Are there any prohibitions against one bankruptcy trustee hiring another bankruptcy attorney to provide legal services for a bankruptcy estate?

Can bank foreclose if you've never missed a payment?? Does anyone know the law here? Help.?
OK….So my Mom (She’s 72) filed bankruptcy protection 7 months ago as she has a retirement income and only one house….So now an attorney for the bank that holds a small mortgage on the property has filed a motion to "Lift the stay" on the house so the bank can immediately foreclose on the property. BUT….She has never failed to pay the monthly mortgage payment or been late on it. Even after she filed for protection. So….How can I help her? Should she file a answer to their motion right away to the judge? Her bankruptcy attorney is busy or wont help. I’m trying to get her to find a new attorney…But for right now, what should she do? How do these things play out?? I’ve had a hard time understanding how a bank can expect to foreclose on someone who’s paid their mortgage? Will the judge take them seriously when they’re dealing in speculation (What might happen) and not absolutes?? Thanks for any help!!
Not sure if any of the covenants of the mortgage have been violated…What’s an example of that type of violation? All I know is that she’s paid every month on time.

I’ve tried getting second jobs,going to credit counseling services.I’ve had 2 car accidents in the last year and also I was sick or hurt a lot in 2006 as well,so those things impacted my wages a lot.Now I’ve even contacted a bankruptcy attorney as well.What are some other ways I can try to get around my debt problem if they are any,what would they be too.
Do I have the ability to bring legal action against my attorney?
Our (chapter 13 bankruptcy) attorney failed to subimit documents to the court. He directly lied to us and told us that he did. We’re in the last year of bankruptcy and in need of purchasing a car. He told us almost 3 weeks ago that he submitted the papers to the court and then admitted to my husband today that he didn’t. What recourse do we have? Thanks in advance…

And just for everyone’s edification… it was not because we had out of control debt. It was because we had a child that was born with extensive medical needs far and beyond our insurance and the fact that I needed to stop working for 3 years. It was all medical debt.

Where would I go if I want to sue my bankruptcy attorney for misrepresentation?
I hired a bankruptcy attorney to file a chapter 7 and I completed all my paperwork and credit counsiling all within the time limits, and then I got a letter from the court saying that my case was being dismissed due to some paperwork. I contacted my attorney’s office right away and they told me that they didn’t file some paperwork, but I shouldn’t worry about it. They told me to show up to the court appointment anyways, that they would take care of the paperwork. Me and my wife showed up to the court, seen our names on the calander and talked with a attorney from my attorney’s office. She told both me and my wife that the trustee might not hear our case because of the paperwork issue. Sure enough we did not get seen that day. The attorney that was there said that the office would be in contact with us within the proceeding three days, and I never heard from them. I have been trying to contact them for the last month now and I have been getting the run-around. This is bull! I need help! I had money taken from my account after I retained my attorney and nobody can tell me where my money is and if im going to get it back.
Our bankruptcy attorney will not return our messages?
Husband lost his job – we’re now on one salary and barely scraping by as it is. We are now so far behind on our debt bills and none of our creditors are willing to work with us, so we’ve decided to file for bankruptcy. We located a bankruptcy attorney and he gave us a list of things to get together and to complete an online credit counseling course. While getting our things together he was quick to respond to our questions. We sent all our documents to him last week (tax info, payment stubs, bank statements) and now he won’t call or email us back. Should we assume that he’s not going to assist us? Could this be a scam and he’s planning on wiping us out using the info we gave him? We looked him up in our state’s Bar Association and he was on there. What should we do?

