Filing Bankruptcy? I need help!!!?
I have at least -10,000 in collection debt. I was in a car accident last year that my insurance refused to cover so there’s additional medical and court costs added on there somewhere. I have no job, no license to get to work ro anywhere. I want to file bankruptcy but I keep hearing there are all types of fees and payments. I have {content}. No savings or checking, I own no house or car. Nothing. Someone please direct me in the right place? There has to be some place out there that helps people in my situation. I live in Chicago IL if that makes a diffrence. And I have searched online and got no where.
Make an in-person appointment with a bankruptcy attorney licensed to practice in your state. Most offer one free appointment, which you should take advantage of.
The attorney may advise you that you do not need to file bankruptcy at this time because (if you truly have no assets and no income) you may be judgment proof (i.e., even if you get sued, they can’t collect anything from you if you truly have nothing). However, the bankruptcy attorney can also help you strategize, including talking about when it might become advantageous to file bankruptcy, how to handle the fees involved, and how to get creditors to stop calling you until you are able to file the bankruptcy case.
It is true that filing bankruptcy is not free. There are fees and costs involved. In part for this reason many bankruptcy attorneys don’t advise filing for small amounts of debt, which – in the larger perspective – yours really is.
Filing bankruptcy won’t fix the problem of not having enough income. It won’t fix the problem of how to pay future debts. It can only discharge debts you already have at the moment that you file.
