I have a relative ("Lou") who is in debt. Lou is in his early 30’s. The debt is more than K. Lou seems depressed, and I believe spends (restaurants, clothes, etc) as an escape from real life. In the past, the family has repaid Lou’s debt without conditions, but every time more debt appears later. This time, the family offered to refinance the debt only if Lou hews to a budget. Lou is resisting the budget since it imposes controls that any adult might resist. Plus, Lou is worried about his life being in too much flux and not being able to guarantee he can live within the budget. The only alternative is for Lou to default on his debt. We don’t really want that because of the long-term implications of bankruptcy. We also worry about pushing Lou "over the edge". There is no drinking or drug problem. There may be a gambling problem. What do we do? Lou refuses to go to counseling.

I have completed the online course and have to call the counseling company in order to obtain the certificate………….why will they ask me or what does this phone call entail?

My husband and I realize the only way out is Chapter 7. We have struggled to pay off our debt, but due to circumstances we just got more and more behind on necessities for our family of 4, not to mention my husband also has a son he pays child support on. We are well below the median income level for our family size and desperately need our tax return to get caught up on needs for our family and home (clothes, car repairs, minor home repairs etc,) and also ensure we don’t get behind again in case of an emergency (like pay an extra 2 months worth of rent or pay extra on utilities etc.) We aren’t trying to cheat or lie about our tax return when we file bankruptcy, nor are we planning on using it for anything other then needs of our family with the exception of maybe a couple hundred to take our kids to a large aquarium they have been dying to go to. We will likely get our tax return at the end of next month and wonder how long we should wait if possible to file for Chapter 7? We are speaking with an attorney, but this isn’t exactly something they will tell you about and so forth. We are in California.
Oh, we know about counseling, but we very much doubt they would NOT think we don’t have to file, more like they will wonder why we waited this long.

I had taken the Means test and passed. I also got all my Bankruptcy Ch. 7 documens done through an online site and its all completed. I also attended the 1st counseling class. I am ready to go to court to pay my file fee and start the procedure. Do I need an Attorney or can I go ahead and file on my own?

I recently filed for bankruptcy on october 25th. I just finished doing my last online counseling for my discharge. They told me that my credit score was a 628. I know that is not a good score, but shouldn’t it be lower, like in the low 500’s seeing as how I just filed for bankruptcy. Do they adjust the final score after the discharge, or is that what my score will be till I raise it by doing good credit and paying on time. I guess my question just is, does your credit score go down after a discharge, or does it go down when you file for bankruptcy????

We live in Washington. We own a home that has 95K in equity – but we owe the IRS about 85K. We have gone through the pre bankruptcy counseling and they say we HAVE to file – because we are in the hole 6K per month (long story – I owned a business and got very ill). My income is commission only – and I don’t have commissions coming in which is why I need to file Pro Se’. Basically – do I let the trustee sell my house? Do I need an attorney to make sure the taxes are discharged (they have been owing for over 3 years and over 2 years since I’ve filed – and also the 3rd rule I’ve passed too) because that would be horrible to walk away without them discharged. I have 2 cars I want to give back. If I file now – how long can i live in the home and when do I need to surrender the cars ? I don’t want to milk the system – I just want to find a place to live and have enough time to earn a commission (should be 30 days away)
They may have changed the rules – but I know you can do it pro se. The reason I would even try is I used to be a creditor rep that goes to court and I reviewed every petition to find fraud. I know most things – it’s just the tax lien stuff and the sale of the home I don’t. My attorney wants 00 up front. It is so embarrassing – I used to make K per week – and now I’m reduced to not being able to pay an attorney. Life goes on.

Don’t give me a "debt management" of "consolidation" solution as I will report you as a SPAMMER.
I have already begun the paperwork for Chapter 7 bankruptcy and know it will be a long hard road to fix my credit.
This is for those who have already or are in the process of filing for BK or those who know the process well, ONLY.
Fed law requires pre-filing counseling and a "certificate". I can do the counseling class online which I prefer. What companies have people who filed BK used for pre-filing counseling and and post-discharge counseling?
AND if you think I can get around the BK with the amazing "debt consolidation company" you are about to mention, don’t… it just shows you haven’t read my question and have no idea what the process is all about. I have no other options but to file BK right now.
And please don’t preach to me about the evils of credit or bankruptcy or how great your loan co or debt consolidation co is. I’m experiencing the evils and just want my life back

I am currently living out of the country to help my in-laws while they are experiencing some medical problems. I want to know if my parents can file bankruptcy for me if they have power of attorney (in the state of GA)? I know I would have to go back for the meeting with the trustee and the counseling, but if they could file for me, that would really help in our situation. Any help would be greatly appreciated! Thanks in advance!

where is the best and most value to take the required pre bankruptcy counseling? ones that are approved by the gov’t and give certification. Advance thanks for any good recommendations!
