I cannot find work and I have over 20K in credit card debt. What will happen to the cars I own if I file for chapter 7 bankruptcy? They are my only assets. I will be filing in the state of California. I am single and a non home owner.
I have had my 73 bronco for sell for almost a year now. No one is buying. What would that mean?

We live in Washington. We own a home that has 95K in equity – but we owe the IRS about 85K. We have gone through the pre bankruptcy counseling and they say we HAVE to file – because we are in the hole 6K per month (long story – I owned a business and got very ill). My income is commission only – and I don’t have commissions coming in which is why I need to file Pro Se’. Basically – do I let the trustee sell my house? Do I need an attorney to make sure the taxes are discharged (they have been owing for over 3 years and over 2 years since I’ve filed – and also the 3rd rule I’ve passed too) because that would be horrible to walk away without them discharged. I have 2 cars I want to give back. If I file now – how long can i live in the home and when do I need to surrender the cars ? I don’t want to milk the system – I just want to find a place to live and have enough time to earn a commission (should be 30 days away)
They may have changed the rules – but I know you can do it pro se. The reason I would even try is I used to be a creditor rep that goes to court and I reviewed every petition to find fraud. I know most things – it’s just the tax lien stuff and the sale of the home I don’t. My attorney wants 00 up front. It is so embarrassing – I used to make K per week – and now I’m reduced to not being able to pay an attorney. Life goes on.

Every since I lost my job last 8/27/08, I lost both my cars I have a tax lien do to the fact when I was working I was paying the IRS that I owe now each time I go on a job interview a credit report is pulled which means I don’t get the job because of credit issues I don’t want to file bankruptcy who should I talk to about this matter I did get a offer for a job no credit report was pulled on me this job pays only .00 what should I do

I am in over my head in debt. Every month I have to "borrow" at least 0 extra dollars just to pay my bills. My husband and I recently separated. He left me to take care of all the bills. Currently I am a 4th grade teacher and make about ,000 a year. That would be a great salary if I didn’t have to pay every cent to a bill collector.
Every debt is in my name (including a car that I got in my name for him, that he now refuses to pay for because someone else put another car in their name for him–his sister). I already had a car of my own. Now I have two. He didn’t have a job at the time, so most of the major stuff that we have gotten was in my name when we got married.
I am probably about ,000 in debt with credit cards; ,000 in student loans–I know you can’t put them on bankruptcy…I plan to pay them and go back to school next summer; 00 in personal loans; ,000 in car payments (2 cars–1 is almost paid for).
I have no extra income other than the child support (5 a month for 2 small babies that I raise alone). I use the child support on them instead of on me or bills because that is what it is for.
Am I an idiot for trying to pay all these bills off monthly and have no money extra to buy groceries and gas???Should I just file bankruptcy?

Okay i recently got into a car accident that totaled my car. And im now looking for another car but if i want to say get a chevy. Is it going to be hard to find parts for my car in the future or what is going to happen? advice on cars will be good to thank youuu

I am going to file a chapter 7 bankruptcy, and I will surrender my cars. I am up to date with both payments, but will not make March 1st payments on them. When should I expect to surrender them to the banks?

Got laid off and cannot afford to pay mortgages. I have 1st home refinanced and cashed out ,000 3 years ago when all was still good. Total balance left is ,000 First home is only under my name which was rented out.
Then we bought a bigger house 2 yrs ago at the peak of housing and Our 2nd home was under my name and my wife this time which became our primary residence which was also foreclosed recently. Balance owed on 2nd mortgage is ,000 was not paid during the auction (purchase loan not refinanced). Both 2nd mortage lenders are now asking for payment on the deficit. I have around ,000 credit card debt also. My questions are;
1) Will any of the 2 2nd mortgage lender be able file judgement against me here in California for garnishment?
2) Considering the concerns above, would it be better to file for bankruptcy? We do not have any car loans as 2 cars is fully paid.
3) If bankruptcy is an option, should I file on my own only considering it is only I who’s on the 1st home 2nd loan which was refinanced and only I who is owing all the ,000 credit card debt? Or is it better for us to BOTH file?
4) Will we be issud a 1099 for tax on those deficit? Are those not going to be forgiven?
5) If we don’t file for bankruptcy what is the advantage considering we have forclosed homes on our record? I noticed all our credit card limit are getting lower and lower every month bec. of the foreclosure.

