If they owe me money but file Chapter 7 Bankruptcy, will I ever get my money?
I had a tenant who is gone now but owes me 00 in back rent, early termination fees and damages to the house. We got a notice of Chapter 7 Bankruptcy Case. What do I do now and will I ever see my money? Can I put a lien on his property? Help!

If they filed a no-asset Chapter 7 bankruptcy, you are out of luck in getting money from them. Even if they have money in the future, their debt to you will be discharged in the bankruptcy.

June 4th, 2010 at 1:15 pmHave you sued in small claims court and gotten a judgment in your favor? As long as your tenant follows through on the bankruptcy, you will not see your money – it will be a discharged debt and you have no recourse.
You need to follow up and make sure the tenant does not drop their case – if that happens, you can go after them.
