Here’s my situation. I was on the top of the world before I even turned 21. I worked so hard to accomplish my financial goals of basically owning my own house and own vehicle before my 21st birthday. Some where down the road I got lost… The great job I had to get the house, I had to eventually step back from to take a slightly lower paying job that offered insurance. To make a very long, struggle-filled story short. I lost everything. And when I say everything, I mean everything. My then fiance` and I split, needing to find our selves again. My new job wasn’t what I thought it was going to be. I inevitabley lost my house, my car, and had to stop making payments on all my credits cards because I quit my job to move across country (with my now husband) who is an Active Duty Marine (now deployed
). I know this is all over the charts, but since my husband is now gone, this is giving me a lot of time to fix/figure out our financial situation. Since my credit score is basically at the lowest point possible now, which bankruptcy should I file for? How does Chapter 7, 11, 13 etc work? My husband does make a decent amount of money, specially being deployed now. But really only enough to pay the bills and pay down his credit. Any and all information on this would be great.

Thanks KMcG. Yes – I am aware of th 7-10 year rule with bankruptcy. We’re even considering staying in the military (boo) to bandage all our debt.

I know that it is strict when entering the federal building. Can I go inside there with my fiance if he is filing for bankruptcy. Cause they asking why are you there.. Can I go with him or only him because he is the only one who has business to take care of there. Thanks

Ok,I’m 25 and I just got a 04 Pontiac Grand Prix with 112,109 miles on it,for ,000 but got slammed with a 21% interest rate. I tried before hand to get a lender/bank/credit union going in but No one would fiance me because I have 540 credit score. I had to take the deal because the truck I had was a gas hog and was falling apart and I need a way to get to work, so I sold that to get the down payment for the Pontiac.Here the issue,I have had it for 3 months and I have no problem paying the car note(1-a month) but when the economy shot 2 year ago and my job gave pick slips to me and hundred of people,unfortunately I had lost my home and voluntary returned a 02 Monte Carlo to the bank.As you may know now I have a for-closer and an repossession on my credit which is the reason for the low score. I currently have had a job now for the past two years so I making it even tho it get ruff at times with other things like college and apartment bills. I cant find any lender on the net to refinance a car with that many miles and it doest help that my credit score is so low. I was told that since I’m still young I should file bankruptcy to clear my dept and start over now. The only issue I have is I want to keep the car I just got but is there a way in the bankruptcy that I can keep the car and get the lender/bank to lower the interest rate so I can keep it?Or do I have to give it back or keep it out of the filing altogether? I’m a perfect example of bad thing happening to good people because I held a job all life and payed bills on time but you know what the say "sh** happens" Please provide me with some good meaningful advice .on what the best possible decision Thanks!!!

I have been forclosed and the defecit to the lender is to high I have no job after a divorce everything went to ground. I am planning to remarry , however I do not want my current bad credit to affect my fiance. would my old financial issues affect her immidiately after marriage? how to prevent that?
would that be better to file bankrupcy before we get married. what are the provision of the law ?

My live-in-fiance has HORRIBLE credit, & as of right now we are renting & financing 2 cars. Everthing including credit cards & cell phone contracts are under my name, eventually we want to buy a house, but either way we need to fix his credit. Alot of the debt is unpaid hospital bills (was unemplyed for 8 mnths & in those months he got very ill & no ins.) and some of the debt are from when he was younger & abused credit cards.
He owes a bank 0 & now cant even get a back account under his name.
I would say 1/2 of his debt is from 8yrs ago & the other 1/2 (hospital bills) are current.
My question is should he try to consolidate the debt or just file for bankruptcy. His medical bills are about ,000 alone. Misc debt is about ,000.

I had a woman call for my fiance’ who is currently in "A" school and not due to come home until next month, regarding his debt….I kindly told her that he was going to try to take care of it when he gets home whether with bankruptcy or making payments…etc….but that he WAS going to take care of it…and she told me that military memebers were NOT allowed to file bancruptcy….??? He has a good amount of unsecured debt (credit cards, repossessions, etc) and in order to get ahead was planning on filing bankruptcy to more or less "wipe the slate clean.." so the conversation with this woman made me a little apprehensive….

Well, me and my fiance have been living in our first home (a double wide trailer) for 3 years. We have kept up with the payments just fine until we had to get this last loan out to cover the air conditioning (last summer). My fiance brings home about 5-7 hundred dollars a week depending on the hours he gets in. We even worked a paper route for about 6 months to get caught up with everything and it seems impossible. We dug ourselves into a deeper hole than we were in before and now it is reallly impossible to get out of. We have tried EVERYTHING to get back on track. My fiance just heard this morning after having a friend cosign for a personal loan, that we were denied and the cosigner had PERFECT credit. My fiances credit has gotten terrible since we bought this house and he is so overwhelmed with bills and working 12 hours 5 days a week that it is driving him crazy. He tried many times to get a personal loan/home equity loan and everything before he had tried to get the cosigner and those times obviously he was turned down as well because of bad credit. I don’t like hearing DENIED once or twice a week and seeing my fiance get disappointed. The loan he is applying for would be used to pay off all of the bills we are currently making monthly payments on and knocking the monthly bills from almost 500$ to just over 150$. Paying that one loan payment will make things easier for now and he can pay that off as much as he can, but the minimum would be a lot easier to keep up with. He is saying that if he can not find a way to keep up with things better, we are going to lose the house. I am unsure of what we could do and i wanted to ask all of you if you have ever been in a similar situation and if so, what did you do to get out of it when everything seemed impossible. We were thinking bankruptcy, but we don’t know how it works. I am hearing that you still have to make payments on your bills unless it adds up to a certain amount. If the current credit accounts do not add up to be enough, would foreclosing our house and filing that on our bankruptcy help since it would be a higher total of debt? I don’t know how this works and he can’t just STOP paying people because i know they will all take him to court and garnish his paycheck. Please give me some advice. Thanks

