To file Bankruptcy or not?

I live in Florida and have spoken with a Bankruptcy lawyer about my situation. I had excellent credit prior to a house I had up for sale being on the market for 6 months and tried to sustain two mortgages plus expenses on both houses and a lot of credit card debt, mostly used to fix up both houses.

It’s been since March 2007 that I made my last credit card payments. I took all of the 00 I received as a tax refund and paid it on 5 different cards.
I called the credit card companies and tried to set up a payment plan of some sort because I was drowning. NONE of the 5 would and acted really crappy when asked. The phone calls also bordered on harassment.
So, eating ramen noodles and peanut butter started pissing me off. If they didn’t want to work with me, then I wouldn’t work with them.
I changed my telephone number and stopped paying them.

After speaking with an attorney early this year, he stated that unless I was faced with court papers to appear, to stave off filing for bankruptcy. If I did file, it would be for Chapter 13 he stated.

I wanted a second opinion so here I am. My questions are…

If I do not file, the statue of limitations runs out in less than 2.5 years for the state of Florida. If I am not served a summons, after the SOL runs out, can they still serve me with papers?

If there is no summons or judgment, will the charge off debts stay on my record for 7 years from the last time I paid the credit card company? Or when the debt was sold to a collection agency which I think is usually a year afterwards (they all have been sold).

If the debt is sold again to another collection agency, does my time start over?

On my credit record, will there be an entry for the credit card company debt AND the collection agency?

I simply want to know when the credit card company debt and charge offs will drop from my record if I do not pay them.

The SOL is 4 years, it will run out in 2.5 years since my last payment is what I was referring to.

How can you protect your equity in a home if your investment partner threatens to file bankruptcy ?

They are filing because of -40,000 credit card debt. I’ve chosen to stay in the house, they have decided to move out but still pay their half of the mortgages until the house is sold…Needing serious help in protecting my equity for my daughters college next year !

Where do you draw your hope from when you have hit rock-bottom?

I am 38 and I have lost all hope and desire to live. All I want is freedom from my pain.

First suicide attempt at age 16
Last suicide attempt was last Wednesday – it was my tenth.
(I know pretty sad that after ten tries I can’t even get that right).

I have seen the inside of multiple emergency rooms and psych units over the years. I have been to more doctors, counselors, shrinks, therapists, alternative medical specialists, rehabs, and groups than I can even count anymore.

If there is a medication out there, they have tried it on me.

I have been diagnosed with borderline personality disorder, anxiety disorder, and major depressive disorder. I am a cutter and I have an eating disorder. I had a habitual marijuana and sleeping pill addiction which I have under control, but I still crave everyday. I also quit drinking. I just finished going through bankruptcy for the 45K in credit card debt I racked up due to a spending addiction. I was married once and have had multiple live-in partners – I drove them all away because I am "crazy".

I am currently in a treatment program (Dialectical Behavior Therapy), it has been five months and I still feel little hope.

I cry everyday, I am lost and empty, I want freedom from the emotional pain I live with constantly. I feel I have no worth or purpose. I have lost all hope as I have been in treatment so many times and yet, here I am again.

How many times can a person hit rock-bottom and still find the courage and strength to try?

I go to therapy, I go to group therapy, I volunteer, I exercise, I try to take good care of myself, I meditate daily, I work with my higher power but still I feel no hope.

What now?

Question about chapter 7 bankruptcy filing?

I have ,000 credit card debt and i get lot of calls from collection agencies but i never pick up the phone and ignore the answering machine. I also ignore letters from creditors.

I will be filing chapter 7 bankruptcy within one week. Someone told me that if you ignore collection calls and letters, then they automatically pull the money out of your bank account.

So i withdrew all the money i had in my bank and keep cash at home. Am I over-reacting or do they really pull money out of your account electronically if you ignore their calls?

How will filing for bankruptcy affect me as a US Navy Master at Arms?

I have three real estate properties that were recently forcelosed on, and I only have a few thousand dollars of credit card debt. I want to file bankruptcy but do not know how it will affect my security clearance in the Navy. What are some of my options?

College debt has ruined my life, and I'm mad at myself for leting it happen.?

I am beginning to regret going to college, it seems the only thing I have attained from it, is debt. When I went to school I was allured to the dream of being an airline pilot. I finally got my pilot’s license, but it got to expensive, so I switched to Aviation Management. I am so depressed and mad at myself for letting this happen, and it seems like there is no way out. A few times I forgot to fill out the FAFSA so I had to take out loans to cover the expenses, or I was late getting it in and got no money.

Here’s where I am at:
1 Loan for ,000 (Monthly Payments of 476/mo); 1 Loan for 620 (Monthly Payments of 128); 1 Loan for 00 (Monthly Payments of 50), and Credit Card Debt of about 00. So I have loans totaling 420.

I also have a car payment, cell phone, however I pay no rent, but my grandparents will soon be asking for that.

