I have a chapter 7 bankruptcy that was discharged in 2009 april….i have a company who is now trying to collect their debt that was discharged….they have even put it on my credit and I was actually denied a car loan due to this debt…..can I do anything to them legaly…ie…sue them or somthing and it should be their resposability to fix this on my credit right.

I have bachelor of science in mathematics and I could not get any job since graduation. Due to my inability to get job, I had to file chapter 7 bankruptcy protection. I noticed the bankruptcy lawyer’s office was flooded with clients. There were like 37 to 40 people sitting in the lawyer office lobby to wait for their consultation. The bankruptcy lawyer told me "its been very stressful with so many clients. I am sorry for making you wait this much". He charges 1800 dollars per clients. And since there were about 40 in lobby, that’s an income of 72000 dollars already. And the consultation fees is 350 dollars for the first time meeting. Having seen this I get motivation to become bankruptcy lawyer myself and open my own law office. Because of poor economy I will surely get lot of people who want to file bankruptcy. And since I have bachelor of science in math I already meet whatever pre-requisites are required to enter law school. Moreover, my bankruptcy attorney graduated from my own university law school. So what more do I have to do now after BS in math to become chapter 7 bankruptcy lawyer? I will file chapter 7’s for all the broke and poor people in the town

I filed for chapter 7 bankruptcy in December of 2002. When can my husband & I file chapter 7 jointly? I know you have to wait 8 years between filings, but what about if you file jointly as opposed to single. We live in Michigan and have been hit very hard by the down-turn in the economy here.
Even with the new, tougher bankruptcy laws; my husband & I financially qualify to file. My question is how long do we have to wait to file jointly (after I filed personally in December of 2002)?

I recently filed chapter 7 bankruptcy and was awaiting my discharge papers. Instead I received dismissed paperwork because my attorneys did not send my financial management certificate to the bankruptcy court. They had the paperwork 5 days before my case was dismissed, now they want me to wait another month to wait for a discharge. I need a car and my children have been living with relatives until I can get on my feet.

I was just curious if anyone out there has ever filed for chapter 7 bankruptcy online and if so, what do I need to know, how much will it cost, is it reliable and sound, do I have to make an appearance in court, etc. Any info on this matter would be greatly appreciated.

I had a consultation with a lawyer and he told me that I would qualify for Chapter 7 bankruptcy. He also told me that he wants 00 in order to proceed. If I had 00 I would be paying off some of my debts. How can I go about filing Chapter 7 without a lawyer or by using the least amount of money possible? Thank you in advance for any advice.

If someone recently filed Chapter 7 bankruptcy in Georgia, and has fallen behind on making their monthly utility payments as a result of trying to make their bankruptcy payments, can their utilities be disconnected? I know that disconnection can be suspended if the person files back utility payments under their bankruptcy; but, does the same rule apply, if the person didn’t include their utilities in their bankruptcy and fell behind on making payments after they filed Chapter 7 bankruptcy?

My HOA’s Attorney raked up excessive unjustified fees on me for their own personal gain. I was late paying my HOA fees initially and willing paid the stated late fees along with my HOA dues. However, the Attorney collecting these fees does not accept credit card payments over the phone or online, etc. Therefore, I mailed the amount owed. To my surprise, I later received another letter indicating I owed another 0 for late fees. I ignored this notice b/c I thought that they probably didn’t input my payment in their system prior to the letter going out. So I received another letter stating I owed the 0 plus additional fees, and so on. Basically, each time I paid the stated late fees via mail, the Attorney claimed my payment didn’t arrive on time to their Office, and therefore I owed additional late fees.
In addition, all of my payments were applied towards Attorney late fees rather than my HOA dues. My dues were only 0 per year, but within that year I paid over 0 in additional fees that were never applied towards the full amount owed to my HOA. The Attorney continued to take their money off the top and say that I still owed a balance towards my HOA dues. As a result, I stopped paying b/c I felt I was being ripped off and the fees continued to increase. They ended up suing me for the amount they claimed I owed along with more Attorney fees and court cost.
Since I mistakenly missed the initial court date, when I showed up for the second court date where they filed a judgment against me, they won simply b/c I missed the initial court date. Now they are garnishing my bank account for the amount owed from the judgment.
Currently, I’m unemployed and my home is in foreclosure. I recently filed chapter 7 bankruptcy to stop the sale of my home so I can have time to secure a job and work out a modification on my home loan and get it out of foreclosure. I have not had the meeting of creditor’s as of yet. Can I discharge the past due HOA fees from the judgment/garnishment? I am willing to pay the past due HOA fees I accumulated after the garnishment since I intend on keeping my property. Also, I live in Georgia. Thanks for your answers.

I filed personal chapter 7 bankruptcy in 2007.
I now own a business, a daycare, that is failing due to so many parents being out of work.
Is Chapter 11 the proper bankruptcy to file for this type of debt, and if so, am I eligible?

I’m filing chapter 7 bankruptcy and the BK attorney tells me that my questionnaire looks good, and I pass the means test so things should go fairly smooth. A collection firm is presently suing me for credit card debt and I expect they will have a judgment soon. I’ve been told that my bankruptcy will "take care" of the judgment. But what exactly does "take care of" mean in this case? Does the bankruptcy simply relieve a need to pay on the judgment? Or does it also erase the existence of the judgment from my credit record? If not then can I take some follow up action to erase it myself?

My husband and I filed for chapter 7 bankruptcy 6 weeks ago due to a wage garnishment and other reasons. Our lawyer told us because of the timing and amount garnished we would get all of the garnished money back. The automatic stay has been in place for 4-5 weeks. My question is when or how long does it take before you receive that money back?

I want to file Chapter 7 to totally get rid of my debt. The only problem is my spouse doesn’t agree with this, so I would have to file by myself. I have 5 credit cards in my maiden name and 1 credit card in my married name. My medical bills are in my married name. As far as my assets, my name is on the house but not on the mortgage. My name is also on the two cars that we own.
Can I file Chapter 7 bankruptcy without the cars and the house being affected? If I can’t file by myself then what else can I do?

My parents may be filling for a chapter 7 bankruptcy and have 4 cars in their name (my truck included). I just paid my truck off and am about to put it in my name. If my parents file for bankruptcy soon after I put my truck in my name can they still take my truck? I heard there was a year time period between letting go of assets and filling for banckruptcy before those assets cannot be taken. I live in Colorado Springs, im sure theres different laws depending on state of residence.
