can you refile a chapter 7 bankruptcy case after it was dismissed?

I filed a chapter 7 bankruptcy case in kentucky. I did it all by myself because i couldn’t afford a lawyer. The reason it was dismissed is because i failed to take the credit counseling course within the time frame. (I didn’t know you had to wait 180 days after taking the test to file). Anyway, my question is how long do i wait to refile. do i have to wait 6 months from the time i filed or 6 months from the time it was dismissed? Seriously need help!

You are still misinformed. You do not have to wait 180 days after getting the credit counseling to file. You must receive a credit counseling certificate within 180 days before filing bankruptcy. This means you cannot get the certificate the same day that you file your bankruptcy case. Your certificate also cannot be more than 180 days old when you file.

Please, please, please make an appointment with a bankruptcy attorney. ALL people who file bankruptcy "don’t have any money." That is the very definition of being bankrupt. Bankruptcy attorneys are VERY accustomed to dealing with people who are "broke" because ALL their clients are "broke."

This is NOT a do-it-yourself project (as you have already discovered).

Please make an appointment with a local bankruptcy attorney, face to face, 1-on-1. Most offer a free or very low cost appointment – take advantage of it. Ask the attorney how you will be able to pay his or her fee if you don’t have any money. Your attorney should be able to give you an answer to this. If not, try a different attorney.
