I live in Florida and have spoken with a Bankruptcy lawyer about my situation. I had excellent credit prior to a house I had up for sale being on the market for 6 months and tried to sustain two mortgages plus expenses on both houses and a lot of credit card debt, mostly used to fix up both houses.
It’s been since March 2007 that I made my last credit card payments. I took all of the 00 I received as a tax refund and paid it on 5 different cards.
I called the credit card companies and tried to set up a payment plan of some sort because I was drowning. NONE of the 5 would and acted really crappy when asked. The phone calls also bordered on harassment.
So, eating ramen noodles and peanut butter started pissing me off. If they didn’t want to work with me, then I wouldn’t work with them.
I changed my telephone number and stopped paying them.
After speaking with an attorney early this year, he stated that unless I was faced with court papers to appear, to stave off filing for bankruptcy. If I did file, it would be for Chapter 13 he stated.
I wanted a second opinion so here I am. My questions are…
If I do not file, the statue of limitations runs out in less than 2.5 years for the state of Florida. If I am not served a summons, after the SOL runs out, can they still serve me with papers?
If there is no summons or judgment, will the charge off debts stay on my record for 7 years from the last time I paid the credit card company? Or when the debt was sold to a collection agency which I think is usually a year afterwards (they all have been sold).
If the debt is sold again to another collection agency, does my time start over?
On my credit record, will there be an entry for the credit card company debt AND the collection agency?
I simply want to know when the credit card company debt and charge offs will drop from my record if I do not pay them.

The SOL is 4 years, it will run out in 2.5 years since my last payment is what I was referring to.

In 2001, we signed a deal with an auto consignment dealer that they would sell our 2000 Pontiac Grand Am for 250, which they did later that year. However, about a week after they sold it, they declared bankruptcy themselves, which left quite a few car owners pretty ticked. In all, I believe they had sold 60-70 automobiles, kept the money, and then filed bankruptcy. So basically no one got paid after they had sold their cars for them. My husband and I had a loan for the car through GMAC, which we continued to pay while it was at the consignment dealer. However, after the car was sold and we realized we were not going to receive any money, we realized that we would not be able to afford to pay GMAC 000 for a car we did not have (this was why we were selling in the first place). So our loan defaulted and we were forced to file bankruptcy in 2005. Our case was closed and all debts discharged on July 29 of 2005. Today, I just finally received word from the trustee of the consignment dealer’s bankruptcy case, stating that we should get 0 out of the settlement (about 6% of the 250 they owed us). Now my question is ths: what do I do when we get the check? Is it supposed to go to GMAC or have they written this off as closed since the bankruptcy was closed? I am going to try to call our bankruptcy lawyer in the morning, but if I remember correctly, he’s somewhat hard to get ahold of, so I thought I would check to see if anyone knew on here. Help! My bankruptcy lawyer is delaying to file my case. Every time I ask him did he filed it he finds excuses, and that he will file it electronically .When i ask him is there any problem he said no everything is ok. Now it’s already three weeks and he still didn’t file my case.

I am considering filing for bankruptcy due to extensive medical bills. I have a car that was totalled, but I owe ,000. I had a co-signer sign for the car. Does anyone know what happends to that person after i file?
Do I get to keep the car? The car has no value and barely drives.
Also does anyone know of inexpensive alternatives to using a bankruptcy lawyer. In california we had a legal document service called "We the People" I am residing in TX.
Can i do the paperwork myself?

1. I have Garnish on my wages right now..can chapter 7 stop or erase any of garnishment against me??

When we filed for bankruptcy last year, our bankruptcy attorney asked us if we had any pending lawsuits. We replied with a yes, as I had to hire a personal injury lawyer cause of a car accident we were in. We were forced to get a lawyer because of the extensive medical bills…the insurance company of the at-fault driver refused to pay any of our bills…my medical bills were over ,000 & growing with my treatment and Dr’s. didn’t know when I’d be finished receiving treatment. With us already paying some of the bills out of pocket, it got to the point were forced into bankruptcy….there was no other way. We were told by the trustee and our bankruptcy lawyer that all monies received from the personal injury case would have to be applied toward the creditors in the bankruptcy. So in the end…these are the figures…
P.I. lawsuit total: ,000+.
P.I. lawyer got his cut: ,000+.
Leaving ,000+ to creditors. Could we have lied & gotten all of the ,000 w/out getting caught

