I get letters from creditors offering to settle my debts for a lower amount. I owe about ,000. Some debts have been charged off and I don’t know who to contact now. Doesn’t it still hurt your credit to pay off the debts anyways? Isn’t Chapter 7 just easier? Please help from anyone who has gone through Chapter 7. Thanks!
I received a discharged from a chapter 7 bankrutcy, less than a month later i get served. I am being sued for a civil matter.
I filed chapter 7, back in April…At least thats when I gave the attorney the retaining fee. Upon my next visit to his office, I paid the filing fee of 5 for initial papers. This was a time sensitive issue because there were garnishments attempting to take place within a matter of weeks. Attorney dragged his feet, and the filing was delayed 30 days after I paid for all services to be rendered to me. By this time, the garnishment had begun to take place. Being paid bi-weekly, this company has taken over 0 from me in the course of 8 weeks.
They are supposedly allowed to keep 0. Problem is, they have refuned 0 to my attorney, and my case has went before court June 10, 2009. The attorney is delaying refunding my money to me, telling me that he has to wait to see what the trustee wants to do with the money. I’ve personally talked with the trustee, and he told me he has NO interest in those funds. I relayed this information to my attorney, and he still tells me that he has to talk with the trustee.
I’m really pissed at this point, and I’m considering lodging a complaint against him because had he filed the papers in a timely manner, the garnishments wouldn’t have never occurred. Secondly, if the trustee has no interest in the funds, then why is he hanging on to them.
Worst yet, the attorney called me into his office July 11 to get matters taken care of. The only thing I did in his office was watch him go through my file, and he made copies and put them in an envelope while I watched.
I signed no documents that day or anything, but I did get ot view my check from afar. Am I supposed to wait until the case it totally closed before getting my money back or should I file a complaint with the Milwaukee Bar association.?

Anyway, I need to file bankruptcy. I believe it is Chapter 7, where you just get rid of all your bills.

I filed for Chapter 7 in april ‘09 and had all my debts discharged. I recently applied for a FAFSA loan. At the end of the filing, the file said I might be eligible for a certain amount of pell grant money.
Will the bankruptcy have any bearing on whether or not I will get approved for either a loan or grant?
In April I filed Bankruptcy. I quit my job after having a devastating miscarriage and felt like there was no other way for us to survive financially. My husband’s job with the Army requires him to have a security clearance and with already shaky credit we decided it would be best for me to file alone. Most of the debt was in my name anyway, so I filed a Chapter 7 in April. Due to my lawyer’s incompetence it wasn’t discharged till December. We’ve been told that with my husband’s low score and my recent bankruptcy our only option is to wait 12-24 months to apply for a mortgage. This makes sense to me, but I’m hoping there is another option out there. We were foster parents for a time and hope to continue that next fall when my husband returns, but he’s stationed in central Texas where CPS prefers foster parents who own their home. We had established a small business in training and boarding horses and would like to continue that in our own back yard and grow from there.
I’ve contacted the three major credit bureaus to clean up any inaccuracy and I’ve been working at my job for almost a year. Our debt to income ratio is great and despite my bankruptcy my credit score is slightly higher than my husband’s, but still low. I’ve done all of our baking with US Bank in hopes of establishing a relationship with them and I have a low-limit credit card I use for gas and pay off monthly and a secured card I use for business expenses and pay off monthly. So, this is probably much more information than you needed, but it will hopefully be enough to help you answer my question. I would hate to spend another 12-24 months paying 0-800 a month in rent and 0 a month boarding our horses when that could be -30k we’ve paid toward a mortgage.
I understand that all actions have their consequences, but we’re a Christian family and hope that through the right network, education and of course prayer there may be some chance of purchasing our first home so my husband comes home from Iraq feeling accomplished and secure.
My wife and I do not want the house anymore, and we need to relocate to be with family. If we give up the house in a Chapter 7, are we relieved of all liabilities pertaining to the mortgage?

My Husband filed for bankruptcy (ALONE) as little as 6 months ago, and I started a new job (which is in the same field I’ve worked in for the past 8 years). I’ve never been evicted and I have a truck that was paid off in 2005. Of course since my Husband filed chapter 7 he has no history (score of 0). When should we be able to purchase?

What is the maximum income in a single income household to file a chapter 7? Is a chapter 7 going to eliminate everything I include or do you have to pay anything back with the new laws in effect?
I’m married but filing for Chapter 7 myself, not joint. My wife will be getting tuition reimbursement in a paycheck coming up. Can this income be deducted in the Means Test? Should we change her direct deposit so that it gets deposited into her personal checking account without my name on it? I don’t want this income to count against me as it will be used for her class tuition. Any help on this would be appreciated.

