If I file bankruptcy chapter 7 will my 2007 tax refund be at risk?

If you file bankruptcy and your home isin process to be sold in a sherrifs auction how long do you have to move out of your home?

    Possibly. Any pending tax refund, or one recently received, is often considered part of the bankruptcy estate and may be taken to be applied towards your outstanding debts.

    Timing is critical. Discuss this with your bankruptcy attorney.

    File after you get your tax return and spent the money.

    There is no relationship between the two. Once your home is sold, you no longer own it and have to get out. It will not affect any tax refund. Your refund may be an asset of your bankruptcy estate. Consult an attorney who can review all the facts and advise you appropriately.
