all these deadbeats who don’t pay bill and file bankruptcy are sore losers. Let these sore losers be punished when bankruptcy is abolished and they be sent to jail for not paying their bills. then the economy will improve, since there will be more financial discipline. My parents may be filling for a chapter 7 bankruptcy and have 4 cars in their name (my truck included). I just paid my truck off and am about to put it in my name. If my parents file for bankruptcy soon after I put my truck in my name can they still take my truck? I heard there was a year time period between letting go of assets and filling for banckruptcy before those assets cannot be taken. I live in Colorado Springs, im sure theres different laws depending on state of residence.

I have a few concerns and questions that I need answered. I have Googled the laws extensively but would like some human perspective.
I have a friend who downloaded software from Vuze.com. The software is a language software and the torrent he downloaded contained files from a bunch of different languages offered by the company. My friend can burn the files onto a DVD and the DVD can be used on any computer. There is no installation required or anything like that. He has posted the software for sale or trade in various cities on Craigslist.com. Originally he was posting the listings and including the name of the software. Soon after he received a cease and desist letter from company demanding that he remove the listings and stop. After that, my friend decided to post the listings but this time not include the actual name of the company. In the postings he does not write the actual name of the software, but rather posts listings such as "language learning software for sale or trade". Since then he hasn’t received anymore notices from the company. Once my friend receives emails from people who are interested he informs them of the name of the software and arranges to mail them the software. He later received payment via mail or PayPal. Like I said, I looked up all the technical legal punishments such as 0,000 fines, etc. I need your input on a few different questions.
1. Does the fact that the name of the software isn’t publicly advertised matter at all?
2. How exactly are people usually caught? I’ve read that the FBI investigates these matters, but is that typical? Are they doing it on their own or are they asked to by the companies?
3. If caught, what is a realistic punishment? I have seen people sent to prison, but in the story I read the defendant had made millions off of the pirated software and had cars, etc. seized. Could you really go to prison?
4. If you are found guilty in civil court and are demanded to pay an astronomical figure in the hundreds of thousands, what do you do? Would you be forced to claim bankruptcy? Are you allowed to claim bankruptcy since theres no practical means for obtaining that kind of money?
5. Would you have any further warnings or would your house just get raided in an attempt to look for evidence?
6. What kind of lawyer would you need to defend yourself and how much would it cost? What could they do to help you?
Obviously this is a serious matter and your advice is greatly appreciated. I am aware of the laws and have looked up as much as I can but I value your personal input and would like to hear opinions on what would happen realistically.

Well I kept it in my past gfriends name because she had better credit(I have no credit and I was getting paid cash)= no loan… The past gfriend decides to file bankruptcy and takes my truck well So now I am living a block away from work still functioning fine when the new gfriend ask me to me move in so … well i do and then she lets me drive one of the cars… Well we both quit our jobs at the sametime and open a limo company and a promotional company together. We are both smart and motivited so we have 3 sucessful events … Net 00 right out the gate we blew some of it paid some bills and put money back into other events… Then we start taking losers and the money haulted completly.. All the time we are out wining and dining blowing money left and right. 100 here a 100 there … all the time madly in love and living the dream… Well next thing I know we run out of money… Well she pulls out ,000 out of her savings to save us over the next 3 months. So during this time we both find jobs 2 months in… She got a salery job while I got a outside sales job…well she got paid while i have strugled on outside sales from b2b sales in dec(I made nothing thru training and learning). .. All b2b sales normally shuts down in dec. … Now she resents me and stop being affectionate and also talks down to me. Tears me down completely.. This pisses me off makes me feel like I am a loser, because she supported us for 3 months… I have had a relationship where I paid for everything for 3 years of course it didnt work out ,but 3 months…. The Mother tells her to break up with me, because I am struggling at my job thru dec… So we do get in this fight over the phone .. Saying that she cant take this anymore that she can have better and that I am the worst mistake of her life.. and I move out… 6 hours later she text baby " I feel like I cant breathe right now i have this empty hole in my chest" I need you back your my bestfriend and husband to be.. calls and saying… I have been sucessful before and I will be, but having someone that you are in love with tell you that you arent good enough is deft working against my confidence…
I love this Girl more than anything and I am totally proud that she is a rockstar when it comes to careers… I treat her like my queen!!!! She wants me to move back in? It has been 3 days that we have been seperate and she has ask me to come over 2 of those and spend the night and has acted completly like she was when we first got together…

