I filed for bankruptcy Jan 2005. Credit card company "wrote off" the debt Jan 2005. I thought it was included with my bankruptcy, but when I check my credit report, it claims I still have the debt, it’s just written off. To be specific, my credit report states that I still have this amount from the one creditor as "revolving debt". Shouldn’t it state that it was included in Chapter 7 like all of the other creditors state? Any help would be wonderful. I just want to know if I have something valid to dispute.

A few years ago I settled a debt with a credit card company and I had to claim the part of the debt that was forgiven as income. Now here it is about 8 years later and I am having to file chapter 7, with all the K in unsecured debt that I have, will I have to claim this as income too?

When filing BK you have to list the original credit card holder. If they are sent to debt collectors, do the debt collectors have to send them back to the original credit card company? Then who notifies the debt collector that the person has filed BK? How does this work?

I have a delima and this seems like the right place to ask this question.
I have a home in Las Vegas which I am trying to short sale, which I believe will ultimately end up as a Foreclosurer. I lost my job 10 months ago when my industry took a crash due to the economy and have been burning through my savings to support my family.
Now that I am working again my payments are the same but my pay check is 1/2 of what I use to make, so its a struggle. I have almost depleted my savings and come to a fork in the road. I have about 25K in credit debt and my credit card company just raise my interest rate so high I can’t possibly afford the new monthly payment. I have tried to get them to help and they said thats the way it is and when I check the internet, this is happening to millions of people.
So here is my question.
Since I will have a foreclosurer on my record, is it worth trying to work to pay off the credit card company or just file for BK and start over.
I have always have perfect credit (790) and this is really bothersome to me. I buy cars every 2 years and always got the best rates, so I want to try and save my credit, but with a foreclosurer on there, will it really matter if I pay off the credit card or not?
My credit is already shot and need to get on the road to rebuild it and I can probably get ,000 to pay off the card, but that will be my entire savings and would leave me in a more volerable state.
Sorry to ramble on and advice would be appreciated!

This is what happened:
I haven’t had a job in 6 years. I have been unable to pay my bills. A credit card company took me to court and I lost. Legal aid wouldn’t help me file bankruptcy because I’m not working. So now I have this case that I lost and I want to know when I do get some money to file bankruptcy do I still have to pay the legal fees? Or is that included in the bankruptcy?

After re-reading my question I think I should make this clearer.
I lost the case and they say I have to pay their legal fees, when I file bankruptcy can I include their fees into my bankrupcty?

I received a notification in the mail that my wages are being garnished by a credit card company, for an outstanding debt. I cannot afford for this to happen because I am a single mother of my daughter. How much or what percentage can be garnished? I live in Maryland. I read on a website that they can take all but 0 of my check a month. Is this true? I am currently unemployed but I have had numerous job interviews. I assume that once I become employed my wages would be garnished immediately. I am thinking of filing bankruptcy because I have other credit card companies that will be coming after me for money that I do not have. I heard bankruptcy can be filed online to save money for a lawyer. I do not have money to pay a lawyer. PLEASE HELP!
Yes, I did have a court date but I did not go because I knew I owed the money and I did not have the money for a lawyer.
I’m afraid if I don’t file bankruptcy I will have no money left to raise my daughter. I owe about 00 to different credit card companies. Can they all garnish me at one time? If so, I may not have enough money to get my daughter what she needs.

When a person files for bankruptcy,do the credit card companies/ banks (or any other institution that person may owe money to) collect on the debt? For instance, if John has acquired ,000 in Credit Card debt. Once he files bankruptcy, does the Credit Card Company lose out on the money or does it some how acquire some or all of it? Is foreclosure and seizure of property after bankruptcy done for the purpose of paying off any debt?

Why would a credit card company send me a credit card with a 0 limit when they can see on my credit report that I filed and received a discharge for a chapter 7 bankruptcy?

If I have a judgment against me that i just found out about can I file bankruptcy ? My friend was served and appeared for her court case but the credit card company asked for a continuance and never said when the next court date was. When she called up with the court she was told that she would receive something from the court (or credit card company) when the next date will be. The next thing she knows she has a default judgment against her and the company is threading to garnish her wages?
Can she have the judgment Vacated after more than 3 years? Should she just set up a payment plan with the court and not the creditor? Should she file bankruptcy?
The credit card company wants the entire amount of 8500 and will not let her make payments without putting half down.
What should she do.

I am currently being sued by a credit card company for 20k. And owe approx. 10k on other credit cards. I rent my apartment and have a car loan. I registered with a debt settlement company, but don’t think they are helping me resolve my current legal issues. I have approx. 2k saved toward a settlement on my credit cards, but no other savings. I am 30 years old, single and have a young daughter. I want to solve my financial problems and hope to buy a home one day. I am lost, confused, and very unsure about what my best options are. Any advice would be greatly appreciated!

For a example.00 cash taken out 1 month before bankruptcy.I heard 95% of credit card company,s don,t show up for the 341 meeting.

I filed chapter 7 back in Dec 2001 when it was discharged.
My credit card company supplies TransUnion scores and credit history every month and it shows that the derogratory item (which was 1 for bankruptcy) is now 0.
So was my bankruptcy removed and why was it removed after only 6.5 years?

My ex gf and i bought a dog together and when we broke up the deal was she take the dog and pay for the bill and I pay for the other bills. She refussed to pay so i paid it so my credit wouldnt look bad i went to court to get my money and i won but found out she had filed for bankruptcy. She file the HSBC on the bankruptcy papers I am an individual person who paid off the dog after the fact that she filed for bankruptcy should I still be entitled to get my money seeing as how I am not on the bankruptcy papers i am my own person?
However i know she is living with her current boyfriend and collecting welfare and has more then what she is willing to share with her Trustee at Price Water House Coppers
We applied for the credit card through Pj’s Pet centre in both of our names she refussed to pay it so they called me we had an aggrement that i pay and she pay me back but after i paid she refussed to pay me back so i took her to court then found out she had filed for bankruptcy .. we had a written aggrement that she pay for the bill since she took the dog and I pay for the other bills we had together while we were living together ..
I was not on the list of Creditors the HSBC card was but the court issued the money to myself not to the credit card company .. we had an aggreement that i pay it and she pay me back but now that ive paid it off and asked her for the money and showed her the court papers shes refussing to pay

I recieved a notification in the mail that stated my wages would be garnished by a credit card company. I am currently unemployed but will be employed soon. I know they can garnish about 25% of my wages when I become employed. I owe to more than one credit card company. I owe in total about 00 to different credit card companies. Should I file bankruptcy? If not, how long will it take to have the 00 paid through garnishment?
Also I have a car loan that is completely up to date and the payments are on time. Will this eventually help me bring my credit back up?

I just received a notice from my credit card company telling me that my minimum amount due has increased. Actually, it has more than tripled. I called the company to see what alternatives I had, but there are no available options. Well the amount is beyond ridiculous and I couldn’t pay that amount even if I wanted to. So I arrive at my fork in the road. Do I consider filing bankruptcy and if so, which one?
