between the time I spoke to him last Tuesday and today. I didn’t have insurance on it, it was something I was working on and was going to be required in order to file bankruptcy. My car payment is almost 3 months behind now and is in danger of being repossessed. My question now is, should I not file bankruptcy and just let them repo my car? I mean if I could get back the 0 bucks I gave the attorney, and save the other 5 that I would have to pay him, I could use that to get caught up on the rest of my bills. Also, doesn’t he have to give that money back to me if I change my mind, right? Nothing has been filed. Thanks for any suggestions, I hate money.

I would like to know if my husband should file a complaint to the Labor Department, because of his boss… abusive behaviour; until a year ago… his boss was paying him a salary that was of $ 800.00 at the beguining to $ 1,000 dollars weekly, actually, this fixed salary was on for ten years, and now the boss…simply decided to stop paying this ‘fixed’ salary (currently 1,000 per week) blaming the national financial crisis, and put my husban on ‘commision’ for the cars he is able to fix…. in a week, the problem is some times he gives a car only 100 dollars of labor.. or only 20 hours of labor, and do not show the insurance company stimates on the cars, … and my husband ends up working the whole week (more than 40 hours) plus the saturdays too!.. just to earn 350.00 dollars!!! we are getting in bankruptcy soon because of this, this is a loss of more than 600.00 dollars… per week, and we can’t go on like this; the truth is he is working the same an even more hours… but he earns only 350.00 or 400.00 every week! this is after the change in the payment method from a fixed salary to ‘comission’, and I think it was a way of stealing his money!!. My husband is getting old and the boss is trying to abuse him by stealing him the money of salary. Besides the boss (mananger of car repai shop) blames the financial crisis for this change.. but he employed more people! and work production seems the same.. no less. My husband have been working in there for almost 14 years. My question is: Could he ’sue’ his boss… for discrimination, I think this discrimination is because of course my husband is not as young as he was when he started in this job of car repair technnician. He is certified technician… has to paid to his certification classes every year, and pays by himself a lot for tools.. and earning 350.00 per week is absurd!~… he hasen’t leave because first we want to know his rights.. but don’t know where to go. Also the boss cancelled his vacation week and said to him won’t paid the one vacation week.. my husband for many many years …usually had. No medical insurance. Nothing. WHere can he complaint??? can he sue his boss for abusively….. changing the conditions of payment and vacations?.
Thank Judith, yes I know he should start looking for a new job, the point is does he still have any rights to claim something legally.. despite there is not contract at all… I mean because we have civil rights I guess.. he has been discriminated because his age, he is not as young as 14 years ago when he started in that job… so of course he is not as productive as when younger. He never agree to the change of method of payment, he is pist off they cancelled his salary…. how can a company do this?.. there are not civil rights for employees?

Can someone sue me personally if they were injured during my work with a company vehicle and already got a settlement from my company for damages they said they had? Question is my company paid someone for alleged damages sustained to them and their vehicle now they’re wanting to sue me for attendant care etc when they got a scratch on them and already received money(s) from my work. Or do they have to go thru my work, The letter said "please give this to your insurance company immediately"so i gave it to my work since I am covered on their insurance when using their vehicles since I drive for a living. Plus I am in the middle of filing bankruptcy so should I tell my lawyer about this also ?

Hey everybody,
I’ll be 23 in a few months. I’ve already been married & we bought a house [but due to a pipe busting in the winter & causing a ton of mold & then five trees falling on the house in a wind storm that the insurance company did not want to fix], the home ended up going into foreclosure. The loan was not in my name, however my name was on the deed. I’m not married anymore & the last time I checked my credit, the house did not show up but, I think that was before it was actually foreclosed on.
He & I have two credit cards [probably 00 of debt total] that I have to pay half off of [so, about 00 right there.]
Then I have a Kohls & Macys card [about 0 total].
Then I have three other items that are not credit cards that come to about ,050.
Total, I have just a little under ,000 worth of debt which I know doesn’t seem like much but, after I deduct all my bills, I don’t have much money left. Things keep popping up left & right like medical expenses & tires for the car, etc & whenever I think I’m starting to get ahead, I end up even further in debt. I already have two jobs, I already save as much money as I can. Every bit of debt that I have has already gone to collection agencies so I can’t go online & pay on anything.
I’m just wondering if [since my credit is already horrible] I should just file for bankruptcy. If I did, would the foreclosure still show up [assuming that has affected my credit]? Would it be easier to rebuild my credit after bankruptcy or repair it by paying everything off? If bankruptcy is my best option, how long will it affect me? Will I be able to rent an apartment? What if a few years from now, I want to buy a house or condo? If bankruptcy is not my best option, is there any programs that aren’t scams that I could use to consolidate or something? Not sure if this makes a difference but, I do have a 2007 car that I bought brand new. I have three years left of payments & I’m current on it. I’m thinking about trading it in for a vehicle with AWD.
Serious answers only please. I’m trying to figure out what steps that will help me further myself faster. Thanks in advance.