He filed Chapter 7 bankruptcy with his wife this past fall. While we were married, we bought the car I am driving now, I am the primary borrower, he is the secondary. The title says me OR him and he was not required to sign in order for me to register here (I moved out of state for a year after the divorce then came back). I tried calling my leinholder (Chase) but they won’t refinance and my credit now sucks because I was out of work (right when I moved out of state) due to a broken leg.
I have been making my payments on time (for the last year almost) but am too scared to call Chase and ask them. I realize I should ultimately call a lawyer but figured I could gain some insight here. I have gotten a few notices from his laywer, listing myself along with the rest of his creditors. He owes me nothing – and in our divorce the papers say we were to take the cars we were presently driving, but neither was listed by make/model etc.
Can/will they repo my car? PS – I live in NH.
I was thinking perhaos because his name is also on the loan they’d take it…
What are the advantages and more so what are the disadvantages? I think i’m pretty up to date on the advantages, I hire a lawyer, he notifies companies I owe money, they have to write me off and can’t call anymore? Is that about right? As far as disadvantages I know it hurts your credit but so does defaulting on loans and credit cards, I owe about ,000 right now not counting my 2 car loans, and what happens with those, it won’t pay off your cars right? But it won’t hurt what you already have set up will it? I try to look stuff up online but can’t find any real help because it just pops up a bunch of debt consolodation companies and I already talked to one of those and realized it was only gonna save me about a month and stretch out what I already owe longer! my grandmother filed years ago and the lawyer was able to get everything written off and they kept their home and truck so I was under the understanding that maybe there are different levels or branches of bankruptcy? It is very confusing and hard to get a straight answer it seems for my particular situation, I think I may try to call a lawyer today and see if I can figure it out a little better. I went from making .00 an hr to .75 an hour because of helping a family member and my hubby makes about 0 to 00 less per week then he was making so that’s why we are in such a bad spot now, and there are no good jobs around here right now trust me I have been looking and applying for something better for over 6 months now.
My husband and I are in over our heads in debt. We owe approx 88k with cars and credit cards. We obtained the debt when he had a good job but now his job has changed and we just can’t pay minimums. We’ve seen a bankrutpcy lawyer who we didn’t like very much and another who we liked. The one we like costs 1300 dollars more and we just don’t have it. We really don’t want to file bankruptcy but w/ a new baby, childcare expenses, a new job, no childcare for one of us to work part-time (due to conflicting schedules), there seems to be no way.
We’re already behind on credit cards… should we scrounge up 500 to pay the retainer and find some way to get the remainder for the good lawyer? Or use what little we have for the crappy lawyer and file there? OR should we just wait until it gets worse to file just incase life seems to throw us something great? HELP!

What do you do to fix your life when you’ve had to file bankruptcy, a teen turns to heroine and steals everything (but is 26 now-living away)– too little too late now – all gone, you lose your home after cancer, you’re working very hard, you owe a lot of money to a lot of people, your cars keep breaking down, you owe the IRS, you have no health insurance, you lose your job (lay-off) and can’t pay car insurance, car insurance lapses and then you can’t get new insurance because it costs MORE because you "let it" lapse, you can’t get ahead because bad bad things keep happening – for years and years and years (not a new thing), you are feeling helpless and hopeless. There’s no help out there because of course you "make too much money" for assistance. No family to help (you don’t want to take from anyone anyway) and you are afraid to wake up every morning? Plus you have a wonderful teen who deserves the WORLD and he’s gone without for many years himself because of everything?

