How do I file Chapter 7 bankruptcy on my own in Utah?

is there any language in bankruptcy law that prohibits a non-citizen of the U.S. here on a Work Visa from filing Chap. 7 or 11?

This sounds a little tricky but it’s not really. I am planning on filing bankruptcy in November as a result of a writ put on my bank account due to a credit card that wasn’t paid off (and I was never served the papers for).
I currently live in PA but will be moving to NJ in October which is in my favor pertaining to the BK I learned. Also I am adopting my cousin’s child who will be coming to live with me in Nov. I was told to wait until he is here to file because that will also help my case. My main concern is that I don’t want it to go to a chap 13 BK.
Any advice on what I can do right now to help set myself up for making sure it becomes a Chapter 7 Bankruptcy would be appreciated. Thank you for your help. Any spam answers, pointless one word answers etc.. will be reported.

When filing for Chap 7 Bankruptcy, under Schedule "J" do I enter all expenses that I incurred in the past 6 months even if I don’t think that they will continue AFTER the bankruptcy?
For example,
I had some dental work 3 months ago…that cost me 0…should I enter the monthly amount as 0 per months for the past 6 months?
I also has a lot of car repairs within the past 6 months..do I still average them out of the 6 month period and enter that amount on Schedule "J" as monthly expenses?
A chapter 13 bk is likely in my future. I’m looking for some real world pros and cons about this scenario:
I’m in chap 13 and making my payments, and I see a 00 auto repair coming at me. Would the trustee let me slide on 00 worth of payments to take care of the critical auto need ? IE, how do judges handle unanticipated expenses that happen while you’re in chapter 13 ?
The other alternative that I see is – stop paying my mortgage and bank those funds. Hire the bk attorney, get it all ready to file, then sit on it. Keep ignoring the mortgage and accumulate some cash until the foreclosure sale is imminent, THEN have my attorney file the chapter 13 to stop the foreclosure and add the mortgage arrears into the payment plan. This gives me a cash cushion to handle the surprise expenses.

We filed for Chapter 13 to protect the house in Foreclosure. Due to unforeseen circumstances, we may have to let the house go back to foreclosure and change Bankruptcy to Chapter 7 – what happens in a 7? What can the courts/creditors take from you if you owned a home that was lost? Hubby is worried the courts can come in and take everything – like collections and TVS, etc.
Do you have a Chap 7 story to tell – good or bad?
I filed for Chap 7 bankruptcy before the law changed in 2005. My house went into foreclosure but was covered in the bankruptcy because I knew I couldn’t afford to keep it even after the filing. I am of the understanding from the attny that I DON’T have to report this, but a CPA is sayin it is included. I am totally confused and wish that people in the legal field and cpas would make agreements on the law.
We are planning on filing for Chap 7 bk. We contacted a lawyer and his fee was 00, which includes all filing costs. He said no lawyer would take a payment plan and file the bk without being paid in full first.
1. Is the fee fair, low or high?
2. Is this true that no lawyer will get the bk filing process underway without being paid in full?
