self filing bankruptcy or hire an attorney??

Really wanna file myself it’d save about 0, already went thru the debt counseling and they said I was a lost cause to pay it back due to being a single mom with 3 kids. so obviously if i cant afford my bills i cant afford to hire an attorney in time to save myself from further garnishments. But is filing it myself a good thing?? Most of the debt is from my divorce and since we didnt file while we was married they will fall back on him and not by choice. But maybe they can get their money from him since he does make over twice what I do. I hate to pin it on him but I need to cleanup my act and look ahead for the sake of my kids…anyone with a suggestion please. Need to file Tues!!!!

What happens to our apartment after we file bankruptcy?

My husband and I are currently living in an apartment and have been here for 6 months now. We have always paid our rent on time. We are now considering Ch. 7 bankruptcy and I want to know how that would affect our current lease? Do they typically run another credit report when they offer you a new lease? I’m worried about them finding out about our bankruptcy and kicking us out, but I’m told that most apartment complexes don’t run your credit again after they do so at the original lease signing so they wouldn’t know about the bankruptcy unless you told them.

I’m not happy at all about having to file bankruptcy, but I see no other option. A bit of background: My husband and I both have excellent credit scores (over 700) and we’ve always paid our bills on time. We have no problem paying back our debt, as that’s what we obligated to do. But I was laid off last year, have so far been unable to find a job, and my unemployment runs out in a few weeks. (unless Congress extends it and we know how that song and dance goes) We even moved to Washington from California when my husband got offered a job and I still have found nothing. My husband’s job is very good and steady, but if we have to live on his income alone until I am able to find a job, we would only really be able to afford our living expenses. Like many other couples, we need two incomes. I’ve considered and done a lot of research on debt counseling or Ch. 13 instead, but our monthly payment amount would have to be small, probably no more than 0/month, for us to be able to comfortably afford our rent, utilities, groceries, gas, etc. I don’t think a payment amount that low is possible, considering our combined debt is about ,000. (all unsecured credit cards) I keep coming back to Ch. 7 being the best option. I could consider filing Ch. 7 on my own if I’m able to, as all my debts are in my name and acquired before we got married a few weeks ago, and he could enter debt counseling for his debt. But again, his payment would have to be very low for us to be able to pay our living expenses on only his income. Discharging all of our debt and getting a fresh start seems like the best option. Does anyone have any advice?
In response to a previous answer, I was single when I was laid off and began receiving unemployment in May 2009. I just got married a few weeks ago.

When filing chapter 7 bankruptcy do I list now due property taxes as secured debt or unsecured priority?

This is an individual filing. I have had debt counseling and told that I need Chapter 7 because negotiating won’t help.

In debt really bad…considering filing bankruptcy..?

Okay, so I’m about 12,000 in debt. I have three credit cards I’m currently paying on. I called a debt counselor and was hoping they could lower my monthly payments. I pay roughly 300 dollars a month to all 3 credit cards. I only get 900 dollars a month, so 300 dollars is a big chunk to have to pay :( So any how, when I talked to the lady she said I would be paying anywhere from 300 a month to 350! That’s already what I pay now! I just thought that debt counseling or management was suppose to help people lower their payments! I’m just confused as to what I should do. Should I just file bankruptcy?

Bankruptcy?

After going to debt counseling,I had no option left except to file a chapter 7. Listed with my debtors are 2 payday loans,2 weeks prior to filing,I took out a payday loan for 5,yes it was stupid,but food on the table seem more important at the time.I called and informed them,that I had to retain a lawyer,and was informed that when I signed the contract I would not be filing bankruptcy within 30 days,and my attorney was a personel friend.I did not plan on filing,all other options were used up.Can and will this effect my bankruptcy? Also,the 2nd payday loan I borrowed from is a prominent member of the community,and told me he would get his $ one way or the other,even if it ment following my butt all the way up the court house steps.I am a emotional wreck! The stress of the bankruptcy has taken it’s toll,and now this.I will call my attorney on Mon.,but if anyone could help relieve some of this emotional roller coaster,I would deeply appreciate it!
