Here’s my situation. I was on the top of the world before I even turned 21. I worked so hard to accomplish my financial goals of basically owning my own house and own vehicle before my 21st birthday. Some where down the road I got lost… The great job I had to get the house, I had to eventually step back from to take a slightly lower paying job that offered insurance. To make a very long, struggle-filled story short. I lost everything. And when I say everything, I mean everything. My then fiance` and I split, needing to find our selves again. My new job wasn’t what I thought it was going to be. I inevitabley lost my house, my car, and had to stop making payments on all my credits cards because I quit my job to move across country (with my now husband) who is an Active Duty Marine (now deployed
). I know this is all over the charts, but since my husband is now gone, this is giving me a lot of time to fix/figure out our financial situation. Since my credit score is basically at the lowest point possible now, which bankruptcy should I file for? How does Chapter 7, 11, 13 etc work? My husband does make a decent amount of money, specially being deployed now. But really only enough to pay the bills and pay down his credit. Any and all information on this would be great.

Thanks KMcG. Yes – I am aware of th 7-10 year rule with bankruptcy. We’re even considering staying in the military (boo) to bandage all our debt.

I have a lot of debt and don’t make enough to pay medical bills off and such. Is chapter 7 the way to go?
Just so you know Jackdneverf, not everyone in this world has such a good life as you! When you have a job that has no insurance every time you go to the doctor it’s automatically 0. Don’t judge someone until you have walked in their shoes!

I have bad hypochondria. I developed this 3 years ago and it’s pretty bad. I’m constantly fearing that I will catch some disease and die or that I will move my body or eat wrong and choke to death or break an internal organ. Most of my fear is of having a heart related problem. I don’t go out anymore and I stay inside so that nothing bad happens, like getting in a car accident. If someone mentions an accident or death of a loved one it makes me both sad and very scared and I have a panic attack. I spend hours looking up symptoms online and I now have to file bankruptcy because of medical bills for doctors visits for minor illnesses when I didn’t have any health insurance. I want to go teach english abroad for a year but I don’t know how I can when I can’t even barely leave the house outside of work. I’m afraid I’ll get ill and die in a foreign country.

Okay my question is if i file for bankruptcy will i stop getting collection notices and calls from a collection agency.
See my case is i have a kidney transplant and when i moved to Seattle WA 3 years ago. The insurance here didn’t want to cover me for my medication(because they were to expensive) and doctor visits. So i got a debt from the hospital of almost 00 dollars. But right now i haven’t work in almost a month and the agent told me that if i don’t give a payment their going to take me to court.
What should i do? Will filing for bankruptcy help?

I already filed chp 7 and went to my creditors meeting june 15. I am giving up my house. When do I need to be out by. My bankruptcy discharge should be aug 15. do I need to start packing and find a place to live? should I drop my insurance on my house?

When I was 16 years old I was driving my parents vehicle and their insurance had just lapsed. I was coming up to a 3 way intersection and my brake line snapped and I ended up hitting this woman, no serious injury’s and alchohol was not involved. any way, the lady that i hit sued my parents for 145k, needless to say my parents didnt have that kinda cash just laying around so they filed bankruptcy. then they (the people that sued my parents) waited until i turned 20 and sued me for 156k. the majority of the amount they sued me for was the cost of their vehical… which was an 84 conversion van. Is this legal? can they sue my parents, then sue me? is it legal to sue someone who was a minor when something happened when that person turns of legal age? thats why they sued my parents to begin with because i wasn’t old enough to be held legally responsible. please help what should i do? they took my license and i cant drive and im 24 now. i don’t know what to do but this don’t seem right
Ok, i dont know how they did it but when they sued me i had moved out of state and some how they served my papers ot my parents and not me, and YES the majority of the lawsuit outlined their van, and YES i KNOW that she didnt have any major injury’s only a broken toe …YES a broken toe. AND NO i KNOW that at 16 you cant hold somone responsible in a civil suit. if your going to sue somone that is 16 you cant. u have to sue their parents. that 16 year old is not legally responsible for his/her actions in a civil suit.when i confronted the ATTNY that sued me his exact words were, "how old were you then? …16… and how old are you now? 22… well your old enough to be held responsible now arent ya!" thats the exact convo that i had with the lawyer 2 years ago when i found out they sued me. and they DID NOT sue me and my parents at the same time, they sued my parents, my parents filed bankruptcy THEN they sued me.
oh and they took my license for failure to pay the suit. If i were neglegent than i can see it but i didnt know that my parents had no insurance, and did nothing wrong, my car malfunctioned and i got into an ACCIDENT, not like i was trying to street race and drift through a 3 way intersection or somthing.

