Is selling and then leasing back my home that has no mortgage owed a good idea when filing for bankruptcy? I would be financing the home. And then renting it in order to keep my place of residence. Can they take your furniture and everything in the home to pay back the creditors?

I am going to be filing for bankruptcy and was wondering how long into the process since I am behind on auto loan payments, will I hold onto the vehicle? Meaning when does the vehicle get taken away during a bankrutpcy? Its my only means of transportation and have read I will have to wait till bankruptcy is complete to buy another vehicle which is anywhere from 4-6months and I live a bit far to walk to work. I just need to know some more information. thanks!

This is more for my friend… She is in the middle of filing for bankruptcy, has horrible credit, and no money… She is also on psychotropic medication that she has to take, and I’m worried about her if she can’t pay for her medication.. What do you do in this situation?

if someone had filed in 2003 for instance how long would it take to refile? I gave this example because I have heard that the laws have changed in recent years. Also, can anyone give me some examples of the side effects this would cause by filing for bankruptcy a second time and is it much more difficult when you file again than the first time? Please help. I need advice. I’m looking to buy a vehicle from someone for 00 this week because I have no way to get to work and he needs the money ASAP or else I’ll lose the opportunity. I have horrible credit (or else I would finance through a car company) and I’m planning on filing for bankruptcy (first time) in the next few months (due to many, many things going to collections).
I just realized today that if I buy this car and then file bankruptcy (Ch. 7), they may be able to take my car, even though it’s worth maybe 00 (it’s a ‘96 Jeep Cherokee). I then thought, well, what if I try to get a loan through a bank to pay it off? I only make about 00/month (when it’s loads of overtime) so I can’t afford to pay this person unless I get a loan of some sort.
My question is, if I get a loan, buy the car and THEN file for bankruptcy, can they take my car?
OR if I somehow come up with the cash and buy the car and THEN file for bankruptcy, can they take my car? Like I said, not worth much.
Any advice would be greatly appreciated. Thank you.

Okay my question is if i file for bankruptcy will i stop getting collection notices and calls from a collection agency.
See my case is i have a kidney transplant and when i moved to Seattle WA 3 years ago. The insurance here didn’t want to cover me for my medication(because they were to expensive) and doctor visits. So i got a debt from the hospital of almost 00 dollars. But right now i haven’t work in almost a month and the agent told me that if i don’t give a payment their going to take me to court.
What should i do? Will filing for bankruptcy help?

So recently I have posted a car on eBay. It went up for the seven days that you have to bet on it but none of the bids went up to my price standards. The last bid was 12,500 and I was specifically asking for 20,000 because the car is not even worth in the 12,000 category, The title is in my hand I paid off the car so its not taking over payments situation. So the bidding ended and I refused to sell it to the last bidder and I filed a refusal case on eBay to not sell it to him, but the guy was threatening me if I didn’t sell it to him he would sue me. Cops were involved and i don’t know what to do if I have to sell it to him or not. In addition I’m only selling this car because I need to pay of debts and I’m also filing for bankruptcy and I can’t deal with this guy threatening me to sell him the car or he will sue me. What could I do? Please tell me as soon as possible.

I just heard today that my parents might file for bankruptcy and I’m very worried. I heard that there are different "chapters" for when you file for bankruptcy My parents tell me not to worry about it and its not that bad, but I can stop feeling concerned.
Can someone please help explain to me what the effects of filing for bankruptcy are and what are these "chapters" Thank you.

I’m struggling to make my loan payment and 3 credit card payment I’m filing for bankruptcy next week so when can I stop paying them I cant afford it because I am unemployed When I was working I was fine and then i went on disability all of 2008 i was still fine and been on unemployment since April now it hard because I have a little girl have to support and now i cant make this payment no long so when can I stop paying i do want to get in trouble i’ve never did this before

I am filing for bankruptcy and was taken to court for about 1400.00 in credit card debt about a year and a half ago. I currently pay on it monthly as instructed by the court. Would this go with all of my other credit card debt when I file? Or will I have to continue to pay on it until its paid in full since it was taken to court?

