I owed the IRS over 0K from back when I was framing houses from 1995 to 2006. Over 100 of my workers (filled as subcontractors) did not have a social security number and now I am responsible for their taxes so-to-speak. I called an out of state tax attorney from a television commercial and for K he got the debt (liability) reduced down to 9K. That was back in ‘06-’07.
As of today, I have lost everything, not to the IRS, but to the fallen economy. I have nothing for the IRS to levy. Seriously…not a single thing I own is worth anything at all.
While seeking investors to fund my new business manufacturing remote control lawn mowers, the first two backed out due to this IRS mess I am in. I have to get this debt cleared if I stand a chance at an investor putting up his reputation for my company.
Can I file bankruptcy on my debt with the IRS in this situation. What are some things I will encounter along the way. I have never filed bankruptcy before. How much could it cost? How long could it take?

It was reported that 30 ministers have held a political rally and issued political comments during this campaign in violation of Federal Law. Once a Church involves itself in the political process it loses it’s tax exempt status. I think IRS is going to come down on these pseudo-ministries and audit them and collect the taxes owed on the monies they received. How many congregations will declare bankruptcy ?

I’m an unemployed teacher and have just lost my car (my only asset) and am representing myself in my bankruptcy. My combined debts (assuming I’ll still owe about ,000 on my car once it sells at an auction) is approximately ,000. I do not have a savings and no longer have retirement accounts because I had to cash them out to cover living expenses. Twelve years ago I had to file bankruptcy and am concerned about how that will look to the judge. I worked to earn my college degree since then and was doing well when suddenly I found myself without a job. Any thoughts on that? My debts back then were fully discharged, and I’m hoping to file a Chapter 7 for another discharge of my debts. Here are some of my questions, any input would be appreciated:
1) Is there any kind of assistance available for people who cannot afford the filing fee?
2) Once I file, how long can I expect for the court date?
3) Does the online bankruptcy class that is required cost anything?
4) Can my 0 debt to the IRS (back taxes) be included or just the interest and penalties?
5) Any suggestions for someone doing this without an attorney?
I’ve done my research and am actively seeking answers to my questions, but there are some very informed and helpful people on this site, so for peace of mind I really welcome your input.

We are talking to this one law firm and the secretary is says we need the last 2 years tax returns to file for bankruptcy.
We have the full return from last year, but from 2007 some little things are missing. I ordered tax transcripts from the IRS which shows our AGI and everything from 2007, and I actually ordered for 2006 and 2005 which is over and above what they needed.
The "secretary" says we cannot proceed without the original W-2’s from 2007. The IRS says this is official tax documentation showing we filed and the amount of income we earned. Should I just drop this place and find anothe lawyer.
Are tax transcripts generally sufficent enough in your experience?

That’s what I’d like to know about, I am so sick of all this one sided "I just wanted to work and be with my son" BS. If the media wants to present a fair and unbiased story then it should also cover that.
Did she cost someone allot of money when she used their number? Did they have to file bankruptcy or lose their home?
caldude – when the income is reported to the IRS it is ADDED to their total income, and then they OWE TAXES on that income.
Also if she claimed more exemptions then she is entitled to there wouldn’t the withholdings, so come tax time there are added fines (interest) on the taxes owed.
The costs to straighten all this out is very high, because you need a lawyer.
no MX, I am right, I happen to have a degree in accounting. The IRS will eventually straighten things out, but ya know what, FIRST the person is audited and then several months later things might get fixed. In the meantime the legal citizen is left hanging.