im in the process of buying a modular home to put on my land, i got approved but havent signed anything. im 23, i just crashed my ,000 truck, into a ,000 dodge towing a ,000 trailer. no insurance! big time restitution im guessing when i go to court. im wondering if i should get the house while my credits good, and file bankrupt on everything else afterwards. any ideas or suggestions would help

PLEASE READ THIS DETAIL! I really need advice…
Just today while my mom and I were in the car, we just came from the grocery store and were talking. We talked about how the people on section aid and government aid were able to get SO MUCH food, dress better than us, and even sometimes live better than us. We live in a nice city bungalow home in a nice neighborhood next door to a University, but I’ve noticed that getting groceries every month is a struggle with all the bills that needed to be paid and any other additional thing I might need for school, etc.
My mom has a job that pays quite well per hour, but they tax her A LOT. She is taxed for senior citizens (because in the past her job took out money from the previous employees pension check so now the current workers HAVE to take out money for their wrong doing), taxed for city, state, pension, and the optional dental and doctor insurance (but who wants to live without those necessary things!?). So by the time she receives her first check, it ALL goes to the mortgage bill for the house. Her second check goes to house hold bills (light, gas, water, telephone, cellphone, car, etc.) Leaving us with very little money to live off on. She has tried receiving some kind of government aid to help pay for the gas and light bill, but they said she was making too much money…which isn’t true AT ALL. They’re not looking at how much she’s being taxed and how much she has to pay for bills.
Anyway, my mom got upset and told me, "Once the job lets me go (they are firing her on my birthday because of the ‘financial crisis’) I will blow up my credit card and pay off the house, the car, and some of your college tuition for 2 years. After that, I will file for bankruptcy because I’m tired of doing the right thing, but get nothing for it. I’m always getting screwed over. We have to work REALLY hard to get just what we need when people on section aid and government aid don’t have to work as hard to get what they need or WANT." I explained to her that her credit score was PHENOMENAL and she shouldn’t make that decision because she worked YEARS to have such a great score. But she said she didn’t care. She was tired of it. She said it wasn’t going to affect me in any kind of way so why should I care? …I got really sad and wanted to cry to think that she wanted to give up like that and even think negatively like that, but could you blame her? My mom has always made the right decisions financially. She bought her first house when she was 18 and has NEVER missed a payment on it. We lived there until I turned 12 and moved to another house with a better neighborhood so…i don’t know what’s gotten into her.
What should I do? Is it in my right to tell her to make a better decision? I’m a senior in high school so what can i do?! I don’t want my mom to stoop so low….please, help me. Serious answers, plz. :’(

My interest was sky high but I didn’t care at the beginning because I had no idea what I was doing. I paid a very large amount per month and then after about a year, I lost my main job. A few months after that, I lost my other job. I now was collecting unemployment and went through HELL to make sure that car was paid off every month. I started making late payments and my life was just a mess because not only did I have to pay for that car, I had the insurance, rent, etc. I was no longer able to pay my car and that day came when Mr. repo came knocking on the door. They took my car after 2 years of me working my butt off and they auctioned it off for SO cheap (almost had a heart attack at how much they sold it for!)
This was in 2008 and 2 years later, I’m still struggling financially in more ways than a hundred lol…I have really bad credit, I can’t even open a bank account and I feel like my once so organized and amazing life is now totally off track. I don’t know what to do. These are my questions:
1. If I open a bank account, can my lender seize all my money? Not a savings, a checking account.
2. Being that I did not pay the upside down on the car (,000) should I file for bankruptcy and is it too late to do that after 2 years? And for those who want to suggest that I pay off the 16 grand, I’m not because I’m not going to pay for a car I don’t have anymore and you might say well you’re stuck with it you should have never bought a car you can’t afford I don’t want to hear it because you don’t know my story. I want serious answers, not answers that are going to sound mean and not help.
If there is anything that I’m missing? Please, any advise would be GREATLY appreciated. Thanks in advance

Can you add expenses that an ex keeps taking you to court for. Such as, medical reimbursements, orthodontic care etc….particulary when the ex changed the insurance so that a large deductible applied and never advised you of that fact….pocketed the difference….or signed a k ortho contract without your input or approval?

Our (chapter 13 bankruptcy) attorney failed to subimit documents to the court. He directly lied to us and told us that he did. We’re in the last year of bankruptcy and in need of purchasing a car. And just for everyone’s edification… it was not because we had out of control debt. It was because we had a child that was born with extensive medical needs far and beyond our insurance and the fact that I needed to stop working for 3 years. It was all medical debt.