I just got a new job that pays me 000 per year. So if I don’t put anything into savings I can pay off my loans in about 4 years, however when you begin to figure in my other expenses it’s more like 7 years.

Consolidation is not really an option, because the 000 is an “Education Alternative Loan”, it’s not a federal loan. The 00 loan is a no interest loan. And the 620 is a direct federal loan.

-My dilemma is that, I have a girlfriend that I want to begin a life with. I wish to get an apartment with her maybe in the next year or so. And I want to marry her.

Situation 1- Do I put no money into savings and just tackle the loans head on? I will have no money for retirement or a down payment on a house.

Situation 2- I put some money aside into savings, and it will take longer to pay off?

Situation 3- Declare bankruptcy if I can?

I apologize for this taking so long, but I don’t know what to do. Thank you for your help.

Will bankruptcy erase a judgement lien?

An attorney file a judgement lien on my home from a credit card debt. When I file bankruptcy, will that go away? There is no equity in the home to speak of. We are planning on keeping the home and I am in Michigan.

Question about bankruptcy, student loans, due hardship, credit cards…?

My husband is planning on filing for bankruptcy. He has student loans of about 0,000 & has already exhausted deferments. We have to prove due hardship for student loans to be considered. I have about 00 in credit card debt. My family has offered to help me pay off my debts, but i’m wondering if my debt will be considered when he attempts bankruptcy. Would it be in our benefit for me to have this debt to prove due hardship? Would my debt be covered if he did get bankruptcy, so I should save my family the $? Thanks for the feedback.

HELP Would I be able to get a loan from my credit union to consolidate my rather high (8,000) credit card deb?

First off, I am a full-time college student. Ok, here’s my situation–I’m a little over ,000 in credit card debt. My monthly payments from all my cards combined add up to about 0, and every one of my cards (with the exception of one at 8%) have rather high interest rates (19%, 20%). Most of them are pretty close to being maxed out. Having to make these payments is really hurting me every month. I would like to consolidate all of my cards through a loan from my credit union. HOWEVER, due to having a bill that has been out in collections (0 electric bill) for the past 3 months, my credit score has gone down. I know you’re prob gonna say just pay it because it’s only a 0, but wouldn’t even be able to pay that right now without ultimately cutting myself short at the end of the month. Would this mark on my credit inevitably prevent me from being able to secure a loan through my credit union?

Also, if that wouldn’t be able to fall through, do I have any other options at all? I am pretty stressed right now about finances and would really appreciate some educated/experienced advice with this type of situation. First hand experience with this would probably offer me the best advice to this predicament–what did you do to get out of debt? Is bankruptcy even a good option, or is my debt small enough to where there’s still hope for another alternative? Please respond to this i am desperate to get out of debt! Thanks a lot in advance.

When a person files for bankruptcy,?

When a person files for bankruptcy,do the credit card companies/ banks (or any other institution that person may owe money to) collect on the debt? For instance, if John has acquired ,000 in Credit Card debt. Once he files bankruptcy, does the Credit Card Company lose out on the money or does it some how acquire some or all of it? Is foreclosure and seizure of property after bankruptcy done for the purpose of paying off any debt?

What should I do about unsecured debt?

I have about 23,000 in unsecured credit card debt. I recently lost my job and had to take one making a lot less per month. I went a debt consolidation program that got my payment down to about 700.00 per month. The problem is i am only bringing home net about 1200.00. I then have a mortage utilities and insurance etc so i am running in the hole. Is debt settlememt a good alternative. I do not want bankruptcy . I know settlement will hurt my credit score but at this point I need a way out. I have heard that settlement companies make you hold off on payments and the credit card companies will keep hounding you? Is this true? Does anybody have a suggestion to my dilema

Can someone file for bankruptcy when they are 78 years old and own their house?

My step-father in-law is in debt with a 2nd mortgage on his home and credit card debt totaling about 0,000. His wife just passed away a few months back. He is 78 years old and is not to handle all of this with creditors arousing him. He has someone wanting to buy his home, but i am afraid he will be left out in the cold. I need some legal free advice.

How do you know what type of bankruptcy to file.?

Thinking of filing bankruptcy but not sure how to determine Chapt 7 vs Chapt 13. Most importantly we want to keep our home and cars. We have credit card debt that we cannot keep up with anymore. Talked to a credit agency and they suggested contacting a lawyer to explore this as an option. We are in Jefferson County Missouri. I need to find a lawyer to answer some questions. Any suggestions?

I own 3 vehicles, 2 of which are paid off. I am thinking about chapter 7 bankruptcy?

I cannot find work and I have over 20K in credit card debt. What will happen to the cars I own if I file for chapter 7 bankruptcy? They are my only assets. I will be filing in the state of California. I am single and a non home owner.
I have had my 73 bronco for sell for almost a year now. No one is buying. What would that mean?