So yeah my soon to be ex- wife makes 3 times the amount i do, we filed taxes jointly at first, with out my knowledge she claimed outreagous deductions and now we have to pay for it. The debt is 30,000, i dont have that kind of money, hence why im filing bankruptcy because off all the stupid mistakes i did when i was married to her. So if i do file bankruptcy i know i can’t get out of the IRS debt like that, so will the debt be split down the middle? Or will one of us be held more responsible then the other?
I constantly argue with her that she is responsible (although i know we both are) for that IRS debt, she so called says that shes making 2,000 payments a month. When not to long ago i got a letter in the mail saying about a recent audit and again i spoke to her and claims that she’s making payments.
im filing bankruptcy for other reasons…
she’s a real estate agent and these deductions are for dry cleaning, car expenses, cell phone expenses…

What do you do to fix your life when you’ve had to file bankruptcy, a teen turns to heroine and steals everything (but is 26 now-living away)– too little too late now – all gone, you lose your home after cancer, you’re working very hard, you owe a lot of money to a lot of people, your cars keep breaking down, you owe the IRS, you have no health insurance, you lose your job (lay-off) and can’t pay car insurance, car insurance lapses and then you can’t get new insurance because it costs MORE because you "let it" lapse, you can’t get ahead because bad bad things keep happening – for years and years and years (not a new thing), you are feeling helpless and hopeless. There’s no help out there because of course you "make too much money" for assistance. No family to help (you don’t want to take from anyone anyway) and you are afraid to wake up every morning? Plus you have a wonderful teen who deserves the WORLD and he’s gone without for many years himself because of everything?

2. I am not the drug addict – my son was. There was a lot of advice about 12 step programs and don’t do drugs. THAT ISN’T MY PROBLEM. I’m NOT asking because I’m feeling sorry for myself. I’m explaining HOW THINGS GOT BAD and wondering how I can get out is all. "Twiddle your thumbs and feel bad for those without thumbs?" First of all, I’ve been one to give my last dollar to a hungry man on a street. The answers I was looking for were some positive real answers from possibly someone with background in this type of thing. I’m looking for real answers – not for you to feel sorry for me. The praying part IS A GOOD ANSWER – and hearing others stories help too (thank you). But the rest of you, if you are going to answer the question, read the question.

My husband and I filed chapter 13 bankruptcy in 2006.
The attorney that represents us has failed to respond to 3 letters sent to him requesting help with our case. A certified letter with
delivery confirmation and signature required upon delivery. At least 5 phone calls and several emails. I have a new lawyer who has looked at our case. She found the case to be "botched badly". I had to quit work due to a back injury. So we lost my income which is included in the case and ch. 13 payments. He has us paying too much back to creditors. The last thing is that he made an error and now we owe over 00 in back taxes to both the IRS and city taxes. I called him once
and the secretary forwarded the call to his line. The phone rang for over 30 minutes. I received a call then flashed to answer when I hung up his phone was still ringing. Should I file
a grievance with the county bar association and also fire him?

I’ve two rental condos foreclosing in a few months. One of them should have a capital gains exemption because I used to live in it and moved out of it in July of 2006. My questions: 1) what is the percentage used in calculating capital gains tax on rental homes foreclosed? 2) I might have to file for bankruptcy also in the next few month. Will a bankruptcy discharge cancel the capital gains tax? 3) What records do I need to give to the IRS next year?

We live in Washington. We own a home that has 95K in equity – but we owe the IRS about 85K. We have gone through the pre bankruptcy counseling and they say we HAVE to file – because we are in the hole 6K per month (long story – I owned a business and got very ill). My income is commission only – and I don’t have commissions coming in which is why I need to file Pro Se’. Basically – do I let the trustee sell my house? Do I need an attorney to make sure the taxes are discharged (they have been owing for over 3 years and over 2 years since I’ve filed – and also the 3rd rule I’ve passed too) because that would be horrible to walk away without them discharged. I have 2 cars I want to give back. If I file now – how long can i live in the home and when do I need to surrender the cars ? I don’t want to milk the system – I just want to find a place to live and have enough time to earn a commission (should be 30 days away)
They may have changed the rules – but I know you can do it pro se. The reason I would even try is I used to be a creditor rep that goes to court and I reviewed every petition to find fraud. I know most things – it’s just the tax lien stuff and the sale of the home I don’t. My attorney wants 00 up front. It is so embarrassing – I used to make K per week – and now I’m reduced to not being able to pay an attorney. Life goes on.

