I just moved from Connecticut to Florida in June 2009. I want to file a pro-se chapter 7 bankruptcy. I contacted a company that said they can’t help me because I have not lived in Florida for the past 2 years. Does anyone know if this is true? And what does this mean to me when it comes to filling in paperwork? I would like to do this soon and I cannot afford to hire an attorney.

I am currently in the process of filing for chapter 7 bankruptcy. I have not yet had the meeting of the creditors. At the same time I am in desparate need of a new car. I spoke with my attorneys office and they told me to apply for financing before filing for bankruptcy. I have read online that the car could be taken away. I am seeking some guidance on how to go about this. I know that once the bankruptcy is filed my credit score will drop so badly that I probably will not be able to get a car loan, however on the other hand I am also afraid that once I file bankruptcy the bank will take away the new car.

I have ,000 credit card debt and i get lot of calls from collection agencies but i never pick up the phone and ignore the answering machine. I also ignore letters from creditors.
I will be filing chapter 7 bankruptcy within one week. Someone told me that if you ignore collection calls and letters, then they automatically pull the money out of your bank account.
So i withdrew all the money i had in my bank and keep cash at home. Am I over-reacting or do they really pull money out of your account electronically if you ignore their calls?

They borrowed more than 0,000 from Hamilton Bank to purchase the building and begin renovation. Disagreements among the partners arose when the renovation costs exceeded their estimates. When Beren was unable to obtain assistance from Elliot and Mannino regarding obtaining additional financing, the partnership quit paying its debts. Beren filed an involuntary petition to place the partnership into Chapter 7 Bankruptcy. The other partners objected to the bankruptcy filing. At the time of the filing, the partnership owed debts of more than 0,000 and had approximately 0 in the partnership bank account. Should the petition for involuntary bankruptcy be granted?

If you have gone through chapter 7 bankruptcy and you need to buy a new car, can you get a loan if someone co-signs the loan with you?

My ex and I are still married, though we’ve been separated for over 2 years. We bought the house that he has when we were married, though my credit was iffy at that time and I am not on the mortgage information.
I am severely in debt and am looking to file chapter 7 bankruptcy. I am on the deed to the house, but not on the mortgage. Does my filing bankruptcy put the house that he lives in at risk? Also, I’m filing for divorce on Tuesday and am giving him the house in the divorce.
I want to ensure that if I go into bankruptcy court they can’t take my ex’s house from him. I am also on the joint bank account that he has, but I’m going to go to the bank with him shortly to have my name taken off of it.
Any information on this would be appreciated. If I sign a quit claim deed for the house does that stop them from being able to take his house? What’s the process?

but what happens if I file bankruptcy and he doesn’t? Will they go after the home to satisfy my debt? He has some equity in the home, but I’m not sure if it’ll be enough to cover all that I owe.
I just don’t want to make this divorce harder than it already has been.

I am going to file chapter 7 bankruptcy in Maryland and I have a joint credit card between myself and my son. What I would like to do is keep the credit card so I still have something for emergencies after I file bankruptcy. Do I have to list the joint account when filing bankruptcy? Because I would like to keep it open and keep making the payments as usual, and if I did list it could that effect my sons credit, even if he makes the payments, since he is joint on the account?

I filed for chapter 7 bankruptcy over a year ago. I know that once you file, you can’t for another 7 years I believe. Well, I just recently got married and my wife wanted to know if she could file on her debt or if we’d have to wait another 6 years before doing it since we are now married?

My husband and I turned in all my paperwork and have paid a lawyer for chapter 7 bankruptcy. I first completed and turned everything in to the lawyer in May, but when I called him at the end of June he told us that he needed more check stubs when we turned everything in already. Now it’s almost September and we haven’t heard anything back from him. So we called his office and he told us that he will file in the morning and need more check stubs from us, but he will still file. So he told me to call for the case number in the morning and when I called he still didn’t file and that was three days later. We paid him and we turned in our paperwork months ago. What should we do? We live in St. Louis, Missouri, is there any advice someone can give my husband and I??
My check stubs were up to date, we went into his office and signed all the necessary paperwork and he said there was nothing else needed. He was suppose to file with the court months ago. But twice he has made up turn in more check stubs because of him not filing with the courts when he promised us. He has never given us one call, we always had to call and get a update or see if anything was missing. At one time they couldn’t even find our paperwork and we had to give them stuff we turned in already, it’s just a mess and starting to stress me out.

