please don’t scold me for having so much debt or being financially responsible. Whats done is done. Only the present and future advise i need now.

I can’t find job. It is very hard. Even though i have bachelor degree in math, i can only get .50 an hour which is nothing to fight the ,000 unsecured debt.

I defaulted on my payments since february 2009. The .50 hour an job — almost all of it goes on cell phone bill, broadband bill, car gasoline, dog food and dog vetreneary expenses (i have 2 large dogs).

I get 100’s of phone calls by harassing creditors. I no longer pick up the phone. I can never raise 00 for bankruptcy lawyer in such poor financial situation. My interest rate has hiked to 36% APR and i keep getting slapped with more and more fees of interest and penalties. I QUIT!

What will the creditors do to me now? there is not 1 single asset i own, except for my 2 beloved dogs.
Will creditors send me to jail? how will this situation end?

Please advise. I see no end to this at all as long as job market is stagnated.
.50 an hour job is as good as being unemployed. right?

I am pretty much broke and tired of creditors harrassing me and my job. I know I messed up when I was younger. I was trying to pay them all off but it seems to me the more I try the more I owe.

I was looking into bankruptcy to give myself a fresh start, but it seems everyone that could help me charges at least 00.00… tell me if i am filing for bankruptcy how am I supposed to pay that.

Hi.. I recently was served with a summons and complaint that states I have twenty days to respond to it in writing to the court or I will be faced with a default judgement. I have looked up alot about this online and found out that in my state (indiana) I can file a "Motion to dismiss fo failure to comply with rules" if the plaintiff did not have a contract written instrument not attached to the complaint and summons, and it did not. I still need to call my court here in my county to be sure that it is the rule before I can try this though. I need to know how to word my answer if I would go with this route and if even if I dont I still have to answer to avoid the default judgement. I know that I need to go through and deny each complaint that is numbered on the sheet but I do not know how to word it exactly. The reason that I am being sued in the first place is because my b/f and I had a couple credit cards that I was a joint on with him. He was always the one responsible for making the payments. He ended up having to file bankruptcy, and once the case was discharged it automatically made me the one responsible for the amount. I have no way of making any kind of payment on it at this time. I have been out of work since 2007 when i found out I was preg with my daughter and i have been a stay at home mom since. So i know that the judge can not order for any kind of wages to be garnished and I do not have any assets for them to take, so most likely its just going to be on my record and if I would get a job or any money withen the next ten yrs or so id have to pay it then. Do I need to deny the complaint in my answer even though I know its true .. or will the judge just order me to pay it then because he wouldnt have been able to hear my story or i guess situation? The complaint states that 1. The defendant is indebted to the plaintiff int he amount of ***** plues accured interest of **** as of jan 2010.
2. Venue is proper with this court and based on the defendant residing in **** County.
3. The plaintiff owns and is the holder of an acocunt due and oweing by the defendant, and is the asignee of Elan/ Mainsource bank.
Wherefore the plaintiff respectfully requests the following relief.
1 Judgement against the defendant in the sum of ******* plus accured intesest of **** as of jan 2010
2 Interest thereon at the rate of 8 percent per annum from jan 2010 , and 8 percent per annum from the date of judgement , until the judgement is satidfied.
3 For plaintiffs costs herein expended
4 For any and all other relief to which the plaintiff may be entitled pursuant to contract, statute. or common law.

So When I was 17-18 I went to college and had to get student loans.. & I am now 21 years old pregnant (38 Weeks) and sick of the interest piling up.. I don’t have a job because of the pregnancy and it seems like even when I was making payments that the more payments I made.. the more interest they tacked on!.. I am now 12,000$ in debt… Would it be smart to file or what should I do? Im totally clueless to any of this.. So any advice would be really great!

My ex-best friend has been on my mind for the past 4 years now. Here is a Short version of what happened:

We were best friends for 9 years. We married brothers, so we became sisters and we were a very close group. My husband became Very ill and had to have surgery. He ended up in the hospital in november 2004 and was there until january 2006. he nearly died 5 times from Several complications. anyway, the last day that i saw her in person was the day of his surgery, she and my brother-in-law come to the hospital and when they left she didn’t even give me a hug.

a week before christmas 2004 she called me to tell me they were getting divorced and when i told her my husband was dying she said "that sucks" with no remorse for her friend/brother at all, or me! she immediately moved into a trailer with three guys, got knocked up, and moved to another state. i havent seen her in 4 years! she left us all in shock, my brother-in-law then lost his job, filed bankruptcy, went through the divorce, and was dealing with his brother dying in the hospital.

plus, i stayed with my husband the entire year in the hospital with no way to contact anyone (i didnt even have a cell phone).. and since she moved around i had no way of finding her anyway. she told a mutual friend that i can kiss her *** for not acknowledging her birthday that year!!! my husband was dying and i never got a call or email or even a card or visit! wtf!

then, my husband passed away in december 2007.. my friend told her and i still got no card or email or anything. but on christmas day 2008 she sent me a message on myspace saying "merry christmas"… how am i supposed to take that? i said, "you also" and that was it.

i can’t stop thinking about her and how maybe i am wrong somehow?!?! but She is the one who abandoned Me.. i keep getting these guilty feelings like the divorce may have been hard for her (but i doubt it), it was her choice to do so and it in no way could have been more stressful than what i was going through.

please someone give me advice or what could make me feel better? everyone is telling me to completely let it go. i dont know if i want closure, but im almost certain i dont want her as a friend anymore.. she’s changed Way too much since then, even her religion, friends, clothes, lifestyle.. everything! Should I contact her? help!!