I hired a bankruptcy attorney to file a chapter 7 and I completed all my paperwork and credit counsiling all within the time limits, and then I got a letter from the court saying that my case was being dismissed due to some paperwork. I contacted my attorney’s office right away and they told me that they didn’t file some paperwork, but I shouldn’t worry about it. They told me to show up to the court appointment anyways, that they would take care of the paperwork. Me and my wife showed up to the court, seen our names on the calander and talked with a attorney from my attorney’s office. She told both me and my wife that the trustee might not hear our case because of the paperwork issue. Sure enough we did not get seen that day. The attorney that was there said that the office would be in contact with us within the proceeding three days, and I never heard from them. I have been trying to contact them for the last month now and I have been getting the run-around. This is bull! I need help! I had money taken from my account after I retained my attorney and nobody can tell me where my money is and if im going to get it back.
I had a chapter 7 discharge on my debt about 13 months ago, and recently have come into some money..and wanted to know if I could pay back the bankruptcy trustee the debt that was discharged and it would clear my credit history of the discharge?

Okay so i was really bored online and googled my last name and address for fun. Only to find my address and parents names and that they had filed for bankruptcy in July. I had no idea. I just got a ton of christmas presents and I go to a private school. I knew it wasn’t the best of times but I had no idea that things were bad enough for us to file bankruptcy, what exactly is bankruptcy and is there anything I can do to help my family?

I know that they paid for my presents in cash, not credit. idk if it makes a difference. They haven’t used credit cards in like 3 years but know that I think about it we always used to use them.
I have listed all of my outstanding debts on my bankruptcy (including the 2 mortgages on my home), although I had planned on keeping our home and continuing to keep up the payments. My atty told me that if I needed to walk away from the home at any point after the discharge, that the bankruptcy would help me to avoid any judgements as long as I didn’t refinance the loans. But even without paying the debts that I am filing on, we are still finding that our monthly expenses are far outstrapping our income, so we are thinking about short selling and getting a smaller rental home for a while until we get back on our feet. My domestic partner is on SSI, and is "judgement proof" from what my atty says, so between that and my chapter 7 simply walking away is an alternative to short selling. My question is: what is the best thing to do for the long term?? At this point, both my partner and my credit scores are in the toilet anyway. I’m just worried about never having credit again.
After going to debt counseling,I had no option left except to file a chapter 7. Listed with my debtors are 2 payday loans,2 weeks prior to filing,I took out a payday loan for 5,yes it was stupid,but food on the table seem more important at the time.I called and informed them,that I had to retain a lawyer,and was informed that when I signed the contract I would not be filing bankruptcy within 30 days,and my attorney was a personel friend.I did not plan on filing,all other options were used up.Can and will this effect my bankruptcy? Also,the 2nd payday loan I borrowed from is a prominent member of the community,and told me he would get his $ one way or the other,even if it ment following my butt all the way up the court house steps.I am a emotional wreck! I was divorced last fall, in Texas, where I still reside. My attorney refused to ask my x for disclosure, so I did not know that my x had ,000 in credit card debt. The divorce papers say she’s liable for debts she incurred from the day I walked out on her, and for all debts that are in her name, which these 3 revolving accounts are. But, she hasn’t paid and yesterday, after getting turned down for credit, I checked my credit online and found out that two of her credit card companies have put charge-offs on my credit, a third one is about to, because she’s 190 days past due on it, and she never paid the phone bill so Embarq has put a charge-off on my credit, too, for 0, which is the least of my worries, but my credit score is barely over 400 now. Everything else on my credit shows "paid on time/as agreed". I’ve never made a late payment on anything my whole life.
I’m considering bankruptcy, but I own two homes (one is a rent house, both are mobile homes). The industry I work in is winding down and I had planned on moving into the landlord business. I’d planned to purchase an RV park, not only as a new career, but as my only retirement income, as well. I’ll be 50 years old in a few months. I don’t have years left over to build more credit.
Suing my x for whatever she owes me will not do any good, because she refuses to work, doesn’t have a job skill and will surely never pay me once I win in court.
My income is excellent, and I may make too much for Chapter 7. Also, one of my homes is in a mobile home park inside a city limits. My main home sits on 2 acres in a subdivision, outside of city limits. I’m concerned that if I file bankruptcy, I won’t be able to keep both houses. I also have two cars. One is a junker that my X trashed and gave back to me while the divorce was still pending. I owe less than ,000 on it. The other car is very nice, only 2 years old, and I owe a lot on it. I’m paying on all this, on time. My only concern is losing my homes and the good car.
Personally, I have no other bills besides the two house payments and the two car payments & their insurance. I have no revolving accounts.