we have had a rough marriage. he has lost his job which caused us to lose our house and file bankruptcy and now we live with our two kids with his dad…… sigh…… now i lost my job of four years and the medical , dental, and life insurance that went with it. i got approved for unemployment….. and the kids are getting approved for insurance so…… why is treating me so bad. He doesn’t say it allowed it’s cause i lost my job…. but that’s when it started.
now he says…… i cant stand to look at you. i can’t stand coming home and hearing the kids scream. Please just leave. I’m through with you….. can u believe he is telling me that he wants a divorce?? I"m usually the one saying that to him. and now that i have no way to support myself with no job he wants to kick me out of his dad’s house….. which is cool…….i’ll go but he says i cant take the kids. and i say i’m not abandoning them.
so what do i do?

Please read all of the following to understand my concern before responding.
Saying up front, I’m not a lefty or a righty. I want the best person for the job at whatever level in politics. So, I’ve been getting started on my research. While making dinner last night, I heard something disturbing on TV. The subject was about how Newt Gingrich went against his party and his quote about “right wing social engineering” or something like that. Then a picture of a Republican who was head of something, I didn’t catch it, followed by an audio of him saying “….Medicare as we know it has to change or it will go bankrupt by 2024.” Later, I went on the Internet for info on this issue and became acquainted with the terms “right” and “entitlement”, as they relate to these issues. “Entitlement” was used in the same context as welfare or a gift. Then I began to consider these facts:
1)My sister, who is retired and disabled, worked for over 30 years and paid into Medicare via mandatory FICA deductions
2)I worked for over 30 years and did the same
3)Neither my sister nor I were given a choice. We were forced to pay.
4)Just because the Republicans say Medicare will go bankrupt by 2024, does that make it so?
I then read that Republicans think that what my sister and I were forced by the government to pay into for over 30 years, with a promise that we’ll be covered after age 65, is NOW somehow the equivalent of us asking for welfare? They want to change it later so that my sister and I will get a “voucher” to go buy our own insurance from the insurance company of our choice, but we won’t be able to afford the difference between what the voucher allows us and what the insurance company will charge for the same coverage. Seems to me, we should be guaranteed the same or better coverage for no additional financial burden on us, since the government made us pay for 30 years without asking us if we want to or not.
On the other hand, I’m reading that the Democrats are saying no to Republicans on changing Medicare, saying to the people, “You have worked and paid into it, you deserve it, and you will continue to receive it.”
If the above is true, then label me what you want: liberal, lefty, whatever. I’m about fairness. In this issue, if the Republicans, or “conservatives”, were successful in this, then for me, the “conservatives” would be bullies, and the “liberals” would be their victims. The fox was allowed into the chicken coup by dropping regulations for Wall Street, corporations, and the banking industry. Greed ran rampant and unchecked, creating an economic crisis. The American people as a whole already bailed out banks and corporations. Now they want to rape Medicare, and senior citizens, to make them all richer. How low down and dirty is that? Do you think this is right or fair?
@John: Given what I wrote above then reading your "contribution", I was about to call you an @$$ Hole of the highest order. Then I realized you’re just jealous, bitter, and ignorant, and you deserve my pity.

I was hit by a pick-up truck 2 years ago when I was 15,the insurance is ready to settle but the amount isn’t enough to cover the first days medical bill and the attorney says I can sue the person himself but he will probably just file bankruptcy. If I sue him and he does file will I still get my money and how much could I get because I am still having problems from it that the doctors say I will always have
It was his fault,it even states it in the police report. I was crossing the street and he ran the red light. He admitted it was his fault but is now saying it is my fault because I was to short to see over the top of his hood.

We (me, my husband and 2 children) moved in with my father-in-law after his wife passed Christmas of 2010. We moved in to help with the house and bills and manage his money (he had to file bankruptcy 9/2010). He’s horrible with money, if it’s in the bank he spends it. Him and his wife had incurred 10’s of thousands of dollars worth of debt. We were not able to strip off a 30K home equity loan attached to the house. We are currently paying more than a double payment toward the loan so it’s approximate payoff is 6 years or less. (This will NOT change). He’s 72 and in good health. The value on the home is about 120,000. The home equity loan is for just under 29K. And he owes about 92K on the home. We are to inherit the house someday. My question is this, should we put my husbands name on the home. If so, when? Should we "buy" it from him or should we leave him on it. PLEASE NOTE I WANT TO BE FAIR TO HIM AS WELL. Should we wait till we’ve paid the home equity loan down substantially or should we do it soon? I’m wondering because of the inheritance tax. He does have life insurance. Term life, we are to get 15K. I hope that’s enough info…Let me know if I’ve left something out.