Every since I lost my job last 8/27/08, I lost both my cars I have a tax lien do to the fact when I was working I was paying the IRS that I owe now each time I go on a job interview a credit report is pulled which means I don’t get the job because of credit issues I don’t want to file bankruptcy who should I talk to about this matter I did get a offer for a job no credit report was pulled on me this job pays only .00 what should I do

I have completed all my back tax returns but have not yet filed them (2005-2008) and have come up with a tax owed of around ,000 which will surely be at least -,000 by the time penalty and interest are added in. My 2004 returns shows me owing ,000 and the IRS has already started the levy process against my personal income last week but made an error on the form so I have dodged a bullet until they get it corrected.
I spoke with the IRS this morning and told them how much my gross and taxes were for the 4 years I haven’t filed and they have asked me to fill out a collection information statement form 433F and have given me until Monday to call them back and give them the info on the phone.
Due to some huge unpaid medical bills, my debts outweigh my assets by at least 3 to 1 (assets ,000, debts including ,000 tax are around 0,000).
I have around ,000 cash saved, and ,000 equity in my house but cant find a lender because my credit is terrible.
Any suggestions? Will the IRS be able to give me an installment plan or could I opt for an offer in compromise? Or is bankruptcy an alternative?
I have never been in such a poor financial condition in my life.

Can I possibly do and offer in compromise? I realize now that federal taxes can not be discharged in a bankruptcy. Can the IRS do an installment agreement for ,000 or is the maximum ,000?

Could they take your money out of your bank account when you have debts and collection agency always looking for you? I am planning on filing bankruptcy but I will need to have money for other things like attorney and money to live. Does anybody of you know if after a while those debts if you don’t file bankruptcy they go into your w4 ?
Then you’ll find yourself owing money to the IRS through the franchise tax board. I saw it in a movie and is worrying me. I thought at the very least they can take what you own, like cars. houses, or anything in your propriety , but I never heard that, IRS or whoever, can take actually money out of your account…
I heard they can take money out of your paycheck.Yes,even giving you bench warrants like they did to me, when is court fines or law-legated debts.
But actually withdrew money from your account I never heard of it…please if you know anything about it let me know otherwise I have to be careful to put my rescue money in a bank account

can someone walk me through the steps of this new bankruptcy law. Also does anyone know of any alternatives? Im in real bad shape though. CC, med bills, IRS, State, Private school tuition, two vehicle payments, …. I went from making 6 figures to the medium 5 figures. Not on the street poor but definately cant maintain this lifestyle anymore.

My wife and I are wanting to declare bankruptcy and our lawyer is asking us for our last 2 years tax returns.
We have one, but moved in the last 2 years and do not have a completed 2007 form. We can’t find our W2’s. I am trying to get it the original ordered through the IRS but it takes 60 days.
What is the usual protocol? Will the court and lawyer wait for us to get it?

I am excellent at defending myself in court. I need to file bankruptcy to clear off a couple of 20-year old student loans and some credit card debt if I or my fiancee ever want to get any income tax refunded or receive any stimulus money. Without bankruptcy, we’ll never receive a dime back from the government and will also never get the debt paid off, at our advanced ages. Are there forms available anywhere which I can use to file with? I live in Texas.
FYI, when one does not pay a guaranteed student loan, the balance is taken out of every refund the federal government issues to you, i.e. your income tax returns, your spouses income tax returns, and any stimulus payments. This has been happening to me for the past few years. Instead of last year’s stimulus check, I received a notice from the IRS saying mine had been sent to a loan company. In Texas, once a student loan is more than…I’d have to look it up again, say 5 or 10 years, it is considered an undue hardship and does qualify for bankruptcy. Mine is 20+ years old.

My sister has been dealing with the IRS for a while and she was recently told by a friend of hers that she could file Chapter 13 Bankruptcy to get all her bills organized and establish a payment that would help her meet her obligations and keep her house. My understanding is that once you file Bankruptcy you can not do it again for 10 years. I could be wrong though -

I just went to bankruptcy court; my house was foreclosed on and the irs sent me a 1099C form. Since I filed bankruptcy, and the mortgage was included in that bankruptcy, do I need to file the 1099C form when I file my taxes?
