I filed in March 2007 and expect my actual discharge letter in the mail any day now-wait, is that the mailman? My bankruptcy already shows up on my credit report and my credit score isn’t so terrible! Specifically, I want to know if its o.k. to start applying for ONE SINGLE credit card and a car loan. That’s it. I’m rebuilding my credit on those two things. Period. Thanks.

I have a chapter 7 bankruptcy that was discharged in 2009 april….i have a company who is now trying to collect their debt that was discharged….they have even put it on my credit and I was actually denied a car loan due to this debt…..can I do anything to them legaly…ie…sue them or somthing and it should be their resposability to fix this on my credit right.

My husband and I have been trying to buy a house for 2 years. We both pay our bills on time and make decent money. The problem is that a few years ago he co-signed for a house for his sister. She moved out and quit paying for it and no one informed him until 3 days before it was supposed to foreclose in his name. They said we had to pay ,000 when he only cosigned originally for ,000 or the mortgage company was going to sue. She had put all her credit card debts and her car loan on the mortgage. So he filed bankruptcy to avoid being sued for ,000. Now all debt and credit is in my name which brought down my credit score and he has a bankruptcy on his credit report. We can’t seem to find any bank that will loan us the money to buy a house because they say my debt versus income to not good enough and his name can’t be on the house because of the bankruptcy. What can we do to buy a house?
It’s been 3 years since the bankruptcy. They did try to contact us many times, but they were mailing it to the address that he cosigned for. We lived somewhere else and didn’t know his sister moved out. They finally found us last minute. He had signed when she did refinancing at one time, but he he didn’t realize how much it was for and didn’t think his own sister would screw him over.
The worst part about it is that even with a bankruptcy he still has an awesome credit score and hardly any debt. He always has been very responsible when it comes to paying bills. One lender at our bank knows that we always pay off our loans, but he can’t seem to convince the other guys that don’t know us that they are safe to loan us the money for a house. So some advice to people: don’t ever cosign for anyone. Even if you think you can trust them. It gets honest people like us into a lot of trouble.

I am so broke. I even tried to look under the seats of my car to find enough change to buy a kid I work with a 54 cent ice cream cone he earned by good behavior and grades for 4 weeks but I did not have enough. I lied and said I forgot my money at home. So I took him to park and I owe him a ice cream next week I work for a small mental health non profit and my husband has been out of work for two years. I was able to make ends meet except for one credit card,student loan and my car. My student loan took my tax refund for the past two years but I still owe them two thousand. I had the car voluntarily repossed because I could not afford it(big mistake because now the court says owe 10000 when the loan with interest was only 6000 and I paid on it for 2 of the 4 years), The credit card got a garnishment that takes 400 a month from my pay at 25% pre tax which is more than I take home in two weeks now, and now the bank(car loan) has sued me too and wants to garnish me too but I don’t make enough for them to take anymore. I am so tired of eating peanut butter sandwiches, soup, or beans that I get from the food bank. If I could find some way to file bankruptcy I would be ok, but I have no clue where to start. Any help would be great, even the info needed to file or ask for help. I just cant do this much longer.

When I pull my credit report it is showing that it was discharged through bankruptcy. Who am I still paying my car loan too if there is no longer a loan on it and how will I know when it is paid off if I don’t have no coupons left to pay with. I live in Pennsylvania.

I am a co-signer on a car loan. I filed Ch 13 due to other financial reasons and listed the car. Now the other person filed Ch 7 and is giving up the car. I can take over the payment but I want to make sure that the title gets released once the loan is payed off, not when my bankruptcy is discharged in 5 yrs. And the title says "or". Help!

I have a few credit cards and a car payment in a debt consolidation. It isn’t moving as fast as I would like. I haven’t had or driven the car for 3 years. The car loan is under my and my sister’s name. How would it affect her if I where to file bankruptcy?
The car has been totaled out and sold at an auction. The insurance didn’t pay.

I am considering filing without an attorney. Situation is a wage garnishment for an 11k judgment that looks to be for credit card. (I’ve been disputing this for years trying to prove it’s fraud but clearly haven’t been successful – another story) Background: single mother, head of household, 2 kids, one student loan about 7k, one car loan, about 7500 left to pay, don’t own property, no assets; all my earnings go to rent, household and child care. I’m not behind on car or student loan payments. I just can’t afford wage garnishments and I think a bankruptcy is my only option to cease the garnishments. Since this 11k judgment is the only debt I need discharged in the bk, I think I may be able to manage this on my own instead of hiring an attorney that I can’t afford. Anyone have personal experience with this or with paying for a sevice that helps only with paperwork?

My husband and I are starting the process to file a chapter 13 bankruptcy. The majority of the debt is from him buying a ridiculously expensive car without my consent when we first married. My name is not on the car loan. I’ve pretty upset and fed up. I am considering at least separating from him while this is going on. Is it better that I wait until the bankruptcy is final, or should I do it now? I don’t want to ask our lawyer because I don’t want to make this worse than it already is.

I’m filing for bankruptcy…included in the list of creditors that I can’ t pay off….is a Car loan. Actually it’s something called a smart buy—kind of like a lease but it’s actually in your name and owned by you. I’m still making payments on this vehicle and when it’s turned in I will owe thousands in over mileage which I can’t afford to pay.
My question is — Should I do a voluntary repossession on the car? If so when? Before I file or as soon as I file?

