My dad owe ,000 to credit cards, lines of credit etc..
It all started when we bought a house. My dad was the only one working. After two months purchasing the house, my dad lost his job. So, hoping the he’ll find another job, my dad kept on paying the mortgage, property tax etc from his credit cards.
He did not find any job. My mom found a job but not a good paying job.
After 3 years, we couldn’t afford it and sold the house.
Right now, we live in an apartment. My dad is diabetic and has other medical problems and can’t find any job. Also, his language difficulty is preventing him from finding a job.
My mom works and its enough just for rent and food for our family.
My dad keeps getting phone calls from credit companies and stuff asking him to pay. My mom gives him 50 or 100 bucks per month to pay his credit cards but she can’t do this every month because she only earn that extra if she works extra hours. She has arthritis and her doctor told she shouldn’t work much.
My parents’ first language is not English, hence my dad has difficulties with English.

I was looking at consolidating my credit card debt into a newer home loan with New Day Loans. The fees were over ,000 and would leave me in negative equity on my home for years to come. I don’t want to live here another year. I am also planning to file for a divorce as well. I am not behind on any payments for anything, but I make many payments late, but rarely 30 days late. The new credit card bill rules increased my payments so much its killing me.
When is a good time to file bankruptcy?
Shoud I file on everything?
Should I file on just the credit cards?
Should I file before or after filing for divorce? Or shoud I wait until after I get divorced?

It’s an empty threat though because I’m not going to file really.
I’m trying to negotiate a ,300 debt for 0 – 00. I want to threaten bankruptcy as leverage but is this a good decision? This would be my line: "I am familiar with the law and know that I am ‘judgement proof’. If I file for bankruptcy I will claim all property as exempt, and if you sue and obtain a judgement you could not collect any of my property to satisfy the judgement."
Will this help? Can it hurt? Any other tips? Is there anything else I can use as leverage?
Here’s some background info: I’m not dealing with collection agencies so it hasn’t gotten too out of hand. I have about K in debt (K student loans, K credit cards). I’m working at part time jobs right now but when I do find work I’ll be making -K a year entry level in my field.

Can I just file bankruptcy? My husband is an authorized user on one of my credit cards, he has never signed anything. Can I have his name removed from the account? Where can I find a means test online to see if I’m eligible for a Chapter 7? Any help would be awesome- thanks!

I’m 23 years-old and my mother began taking out credit cards in my name when I turned 18. My credit is now horrible. I’ve contacted all three bureaus, the police, etc. The bureaus and companies I’ve contacted have told me that I’m still responsible. The police have done nothing. Now I’m apartment searching…except I’m getting denied everywhere because my credit is so horrible. I contacted a lawyer to clear this up, but it’s ,000 down. As a 23 year-old student, I don’t have that money. I’m wondering if I should/could just file for bankruptcy and be done with this. This sucks.
*I had no knowledge of her doing this
*I’m not trying to protect her
*I’ve written letters to all credit bureaus, they’ve done nothing and are holding me responsible
*The cops are fully aware, I even have a police report, and they literally have done nothing
*I’d prefer they throw her in jail, because it’s where she belongs

I am very nervous about what can happen to my home. I am waiting for a closing date as my parents gave me money to purchase a modest home. I am married and my husband and I need to file bankruptcy. We lost our home to forclosure a few years ago, lost our vehicles and had some credit cards. My parents want to see me enjoy part of my my inheritance now and I also have health issues that allow me to only work part time. I know I need to contact an attourney but I dont have the money for that yet. We are still renting but will be closing within the next 2 weeks. What should we do when we file? Again, the home will be only in my name which I am not sure if this will help or not. My husband has some personal credit issues and I as well. But, most of our issues are together. We believe we should file a chapter 13. He is a school teacher and I am a part time self employed music teacher. He also owes a lot of money on student loans from getting his Bachelors degree. I am 51 years old, am very grateful to my parents yet very nervous about losing my home. Thank you !
My parents do not want the home in their name as they do not want to pay Insurance and taxes among other reasons. I have heard of many people owning homes and filing chapter 13. If this is the answer do you think we need to do it soon so the courts do see that we are trying to resolve the issue after recieving this gift? They will also see that our hardship and loss was due to my husband being in the mortgage industry and my health issues.