I am on the verge on leaving my boyfriend. Its not so much him but its our living arrangement. It is us my 3yr old and 3 big dogs that are not house broken. They are constantly going to the bathroom in the house and I have told him i refuse to clean up after his mutts! He wanted all these animals in this house he needs to clean up after them. He considers cleaning up throwing a towel over it and picking it up a week later. We have had to rip up all the carpet in the living room and hallway because the puppy he bought me could not stop going to the br on the carpet. I wanted to crate train her but no he didnt want to leave her in a cage all day. So therefore everyday is a new adventure to see what kind of mess she ahs made, emptying the water dish all over the floor or his other dog knocking over the food dish all over the floor. He is so lazy! We have to walk around with shoes on 24/7 because of the dogs. One pees everytime she lays down just about, one has her spot in the kitchen and the other goes right in front of the kitchen. Its not just that. We just dont see eye to eye on the kids. I am more laid back when it comes to the kids, well mine anyway. he is 3 he is going to play and crash his cars and just be a boy. Not while he is around. I dont know, maybe its just me but I just want more out of life! I am constantly broke cant even afford to go to the grocery half the time! I am overweight because i cant afford to buy the foods i like to lose weight to eat right. I had to file bankruptcy 3 months after moving in with him. Here it is 3 yrs later and I am still not happy! I love him but I want more for my son and myself. I want to be able to provide for my son and have money to do for me sometime. Is that being selfish? Now that I am seriouly thinking of leaving I feel guilty. Why should I feel guilty for wanting to be happy? I am scared to death to even say anything to him about it. I dont know how he will react. My live-in-fiance has HORRIBLE credit, & as of right now we are renting & financing 2 cars. Everthing including credit cards & cell phone contracts are under my name, eventually we want to buy a house, but either way we need to fix his credit. Alot of the debt is unpaid hospital bills (was unemplyed for 8 mnths & in those months he got very ill & no ins.) and some of the debt are from when he was younger & abused credit cards.
He owes a bank 0 & now cant even get a back account under his name.
I would say 1/2 of his debt is from 8yrs ago & the other 1/2 (hospital bills) are current.
My question is should he try to consolidate the debt or just file for bankruptcy. His medical bills are about ,000 alone. Misc debt is about ,000.

I have a home in Las Vegas which I am trying to short sale, which I believe will ultimately end up as a Foreclosurer. I lost my job 10 months ago when my industry took a crash due to the economy and have been burning through my savings to support my family.
Now that I am working again my payments are the same but my pay check is 1/2 of what I use to make, so its a struggle. I have almost depleted my savings and come to a fork in the road. I have about 25K in credit debt and my credit card company just raise my interest rate so high I can’t possibly afford the new monthly payment. I have tried to get them to help and they said thats the way it is and when I check the internet, this is happening to millions of people.
So here is my question.
Since I will have a foreclosurer on my record, is it worth trying to work to pay off the credit card company or just file for BK and start over.
I have always have perfect credit (790) and this is really bothersome to me. I buy cars every 2 years and always got the best rates, so I want to try and save my credit, but with a foreclosurer on there, will it really matter if I pay off the credit card or not?
My credit is already shot and need to get on the road to rebuild it and I can probably get ,000 to pay off the card, but that will be my entire savings and would leave me in a more volerable state.

