How does someone file for bankruptcy? What are the initial steps? Do you need an attorney?

    There are some forms you need to pick up. You can probably pick them up at a courthouse. An attorney will definitely have them. An attorney is not required. They are good to proof read and verify all of your documents. They help a lot since a single mistake means that your case can be thrown out and you have to start all over again. There is a filing fee that you will have to pay to the courts when you turn your paperwork in. After a while, a court date will be set up and you will go in with a bunch of other people. You’ll answer a few questions, a few weeks will pass to allow your creditors to challenge. Then, you’ll get a discharge letter and it’s off to your new life.

    You don’t have to have an attorney, but in case some of your creditors show up, you may want to have an attorney. I haven’t worked in a bankruptcy office in years, and I know the bankruptcy laws have changed, making it more difficult to file for a Chapter 7. But I believe you can still get a bankruptcy petition from bankruptcy court and fill it out and file it.