We had put down a chunk of money for escrow. We were to close a few weeks ago until Fannie Mae said that they need go over the homes forclosure papers. Something was not done exact. I and Fannie Mae signed an extension. Can I back out of the deal and do the bankruptcy then look again for a home again? Or, will I lose the escrow money which my dad would kill me for that. That is my concern now?

Essentially, it’s a question of dilemma for a friend who allowed her family to use her credit cards in promise to pay on it. As it naturally goes, her family did not pay on the credit cards. Can charge-offs be included in the bankruptcy as well? Thank you in advance.

I have been married almost 3 years. I have 2 children under 2 yrs old. My husband has a pill problem and is a thief. He has stolen my money so many times I have had to file bankruptcy. I can’t have credit cards, a checking account, or anything. My husband always begs me to come back and I do because I love him. Earlier this year, he stole the last 0 I had and bought pills and wrecked my car. We couldn’t even pay the utilities on our house. (well, I couldn’t pay them, my husband doesn’t have a job.) So he moved in with his dad and I moved in with mine. Recently after we moved in with our dads, I found out I was pregnant. My husband got kicked out of his dads house for stealing and being on pills. He had nowhere to go so I let him stay with me to help me with our newborn daughter. Last week he was on pills again and stole some money from my dad and me so my dad kicked him out. Every time this happens he says he is done with the pills and it won’t happen again. I always take him back and this time I said he cannot stay with my dad and I. We have a house that I am still making payments on but since he doesn’t have a job I can’t pay for the house, utilities, and groceries by myself. Thats why I’m living with my dad so my kids will have water and heat. He is now telling me that he is completely done with pills. His mom is going to put him in therapy and he is going to apply for jobs and possibly go to the army. I do love him and that would be fine but I’m afraid I can’t trust him. My parents are begging me to get a divorce. But even if I do I know I will still see him alot because of the kids and that will be hard for me. When we got married I knew he already had 1 kid which was fine but since we got married he found out he has another and next month he is getting a DNA test for another, which that is really hard for me to deal with. I know he didn’t cheat on me. But if he does get a job, all his money will go to child support for these other kids? He has been put in jail more than once for back child support and is also being questioned for some residential break ins. I am afraid if I leave him I won’t find anyone else and if I did find someone else my husband would make it hell for me. I’m sure it sounds like a no brainer I wish I could turn off my feelings but I really do love this guy too much. I just wanted an outside opinion from someone that doesn’t know us. Thanks in advance
I do not have a drug problem, and when he is on drugs I do keep the kids away from him.

I just checked my credit report online, and I see that Con Edison (my electric company) checked my credit report last year. Why would they do that? I did file for bankruptcy two years ago (for credit cards), but I’ve been paying consistently to Con Edison for 8 years. Why would they request my credit report?!

I have a friend that is trying to find ways to fix her credit score. She has no debt (credit cards, car, etc.), just monthly rent and utilities. She has some blemishes on her credit score from a repossesion and some other things, but no more debt. She brought up the idea that she was going to file for bankruptcy to clear her credit and start over again. Is this possible? Can someone file for bankruptcy when they don’t hav any debt? Will it really help her credit?

