mr. repo came knocking on the door. They took my car after 2 years of me working my butt off and they auctioned it off for SO cheap (almost had a heart attack at how much they sold it for!)

This was in 2008 and 2 years later, I’m still struggling financially in more ways than a hundred lol…I have really bad credit, I can’t even open a bank account and I feel like my once so organized and amazing life is now totally off track. I don’t know what to do. These are my questions:

1. If I open a bank account, can my lender seize all my money? Not a savings, a checking account.

2. Being that I did not pay the upside down on the car (,000) should I file for bankruptcy and is it too late to do that after 2 years? And for those who want to suggest that I pay off the 16 grand, I’m not because I’m not going to pay for a car I don’t have anymore and you might say well you’re stuck with it you should have never bought a car you can’t afford I don’t want to hear it because you don’t know my story. I want serious answers, not answers that are going to sound mean and not help.

If there is anything that I’m missing? Please, any advise would be GREATLY appreciated. Thanks in advance :)

Should we file for bankruptcy?

I am confused as to what to do – my husband and I recently reconciled and between the two of us, we have ,000 in unsecured credit card debt. Although he makes very good money, approx. 00 per month, we cannot keep up on all the minimum payments for these cards, let alone trying to pay the principal.

He has a car payment and we own our house (or we will in 27 years anyway :) – we have not been late on the mortgage as that is our top priority. We also have 4 kids…… should we file? We figure since we have the house and vehicles that we can deal with the bad, bad credit that this will result in but are we forgetting something?

We considered a debt consolidation but we heard this is more often then not a scam and ruins your credit as much as or more then a bankruptcy. Any advice is appreciated ~ thank you.
Unfortunately all the late payments have resulted in a credit rating in the 500’s which is too low to qualify for a re-fi.
