There are some forms you need to pick up. You can probably pick them up at a courthouse. An attorney will definitely have them. An attorney is not required. They are good to proof read and verify all of your documents. They help a lot since a single mistake means that your case can be thrown out and you have to start all over again. There is a filing fee that you will have to pay to the courts when you turn your paperwork in. After a while, a court date will be set up and you will go in with a bunch of other people. You’ll answer a few questions, a few weeks will pass to allow your creditors to challenge. Then, you’ll get a discharge letter and it’s off to your new life.
September 10th, 2010 at 9:24 amYou don’t have to have an attorney, but in case some of your creditors show up, you may want to have an attorney. I haven’t worked in a bankruptcy office in years, and I know the bankruptcy laws have changed, making it more difficult to file for a Chapter 7. But I believe you can still get a bankruptcy petition from bankruptcy court and fill it out and file it.