I currently live in NH/ over 10 years. I own a mobile home and a car. Due to health reasomd I will be moving tp a warmer climate. Yhe house is in my name and PIF as it is old and does qualify for moygage so I pay my parents/ The house will be sold and the money will be a swap for a house where I relocate and technically is for my parents for loians to get me by during litigation. Much of my debt credit cards as I was in a MVA a few years ago by underinsured and dishonest motorrist- cc charges were fort medical bills and if used for purchases cash was tight and some medfical bills wete paid in cash so other needs where charged. I think I have 1 student loan nvut thought all were paid 12 years ago/ Loan is about 1200 cc debt is about 120000 and a few thousand of medical billls are remaining. I did wotk after accident but had surgery from said approximately 2 years after. I did my best paying off debts incured from 2005-2007 but after the surgeries which were kinda influenced by my lawyet as he enphasized need for medical end point even though I expressed there is no medical endpoint. Well my climb to pay devts started again after surgeries and additional disorder called Rsd. I did have LTD but they never paid as a doctor was paid off to fabrricate my evaluation when my job did not like what 2 other doctors concluded, which one of yhese 2 my work sent me to. After aan error on Socoal Securoty ceases ny income for 2.5 years, the feds granted the claim for SSDI. Besides stress of litogation, no income, age of digerative disorders SSDI was granted with an apology of the sort. I akso annulled a marriage within this time leaving me with deby from spouse who commited domestic violence on me and he chose to live off of me. I was also robbed of 5 figures of assets and lost alot of electrical utilities from lightning. I salvaged what I could and did not complrte insurance clai, as briefed to ageny as I was loosing hope and in alot of pain physically abd mentallyt. Years of litigation, paying medical bills, healy
th, etc I started loosing hiope and addressing many issues became to taxing but I did what I could and blockrd out what I couldn’t deal with mentally and financially. My parents lent me money to get by. I alsoi have 1 speeding ticket that I was under thje impression was dismissed. Well I got a letter recenrtly that stated it had veen 3 years and threat tp revoke my license, I alsp have a scar ocroissd my face that is a constant remonder of somr horrific times which will codt about 4000 to fix. I can’t handle another winterin NH as it is compromising my healyj and litigation has and cointinues to keep me from mty lovrf onrs. If my parents pass qwhile waitimhg for the litigation , it would devistate me. Additionally more medical problemsa have arisen due to tjhe weather, stress, and afe. I also have apptoximately 10000 in legal fees from the lawyer for ssdI who did not do his job, I did hid jpb and he wiithdrew representation as I mentioned consideration but planned to dicuss our relationship before making a decision and he wityhdrew vefore our meeting , as I ended up in hospital that day buit left vm in evening avout hospitalization. When I talked to him the next day he informed me that he notified social Security of his withdrawal. SS was one who informed me of incomplete and questionable lawyers effort and mentioned I shpuld consider terminating him. They did thos as a favor as they technically were to correspond with my council but they were quite hekpful and confirmed my concerns of lawyers incompleteness. Well, now he wants 6000 dollars for 1 days work/ I was ythe adjudicator with the congresswoman, Social Security judge and doctors. O had already elvaluated with states doctors, submitted 380 pages of medicsl records, went to 1sr hearing, filed an appel as my doctor still did not feel comfortable that it was safe for me to work. SSI;\ost appeal forms but it was emtered om ytheir computer that it wsd recieved 9 mpnths earlier per protocol and admitted error on theirr part;. such action hindered rehabilitation, medical treatment, quality of life, and blew my immaculate credit, and eventually had to cxcl health insurance and homeowneras insurance. If I fplr ch 7 or 13 and have to appear im court wiyh drawm out litigstiom I would noy file in NH I wpuld opt to fil whrm I move. I am now a stay home mom due to having two children with a rare disease and due to daycare costs. I would be working just to pay daycare, so my husband is the only income we have now. We have ALOT of medical bills that we were barely paying off before when we had 2 incomes. We also have some credit cards that need to be paid. We also pay on a repossession and we have a judgment for a credit card that we used to have. In plain words we have alot of debt and we don’t really have to means to even pay it off. i have 2 school loans that I have put off repaying. It really seems like bankruptcy is our only option and I have accepted this but I wanted to know if anyone has any other ideas?

