My husband I are going to be in the process of filing chapter 7 tomorrow when I drop off our payment but had a question.. How will they tell which creditors to notify of us filing bankruptcy when we dont receive actual statements since most of our accounts were on paperless pay online type of things and when i log on they disable the accounts and ask to call them, and I cut up all the credit cards.. can they do a credit check and notify my creditors that way? I’ve never gone thru this before and curious how they would do that since we have sooo many creditors and hard to keep track of who we get statements from and who we dont thanks

I am currently being sued in civil court, and have no money for an attorney, the case has gone on for a year now in federal court, and have basically lost my business because of all the time I’ve put into defending myself from something I did not do, and am being "lawyered" to death by 6 lawyers. Because of all this, even if I "would easily win" if I could afford an attorney, I will have to file bankruptcy (chapter 7 for me).
Therefore, relating to an ONGOING CIVIL case and a need to file BANKRUPTCY, here’s my QUESTIONS if you would please use the same numbering system to answer them so I can keep track (thanks thanks thanks):
I would LOVE it if filing the bankruptcy would END the case so I could go on with my life, find another job, build another company etc. I read a lot of yahoo answers and one said “If they haven’t gotten judgment against you … then your bankruptcy filing can and will stop the case.”, but I need to be sure.
1) is there any ADVANTAGE to me in filing bankruptcy BEFORE the judgment (now is preferred so that I can go on with my life which has been destroyed)?…. and what will opposition do if they know I’ve filed for bankruptcy? Will they attempt to continue the case when they know the bankruptcy will go thru? If so, why would they continue the case?
2) Since I’m going to be filing In advance" of the judgement, can I "claim" the "injuries" they haven’t yet enumerated " …on my petition for bankruptcy? …or do I just “list the case” and say “amount pending”? THANKS.
I know about the "automatic stay" (keeps creditors (I currently have NONE and a perfect credit score I’ve worked hard to build all my life) from coming after you etc).
3) After I file for bankruptcy (I know it takes so many months to go thru), these additional related questions, thanks:
3a) what happens to the current civil case?
3b) what do i tell the judge? Do i have to tell the judge or just inform the other side?
3c) will i still have to finish the case (expected one more year of my life)?
3d) if we’re currently in discovery, will it / can it stop discovery / subpoenas etc?
3e) ….or…does it just “suspend” the case until the b/k procedings are over? …or does the case just continue on in real-time?

Me and my husband are wanting to file bankruptcy. He is in the military and we have a lot of "allotments" (where money comes out of his paycheck automatically before we see it to creditors) How long will it take after we file bankruptcy until we are no longer obligated to make payments to these creditors or when can we stop the allotments? Does it happen as soon as you file or what?
Also, Does filing bankruptcy effect you being able to rent a house/apartment?

Can someone sue me personally if they were injured during my work with a company vehicle and already got a settlement from my company for damages they said they had? Question is my company paid someone for alleged damages sustained to them and their vehicle now they’re wanting to sue me for attendant care etc when they got a scratch on them and already received money(s) from my work. Or do they have to go thru my work, The letter said "please give this to your insurance company immediately"so i gave it to my work since I am covered on their insurance when using their vehicles since I drive for a living. Plus I am in the middle of filing bankruptcy so should I tell my lawyer about this also ?

I purchased a vehicle over 5 years ago and the vechicle was almost paid off, then in July of last year I stopped paying on the vehicle because I am struggeling financially. I received a call from a man saying that he was an investigator and that he wants 1600 within five days the first 800 must be paid today or I must surrender the vehicle. I am in the process of filing bankruptcy but have been unable to reach my attorney to find out if I should pay them. I will have to borrow the money to pay them. I know the loan is charged off and have not yet filed the bankruptcy. Will be filing Tuesday. What would you do? Need help. Also when I try to get somehting in writting from the man who claims to be an investigator he gets really angry and says I ask too many questions and that he is doing me a favor. I live in CA

I have a bachelors in business finance and I will complete my MBA next month. I was laid off about 20 months ago. The same week I was laid off I found out my wife was pregnant. We now have 3 children. I was eligible for unemployment and it did not last for very long. I then picked employment where I made 60% less than I was previously making to make ends meet. I now have gainful employment and I am making about 15% less than 20 months ago.
My wife and I will have student loans coming due in about 6 months and I am considering using my credit cards to payoff auto loans and other secured debts that are in both our names. When the student loans come due we will not be able to pay all of what is due every month with no end in sight. After being unemployed, we did very well keeping our heads above water however we are now feeling the pinch of our delayed situation. We feel if bankruptcy is our only solution we should use our credit cards to pay off everything.
We are considering filing bankruptcy under one of our names and NOT a joint bankruptcy so as to avoid having to forfeit any assets like the autos, etc. If we do this we should be able to retain all assets because it is not a joint filing. All of the credit cards we would use would be in wife’s name. Are there any issues with this?

The parent plus loan was for my education in the amount of 18,000. Will they make me pay it or does the loan get erased or something because he is filing bankruptcy?

