Here’s my situation. I was on the top of the world before I even turned 21. I worked so hard to accomplish my financial goals of basically owning my own house and own vehicle before my 21st birthday. Some where down the road I got lost… The great job I had to get the house, I had to eventually step back from to take a slightly lower paying job that offered insurance. To make a very long, struggle-filled story short. I lost everything. And when I say everything, I mean everything. My then fiance` and I split, needing to find our selves again. My new job wasn’t what I thought it was going to be. I inevitabley lost my house, my car, and had to stop making payments on all my credits cards because I quit my job to move across country (with my now husband) who is an Active Duty Marine (now deployed
). I know this is all over the charts, but since my husband is now gone, this is giving me a lot of time to fix/figure out our financial situation. Since my credit score is basically at the lowest point possible now, which bankruptcy should I file for? How does Chapter 7, 11, 13 etc work? My husband does make a decent amount of money, specially being deployed now. But really only enough to pay the bills and pay down his credit. Any and all information on this would be great.

Thanks KMcG. Yes – I am aware of th 7-10 year rule with bankruptcy. We’re even considering staying in the military (boo) to bandage all our debt.

My girlfriend and her husband are considering on filing Bankruptcy, but wanted to know exactly how it appears on their credit report? He already has a Foreclosure, Repossesion and countless of other delinquencies.Anyway, when he files for Chapter 7 will all those deliquent accounts be removed and the only thing appears on the report would be BANKRUPTCY or will it still reflect those creditors in addition to Bankruptcy? I think it would but that’s just my guess anyway if anyone here has filed and saw how it’s reflecting on their report, please reply.

I have a lot of debt and don’t make enough to pay medical bills off and such. Is chapter 7 the way to go?
Just so you know Jackdneverf, not everyone in this world has such a good life as you! When you have a job that has no insurance every time you go to the doctor it’s automatically 0. Don’t judge someone until you have walked in their shoes!

There is a utility trailer and some lawn equipment that is needed to keep the business going, would that be liquidated in chapter 7 or is work equipment safe? Chapter 13 plan is no longer feasible and there is consideration to convert to 7 but the work equipment must be preserved. Please let me know specific to New York State, because NY is always "different".

I was having over 70000 dollar credit card debt and about 32000 dollars in bank loans. i filed chapter 7 protection and my 102,000 dollar debt was eliminated. What other benefits exist beside elimination of debt?

My husband and I live in Alabama and initially filed chapter 13 bankruptcy 2 years ago. We have had to revisit our chapter 13 once to have the payments reduced and surrendered our home and a vehicle in the process. I am no longer employed and we have lost about 20,000.00 in annual income, that puts our total income at less than 35,000.00 per year. I have returned to school under a pell grant and it is just enough to cover tuition and books. I contacted our bankruptcy attorney’s office and sent them the paperwork showing the change in income and a letter from my previous employer. We had to send it certified because they claimed to have never received it by fax or email. We want to convert to a chapter 7. We are renting a home, my husbands work has slowed to a crawl, the bank has yet to take possession of our house that we surrendered, we cannot make our bankruptcy payment and I cannot get anyone from the attorney’s office to call me back with any answers. Would it be a bad idea to fire this attorney and start again with a new attorney? Or is it just the way things are? It took us nearly a year to get our first chapter 13 revisited and at this rate we are going to be in huge trouble if we can’t get something resolved. I might even have to cash out the little 5000.00 I have in retirement. ( I am 45 years old). Any advice. I cry every day.

I filed for bankruptcy Jan 2005. Credit card company "wrote off" the debt Jan 2005. I thought it was included with my bankruptcy, but when I check my credit report, it claims I still have the debt, it’s just written off. To be specific, my credit report states that I still have this amount from the one creditor as "revolving debt". Shouldn’t it state that it was included in Chapter 7 like all of the other creditors state? Any help would be wonderful. I just want to know if I have something valid to dispute.

My debts have been discharged in Chapter 7. However, a major electronics store has contacted me indicating they have a lien against a laptop computer purchased from their store (on a store credit card) and they want the property returned. Can this property be seized?