I have a few credit cards and a car payment in a debt consolidation. It isn’t moving as fast as I would like. I haven’t had or driven the car for 3 years. The car loan is under my and my sister’s name. How would it affect her if I where to file bankruptcy?
The car has been totaled out and sold at an auction. The insurance didn’t pay.

have been laid off for a while. I have a personal loan, phone bills and about four credit cards. All my credit adds up to about 20k. I just got a new job and I am making about 2400 a month. My rent is 600 a month and I have about 200 monthly bills. All my credit went into collection agencies. Does anyone have any advice…Its not so easy just to pay it off because of my other expenses and settlements usually require 2 or 3 payments to pay off the whole debt. My loan alone was 8 thousand dollars. I want to pay all this off. Can you please give me advice how to pay it all off and than gradualy how can i rebuild my credit. Another option is bankruptcy…I live in New York. If I do bankruptcy, how bad would that affect my future. Also, would it affect me inheriting a house? Would it be a good option? I know it stays on my credit report for 10 years but can i still build credit after filing bankruptcy and how soon? thanks.

I know of a person who fell on some very hard times and now has let 8 months go by without paying on his credit cards. It appears that now some of the cards have written off his loan as bad debt, or have turned the delinquent accounts over to collection agencies. This person is unfortunately still so pennyless (and so in debt- close to ,000 between a handful of credit cards) and he still cannot afford the legal fees to file for bankruptcy. At this point, since he is so delinquent on his credit cards, and his credit is already turned bad after being delinquent for 8 months, is there any reason to file for bankruptcy? He has heard that the bad debt will drop off his credit record after about 7 years, just as one’s record of going bankrupt would. Can anyone validate that this is true? Could there be any advantages for him to go through the bankruptcy process at this point? In other words, what would be the difference in his credit ultimately?

I bought my home in 2006 and put down $ 100k, yes its 20% down for a $ 500k house. I have put in another $ 50k in upgrades and remodel. Fast forward to 2009, laid off, no income I resort to using my credit card to pay my mortgage while my house was being listed by my realtor. 6 months went by, then a year, the house remained unsold. I’m up to my limit in credit card debt, thinking to sell the house for $ 350k, which will give me approx. $ 50k to pay my credit cards. Year and a half later, house is in foreclosure; credit card at max limit. No job, no car (sold it to pay credit card debt), ..and now living like a deadbeat.
Credit card companies still call and say "hello". Same story told to them over and over, no income, no job, no money etc. They "understand". Then they sell the debt to collection agency, same thing again. I told them my story..and they don’t care. "When are you gona pay?" I say with what? I can sell my t-shirt and underwear, but that might be worth 25 cents. What good will it do? So now, they are suing me in court. Went there and told the same story…judgment for the plaintiff. Okay, now they want to garnish my wage…but I don’t got no job. They want to freeze my bank acct…I have none. They want to..probably kick my ass..that they can definitely do..but that would hurt them, because if I get hurt and sue, they probably owe me money.
So here is my dilema, should I file Bankruptcy ..as there are other creditor waiting in line to sue me. Or should I go to court and and plea guilty but have no way to pay?
Yeah, I know..I’m a deadbeat, but I don’t blame my misfortune on no one except myself. Lost my life savings and people are laughing at me. What a cruel world this is. To file BK or not to file BK? If I do, I will have a fresh start says a friend. If I don’t, my friend says that the creditors will put my balance on my credit report, and renew it every 7 years…meaning that I can call the credit reporting agency to remove it, but they have a right and probably will repost my balance…as nothing had been collected. Is this true? I thought a negative item must be removed after 7 years, but it could be put back in and stay for another 7 years?? Please help. Thanks in advance.

I want to file Chapter 7 to totally get rid of my debt. The only problem is my spouse doesn’t agree with this, so I would have to file by myself. I have 5 credit cards in my maiden name and 1 credit card in my married name. My medical bills are in my married name. As far as my assets, my name is on the house but not on the mortgage. My name is also on the two cars that we own.
Can I file Chapter 7 bankruptcy without the cars and the house being affected? If I can’t file by myself then what else can I do?