I am considering filing for bankrupty. I am 3 months pregnant and i will not be able to work after the baby is born. i owe about 18K. my fiance and i are getting married. i want to file for bankruptcy before we are married. after we are married would it effect him since i was in this situation before we wed? there is no way he would be able to pay all of my bills for me because he will be paying for rent food utilities and all other expenses for me and the baby. as for me, how long can i start building credit again after bankruptcy in new york city? if the court denies bankruptcy for me what other alternatives do i have. my fiance/ future husband cant afford to pick up all my bills for me. what i am really concerned about is is this going to effect him since this situation occured (will occur before we are married) how long does the process take?

My fiance recently got his credit report and has about ,000 in debt that he was unaware of. He’s been drawing disability for several years and has medicaid and medicare. The majority of his debt is medical bills that he thought the insurance paid for, but obviously it didn’t. About ,000 of it is basically identity theft. His former roommate opened up two accounts in his name and ran the bills up. We know he did it, but we have no way to contact that person. Well, my fiance decided his only way out of this is to file bankruptcy. However, he doesn’t have enough money to get a lawyer. Would he just totally be screwed if he filed himself? He doesn’t have any assets. No car. He rents his house. So, I’m assuming it wouldn’t be as complicated as it would be for someone with assets. However, I’m sure it’s no easy task either. Yes, I’ve heard the saying that if you represent yourself, you have a fool for a lawyer or whatever.. but we just don’t know what else to do. We have to get this taken care of before they start getting his pay check. He just started working again and isn’t drawing disability anymore so we’re really tight on money. Is there any way a lawyer could help him file bankruptcy and then we just pay the lawyer payments? I’m sure that seems pretty contradicting, but we could afford payments for the lawyer if we didn’t have all this other crap that we’re paying on.

My mom and my fiance need the cheapest way to file bankruptcy. They both qualify (done consults with lawyer who quoted them at almost ,000 to file). I can use all the help I can. Info on how to get what can be filed against, how to file (by lawyer CHEAP/FREE or doing it yourself), how to get the account info on everything that needs to be filed against (FREE PLEASE). My mom is without a job currently (looking for a new job) and my fiance and I struggle paycheck to paycheck with our baby girl. We need something that is going to get them out from underneath a WHOLE LOT of debt the quickest. We have no money.

My fiance (not sure on my mom) cannot do ANYTHING to pay back ANY of his debt! It is over ,000 (at least).
Also I see one answer say that "you WILL lose everything" well it is hard to lose everything if they have NOTHING! All he has in his name is a car (not worth anything according to Blue Book Kelly) and a bank account with NO MONEY in it anyway. His ex wife get 55% of his paycheck for current and back child support. I don’t know what is going on with my mom, I don’t ask anymore. But I know how it is with my fiance, we don’t make any money and we don’t have any money. He doesn’t own anything of value!

does anyone know if it varys depending on the amount you are filing for??? or does it depend on how much you make???
Ok, again, I am not the one filing bankrupcty, My fiance had to have surgery and didn’t have medical insurance so he is bombarded with medical bills, I am looking into options on this issue, the collection agency will only accept a minimum payment a month and we can not afford 400 a month.

I have really good credit. My fiance made some really bad decisions in the past and has terrible credit. (credit cards, overdrawn bank account car loan …..) We are buying a home . We are planning on getting married next year. I am wondering would it be better for him to consolidate his bills and us try to pay them off or should he just file banktruptcy? We plan on doing something before we get married. We dont have any savings and I have a child and he has three from a previous marriage that he pays support for. My concern about debtconsolidation is that we wont be able to make the payments with everything else we are having to take care of. How bad is a debt consolidation or bankruptcy going to look when we do tie the knot if I have really good credit. Also what kind of affect does that have if any on employment?
I am already buying a home so that is not an issue
I am also being told that chapter 7 and chapter 13 affects your credit in the same way and tat both stay on there for ten years
He no longer has credit cards or bank accounts. All of these things on his credit have been on there since before I met him. I asked for financial advice not for someone to make negative comments about bad decisions made in the past. As for having a budget we already live togather and pay all the bills togather We already have a home that we are buying.
We both work. Who doesnt?