Here it is, I was considering filing for bankruptcy and found a firm online that offered a free initial consultation. Half way through my initial consultation I was asked to pay a 0 down payment for a retainer fee for this firm to file bankruptcy papers for me. The phone call lasted about 1 hour. After hanging up I read some info that the bk attorney emailed me and decided that I was not ready to file for bankruptcy. I called the firm back asking for a refund as I had changed my mind, it was less than an hour since I hung up from my initial consultation, so I didn’t really expect it to be a problem. The attorney told me they would not give me a refund & if I tried to stop payment they would sue. Well, I hung up, called my bank and stopped payment and now 2 weeks later they are calling me and threatening "legal action". My question is should I really have to pay them? They didn’t do anything other than the initial consult which was supposed to be free.
I live in California and I did not sign anything. I was not even sent anything to sign. The reason I say he did not do anything is because I did not sign anything that would allow him to start paperwork on my behalf. And as he did not set up any future appointments with me I fail to see how he could have turned down any other clients due to my "retainer"

I’m curious why you think I’m in the wrong. Doesn’t a customer have the right to change their mind? Especially within a 24 hour period?

I know that it is strict when entering the federal building. Can I go inside there with my fiance if he is filing for bankruptcy. Cause they asking why are you there.. Can I go with him or only him because he is the only one who has business to take care of there. Thanks

My wife is filing for bankruptcy and one of our creditor’s is Kay Jewelers. We bought our wedding rings through them back in 2008. We received a letter in the mail today saying that they may have a non-dischargeability cause of action against us if we don’t turn our rings over, which we really don’t want to have to do. I know that it seems like the sensible thing to do and we can’t really afford to pay off the debt. Is there any alternative to giving the rings back or paying the debt?
Thank you all for answering so quickly. First, I am not on any of her loans/ debts so it wasn’t really advisable that I file as well. The only thing I have in my name is my student loans and our car (which the person who helped us file our paperwork said we wouldn’t need to worry about since the title is in my name). With that said, while we were filling out our paperwork, there is a section that you get to put items that you would like to have exempt from the bankruptcy i.e. jewelry, clothes, electonics… and you’re allowed up to a certain value for each item. Our rings fell way below the limit so we were told that we could keep them. Lastly, and unfortunately, it was a secured loan so they are saying that the rings are collateral and they have the right to either take them back or have us pay it back.

I am pretty much broke and tired of creditors harrassing me and my job. I know I messed up when I was younger. I was trying to pay them all off but it seems to me the more I try the more I owe.
I was looking into bankruptcy to give myself a fresh start, but it seems everyone that could help me charges at least 00.00… tell me if i am filing for bankruptcy how am I supposed to pay that.
I am looking for someone who can take care of this right away without costing me thousands of dollars. I live in the clearwater area off US 19…PLEASE HELP!!!!

I am 17 years old (6 months shy of 18!), and I need money.
My family is filing for bankruptcy and I’m going to need to make some money to pay for college books and other (social and recreational) expenses. However, I get sick a lot and have a weak immune system, there are no jobs available in town, and I have no source of transportation. Working for a company online would be ideal for me. I could do it whenever I want, wouldn’t have to worry about being too sick, and countless other reasons. However, I can’t seem to find anything that suits me. I’ve looked at survey sites, but they all seem to be hours of work for 50 cents. I want decent pay for decent work. I don’t expect to "get rich quick" or anything like that, I just want a job that will pay at least 10 dollars for an hour’s work (as my friends who work at fast food joints get paid at least that much).
So basically: Decent (or well) paying job online available to a 17 year old that isn’t too much work for not enough pay. Is there anything out there for me or am I just dreaming?
I would also like to acknowledge the fact that I’m not looking for snotty remarks and worthless answers. I am aware that there are scams and pyramid schemes and stupid crap like that, I was asking whether or not there are jobs available online. I know for a fact that people work online (my dad’s friend Doug works online for an advertising company, he does graphs and calculations and that is a part time job for him), I was just wondering if any job like this existed for someone under 18 years of age. I’m not sure if "freelance" would be the right term, but I’m looking for something similar. Please refrain from comments that imply that I’m naive or stupid, because I am not and it just makes you come off as a judgmental and inconsiderate member of this community. Thank you.
I worked at a magazine for 7 months on a paid internship. I imput data, called advertisers, did research related to the magazine, formatted certain articles and edited many. I am a published writer as I have both a published poem and published articles. Those are (some of – I can’t list them all)my qualifications/experience. I don’t mind imputting data or doing mundane things like that, I just need a job because my family is desperate.