Can I just file bankruptcy? My husband is an authorized user on one of my credit cards, he has never signed anything. Can I have his name removed from the account? Where can I find a means test online to see if I’m eligible for a Chapter 7? Any help would be awesome- thanks!

I filed for Chapter 7 in 2007, I think, but it was just myself that filed. I was wondering when I would be able file again if I were to file individually again? Would I be able to file again if my wife also filed for Chapter 7?

I have a 341 meeting for a chapter 7 case on June 14th. Ive filed bankruptcy without an attorney so I don’t know what paperwork I need to bring with me.
I contacted the trustees office who’s handling it and they said they would need
2 months of bank statements
2 months of pay stubs
copy of petition
05, 06 tax return copy
Is there anything I will need to have with me on my person when I go to the meeting next week? Im without an attorney so I cant ask one

in 2005 republicans made bankruptcy laws much tighter. Despite it, I still successfully filed chapter 7 protection last year and wiped out 0000 insecure debt. The reason for cracking down on bankruptcy filers in 2005 by repubs were as follows — "people should be financially responsible". As if the government is very financially responsible? How can government tell people to be financially responsible when they themselves are reckless spenders like bailout, iraq war spending, etc etc? That’s being so hypocrite. Also republicans now say, "its not government’s job to tell people how to live". Again they defy their own advice. And most of all, its not person’s fault he goes into bankruptcy. The recession caused millions to become bankrupt, when they lost jobs. And in such situation Bush/Cheney led government tried to choke and hurt these people by making it harder for them to file chapter 7? Then why didn’t they let corporations file chapter 11 instead of being bailed out? Hypocrite republicans. Also shows republicans are only for the rich and not poor. This proves it.

I don’t know if it’s going to be chapter 7 or 13. I’m really depressed over this situation, had perfect credit my whole life until a few months ago when my mortgage lender kicked me out of the modification for no justifiable reason and put me straight into foreclosure
I have to take my income info etc. I’m confused because I wanted to initially sue my lender for not doing my loan and a BK disqualifies getting a modification, but on the other hand it stops them from auctioning the house. Anyway, if you have any advice or questions to ask please let me know.
Also, my mom added me on the title of her home a few years ago when she asked me to refinance her loan under my name since I had excellent credit. It’s in reality her home, just technically I’m on it until one day her credit is good enough to refinance back to her name and then she’ll drop me off of the title. Will this look like I have assets and affect the BK?

I had a discharge in 02/06 and wanted to know how long after a chapter 7 discharge that the court Trustee, can request information or try to take away income tax returns etc?

We are going to file for Chapter 7 this December. I was curious how many months they usually want to see. Most places I read it is 3 months. I am hoping it is 3 months because we were not expecting to file until now and our statements might look bad any further that 6 months back.
The reason we have to wait till December is that my husband had a previous bankruptcy before I met him. The lawyer told us to wait. We are not paying our credit cards because we can’t afford it.

I made the mistake of trying to pay my credit cards as long as I could instead of stop paying 2 months beforehand to use the money for a bankruptcy attorney. I can’t go back on that one and my cards ar 3 months late and one is turned over to an attorney already. I have no money, actually 2 months away from not even having rent money so I have no money to pay anymore (I paid a small payment for a while to them but that didn’t satisfy them) and have no money to file chapter 7. I called the legal assistance numbers for Texas and they don’t handle bankruptcy anymore. Why do you have to be a murderer, illegal alien, child molester, rapist, etc, to get free legal assistance in Texas? Every private organization that I was refered only handles illegals and real criminals?
I have no money, no car, no assets, and give money to my child who lives with my mom, so I have nothing for them to take and only make 600 month currently (my employer won’t let me work any extra hours and I got in trouble for working 15 minutes extra last week (I had a customer so I couldnl’t just go clock out).
this was supposed to be in credit but somehow ended up in singles and dating? Another good question
to answered number 4, my life changed completely last year after being stable for 14 years. Lost my family, home, job, etc. Paid my cards on a timely basis for 14 years and did have to depend on them for things like dental and medical (no insurance), clothes, and other of life’s necessities. Having no transportation limits job opportunities as does not being able to get out after dark because of the gang activity in my neighborhood. And no I can’t move, I have a lease and can’t afford to live anywhere else anyway.