I was told by a lawyer that I am judgment proof. I am ,000 in credit card debt. One of my cars is owned by my boyfriend who makes the payment but it is in my name. What will happen to his car if I file for bankruptcy?

my car was reposessed about 2 weeks ago and is just now going up for sale. If I file for bankruptcy is it really possible to get my car back before its sold. I believe filing would require the bank to put a hold on the sale.

and he hasn’t responded to our calls or emails on questions about our status. I am a little worried. Meanwhile my car was repossessed and they are looking for my husbands, what should I do? I could of used the money we paid him to pay on our cars, but we are filing chapter 11 to get one payment per month for all of our debts.

Could they take your money out of your bank account when you have debts and collection agency always looking for you? I am planning on filing bankruptcy but I will need to have money for other things like attorney and money to live. Does anybody of you know if after a while those debts if you don’t file bankruptcy they go into your w4 ?
Then you’ll find yourself owing money to the IRS through the franchise tax board. I saw it in a movie and is worrying me. I thought at the very least they can take what you own, like cars. houses, or anything in your propriety , but I never heard that, IRS or whoever, can take actually money out of your account…
I heard they can take money out of your paycheck.Yes,even giving you bench warrants like they did to me, when is court fines or law-legated debts.
But actually withdrew money from your account I never heard of it…please if you know anything about it let me know otherwise I have to be careful to put my rescue money in a bank account

With a bankruptcy they could get rid of all pension plans and health benefits to retirees, and pay current employees a much more reasonable wage. They could then produce cars that people want and can afford.

I am about ,000 or so in debt right now. ,000 of it is from medical bills from an emergency surgery I had to have (I had insurance to cover the surgery but they only paid 10% and now I’m stuck with the medical bills from it and NO way to pay them). I’m working full time but am currently switching to part time because I just recently had a baby and need to be able to stay home some of the time with him to cut costs on babysitting. I don’t care tht the bankruptcy will be on my credit for 10 years….it will take me that long to pay off the medical bills at the rate I can afford to pay them now…I also have diabetes and my prescriptions cost a TON a month…it’s impossible for me to work part time (or even full time for that matter) and even survive at this rate. I need to get an apartment for my son and I and just can’t do it with the amount of bills I owe. Is there a minimum amount of money you must owe before filing bankruptcy? Will I be able to keep my car?
I have one of the cheapest cars you can buy (Chevy Cavalier) and it is 2002. Someone suggested I sell it and get a crappy car for now…I can NOT do that. I must have a solid, secure car to make sure I have a way to and from work and also to have transportation to my son’s docs appintments. I need to keep my current car and my interest rate on my loan is locked and VERY low (3.4%). This car is great…but if I file bankruptcy will I lose it?
I don’t WANT to send my son to a childcare center. They are dirty and nasty. His father and myself will be watching him. And I AM working full time right now thank you. I can NOT afford the debt I owe either way….

My husband is self employed and that is our only form of income. I got fired from my current work. Can’t seem to pay our credit cards and bills. Getting collection letter now. Can we file bankruptcy and still keep the business and keep our cars?

Hi, my dad past away 3 years ago and my mom never worked, so when he died (he was 46) only had 100k for her and an annuity. She spent all the money on fixing the house, like my dad wanted, and paid off all the debt they had. The annuity brings in 0 and her bills are triple that! She’s financially dumb! She listens to nothing we say. She does have a job now, but only pays 5.50/hr.
She also has 2 vehicles, one leased and one on a loan, fully financed. She has come to the point of them sending the repo papers, but she pays them eventually, she asks for money from family.
Should she file for bankruptcy?

To answer some of the questions…..
1. she has two vehicles because my sister is in the same situation (spending more than she makes), newlyweds and already having trouble, so my sister has one of the cars!
2. I have bought books for her, but she’ll read maybe 10 pages! She does not want to sit down and see the whole picture, she use to do that with my dad.
3. She owns the home, she paid off a HELOC after my dad died.
4. She has canceled her sat., cell, pest control and is on a basic land line service. All she has is her debt.
5. She’s living off of her CC’s because she uses her 0 to pay the car bills and maybe part of the care insurance. My grandmother gave her ,000 last month and paid maybe 4 bills, including the cars, and still ended up over drafting 0 because she ate out too.
6. I’ve told her to sell, i’ve even posted an ad in craigslist myself, but she says she can’t sell because she needs a car! So frustraiting.

I make a good salary, but our home moretgage is too much for us to handle (it was a teaser rate and we are not even covering the interest). It is causing us not to have ANY money to do anything else. Considering I am the only one on the mortgage, would it be wise to go ahead and just file for bankruptcy and leave the home?
What happens to my other debts (credit cards, personal loans, rental property, etc)?????
Will it negatively affect my wife’s credit profile?
Will I still be able to finance cars, future homes, etc?
How long does it remain on my report?
