According to statistics on the www.uscourts.gov website, bankruptcy filings have increased substantially since 2009. Yet, when I look for bankruptcy attorney jobs online, they are virtually non-existent. Why is this?
I thought my mortage was re-affermed for two and a half years until I got my credit report and it said it was discharged. I talked to my bankruptcy attorney and he also told me it was discharged back in january 2009. My realter and I are trying to shortsale and I have stopped making payments. What can the lender do as far as credit reporting and foreclosure process? Shouldn’t they have come taken the house after bankruptcy? Im confused!
My husband and I live in Alabama and initially filed chapter 13 bankruptcy 2 years ago. We have had to revisit our chapter 13 once to have the payments reduced and surrendered our home and a vehicle in the process. I am no longer employed and we have lost about 20,000.00 in annual income, that puts our total income at less than 35,000.00 per year. I have returned to school under a pell grant and it is just enough to cover tuition and books. I contacted our bankruptcy attorney’s office and sent them the paperwork showing the change in income and a letter from my previous employer. We had to send it certified because they claimed to have never received it by fax or email. We want to convert to a chapter 7. We are renting a home, my husbands work has slowed to a crawl, the bank has yet to take possession of our house that we surrendered, we cannot make our bankruptcy payment and I cannot get anyone from the attorney’s office to call me back with any answers. Would it be a bad idea to fire this attorney and start again with a new attorney? Or is it just the way things are? It took us nearly a year to get our first chapter 13 revisited and at this rate we are going to be in huge trouble if we can’t get something resolved. I might even have to cash out the little 5000.00 I have in retirement. ( I am 45 years old). Any advice. I cry every day.
I have bachelor of science in mathematics and I could not get any job since graduation. Due to my inability to get job, I had to file chapter 7 bankruptcy protection. I noticed the bankruptcy lawyer’s office was flooded with clients. There were like 37 to 40 people sitting in the lawyer office lobby to wait for their consultation. The bankruptcy lawyer told me "its been very stressful with so many clients. I am sorry for making you wait this much". He charges 1800 dollars per clients. And since there were about 40 in lobby, that’s an income of 72000 dollars already. And the consultation fees is 350 dollars for the first time meeting. Having seen this I get motivation to become bankruptcy lawyer myself and open my own law office. Because of poor economy I will surely get lot of people who want to file bankruptcy. And since I have bachelor of science in math I already meet whatever pre-requisites are required to enter law school. Moreover, my bankruptcy attorney graduated from my own university law school. So what more do I have to do now after BS in math to become chapter 7 bankruptcy lawyer? I will file chapter 7’s for all the broke and poor people in the town
I have a lot of old debt from my younger years which I never took care of. I never could afford to either pay it off or to hire an attorney to file BK. Now I have 1 of the companies that just put in a wage garnishment for me and is taking about a week, money which I need to be paying my daycare provider for my girls.
My wife and I have talked about getting an attorney, but we know we cannot afford to pay the full amount up front and that it may take a few months or so before we have the entire amount available to pay the attorney. I also know that you can just pay a retainer fee in most cases and they will start working on collecting information and such. I guess, my question is, if I pay the retainer fee for a bankruptcy attorney in Wisconsin where I live, will this put a hold on the wage garnishment or does the wage garnishment continue until we actually file?
I hired a bankruptcy attorney in Aug of 2010. But before accepting their service I had asked them specifically that I had money combined with my mom and would that be a problem. The person who interviewd me told "Oh no problem, we just send an amendment document to declare that this account belongs to your mother and not you." Time paaast. And I finally had an appointment with the attorney in Feb 2011 that it was best to dismiss the case so I could have time to fix my mom’s account and refile or do the ammendment and he would charge me 250/hour( even though the contract said 215). So I agreed to dismiss it for him to refile. I was dismissed in early March. I fixed my mom’s account immediatley and within 2 weeks advised to refile. Upto this date, I have been given the runaround stating "well we’re in the process of tranfering your file". Everything was sent electronically. I have given them everything they have requested from me on time. My life is at a stand still. Can’t do anything financially until I resolve this situation. Can I fire this deadbeat and get my money attorney fees back? If so HOW?

