My bankruptcy lawyer hasn't done anything and it's been 2 months?

How long did each step take for you?
I hired him in March,paid him in full,completed all the necessary steps including the online class and gave him all my documents.I called and they claim they are short on the staff drawing up the petitions.Is this a normal amount of time to wait for a filing? I’m starting to feel taken advantage of considering I already paid him.

Can a creditor force you to pay them after filing bankruptcy?

I think most creditors are notified when a bankruptcy is filed & are given a certain amount of time to respond and refuse to accept the bankruptcy.
Can they still force you to pay them or turn the account into collections, when the bankruptcy is final and, they didn’t respond to the initial court notice?

Option's after my Bankruptcy discharge?

Ok I just have a few questions here. I filed bankruptcy in April of 2008, went to court with the trustee in May of 2008. Well finally in March of 2009, my case was discharged. I was discharged 03/30/2009.

I have been trying to look online about my questions, and keep finding different answers, on a bunch of different sites. What I am wondering is:

1. After being discharged, how soon can I, or how soon should I pull my credit report to see if all of my creditors were discharged on my bankruptcy?

2. If their happens to be creditors on my bankruptcy that were included in my case that weren’t discharged, how do I take care of that?

3. And the credit card question. I know that these are what get people into trouble, but you do have to rebuild your credit somehow. I am now 24 years old, and have established a savings of over ,000.00, so I am wanting to head in the right direction.

- What is the best company I can go to for a credit card that will approve me with having a bankruptcy on my credit report?

-What company’s don’t charge those 0.00 process fee to get a credit card?

Any help would be great, the sooner I can rebuild my credit, the better.

OH, is their a certain amount of time I should wait to get a credit card? Like to try avoiding getting denied because my discharge is so new?

10 year statute of limitation with IRS debt question?

in aug 1999, i filed about 7 years of IRS income tax returns. i had an accountant prepare the returns but he was not a CPA and i do not remember if he signed the returns or not.

i was a non-filer for many years of income tax.

i sent the IRS my package in august 1999 for all of these years.
i owed a LOT – over 000. i knew that.

i intended to do an offer in compromise but i never got around to it. i live in bklyn now. in around 2002, the irs started with the letters and i got very upset because i didn’t have the money to pay and i was not employed on a regular basis.

somehow, in the past 5 years, i have not heard a word from the IRS.

at this point, i believe through conversations with the agent or whomever the woman was at the irs, that she was convinced i was a financial basket case and i could not deal with this debt. i also had terrible problems with the irs in the 80s and they hounded me for debt that i didn’t owe but i didn’t properly handle it and i got a liar of a revenue collector and i paid through the nose, about k although in reality, i never owed one penny (the irs assessed additional taxes in 1982 – 84 on mileage deductions i took as a part of my sales job at the time and it was totally legit). but i didn’t answer their letters in the right amount of time allowed because i moved to another state and i got all kind of fees added and it became a total nightmare, and i paid back a LOT of money.

i told the agent in 2002 all of this and i think she believed me. i told her to look it up so she could see that every word i said was true. (it was).

so i thought that maybe the irs would leave me alone for the taxes owed that i sent in august 1999.

my question is that there is a federal tax lien on my credit file for over ,000 now and it was placed there on december 2000. so the federal tax lien was placed on my file one year and 4 months AFTER i filed my taxes.

in august 2009 (which is 10 months from now), 10 years would have passed and if the IRS has not collected from me (i still don’t have the $$ to pay NOR steady employment), do i owe the money still.

FIRST QUESTION: will they likely renew the lien?? i have heard that they seldom do this.

SECOND QUESTION: i have not heard from the irs in over 5 years concerning my debts. what does this mean?? it is a positive sign???

THIRD QUESTION: does the 10 years SOL start and end the day and month and year of the date of taxes that i filed (meaning my date and signature which was my name – MH HALLSTIN and the date was Aug 1999 OR

FOURTH QUESTION: is the SOL from the date of the lien that is listed on my credit report, which is actually december 2000 (which is one year and 4 months AFTER the date i filed).

FIFTH QUESTION: i have decided to file bankruptcy at any time that the irs has decided to renew this lien for another 10 years because i cannot take the stress of it. so my question is, is this old irs debt dischargable in a chapter 7 bankruptcy (what about a chapter 11???)

also, since 1999, i am again a non-filer however i probably don’t owe much money and probably the irs owes ME money (which of course i will never see and i am OK with that).

ANOTHER QUESTION: i would like to file those years since 1999 and catch it all up. will filing these years trigger anything with the IRS to look at my situation again and make them renew the lien i referred to again.

or should i wait to file the back tax years AFTER the 10 year lien expires??

ANOTHER QUESTION: when does the irs renew an old lien and are there any rules about it (such as does the irs have to file another tax lien before the 10 years expires) and most importantly, as i asked above, the crux of this very long post is when does the 10 years start and end on a tax lien, when i file my taxes or when they put a lien on my credit file (or is there another factor that i am unaware of that is used as the 10 years that the irs is allowed to use).

ANOTHER QUESTION: if i ask the irs all these questions, is it going to trigger/renew their interest in me???

can I file bankruptcy when an insurance company is suing me?

My wife got in a car accident with a semi truck. Those roaches claimed 68K to their insurance agency. Our insurance only covers 25K. After the fact of what the 25K will pay for we’re getting sue papers for 30K. Can we file bankruptcy now or do we have to go to court first to get the judgment then file bankruptcy? YES YES YES I know how long it will be on our credit and all that but I we could care less. We don’t want to pay for a BMW and not drive one.

Also, all I own is a 1972 chevy truck (not restored, worth 2,500), no house, no savings account.

When is it appropriate to file bankruptcy?

My husband is 21, unfortunately he has made some horrible decisions in his life regarding money. He is now considered ‘high risk’ by EVERY loan company you can think of, including the NO CREDIT BAD CREDIT NO PROBLEM people, lol. Now his (not mine, my name is not on it, and please remember, I just recently became his wife!) car is up for repossession. He leaves for basic in January, and that will solve many of our money problems. However, we NEED this car, myself and my daughter, while he is in basic and up until that time. How long will it take them to come get it? And the real question I am asking is–with his credit being this horrible, and owing all this money that’s so terribly behind, should he just file bankruptcy?? I know it will freeze the repo and we can at least keep the car. He is only 21, I know that is young, but his credit report is four pages long–of crap he still owes. Would it be better to start over even with a bankruptcy? (my credit is good.)
That is–keep the car for an undetermined amount of time. His mother (imagine that, the apple doesn’t fall far from the tree) filed bankruptcy earlier this year and drove her truck for free for over six months.

I was told that when you file bankruptcy, that it only shows up for 7 to 10 years?

So I am only 23 and a family memeber ruined my credit. She opened up bank accounts in my name , bills, apartments … etc, stole my check book and wrote 14 bad checks in one day…. used my name and social for doc. visits and precriptions. She just admitted this to me and she started all this when I was only 17 18 years old. Ther are things on my credit that are mine, but not enough to ruin my credit. I think I may have to file bankruptcy. I was told that it will not show on your credit after 7 to 10 years. I mean since I can’t do anything now because of my credit, and the bankruptcy will go away in that amount of time, then by the time I am 33?? or so It will be gone and I can start from there. I feel like this is my only option, but it seems to good to be true to just wipe out all my credit with bankruptcy and then be able to start all over in ten years??Is this true, how does bankruptcy work ? How do I go about checking my credit if I don’t have a cc to do it online? I have went to freecreditreport.com and freetriplescore.com and they are just a scam cause you still have to put a cc down… so how can I look and see exactly what I have on my credit?