I’m meeting with a bankruptcy attorney tomorrow morning. This is only because in 6 months, I have been unable to find a job and my unemployment is going to run out. I want to start a criminal justice program and I originally had planned to wait till I had a job to make monthly payments, but would it hurt to add the 0 to my already 00 credit card today? Chapter 7 Bankruptcy Attorney in Florida?
Can someone recommend a knowledgeable Bankruptcy attorney in Hillsborough, Pasco or Pinellas County? I was told that I may be able to charge-off my income taxes, if they are 7 years old. I have to file a Chapter 7 Bankruptcy as I can’t afford to pay my outstanding bills. My IRS taxes are from 2003 and 2008. The 2008 I only owe about 0. The 2003 I owe over ,300. I can’t seem to get ahead as I’ve only been paying monthly payment agreement that I made with them in January 2010. I can’t afford to pay any higher, as my income is extremely low. I also have private student loans from a bank, but they are not listed as student loans; they’re listed as private loans. Can I have these private student loans discharged as well? I owe about 0,000 in debt which includes income taxes, federal student loans, and other financial debts.
Will I loose my car due to a chapter 7 bankruptcy?
I have recently retained a bankruptcy attorney, but I am hesitating filing because I am afraid I will loose my car. I don’t even own my car, it is still being paid for, which I am current with my payments, in fact i’m not even filing against it. I’m afraid I’m going to have to decide whether to be debt free or have a way back and forth to work so I can raise my daughter, someone please help!
Is the attorney bound to Attorney-Client Confidentiality?
I may file bankruptcy and one of our accounting clients at my work is a bankruptcy attorney. If I were to go through them for assistance (as they’d probably give me a price break), are they bound by attorney-client confidentiality to not turn around and openly inform my employer of the services they provided me and/or any information regarding my debts, etc?

Is bankruptcy moral when one has lost their job and can not pay all their debts?
If you must choose which debts to pay first wouldn’t it be the rent, utilities and food? Credit card debt would come last or not at all. I have been told by a bankruptcy attorney that I can file against credit cards because I meet the means test for my state.
Could we have lied to our bankruptcy lawyer about a pending personal injury case (in our favor)?
When we filed for bankruptcy last year, our bankruptcy attorney asked us if we had any pending lawsuits. We replied with a yes, as I had to hire a personal injury lawyer cause of a car accident we were in. We were forced to get a lawyer because of the extensive medical bills…the insurance company of the at-fault driver refused to pay any of our bills…my medical bills were over ,000 & growing with my treatment and Dr’s. didn’t know when I’d be finished receiving treatment. With us already paying some of the bills out of pocket, it got to the point were forced into bankruptcy….there was no other way. We were told by the trustee and our bankruptcy lawyer that all monies received from the personal injury case would have to be applied toward the creditors in the bankruptcy. So in the end…these are the figures…

Is College Debt Dischargeable In Chapter 7 Bankruptcy?
I will be filing Chapter 7 bankruptcy soon, and am trying to figure out if the ,000 I owe my University will be discharged. None of the balance is from student loans, or any other type of Financial Aid. It is from past tuition, bookstore charges, room & board, as well some other irresponsible charges to my Bursar bill. To answer the answers below, I am actually in the process of choosing my bankruptcy attorney, but the last one I spoke with wanted to charge me 0 to look up that information, and would not include it in his normal bankruptcy rate.
As for the answer regarding student loans, NONE of the University debt includes any type of loan or other type of financial aid. Thank you for such quick responses though!
Collection agency, CFO financial still calls me even though I provided them my bankruptcy attorney's info?
I will be filing chapter 7 bankruptcy and I paid 00 to the bankruptcy lawyer. The attorney advised me that if I get any collection agency calls, I tell them to contact him instead of me talking to them.
So per his advise, I keep telling creditors that if they have any questions, they kindly contact my bankruptcy attorney instead of calling me. However, a collection agency named CFO financial says that they will still continue calling me for payment regardless of the fact that i provided them the lawyer info.
Isn’t this harassment? The collection agency clearly knows it I cannot pay and they know it I have retained a bankruptcy lawyer and they know it well chapter 7 is on the way. However they insist to call me instead of communicating with attorney. Why?
I am tired of telling them "to contact my lawyer" and they still keep ringing the phone a lot. Isn’t this supposed to be a violation of my rights?
It seems this collection agency is asking to be sued by the attorney for doing this. Why?
Also they seem very stunned that I have the ability to pay 00 to the lawyer. They kept saying, "are you sure you made the payment to the lawyer? are you aware the payment for the lawyer is more than what you owe us?"
They keep on pressing me to communicate with them, and the lawyer said never to open my mouth except to refer them to him.

I got my discharge in the mail at the end of Febuary 09′ , I paid 00.00 for this bankruptcy.
It is now April 09′ and received a collection letter from Hudson & Keyse , should I mail or fax this to the law firm that handled my bankruptcy ?

I have A LOT of credit card debt from opening a business and having to sell it in one year because of family responsibilities. Saw a bankruptcy attorney, but the options don’t seem to work for me as there’s no way I could ever pay off these debts.
I know it’s very immoral, but what will actually happen if I just stop paying on them? I know I’ll be inendated with phone calls and lose my good credit standing, but can they attach my bank account or any other asset?