Has anyone ever heard of/done classes with Online Trading Academy? Is it a good idea? I’m an 18 year old who’s just started college and living with my parents…they’ve been through a lot financially in the past 2 years and it’s come to the point where they are now filing for bankruptcy…I’d really like to help them out and I don’t think a part-time job will be enough. I’d like to get into the stock market but with college I don’t really have the time to bury my head in books at the library trying to learn the stuff myself…is Online Trading Academy a good idea?

My b/f is currenty filing for bankruptcy. We got credit cards when we bought our house and we just got way out of hand with them and are now in alot of financial trouble. There are about five cards out of the many that I am a "joint" user on with him. We didnt know the difference between joint and authorized user when we were signing up for the cards or we would have never put me on as a joint with him. Im afraid that the creditors are going to come after me once the case has went completely through, because according to what I have read online they are allowed to. Is there anyone out there in this same situation or anyone that has went through it?? His lawyer told me that they dont always choose to go after the joint user but if the debt is over a thousand dollars they may. Is it true that they can not go after me if I am unemployed?? We had thought about filing together in the beginning but we are not married so we were not allowed to do that and would have to pay for two seperate filings when most of the debt is only in his name and about 6500.00 of it is in mine….

Car accident with no insurance, over ,000 in debt, what should I do?
I was leasing an ‘07 BMW and back in November of 2008 I was in a car accident a few days after my insurance ran out. I paid for my insurance up front the last time for a year, therefore because of some circumstances, I was unaware that it ran out when it did. Not saying it wasn’t my fault, but that’s the truth.
Anyway, like I said I was in an accident and it was MY fault. The other guy had a Saab and the damages to his car were about ,000. The damages to my car were about the same. Bmw has sent me a couple letters, but I haven’t spoken to them yet. I made a plan with the other guy’s insurance lawyers to pay them like 0 a month for the next twenty-some-odd years! I am definitely not in the same financial situation that I used to be in (it’s a long story). I’m basically broke. I want to know if anyone has any advice as far as filing for bankruptcy goes? Can I even file for bankruptcy under something like this? Or will I completely lose my license? Or do I have some other option to lower something? I am unemployed and have no assets. I am only 22. Someone please help me with some advice! I was stupid, I want to change, thank you for not judging me and giving some positive advice.

The number of people filing for bankruptcy protection in retirement has soared in recent years — even before the recession.
In fact, people 65 and older are the fastest-growing segment of the population seeking bankruptcy protection, according to a recent study from the University of Michigan Law School.
The problem is simple math, said Johanna Sweaney Salt, a CPA with Kaufman, Schmid, Gray & Salt in Claremont, Calif. Their medical expenses, taxes and other costs keep going up, while their income is going down. Social Security hasn’t had a cost-of-living adjustment in a long time and pensions and retirement accounts took a huge hit during the recession. Reverse mortgages and other alternatives presented to them as "solutions" often just dig them further in the hole.
"Most people think ‘Oh, I have Medicare — I’m covered,’" said Jean Setzfand, director of financial security at the AARP. "But in fact, there are quite a lot of out-of-pocket expenses — and those continue to rise." The biggest one, she said, is long-term care costs. Plus, a lot more people are going into retirement carrying a mortgage. So it is not so good as we think