I am 22 and paying for my financial mistakes when i was younger. I recently just finished paying a garnishment for a apartment I once had, and I just received another noticed today that I would be getting another garnishment starting with my next pay check. I have gone to see a bankruptcy lawyer as well as a credit counselor, but have been to scared and confused to make a decision on anyone of them. I’m not really sure how exactly how much money I owe between, credit card companies, medical bills, etc. I’m not sure what I should do? I mean bankruptcy stays on your credit score for 7-10yrs but I’m only 22, but at the same time I would rather it not be on my score at all. Any suggestions?

I filed chapter 7 in 8/08. As of today, the house I surrendered is still in my name. We moved out in 4/08. No notice has been posted in the local paper. The county has cited me for code violations since my name is still on the house. I can never move on with my life and credit unless I can get my name off of that house. My bankruptcy lawyer says not to be concerned. Help!

I will be filing chapter 7 bankruptcy and I paid 00 to the bankruptcy lawyer. The attorney advised me that if I get any collection agency calls, I tell them to contact him instead of me talking to them.
So per his advise, I keep telling creditors that if they have any questions, they kindly contact my bankruptcy attorney instead of calling me. However, a collection agency named CFO financial says that they will still continue calling me for payment regardless of the fact that i provided them the lawyer info.
Isn’t this harassment? The collection agency clearly knows it I cannot pay and they know it I have retained a bankruptcy lawyer and they know it well chapter 7 is on the way. However they insist to call me instead of communicating with attorney. Why?
I am tired of telling them "to contact my lawyer" and they still keep ringing the phone a lot. Isn’t this supposed to be a violation of my rights?
It seems this collection agency is asking to be sued by the attorney for doing this. Why?
Also they seem very stunned that I have the ability to pay 00 to the lawyer. They kept saying, "are you sure you made the payment to the lawyer? are you aware the payment for the lawyer is more than what you owe us?"
They keep on pressing me to communicate with them, and the lawyer said never to open my mouth except to refer them to him.
abel, this is a useless answer. my lawyer has already pulled my bankruptcy report from all 3 credit bureaus.
cat dad: they have ignored my letter.
i mean NCO financial, not CFO financial.
should i let my bankruptcy lawyer know about this? or i should not bother him?

We live in Blue Springs MO, we need to file for a chapter 7 bankruptcy and so far all the lawyers we’ve contacted seem very expensive, and my husband does not have a job right now so money is very tight! So if any one knows of a good cheap bankruptcy lawyer let me know!

I am looking for the best bankruptcy lawyer in las vegas that won’t cost me and arm and a leg since I obviously don’t have the money. And possibly someone who takes payments, although I think most of them do. Any suggestions?

I am in a desperate situation. (Please, do not judge or criticize) My husband and I went to a financial counselor who told us to get a bankruptcy lawyer. We owe a lot, especially credit cards. We both work fulltime and have a decent income, but somehow the expenses has gotten out of hand.
I have an app’t next week with a lawyer. What can expect if we go this route? Anyone with experience with a personal bankruptcy?

his job I am told but 2 years later I took everything off then I go to refinance and the lawyer at new bank says there’s a lien for 21000. Meantime his broker promised me the world. Now it’s been 2 1/2 months of holding 30,000 dollars of mine. Will not return phone calls I have called numerous times. I am disabled and now my mortgage went from 807 to 2100 I make 1200 a month. I put 140000 aside to pay mortgage till credit goes up but, don’t look good to me I am broke. Then he paid the Bankruptcy lawyer behind my back 450.00 to reopen the case which I swear wasn’t was not on my credit report. Or in the house of deeds. He wants more he told me. Does he get it? Isn’t one price it. If he did do it? . I called the Court House it was written off. Will legal aid take care of this? I can’t afford a big lawyer and don’t trust anyone after 3 predator lenders and two lawyers who are playing with my mind. At 18 percent a day. Legal??? Please someone.