When my ex and I split up and child support was set up, I made a budget that fit the income. After a few years, my ex quit his job to get out of child support. After finding where he was working and turning it in, he would quit again to move to another job. I used my credit cards to fill in the missing money thinking i would pay it off when he started to pay again. Well that didn’t happen. Now I am filing bankruptcy after cutting everything we used to do out. I will be able to pay the bills with my own income when this is through. My daughter sees that I am stressed and hears the collections calls. Do I tell her the whole truth? I don’t want to seem like a complete failure in her eyes like i can’t handle money and she lost everything she used to do because of my incompetence. We wouldn’t be this bad off if he didn’t run from his responsibilities. But I don’t want to make her hate her dad.
She is 13 years old. Her Dad rarely sees her because it is now his turn to enjoy life since he started to have kids at 20(he is 42 now- and that is a quote from him) He has a 21 year old son from a first marriage living with him who he makes pay all the bills in their house. That son is going to move in with me next month because he has been wanting to go to college but hasnt been able to since all his money goes toward the household expenses(he works 60 hours a week at a little more than minimum wage and he is not my biological child)
This is for the people who asked how much he was in her life and how old she was.

My ex and I are still married, though we’ve been separated for over 2 years. We bought the house that he has when we were married, though my credit was iffy at that time and I am not on the mortgage information.
I am severely in debt and am looking to file chapter 7 bankruptcy. I am on the deed to the house, but not on the mortgage. Does my filing bankruptcy put the house that he lives in at risk? Also, I’m filing for divorce on Tuesday and am giving him the house in the divorce.
I want to ensure that if I go into bankruptcy court they can’t take my ex’s house from him. I am also on the joint bank account that he has, but I’m going to go to the bank with him shortly to have my name taken off of it.
Any information on this would be appreciated. If I sign a quit claim deed for the house does that stop them from being able to take his house? What’s the process?

but what happens if I file bankruptcy and he doesn’t? Will they go after the home to satisfy my debt? He has some equity in the home, but I’m not sure if it’ll be enough to cover all that I owe.
I just don’t want to make this divorce harder than it already has been.

I am in the process of filing bankruptcy, getting the paperwork together and such! I was served papers to appear in court over a defaulted credit card. i keep getting conflicting information. my car was paid off in full on one of the credit cards i am filing bankruptcy on. so i own it outright. it is my only car, it has a value of 7-8500 depending who you ask. if i filed 7 could i keep my car? obviously i would rather file 7 then 13.

I am working on paperwork to filing bankruptcy. My attorney wants me to list all my creditors. Thing is, most of them were charged off three years ago and now belong to collection agencies. If I list my original creditors in the bankruptcy, will the collection agencies still have the debt, and will they be able to harass me? That is to say, will the debt really be gone?

My husband and I are going to file bankruptcy as soon as we can get the lawyer money together. We have decided to voluntarily surrender our house to the bankruptcy and get a clean start. We are trying to find a place to rent now, that way we don’t have to hurry later. Should we tell the landlord that we are going to be filing bankruptcy? Also, are there any ways to help persuade the landlord that we will not default on our lease, in any way? Please, no comments on how filing bankruptcy is the worst thing to do. You don’t know our situation. Any suggestion are helpful, but please, no snide remarks. Thank you in advance.

I have improved credit after filing bankruptcy about 5 years ago . I was able to secure auto loan and capital one card , but I find I am desperate for small loan of about 1,500 and most payday loan places offer a max of 800.00 in our area. I am also very scared of all the online fast loans due to scamming for information .Any ideas?

I am going to file chapter 7 bankruptcy in Maryland and I have a joint credit card between myself and my son. What I would like to do is keep the credit card so I still have something for emergencies after I file bankruptcy. Do I have to list the joint account when filing bankruptcy? Because I would like to keep it open and keep making the payments as usual, and if I did list it could that effect my sons credit, even if he makes the payments, since he is joint on the account?

Due to my ex-husband being a co-debtor on some medical bills for our 2 sons, he will be receiving a notice that I am filing bankruptcy. I do not want him to know my business because it’s his fault I’m having to file. He has to receive the notice by law since he is responsible for 1/2 of the medical bills (which he never pays). During the divorce he was ordered to pay on a credit card which my name was listed first. Well he never paid and know I’m being sued for k. I had no other options but to file for bankruptcy. I filed today and he will receive a notice and become privy to my filing for bankrupcty. I know he will call me and give me crap. I don’t want to deal with him. I would just like some good come back to say to him when I get the call!!!!!

I received a notification in the mail that my wages are being garnished by a credit card company, for an outstanding debt. I cannot afford for this to happen because I am a single mother of my daughter. How much or what percentage can be garnished? I live in Maryland. I read on a website that they can take all but 0 of my check a month. Is this true? I am currently unemployed but I have had numerous job interviews. I assume that once I become employed my wages would be garnished immediately. I am thinking of filing bankruptcy because I have other credit card companies that will be coming after me for money that I do not have. I heard bankruptcy can be filed online to save money for a lawyer. I do not have money to pay a lawyer. PLEASE HELP!
Yes, I did have a court date but I did not go because I knew I owed the money and I did not have the money for a lawyer.
I’m afraid if I don’t file bankruptcy I will have no money left to raise my daughter. I owe about 00 to different credit card companies. Can they all garnish me at one time? If so, I may not have enough money to get my daughter what she needs.

I am currently am not living with and about to file for legal separation from my husband. He just told me he is filing bankruptcy, he owns a construction company that’s had a hard year. We are not ready to call it quits yet and divorce, but I want to protect myself. We have no joint accounts and my name is not even on the house he’s living in or associated with his business. Even if we get a legal separation will I still be affected by his bankruptcy? We live in Oregon.