I have a friend that has over 000 in credit card debt.He makes approx/ 000/year.He has conferred with an attorney who has told him he needs to file Chapter 7 bankruptcy.Would it be better to file bankruptcy or charge off the credit cards?Which one would take the shortest timeline to be removed from his credit ?He just can’t continue at the rate he is going now ,trying to pay the minimum payments on his cards and pay other debts as well(mortgage,auto,utilities,etc)He is desperate and needs some insight.

what to expect when spouse files bankruptcy in WV?

We sold our home and relocated for spouse to start new business. All income and assets wiped out from business venture which is 4 yrs old. We both have credit card debt from the business but I am not filing. Can heirloom furniture I own be taken as an asset to satisfy creditors? Other than my spouse not having credit what are the pros and cons to filing bankruptcy.

Bankruptcy or debt consolidation?

I was divorced last fall, in Texas, where I still reside. My attorney refused to ask my x for disclosure, so I did not know that my x had ,000 in credit card debt. The divorce papers say she’s liable for debts she incurred from the day I walked out on her, and for all debts that are in her name, which these 3 revolving accounts are. But, she hasn’t paid and yesterday, after getting turned down for credit, I checked my credit online and found out that two of her credit card companies have put charge-offs on my credit, a third one is about to, because she’s 190 days past due on it, and she never paid the phone bill so Embarq has put a charge-off on my credit, too, for 0, which is the least of my worries, but my credit score is barely over 400 now. Everything else on my credit shows "paid on time/as agreed". I’ve never made a late payment on anything my whole life.

I’m considering bankruptcy, but I own two homes (one is a rent house, both are mobile homes). The industry I work in is winding down and I had planned on moving into the landlord business. I’d planned to purchase an RV park, not only as a new career, but as my only retirement income, as well. I’ll be 50 years old in a few months. I don’t have years left over to build more credit.
Suing my x for whatever she owes me will not do any good, because she refuses to work, doesn’t have a job skill and will surely never pay me once I win in court.
My income is excellent, and I may make too much for Chapter 7. Also, one of my homes is in a mobile home park inside a city limits. My main home sits on 2 acres in a subdivision, outside of city limits. I’m concerned that if I file bankruptcy, I won’t be able to keep both houses. I also have two cars. One is a junker that my X trashed and gave back to me while the divorce was still pending. I owe less than ,000 on it. The other car is very nice, only 2 years old, and I owe a lot on it. I’m paying on all this, on time. My only concern is losing my homes and the good car.
Personally, I have no other bills besides the two house payments and the two car payments & their insurance. I have no revolving accounts.
Given my plans for retirement and my unsteady job security right now, which do you think I should do, file or consolidate just her bad bills and pay them off over time?

Could we be seeing the start of the great depression, likely to hit '11 – '14?

With subprimes coming to an end (about time), Now it’s time for the Option-arms and Alternative A-papers, which will tack on another trillion or so in write offs for companies which are already tinkering on bankruptcy (even with the bailout)

then in about 2-3 years, we’re going to see the credit crash as those millions of americans who have tens of thousands in credit card debt and other non-mortage loans default, especially if they start to lose jobs / give up as buying power decreases.

Heck, In my ranked MBA program, a vast majority of my fellow students have 10-25k in credit card debts which they just plan on paying off with their "high paying" MBA jobs- which they aren’t getting because everyone has hiring freezes. If these are supposed to be some of the "smart ones" among us, what do you make of the rest?

Although in the financial discussions, there seems to be backlash against the media for saying that the "majority of americans" are in MAJOR debt, as in fact it’s only a "very small percentage" (44%). Now, these articles are literally stating 44% is a small percentage- and that 55% are being very good trying to pay their bills off in time. However, I also read that the majority of bankruptcy’s are people who "do not spend wildly, but are in debt to to other reasons such as loss of jobs or health problems". If the job market turns downwards, buying power decreases, and salaries don’t keep up with inflation would that not suggest that even those who "try" are likely to rack up more debt? and isn’t it likely that this 44% is likely to increase to 50, 55%? In this case we are saying atleast almost 50%, and potentially more than 50% are likely to run into major credit and debt issues?

Then with credit card companies such as American Express already tinkering on bankruptcy, a CC card company going under would only add to the fun.

That in itself could be the next great depression. What do you think?

Now I could be taking this a little far, and I don’t expect anyone to agree with me beyond this, however, I raise yet another question- If over 1/2 of america loses their buying power and credit-worthyness all together, based on what I see in the Government now, I would presume that they would feel the need to step into action, and bailout the individuals- and in this situation, it seems like the only action which they could do is to take control over many aspects of the country, essentially creating an extreme socialist culture overnight.

Although I have my savings spread in Euros, Rupees, and Dollars, the intense globalization occurring as of the last 10 years means that money isn’t safe anywhere. So now I’m thinking maybe I should just rack up 30k in debt since I’ll be in the doghouse with everyone else anyway, and 5-10 years from now we’re all going to be in the same position whether we have 000 in the bank, or -000 in our credit history.