The short version is that I was denied a position at a local retailer and the only reason I could ascertain would be because of a misdemeanor that I was found guilty of when I was seventeen. The misdemeanor was supposed to be expunged upon successful competeion of juveille probation. Who’d have thought it would come back? The only other thing I could imagine it being is a bankrupty filing, but can an employer deny me a job becase filed chapter seven?

I am currently being interviewed for a Dept. of Army job but am also going through bankruptcy (in the attorney’s hands waiting to file the case), if offered the job, will I be able to get a security clearance?

I had one granted in 2004 before my credit was bad but left that job in mid-2006 and have since worked in the private sector with no need for a clearance.

a few months ago i was jobless and homeless and ended up in the hospital in a state that i was not a resident of and the hospital sent me to like a psych ward/rehab place and that place wouldnt release me because they had nowhere to release me to until they got a hold of my parents and my parents came and got me and i got two bills from the hospital and one bill from the other place and i have a job but i dont get many hours and there really arent many options for jobs where i live i made payment arrangements with the hospital for two bills and i can just barely make the payments each month and the other place didnt send a bill until just recently and its over ,000 and they wont give me a payment arrangement that works for me they want almost ,300 a month for 4 months which i cant do i make less then 0 a month right now since that payment arrangement doesnt work they want me to get a loan from a bank but i dont have a credit history and no one would cosign and i dont make enough money to afford another bill each month my mom says that i should just file for bankruptcy my parents dont have the money to loan me and refuse to cosign anything for me or really help me in any way i dont want to have to file for bankruptcy because i dont want bad credit to start my credit history and i was hoping to go to college in the next few years (which would require loans) im only 19 and i have a daughter whos 10 months (she lives with her dad – she was not with me when i was homeless and all of that) and i want to be able to set the best example for her as i can and ive already messed up so is bankruptcy the best option or does any one have any ideas on what i should do?

I am going through a hard time and after having good credit need to file BK unfortunately. The attorney quoted ,000 to file for 13 and ,000 to file for 7 so I wanted to know why one is 1/3 cheaper. I read online that the 13 says you have to repay the debt, so what would the point of filing BK be if i don’t have the money after I lost my job to pay it? This is in CA if that makes a difference.

We owned a house, two cars and 1 credit card together. We leased to own our house and relocated to another part of the county. I had yet to find a job when our tenants bailed on their contract and ex-hubby cheated on me.

I moved in with a male friend and it took awhile find a job. I could not afford to pay for our mortgage, cars and credit card in time. He refused to sell or rent out the house, but would not pay on it either. I did not have the money to bring him to court before the house got forclosed on. So we lost the house, the cars have been repossed and the credit card charged off.

I am now looking to try to repair my life and possiblly buy a home in the future, but I don’t know where to begin? Should I file BK? I can’t afford to pay back the money.

I own a home in which I am willing giving up due to my circumstances. I became deaf. Since then, I have been unable to find a job. I have been living off of unemployment which is not enough to pay my mortgage. When I tried to send partial payments, they returned my payments. I was given a forbearance but that did not waive the amount I was behind which is over 12 months now. My unemployment is running out and though I am capable to continue to work in my field with reasonable accommodations, or even outside my field, I am not getting any job offers.

I have 20K to use towards prepayment for rent, food, etc, for a little while….to help by more time for me to search and find a job.

I have a few credit cards, one is up to date on the payments, several medical bills, student loans, unemployment payments that I need to repay in a different state, about 00. Back when my credit was good, I was a victim of identity theft which is why internet accounts, credit cards and wireless phone accounts were opened in my name. I tried disputing the items that were not mine but only 1 thing was removed.

Will Chapter 7 Bankruptcy help me? Will they try to take the little money that I have to live off of. I also have 3 paid off vehicles.

we have lived in our home for 30 years but do to medical problems, a death in the family, and the recent economy we finally had to give up and file bankruptcy. we need to rent a home and don’t know how to go about it with bad credit my husband has been at his job for more than 25 yrs. we need help any suggestions

Does anyone have any suggestions as far as applying for a mortgage after a bankruptcy? My husband and I filed for bankruptcy last year. We were discharged on December 1, 2008. We live in SC and the company he works for is about to downsize and he’ll probably lose his job in September. But if he transfers to Delaware he’ll be able to keep his job so that’s probably what we’ll end up doing. We’ve been looking at homes online but haven’t been able to find many rentals that fit our needs. But we did find a great home, with 2 rental units for 5,000. So I was curious …

1. What kind of chance do we have of being approved for a mortage (in the 3K-5K range) so soon after bankruptcy?

2. In applying for a mortage do they take the rental units into account? (They’re both being rented right now for 0 a month each)

3. Can anyone suggest any websites or banks we should apply to?

So I have about k or so in debt, most of it is CC.