I’m 20 years old and about to go through a divorce. I have a CC in only my name that my husband has run up to ,000 in debt. I also have ,000 in student loans. I am co-signed on his ,000 + car loan and I am the primary on my ,000 auto loan. If I file how will it affect our cars. I can afford to pay my monthly payment although it is steep. BTW it wasn’t my idea to get expensive cars! Also my wedding ring went missing a couple monthes ago when I took it off to do dishes. Can he legally get me to pay him back for the ring?
My car is only worth 000. The other 000 on top of it is negative equity from previous vehicles my husband kept on trading in for "better" cars. I can afford to pay for my car. I am co-signed on my husbands car b/c if I didn’t I would have been the only name on his other car. He has bad credit too. I had great credit BTW before I met him. He’s been through so many cars I’ve lost count.

We got a home equity loan in June to consolidate credit card bills, another home equity line, and small construction loan. Things were fine until I was recently diagnosed with multiple sclerosis and declared disabled. I receive social security, which is currently one-half of my former salary, but only until my children graduate when it will drop to one-third. We now realize that we cannot pay for my graduate school loan (simple bank loan-not federal), the car loan, the equity loan, AND the home first mortgage. We can pay for a cheaper car and the first mortgage for the home, but not the equity loan too. Can I put SOME not all of the equity loan onto my unsecured loan to "pay it down" so that when we file bankruptcy we can afford to keep our home?

If you have debt including car loan, credit cards, and other misc debts more than the amount you make in a year or more is filing Bankruptcy the best option? I am young with a child and have accumulated so much debt making bad decisions and now I have to face the situation sooner or later. There really isnt any other option I can think of besides consolidationg or a debt management plan and if I were to consider a program like that I would be able to afford that. I am young and I figure if I was to file BK and get a fresh new start things will get better for me. but then I will have to face the penalties of filing BK and after that your credit score is ruined and alot of companies try to charge you an arm & leg with rates and everything. Eventually I want to buy a home dont want to have to rely on people for a co-signer everytime I will need credit. I sure can say this is a learning experience. Please respond if you fell you have good advice in this situation.

I am currently in the process of filing for chapter 7 bankruptcy. I have not yet had the meeting of the creditors. At the same time I am in desparate need of a new car. I spoke with my attorneys office and they told me to apply for financing before filing for bankruptcy. I have read online that the car could be taken away. I am seeking some guidance on how to go about this. I know that once the bankruptcy is filed my credit score will drop so badly that I probably will not be able to get a car loan, however on the other hand I am also afraid that once I file bankruptcy the bank will take away the new car.

I received a notification in the mail that my wages are being garnished by a credit card company, for an outstanding debt. I cannot afford for this to happen because I am a single mother of my daughter. How much or what percentage can be garnished? I live in Maryland. I read on a website that they can take all but 0 of my check a month. Is this true? I am currently unemployed but I have had numerous job interviews. I assume that once I become employed my wages would be garnished immediately. I am thinking of filing bankruptcy because I have other credit card companies that will be coming after me for money that I do not have. I heard bankruptcy can be filed online to save money for a lawyer. I do not have money to pay a lawyer. PLEASE HELP!
Yes, I did have a court date but I did not go because I knew I owed the money and I did not have the money for a lawyer.
I’m afraid if I don’t file bankruptcy I will have no money left to raise my daughter. I owe about 00 to different credit card companies. Can they all garnish me at one time? If so, I may not have enough money to get my daughter what she needs.

I filed bankruptcy in 2005. My car loan was included in the bankruptcy. The loan was not reaffirmed, but I kept the car and continued to make monthly payments. The car company has made me pay through their "bankruptcy department" and won’t send me bills or provide me online access to my account. If I let this car go back, will it be counted as a repo, or is it part of the bankruptcy? My lawyer at the time said that it would be part of the bankruptcy and the car company couldn’t count it on my credit as a repo if I ever lost the car. But he wasn’t that good of a lawyer. My credit is really really poor, so would a repo on my record really hurt me at this point?

I am currently being sued by a credit card company for 20k. And owe approx. 10k on other credit cards. I rent my apartment and have a car loan. I registered with a debt settlement company, but don’t think they are helping me resolve my current legal issues. I have approx. 2k saved toward a settlement on my credit cards, but no other savings. I am 30 years old, single and have a young daughter. I want to solve my financial problems and hope to buy a home one day. I am lost, confused, and very unsure about what my best options are. I did 2 years of active duty in the military and when I got out in 2008 i went back home (Los Angeles). i got out with a 15,850 dollar "Car Loan" I’ve been unemployed since then, now I have a 35,000 dollar debt. I am still in the reserves but I can’t find a civilian job. I just received my phlebotomy technician certificate and I’m looking for work on the medical field. the 35,000 dollar debt does not let me live in peace I can’t think right. I’m only 21 years old, I wanna go to college. I don’t know what to do, I’m about to be homeless. I need help. Please give me some advice. Anything would be helpful.

My husband is getting ready to file because we are going to lose our house.. the only other things he has is one credit card and his car loan… but I’ve heard the law has changed now to where you have to pay money back.. but do you have to pay everything back or is it only part of it..? and do we have to turn in our car after we file?
