We (me, my husband and 2 children) moved in with my father-in-law after his wife passed Christmas of 2010. We moved in to help with the house and bills and manage his money (he had to file bankruptcy 9/2010). He’s horrible with money, if it’s in the bank he spends it. Him and his wife had incurred 10’s of thousands of dollars worth of debt. We were not able to strip off a 30K home equity loan attached to the house. We are currently paying more than a double payment toward the loan so it’s approximate payoff is 6 years or less. (This will NOT change). He’s 72 and in good health. The value on the home is about 120,000. The home equity loan is for just under 29K. And he owes about 92K on the home. We are to inherit the house someday. My question is this, should we put my husbands name on the home. If so, when? Should we "buy" it from him or should we leave him on it. PLEASE NOTE I WANT TO BE FAIR TO HIM AS WELL. Should we wait till we’ve paid the home equity loan down substantially or should we do it soon? I’m wondering because of the inheritance tax. He does have life insurance. Term life, we are to get 15K. I hope that’s enough info…Let me know if I’ve left something out.

My boyfriend lost his job and I co-signed for him but now we canno afford his payment. We don’t want to file bankruptcy or have a repossession on our credit. Ibhve really good credit and I’m freaking out. Does any one know of any programs in California or anythingwe can do or try?
LET ME MAKE THIS VERY CLEAR! I’m not depending on the state or anyone else to bail me out! And it makes no difference to co sign to someone your married to. Dovorce is on the rise honey! My bf and I have been together 6 years, have both kept the same jobs for the bast 8 years for me and 9 years for him. LIFE HAPPENS and he got laid off!

i need help,ive been married for 3 1/2 years we have a 4 year old, my husband is a good father.but he cant hold a job, shes been out of work for 5 months and has not applied for a single job, he says hes waitng to go back to his job in spring (construction) where he works part timeish whenever he wants because hes friends with the owner, i kept pleading with him to find a real job,but he wont and it causes a big argument every time. ive known him for 6 years and hes never been able to hold a job (we met when i was 17), im scared because weve been forced to file bankruptcy and have no money for food and cant pay our bills, his mom brings food over. i dont want to lose my house and things keep getting worse i hold a good job buts it not enough, i cant live like this any more, what can i do he wont listen to me!

This is what happened:
I haven’t had a job in 6 years. I have been unable to pay my bills. A credit card company took me to court and I lost. Legal aid wouldn’t help me file bankruptcy because I’m not working. So now I have this case that I lost and I want to know when I do get some money to file bankruptcy do I still have to pay the legal fees? Or is that included in the bankruptcy?

After re-reading my question I think I should make this clearer.
I lost the case and they say I have to pay their legal fees, when I file bankruptcy can I include their fees into my bankrupcty?

After you file for bankruptcy several years ago let’s say 4 , can you get a home loan with a decent rate? Or how long should you wait before trying to get one? If you have a stable job since 6 years and making 60 000$ a year will you have more chance to be approved? Is there a bank that has better reputation when it come to home loans I mean some banks are more hard than other to get a loan ? Pls give me information that might help. Thanks

I’ve had perfect credit since I was a teenager. Last year we opened a business and it has failed miserably. We have tried selling it with no luck as the lease is too high. We just lowered the price dramatically but my lawyer says only give it a few weeks at the low price then I’ll have to file personal bankruptcy.
It makes me sad but I have no choice. Only I am filing, not my husband. Most of our debts are in both of our names which will transfer to him. But, the store lease, our back store rent, my credit cards and some of my student loan could go into the bankruptcy. I will be bankrupt for 9 months and then discharged. It will be on my file for 6 years after discharge. I’m in Canada.
I’m scared that it will affect our home as when it comes up for renewal my husband may not qualify on his own. Do you have to requalify at every mortgage renewal or are you safe for the 25 year term as long as you pay every month?
We have 5 children and I just need some peace of mind.

I filed for chapter 7 bankruptcy over a year ago. I know that once you file, you can’t for another 7 years I believe. Well, I just recently got married and my wife wanted to know if she could file on her debt or if we’d have to wait another 6 years before doing it since we are now married?

I have about 7,000 credit card debt i am in a credit counseling program. Ive had my car for a year and I am so upside down the loan was for 15,000 6 years at 20 % interest. My current income is only about 900 a month so i am considering filing bankruptcy and having my dad cosign for a new car and a house which wont be for a few years when im done with school. My whole family is pressuring me to go bankrupt but im tempted to just tough it out so i can maintain good credit? What should i do?

I have been married for 6 years. When I was first married, my husband would use my ssn for his own personal usages. Such as, adult chat lines, and utilities… I was not working for the first three years, and in that time, he opened credit cards, fell delinquint on our utility bills, and never paid a single bill.
I am now 26 with two children, and I am tired of having to move every year because he won’t even help to pay rent now that we are both working. He makes twice, if not three times what I make annually.
To sum up, my credit is a mess, I need to clean it up and I am not making much working my full time job… I would love to have a home one day in the next few years or so, but need help.
Should I file for bankruptcy?
(please, no comments about divorce. I am not looking for that type of advice)

I need to write an explination on why i filed bankruptcy 6 years ago…well the reason is not so heartwarming. I filed on a mobile home in a crappy park surrounded by drug addicts, so I didnt want to live there anymore, I tried to sell first buy couldnt.
Please help me put into words how I can explain this so I will now get another home loan!
Ive checked the community, so now i know what im getting into!
I never want to file bankruptcy again, it is so hard to pull yourself back up!
Please if you can help me, tell me what they are looking for in the letter!!!

I was thinking about this the other day, I used to work in collections and couldnt figure it out. It takes what 7-10 years for bankruptcy to age of your credit, the normal statute of limitations is (in my state) 6 years for credit card debt and 10 years for car notes and such. Why would someone file bankruptcy when it costs so much when they can wait it out? Also if the debtor gets a judgement against them does the creditor always put a body attachment out like they do in small claims personal suits?