Im broke, have a wife and two kids… in this economy /hour is the best I can do for a job…

Realistically there is no way that I can pay these people off.

Im afraid that if I file, I may be forced to sell my boat.

We all live on a sailboat, its worth -k probably. I own it with no payments.
I live on it because its cheap (0/mo)
If I am forced to sell it, I will have to move into an apartment, which will cost me about 0/mo. and when you take home 00/mo….. thats not really an option.

We also have two cars, neither is worth more than 00.

Thats all I have, a 40yr old boat, and a couple of 20 year old cars. If I file bankruptcy, will I be able to keep my home (boat) and my cars?

also, if it matters, I live in Oregon.

i have to file for bankruptcy because he stole thousands of dollars from me to buy drugs & video games. i had to take our daughter & move in with my mom because of this & his verbal abuse. he doesn’t take care of her, and never has (times when he was watching her she’s gotten into harmful things & never got diaper changes). he has a temper. he’s racist, sexist, selfish, etc. he of course can talk a good talk but it’s all lies. he’s unemployed & has no desire to get a job or training.

he’s still living in my house (he was never on the mortgage & never helped pay the bills) and he’s trashing it. i’d like to sell it, but with all the damage i don’t think i can (the dishwasher is smashed to bits, along with most cabinets & walls have holes in them). he smokes in the house, even if our daughter is there. he has a son older than our daughter & his parental rights to him were terminated.

should i cut him loose? i plan on divorcing him. should i also evict him & refuse to let him see our daughter until we get it figured out in court?
should i feel bad??
i meant not see her until the courts figure it out.

he doesn’t do anything FOR her either!
he’s NEVER come to see her in the 2 months we’ve been living apart.

and actually, he will smoke & do drugs in front of her if i’m not around. & i’m not wanting to be around him as he’s verbally abusive. (that doesn’t do her any good either)

i think one of the worst things about this is that i just feel completely STUPID for believing what he told me aobut everything, from day one. "his ex & the courts screwed him over to terminate his parental rights" and falling for what i can only assume was his act with his son during supervised visits (since he isn’t nearly that great with our daughter, EVER). i believed he was going into jobcorps in a couple weeks, only to find a letter a few days ago that he stopped his application from even being sent. i believed he was sorry & loved us & had stopped doing drugs & stealing from me–until tonight when taking our toddler to visit him i found his stash (well, actually our DAUGHTER found it to my horror!) and then i checked & noticed 0 was missing from my purse; and when confronted he practically laughed & said something to the effect of "yeah, so? you keep coming over here"

i just feel so stupid!!! and like i’ve totally failed my daughter by conceiving her w/HIM

Ok,I’m 25 and I just got a 04 Pontiac Grand Prix with 112,109 miles on it,for ,000 but got slammed with a 21% interest rate. I tried before hand to get a lender/bank/credit union going in but No one would fiance me because I have 540 credit score. I had to take the deal because the truck I had was a gas hog and was falling apart and I need a way to get to work, so I sold that to get the down payment for the Pontiac.Here the issue,I have had it for 3 months and I have no problem paying the car note(1-a month) but when the economy shot 2 year ago and my job gave pick slips to me and hundred of people,unfortunately I had lost my home and voluntary returned a 02 Monte Carlo to the bank.As you may know now I have a for-closer and an repossession on my credit which is the reason for the low score. I currently have had a job now for the past two years so I making it even tho it get ruff at times with other things like college and apartment bills. I cant find any lender on the net to refinance a car with that many miles and it doest help that my credit score is so low. I was told that since I’m still young I should file bankruptcy to clear my dept and start over now. The only issue I have is I want to keep the car I just got but is there a way in the bankruptcy that I can keep the car and get the lender/bank to lower the interest rate so I can keep it?Or do I have to give it back or keep it out of the filing altogether? I am always willing to do everything in my power to help my spouse finanicially but, he will not do that for me. For example, when he’s short on money paying our bills or his bills. I always pick up the slack,which I don’t have a problem with at all! I’ve even put my credit on the line for my spouse and he’s left me with bills to pay on my own. Eventually, I had to file for bankruptcy! But when it comes to me! It’s always an excuse or he tells me he just doesn’t have any money to spare for me. But he doesn’t make that excuse when it comes to his mother or his siblings. It’s like I always come last. I suggested that he gets another job part-time to pay his bills. All I got was"Why should I get another job when I already got one?" "I’m not going to get another job when I already worked hard for 8 hours already!" I’ve considered just leaving, but I have the kids to consider. I work and go to school and take care of a household. I don’t feel like my spouse cares me. I feel like a used ATM.