Thanks to idenity theift i pulled my credit, i found alot more than i expected but as it turns out they do all pan out. I am thinking about filing chapter 7 bankruptcy but since my wife’s credit is good we dont want it to show on her file, heres the thing. We are young we have nothing in our name our house is owned by her parents our cars are paid off we have no loans or anything of that nature with both of our names on it I would be filing by myself with out her. All my bad credit is old starting when i was 18 and I want to get a fresh start and with all the old medical bills and things bankruptcy seems the best for our family. I’ve read alot on these sites saying your credit is there credit and when you are married there debt becomes yours, this isnt true my wife’s credit score is over 700 while mine is in the 500’s this is why i am asking i dont want it showing up on her file…. does anyone get what im trying to say???
In 2001, we signed a deal with an auto consignment dealer that they would sell our 2000 Pontiac Grand Am for 250, which they did later that year. However, about a week after they sold it, they declared bankruptcy themselves, which left quite a few car owners pretty ticked. In all, I believe they had sold 60-70 automobiles, kept the money, and then filed bankruptcy. So basically no one got paid after they had sold their cars for them. My husband and I had a loan for the car through GMAC, which we continued to pay while it was at the consignment dealer. However, after the car was sold and we realized we were not going to receive any money, we realized that we would not be able to afford to pay GMAC 000 for a car we did not have (this was why we were selling in the first place). So our loan defaulted and we were forced to file bankruptcy in 2005. Our case was closed and all debts discharged on July 29 of 2005. Today, I just finally received word from the trustee of the consignment dealer’s bankruptcy case, stating that we should get 0 out of the settlement (about 6% of the 250 they owed us). Now my question is ths: what do I do when we get the check? Is it supposed to go to GMAC or have they written this off as closed since the bankruptcy was closed? I am going to try to call our bankruptcy lawyer in the morning, but if I remember correctly, he’s somewhat hard to get ahold of, so I thought I would check to see if anyone knew on here. I mean your credit will be horrible either way and it will stay on there 7-10 years. But the difference I can see is you don’t have to say you filed bankruptcy and you don’t have to pay a lawyer. And quite honestly if you are going bankrupt, how the hell are you going to pay for a lawyer anyways?! Well I don’t even know, so please give me your feedback…THANX!
well let me clarify the situation…it is a business that will be going bankrupt not me personally. and In Texas they CANNOT mess with your homestead or cars..so I know I don’t have to worry about that…
I would like to know if my husband should file a complaint to the Labor Department, because of his boss… abusive behaviour; until a year ago… his boss was paying him a salary that was of $ 800.00 at the beguining to $ 1,000 dollars weekly, actually, this fixed salary was on for ten years, and now the boss…simply decided to stop paying this ‘fixed’ salary (currently 1,000 per week) blaming the national financial crisis, and put my husban on ‘commision’ for the cars he is able to fix…. in a week, the problem is some times he gives a car only 100 dollars of labor.. or only 20 hours of labor, and do not show the insurance company stimates on the cars, … and my husband ends up working the whole week (more than 40 hours) plus the saturdays too!.. just to earn 350.00 dollars!!! we are getting in bankruptcy soon because of this, this is a loss of more than 600.00 dollars… per week, and we can’t go on like this; the truth is he is working the same an even more hours… but he earns only 350.00 or 400.00 every week! this is after the change in the payment method from a fixed salary to ‘comission’, and I think it was a way of stealing his money!!. My husband is getting old and the boss is trying to abuse him by stealing him the money of salary. Besides the boss (mananger of car repai shop) blames the financial crisis for this change.. but he employed more people! and work production seems the same.. no less. My husband have been working in there for almost 14 years. My question is: Could he ’sue’ his boss… for discrimination, I think this discrimination is because of course my husband is not as young as he was when he started in this job of car repair technnician. He is certified technician… has to paid to his certification classes every year, and pays by himself a lot for tools.. and earning 350.00 per week is absurd!~… he hasen’t leave because first we want to know his rights.. but don’t know where to go. I am in over my head in debt. Every month I have to "borrow" at least 0 extra dollars just to pay my bills. My husband and I recently separated. He left me to take care of all the bills. Currently I am a 4th grade teacher and make about ,000 a year. Every debt is in my name (including a car that I got in my name for him, that he now refuses to pay for because someone else put another car in their name for him–his sister). He didn’t have a job at the time, so most of the major stuff that we have gotten was in my name when we got married.

Would it be more beneficial to file for bankruptcy if you’re in over your head and owe a good chunk of change or stick it out and in time and years get things paid off little by little. Which looks better when applying for life items such as Cars, houses, etc.
And in the long run, which will a company trying to finance you see as the better option?
I guess I’m looking for pros and cons for both options.

Thinking of filing bankruptcy but not sure how to determine Chapt 7 vs Chapt 13. Most importantly we want to keep our home and cars. We have credit card debt that we cannot keep up with anymore. Talked to a credit agency and they suggested contacting a lawyer to explore this as an option. We are in Jefferson County Missouri. I need to find a lawyer to answer some questions. Any suggestions?
