I don’t really know what does happen.
My friend is under water on her house in Las Vegas, can’t rent or sell it & has decided to file bankruptcy. So what happens to her house now?
I’m a property manager but not a sales agent so I don’t really know about this kind of thing.
She already tried to short sell- bank would not agree.
Yes she has other debt.
OH – OK. So she can give the bank possession of the house during the bankruptcy then it turns into a foreclosure. Did I understand that right?

So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!

Can you file bankruptcy on Attorney Fees?
If you are going through a divorce and have temporary orders that you have adhered to (you owe your spouse no monies and you owe no child support-all paid in full and current) can you file bankruptcy on Attorney Fees? The amount is 00 to spouse attorney and 00 to an independent attorney assigned by the judge. I am in Texas.

(and he knows it…. like if I find out I don’t need him in a few months, he would lose out on the fees I’d have to pay him to file bankruptcy?)

Here’s my situation. I was on the top of the world before I even turned 21. I worked so hard to accomplish my financial goals of basically owning my own house and own vehicle before my 21st birthday. Some where down the road I got lost… The great job I had to get the house, I had to eventually step back from to take a slightly lower paying job that offered insurance. To make a very long, struggle-filled story short. I lost everything. And when I say everything, I mean everything. My then fiance` and I split, needing to find our selves again. My new job wasn’t what I thought it was going to be. I inevitabley lost my house, my car, and had to stop making payments on all my credits cards because I quit my job to move across country (with my now husband) who is an Active Duty Marine (now deployed
). I know this is all over the charts, but since my husband is now gone, this is giving me a lot of time to fix/figure out our financial situation. Since my credit score is basically at the lowest point possible now, which bankruptcy should I file for? How does Chapter 7, 11, 13 etc work? My husband does make a decent amount of money, specially being deployed now. But really only enough to pay the bills and pay down his credit. Any and all information on this would be great.

Thanks KMcG. Yes – I am aware of th 7-10 year rule with bankruptcy. We’re even considering staying in the military (boo) to bandage all our debt.

Rec’d a discharge last year and I just got a letter from a towing company in an old repossession who is trying to collect on a charge. I did not know the charge existed and therefore did not include them in the bankruptcy. Do I have to pay them? I called the attorney who said our relationship ended with the discharge and he would have to charge for more assistance! Gee, thanks.
Any help is appreciated.

Lawyers, as far I know, cost hundreds if not thousands of dollars… So… if I want to try to file bankruptcy with my wife how are we supposed to hire and/or afford a lawyer to help us?

I filed in March 2007 and expect my actual discharge letter in the mail any day now-wait, is that the mailman? My bankruptcy already shows up on my credit report and my credit score isn’t so terrible! Specifically, I want to know if its o.k. to start applying for ONE SINGLE credit card and a car loan. That’s it. I’m rebuilding my credit on those two things. Period. Thanks.

I was looking at consolidating my credit card debt into a newer home loan with New Day Loans. The fees were over ,000 and would leave me in negative equity on my home for years to come. I don’t want to live here another year. I am also planning to file for a divorce as well. I am not behind on any payments for anything, but I make many payments late, but rarely 30 days late. The new credit card bill rules increased my payments so much its killing me.
When is a good time to file bankruptcy?
Shoud I file on everything?
Should I file on just the credit cards?
Should I file before or after filing for divorce? Or shoud I wait until after I get divorced?

I filed for bankruptcy Jan 2005. Credit card company "wrote off" the debt Jan 2005. I thought it was included with my bankruptcy, but when I check my credit report, it claims I still have the debt, it’s just written off. To be specific, my credit report states that I still have this amount from the one creditor as "revolving debt". Shouldn’t it state that it was included in Chapter 7 like all of the other creditors state? Any help would be wonderful. I just want to know if I have something valid to dispute.

I am in the process of buying a short sale and sellers lenders have approved a pay off. We were getting ready to close when the title company found a judgement lien on the house from a car company. Obviously we can’t get the title until the lien is removed. Since the sellers filed bankruptcy what are the chances that they can file a lien avoidance and a judge will remove the lien from the house so we can legally purchase it?

I have bad hypochondria. I developed this 3 years ago and it’s pretty bad. I’m constantly fearing that I will catch some disease and die or that I will move my body or eat wrong and choke to death or break an internal organ. Most of my fear is of having a heart related problem. I don’t go out anymore and I stay inside so that nothing bad happens, like getting in a car accident. If someone mentions an accident or death of a loved one it makes me both sad and very scared and I have a panic attack. I spend hours looking up symptoms online and I now have to file bankruptcy because of medical bills for doctors visits for minor illnesses when I didn’t have any health insurance. I want to go teach english abroad for a year but I don’t know how I can when I can’t even barely leave the house outside of work. I’m afraid I’ll get ill and die in a foreign country.

I recently changed my first name & my original name is now my middle so pretty much the same, i have updated my drivers license but not my social security card, would i be able to file bankruptcy under my old name on my social security card? or do i have to update it? also if i update it all my past tax forms have my old name so thats why i just wanted to file under my old name…

all these deadbeats who don’t pay bill and file bankruptcy are sore losers. Let these sore losers be punished when bankruptcy is abolished and they be sent to jail for not paying their bills. then the economy will improve, since there will be more financial discipline. I’m tired of all these losers who don’t work and sit home yet have cell phones, broadband, cars, etc etc and then say they are bankrupt
