Car accident with no insurance, over ,000 in debt, what should I do?
I was leasing an ‘07 BMW and back in November of 2008 I was in a car accident a few days after my insurance ran out. I paid for my insurance up front the last time for a year, therefore because of some circumstances, I was unaware that it ran out when it did. Not saying it wasn’t my fault, but that’s the truth.
Anyway, like I said I was in an accident and it was MY fault. The other guy had a Saab and the damages to his car were about ,000. The damages to my car were about the same. Bmw has sent me a couple letters, but I haven’t spoken to them yet. I made a plan with the other guy’s insurance lawyers to pay them like 0 a month for the next twenty-some-odd years! I am definitely not in the same financial situation that I used to be in (it’s a long story). I’m basically broke. I want to know if anyone has any advice as far as filing for bankruptcy goes? Can I even file for bankruptcy under something like this? Or will I completely lose my license? Or do I have some other option to lower something? I am unemployed and have no assets. I am only 22. Someone please help me with some advice! I was stupid, I want to change, thank you for not judging me and giving some positive advice.

If I file bankruptcy will I get my car back?

A friend of mine filed bankruptcy about 5 years back, but canceled the bankruptcy when he got the money to take care of everything. So he never went through with it. At this point in his life, his daughter has no way to get to school, and he knows that last time he filed, he got his car back. Has that law changed? He needs the car bad enough out of repo, and this is serious.

To file Bankruptcy or not?

I live in Florida and have spoken with a Bankruptcy lawyer about my situation. I had excellent credit prior to a house I had up for sale being on the market for 6 months and tried to sustain two mortgages plus expenses on both houses and a lot of credit card debt, mostly used to fix up both houses.

It’s been since March 2007 that I made my last credit card payments. I took all of the 00 I received as a tax refund and paid it on 5 different cards.
I called the credit card companies and tried to set up a payment plan of some sort because I was drowning. NONE of the 5 would and acted really crappy when asked. The phone calls also bordered on harassment.
So, eating ramen noodles and peanut butter started pissing me off. If they didn’t want to work with me, then I wouldn’t work with them.
I changed my telephone number and stopped paying them.

After speaking with an attorney early this year, he stated that unless I was faced with court papers to appear, to stave off filing for bankruptcy. If I did file, it would be for Chapter 13 he stated.

I wanted a second opinion so here I am. My questions are…

If I do not file, the statue of limitations runs out in less than 2.5 years for the state of Florida. If I am not served a summons, after the SOL runs out, can they still serve me with papers?

If there is no summons or judgment, will the charge off debts stay on my record for 7 years from the last time I paid the credit card company? Or when the debt was sold to a collection agency which I think is usually a year afterwards (they all have been sold).

If the debt is sold again to another collection agency, does my time start over?

On my credit record, will there be an entry for the credit card company debt AND the collection agency?

I simply want to know when the credit card company debt and charge offs will drop from my record if I do not pay them.

The SOL is 4 years, it will run out in 2.5 years since my last payment is what I was referring to.

Question about debt & bankruptcy?

Hey everybody,

I’ll be 23 in a few months. I’ve already been married & we bought a house [but due to a pipe busting in the winter & causing a ton of mold & then five trees falling on the house in a wind storm that the insurance company did not want to fix], the home ended up going into foreclosure. The loan was not in my name, however my name was on the deed. I’m not married anymore & the last time I checked my credit, the house did not show up but, I think that was before it was actually foreclosed on.

He & I have two credit cards [probably 00 of debt total] that I have to pay half off of [so, about 00 right there.]
Then I have a Kohls & Macys card [about 0 total].
Then I have three other items that are not credit cards that come to about ,050.

Total, I have just a little under ,000 worth of debt which I know doesn’t seem like much but, after I deduct all my bills, I don’t have much money left. Things keep popping up left & right like medical expenses & tires for the car, etc & whenever I think I’m starting to get ahead, I end up even further in debt. I already have two jobs, I already save as much money as I can. Every bit of debt that I have has already gone to collection agencies so I can’t go online & pay on anything.

I’m just wondering if [since my credit is already horrible] I should just file for bankruptcy. If I did, would the foreclosure still show up [assuming that has affected my credit]? Would it be easier to rebuild my credit after bankruptcy or repair it by paying everything off? If bankruptcy is my best option, how long will it affect me? Will I be able to rent an apartment? What if a few years from now, I want to buy a house or condo? If bankruptcy is not my best option, is there any programs that aren’t scams that I could use to consolidate or something? Not sure if this makes a difference but, I do have a 2007 car that I bought brand new. I have three years left of payments & I’m current on it. I’m thinking about trading it in for a vehicle with AWD.

Serious answers only please. I’m trying to figure out what steps that will help me further myself faster. Thanks in advance.

I recently had to file a chapter 7 bankruptcy. I am currently unemployed and have been applying online for?

a job at several banks. Every time I get a call back from a recruiter for the company or get an e-mail saying I should be hearing from someone at the bank to set up an interview. I never hear anything else from the bank and since I have to sign something authorizing them to do a credit check during the application process I am afraid this is why I’m not hearing from them. Is this possible? I’ve read that it is illegal for them to not hire you because of info on your credit report, if this is true why do they insist on checking it? How would you know if that was why you weren’t hired they certainly would never admit it if it is illegal? I know this is a separate question but the last time I asked a similar question on this website my email kept saying I had a new answer but every time I looked there was no answer to read. When I pulled up my question It said there were four answers but when I looked at the question , only one answer was showing.

What would happen if you filed bankruptcy while in the military?

My fiancĂ© is trying to rejoin the Navy. He’s talked to a recruiter, gotten his DD214 and knows his reenlistment code. He’s been to a dr. to prove that what discharged him last time no longer applies, now he’s worried about his debt. He knows that if he gets in, he’ll be on salary again which will make meeting his financial obligations easier, but he asked me to try to find out what I could about what would happen if after in re enlists, if he files bankruptcy. Everything I’ve found online says he could be immediately discharged and he won’t get the same clearance he had last time because of the debt alone. He used to have an active SCI Top Secret clearance. He won’t get that this time. Is it true they will discharge him if he tries to file bankruptcy? Do they have any options to help him repay his debt? Thanks in advance.
He’s not getting a steady salary right now and hasn’t been for over a year. He’s got a lot of debt that has built up over the past year and he can’t get out from under it. He needs to clear it. Or find a manageable way to pay it back. We are getting married as soon as he finds out if he is accepted back or not and he needs to be able to take care of me and the kids. Not spend his entire salary on old debts.
Will his debt be an issue when he tries to rejoin? His recruiter didn’t say anything about it but we’ve read he’d need a waiver for that kind of debt to get back in. Is this true?