I’m from Mass how do I get a copy of my chapter 7 Bankruptcy Discharge paper work. I have all my other papers. The only one I cant find is the One piece of paper that states I was discharge. It was back in 2004 I know that.

I had a tenant who is gone now but owes me 00 in back rent, early termination fees and damages to the house. We got a notice of Chapter 7 Bankruptcy Case. What do I do now and will I ever see my money? Can I put a lien on his property? Help!

I have no income, between 20-25k in debt, and no assets other than my car that is falling apart. I feel that it will take me forever to pay off the debt once i start working again. Is filing chapter 7 bankruptcy right for me?

This sounds a little tricky but it’s not really. I am planning on filing bankruptcy in November as a result of a writ put on my bank account due to a credit card that wasn’t paid off (and I was never served the papers for).
I currently live in PA but will be moving to NJ in October which is in my favor pertaining to the BK I learned. Also I am adopting my cousin’s child who will be coming to live with me in Nov. I was told to wait until he is here to file because that will also help my case. My main concern is that I don’t want it to go to a chap 13 BK.
Any advice on what I can do right now to help set myself up for making sure it becomes a Chapter 7 Bankruptcy would be appreciated. Thank you for your help. Any spam answers, pointless one word answers etc.. will be reported.

I was wondering if anyone knew if a persons 401K is affected by the person filing for a chapter 7 bankruptcy? Is it left alone or is it included in with the bankruptcy proceedings in which the person must give it up?

When I filed chapter 7 bankruptcy, neither my lawyer or the bankruptcy trustee informed me that my debt to a university would still have to be paid. Is there anything I can do??

I had a few judgements that were supposed to be removed from my credit report when I filed for chapter 7 bankruptcy, but 2 of them are still on there. How do I get these removed, like who do I contact. One I had contacted someone before and they said they were going to remove the item, yet they haven’t and it is being reported on all 3 agencies which I am sure is bringing my score down. The other one is only on my experian, but it should have been removed once I declared bankrupcy right. There was also a collection that was never removed. All three of these items are on my discharge report and my report when I filed, so they should be gone right. Any info would be greatly appreciated.

I live in Ohio and my chapter 7 bankruptcy has been disharged for almost a year. I am hearing now there might be trustee fees. Has any one heard of this? If there is such a thing any clue the cost?

I filed chapter 7 bankruptcy protection on April 20, 2010. Every single creditor was notified of the filing, including the creditor being represented by NCO financial. Despite this NCO financial engaged in very harassing and nasty behavior. When I did not pick up the phone, they never left any message and hung up. They used different phone number each time to do that. When I called them back, I kept getting a message, "Please hold. All our lines are very busy". I kept holding for almost 20 minutes and this same message was repeated.
I hung up. Then i called back again and was put on hold for a very long time. A rude man came on the line saying I have to pay 0 immediately and it must be resolved right now. I said I filed chapter 7 bankruptcy protection. He said he needed proof that I filed it and will not go by my word, so I must pay. I hung up.
Then 20 minutes later another call from NCO financial came where they left no message. By now I found my bankruptcy case number. I called them back and was again put for a long hold. Then i told the agent (this time it was another rude man) i filed chapter 7 and have case number too.
After telling him the case number he responded, "we still have to verify this. its not enough. what is the phone number and address of your lawyer?" I gave them the address and phone number of my lawyer. Then he asked, "what is the zip code of the office". I said, "i’m sorry I can’t recall the zip code but you can check it on google"
He then said, "you are not complying and we will call again". By then I hung up the phone being fed up.
he made zip code a big issue. This was cruel on his part.