I have a few credit cards and a car payment in a debt consolidation. It isn’t moving as fast as I would like. I haven’t had or driven the car for 3 years. The car loan is under my and my sister’s name. How would it affect her if I where to file bankruptcy?
The car has been totaled out and sold at an auction. The insurance didn’t pay.

I have been married for awhile now but I wouldn’t say that I was happy. My wife constantly takes everything out on me. I find myself being more happy when she is away. I just got out of the hospital, while she was out of town, and rather than spend a night with my wonderful family…I get attitude about how I need to find a better job and she is sick of being the one to carry benefits. Could I do better…probably. However, with the job situation today…my job is 100% secure and I do make about 45K a year. So, not the poor house either.
If I leave her, I will be without health insurance since my company is too small to provide me with such and I have a chronic health condition. It would also probably mean bankruptcy due to the house. We also have a small child that loves it when we are together. My religion and views that I have held so strongly would dictate that I could not remarry without being outcast from my family and friends that I have known for over 20 years. My wife says she wants more of a physical relationship but it is hard for me to want to be physical with her when she puts me down so often. My wife plays the "good wife" when needed but a few times she has slipped up and said something with my family in the next room. They have asked me about it and I have assured them that it was an isolated event but it wasn’t.
I strong part of me doesn’t want to go but I don’t know if any alternative is better.

Car accident with no insurance, over ,000 in debt, what should I do?
I was leasing an ‘07 BMW and back in November of 2008 I was in a car accident a few days after my insurance ran out. I paid for my insurance up front the last time for a year, therefore because of some circumstances, I was unaware that it ran out when it did. Not saying it wasn’t my fault, but that’s the truth.
Anyway, like I said I was in an accident and it was MY fault. The other guy had a Saab and the damages to his car were about ,000. The damages to my car were about the same. Bmw has sent me a couple letters, but I haven’t spoken to them yet. I made a plan with the other guy’s insurance lawyers to pay them like 0 a month for the next twenty-some-odd years! I am definitely not in the same financial situation that I used to be in (it’s a long story). I’m basically broke. I want to know if anyone has any advice as far as filing for bankruptcy goes? Can I even file for bankruptcy under something like this? Or will I completely lose my license? Or do I have some other option to lower something? I am unemployed and have no assets. I am only 22. Someone please help me with some advice! I was stupid, I want to change, thank you for not judging me and giving some positive advice.

My home is only 5 years old. We have had the insurance people to look at it and they all agree that it is a manufacturing error when the shingles were placed on the roof. So now I am paying for a home that could fall in on us at anytime. When my husband removed the vents under the roof we had pieces of the frame work fall out along with pieces of the plywood that is under the roofing paper. What are my options other that fixing it myself?

My employer filed bankruptcy last year and the company was sold. I was hired by the new company, but my husband and I decided to get on his (HD) plan and not pick up insurance with my employer. Since I didn’t take the new employer insurance (expensive!) I was told that I would be charged monthly administrative fees to continue the HSA. A few months later (still in 2009) my husband’s employer offered an HSA and that they would be contributing 0 a year to it, so we decided to roll my HSA funds into his new account (we were assured we could do this). We filed the paperwork about 3 months ago and heard nothing more. My husband attempted to get answers from his employer and was told to just be patient. I called the bank that’s handling his HSA setup and sure enough, my paperwork hadn’t gone through. We were told this was probably because there were so many employees with his company that were filing paperwork at the time, and when my paperwork was received it was ignored because I wasn’t the employee trying to roll the funds (my husband was).
What I want to know is, do I have to wait til this whole mess is straightened out until I can file my 2009 taxes due to the fact that eventually there should be a distribution (from my HSA going into his)? Or does it not matter unless we exceed the family HSA $ limit for 2010 contributions? There’s over 00 that will be rolled and I don’t want to have to pay taxes on it.