I made the mistake of trying to pay my credit cards as long as I could instead of stop paying 2 months beforehand to use the money for a bankruptcy attorney. I can’t go back on that one and my cards ar 3 months late and one is turned over to an attorney already. I have no money, actually 2 months away from not even having rent money so I have no money to pay anymore (I paid a small payment for a while to them but that didn’t satisfy them) and have no money to file chapter 7. I called the legal assistance numbers for Texas and they don’t handle bankruptcy anymore. Why do you have to be a murderer, illegal alien, child molester, rapist, etc, to get free legal assistance in Texas? Every private organization that I was refered only handles illegals and real criminals?
I have no money, no car, no assets, and give money to my child who lives with my mom, so I have nothing for them to take and only make 600 month currently (my employer won’t let me work any extra hours and I got in trouble for working 15 minutes extra last week (I had a customer so I couldnl’t just go clock out).

to answered number 4, my life changed completely last year after being stable for 14 years. Lost my family, home, job, etc. Paid my cards on a timely basis for 14 years and did have to depend on them for things like dental and medical (no insurance), clothes, and other of life’s necessities. Having no transportation limits job opportunities as does not being able to get out after dark because of the gang activity in my neighborhood. And no I can’t move, I have a lease and can’t afford to live anywhere else anyway.
My bankruptcy attorney failed to actively pursue my case. She ignored my desire to retain my home and during the last court appearance, she asked another attorney to represent me because she had another appointment. This attorney claimed her office misplaced the original copies of various documents. I lost my home to foreclosue as a direct result of incompetent legal representation.
Considering filing bankruptcy. Attorney gave me a paper to fill out stating evey thing we own. Right down to pets, and clothes. I did some research and found our state allows up to ,500 in house items to be exempt along with animals. I do not understand how they can even get by with asking you to list your pets as part of what you own, or your personal clothes. I may see such if you were raising animals for resell, or if you had real expensive clothing, or a movie star who some one else may want to say they own a piece of such and such clothing etc. But if this were the case those people would not be considering bankruptcy in the first place. As for the house items who makes the decisions as to what is exempt and what is not. I know my house items will not exceed the allotment in our state, but still I am curious about such.
I have even tried to pull his criteria and his information page and nothing…All I need to know is if he is a Criminal, Bankruptcy Attorney, what is it he specializes in..
The only way a chapter 13 will work is if this debt is discharged and the lien removed. Chapter 7 is not an option. Two Bankruptcy attorney’s have told me to different things I need a clear answer about the lien only.
‘ve filed for bankruptcy and now it’s time for my daugter to fill out her FAFSA form for college. My bankruptcy attorney told me to not fill out the FAFSA form. The only way my daughter can apply for scholarships is if she fills out the FAFSA form and the form asks for parents income. What do I do?
My bankruptcy attorney was very quick to get my paper work in for chapter 13 and said that I wasn’t eligible for chapter 7. I have over 56k in debt and I was the only one filing not my husband. I paid the plan payment of 0.00 a month since April. In October I still was not confirmed and they wanted me to pay 30. a month for the plan payment. If I could afford to pay 30.00 a month then I really didn’t need to claim bankruptcy right? Now because I can’t afford the plan payment they will have to dismiss my case. I will still have to pay the attorney’s fees and 10% to the Chapter 13 Trustee’s. Then I will get back my money that I put into the plan payment. I was never late on my mortgage but because I went to find out about claiming bankruptcy they told me not to pay my mortgage that it would be part of the plan payment.
I might have to file chapter 7 however I would like my wife not to file. We together own 51% of an S-Corporation, both of our names are on the stock certificate. If I file, and she does not, what happens to the stock we own?

This is for Mr. " get a life", I found an attorney in my price range, and he is taking care of what I need him to take care of. I’m sorry you had to pay 00 but you know what they say "there’s a sucker born every minute".
My hubby makes ,000/year, but over the past 3 years, over 60% of his income has been going towards debt payment alone, meaning we have been living EXTREMELY TIGHT for 3 years now. We are now only down to ,000 and my husband is thinking about filing NOW, after all we have already paid off! Is filing worth it?

We filed a chapter 13 last year. We’ve made several payments, only to just now find out that our bankruptcy attorney severely underestimated the value of our vehicle. Our balance to the trustee will now go up ,000 dollars, and our monthly payment will almost double. To add insult to injury, the attny was very non-chalant and yawning on the phone when he delivered the bad news. At the time of filing, we gave the attorney complete information on our car (including the VIN # and Bill of Sale) , so we assumed his calculations were accurate. Is there anything we can do, or are we just "stuck" ?
Maryland, and typically, I know that the judicial process of bankruptcy only costs about 9 in Maryland, however, I am having an issue with locating a "good" bankruptcy attorney that is legit and isn’t going to over charge me 
through this gut wrenching decision……