I have like a 10,000 dollar accident debt from getting in an accident without insurance. I was under 18 at the time and my parents filed bankruptcy but it came back to me when I turned 18. I plan to file bankruptcy because with the amount and the interest on that amount it would take me way to long to pay that off…but I was wondering if I should load up some credit cards or something before I file, just to get something out of it. My credit bad already apparently so it doesnt look like I can get any credit cards or even loans. Any advice?
Im only 18 and I feel like these are my prime years, I dont want to work full time for free basically to pay off some stupid debts. I would rather pay the 1,000 dollar bankruptcy and deal with bad credit for awhile. I guess Im more so asking if theres anything I can do before that to get something out of it.
I dont know how it came back to me, but my mom sent the a letter to the judge showing where in there bankruptcy thing it showed it got rid of that debt but they still said I was responsible.

I was told by a car dealership salesman that the only way I could get into a car was through a lease, so I did. I have not had the vehicle for a year yet, but have put about 40K miles on it and am having a difficult time making the lease payment and paying the considerably higher insurance requried. I want to turn it back in, but am unsure about how much money they are going to try and bill me for for the mileage and wear and tear, and a host of other penalties etc. Will they put a lien against my home for this, garnish wages, etc.? Would filing bankruptcy before turning it back to them protect me from this? Would a bankruptcy be better than a repo on my credit history?

I have about 23,000 in unsecured credit card debt. I recently lost my job and had to take one making a lot less per month. I went a debt consolidation program that got my payment down to about 700.00 per month. The problem is i am only bringing home net about 1200.00. I then have a mortage utilities and insurance etc so i am running in the hole. Is debt settlememt a good alternative. I do not want bankruptcy . I know settlement will hurt my credit score but at this point I need a way out. I have heard that settlement companies make you hold off on payments and the credit card companies will keep hounding you? Is this true? Does anybody have a suggestion to my dilema

I would like to get my husband’s business name secured and him have insurance, etc so when he does side work, he is insured, etc. I am just wondering if it’s okay to go ahead and set up an LLC if I am filing for bankruptcy soon? I don’t even know if he’ll do any work under this name before we file but I just wanted to secure the name, etc. Will they frown upon this even if the business doesn’t make any money? We want to do everything we can to pick up our income since obviously (provided by the fact of filing BK) are struggling tremendously? I just don’t want creditors attacking our business? I wish I didn’t have to file BK but we are left with no other options. We can barely afford our home anymore so I can’t pay these poor people back. My husband’s pay got cut in half several months ago and there was no warning at all. We are lucky at this point that he has a job at all compared to many others out there. I am hoping this side work will help us in the end and potentially even not be able to file BK and make settlements. Sorry…that is O/T. Do you think I should go for an LLC…it costs to file it as such and has many benefits. Thank you.

I have at least -10,000 in collection debt. I was in a car accident last year that my insurance refused to cover so there’s additional medical and court costs added on there somewhere. I have no job, no license to get to work ro anywhere. I want to file bankruptcy but I keep hearing there are all types of fees and payments. I have {content}. No savings or checking, I own no house or car. Nothing. Someone please direct me in the right place? There has to be some place out there that helps people in my situation. I live in Chicago IL if that makes a diffrence. And I have searched online and got no where.

I have found many hosting companies, like X-Drive, that offer online file backup. what I want is a guarantee, by, say, a major insurance company, that insures that if a company goes out of business or files for bankruptcy, the files would not get lost.
this should be offered, but it seems none of the major file storage sites bother either offering such a guarantee, or fail to mention it in the FAQ or promotional material.

My wife got in a car accident with a semi truck. Those roaches claimed 68K to their insurance agency. Our insurance only covers 25K. After the fact of what the 25K will pay for we’re getting sue papers for 30K. Can we file bankruptcy now or do we have to go to court first to get the judgment then file bankruptcy? YES YES YES I know how long it will be on our credit and all that but I we could care less. We don’t want to pay for a BMW and not drive one.
Also, all I own is a 1972 chevy truck (not restored, worth 2,500), no house, no savings account.

I filed for Bankruptcy in California in 2004. I have just found out when trying to refinance that there is an abstract judgment filed in 2001 in Orange County. 2 part question, Should/Can I file a motion to re-open the chapter 7 and try to include the judgment and have removed? approx cost? The judgement was for ,500. I need the lowest cost option to remove the abstract judgment/lien.
Do I have any recourse on my title insurance because I wasn’t aware when I purchased my home in 2008 there was an outstanding judgment and was under impression the BK included everything? (The BK was due to medical emergency at the time, orginal BK attorney no longer has paperwork)

Since you can pay 00 to the federal government and just buy insurance when you need it why would anyone pay over 00 a year for insurance?