I lost my job in October, so about two months ago. I have been living off savings, family assistance, etc. I can no longer afford my 500/mo car payment plus my 120/mo car insurance. I contacted the finance company, but they don’t offer refinancing. To top everything else off my dad and cosigner filed bankruptcy, so they won’t even give me a extension. They said they cannot discuss the debt because my dad filed bankruptcy. Also I cannot pull a loan because the car has depreciated 8,000, and lenders won’t lend me more than a percentage which mine suceeds. They will only lend me the amount its worth. I know I am still liable for it. I have great credit I pay all my credit cards off. I am never late on payments. I just can no longer afford it. Please help me. Any suggestions? and how bad will this effect me if I surrender/it gets reposessed?
Also I am still young, so someday I would like to buy a house. Hopefully even another car sometime soon.

I’ve searched 19 pages of answers, did not find anything. My wife & I have jobs. We have 2 kids. Wife has amassed lots of medical bills, due to 4 hospitalizations. Had Credit-card debt also, but not enormous. We have not paid hardly ANY medical bills in about a year, and no payment on credit-cards in that same time. We had retained an attorney, because we wanted to file for bankruptcy. Now…almost 1 year later, (still have not used c.cards, or paid med bills) we want to include the house in the bankruptcy. (Unfortunately!) I’ve just re-financed several months ago, and can afford the mortgage…however, our home is 20 years old, in need of many repairs, (roof, siding, windows) and insurance is not covering some damage we have to our house….Our mortgage is not quite 1 month late. Any advice? We just want to "let it go", take the hit, and downsize to a town home. In the months ahead… I know we need to SAVE $$$$ When should the lender be notified…if at all? WHAT NEXT?

I purchased a bike at a Honda dealership and they had me apply for a Honda card. I recently filed bankruptcy and all of a sudden a lien has been placed on the title. It is like a JC Penny’s card yet they put a lien on my title? My wife called the DMV a month ago and there was no lien. I used to be in the insurance business and normally they would have required me to carry full coverage but I was only required to carry liability. The DMV said that they assumed that Honda (GE Money Bank) had the lien all along but that isn’t true. I lost the title but when I bought the bike it HAD NO LIEN. It seems the GE is breaking the law. Heck, with the interest I paid for 5 years I already should have owned the bike. My Chapter 7 court is in a few days. What can I do? I fell like they have done something illegal and that the whole "card" thing was to get me to pay higher interest than Arkansas allows. I need this bike for transportation.

First, we used Massachusetts as a lab rat for health care reform. Look how that turned out: the program went bankrupt and many doctors fled the state. We also had many warnings from Europe and Canada. Canada implemented the same kind of "single-payer system" and look where that got them, the same situation Massachusetts is in. Even though we were warned, America voted for President Obama whose political agenda revolved around this topic and now our government has taken several more steps in invading medicine.
I just don’t understand any of this. My father is a doctor and I have seen what this health care system is like from his time in the military. For instance, the doctors in the military get paid the same amount no matter how many extra hours worked or how many surgeries were performed in that time, so the doctors and surgeons lose the incentive to work harder and in fact, seem to work less. I have also worked at an Ophthalmologist clinic and Optic shop for two years and I have been to an Ophthalmologist convention and saw proof of what was to come.

My husband has been getting phone calls from a collection agency at work. The agent calls but when my husband answers he hangs up right away. They will leave messages but will not talk to anyone when they call and someone answers.
The supposed debt was from an HSBC credit card. We filed chapter 13 bankruptcy in 2006. The card application was dated April 2007. I would have never applied for a card after filing bankruptcy. We received a bill for a credit card from Orchard Bank which we had in 2005 and the account was placed on our bankruptcy case. So I contacted the attorney and he said to disregard the notice. We moved in 2007 and had problems with mail being forwarded back to our old address. We had electric, cable, insurance bills that were sent to our old address. I became concerned and called the providers. They told me that the bills were sent back to them with address unknown.
I almost had all my utilities disconnected and our insurance canceled. We also had problems with the postal carrier placing mail in wrong boxes at the old address.
I’m concerned that someone may have opened up an account with a pre-approved credit offer. We received letters from one collection agency and I contacted my new attorney and she asked them to verify the debt. They did verify the debt but it wasn’t a card that we ever had.
HSBC then sent it to another agency. Then this new one. I sent them 3 letters asking them to verify the debt. I have never received any bills, letters, nothing from them. Just the phone calls at work. I then mailed them two certified letters asking them to stop calling my husband at work and to verify the debt. This was 2 months ago. No letters but the calls are still happening.
I checked my husband’s credit report and found the old HSBC/Orchard card listed and a new HSBC card listed to it. Should I dispute the file to the credit agency? Another strange item is that the collection agent told my lawyer that we paid on the bill. This is all really strange. I would never send in a payment of only . Is this a way to get this off of my husband’s credit report and to get this agent to stop? Thanks.
